July 25. 2. Petition of Joseph Hillery to the Council, for permission to export 150 fother of lead into Holland and Zealand. [Permission granted; see Conc. Reg., iv., 332.]
July 25. 3. Petition of Priscilla Rous, widow of Capt. George Rous to the Council. Petitioner's husband went Captain of the Jane Bonaventure in the expedition to Cadiz, and died in the Isle of Wight on his return. A kinsman of his name personated the captain, and procured his pay and the King's additional gratuity. Prays that the personator may be brought before them to make satisfaction. [George Rous was this day ordered to give satisfaction to the widow. Reg. Conc.]

4. Buckingham to Capt. John Pennington. One hundred nobles are due to Capt. Robert Walsingham, as a gratuity for his service in the Cadiz expedition; by reason of continual employment he has not been able to solicit the same; Pennington is to pay him out of money received for fitting up the ten pinnaces. Appended,

6. Sec. Conway to the Keeper of the Gatehouse. Warrant to receive Jacques du Plessis into his custody, and to keep him safe prisoner until further order. [Copy.]

Winchester.
7. Sir Richard Norton, Sir Richard Tichborne, and Sir Thomas Jervoise to Sec. Conway, Lord Lieutenant of Hants. Acknowledge the receipt of letters from the Council and his Lordship, directing that order be taken for removing the soldiers billeted in that county to Portsmouth, and taking order for billeting 3,000 men in places nearest that town. They have given order to the soldiers to rise from their quarters, and proceed accordingly. Suggest, that, in regard of the many employments of the writers, order may be given to Sir William Uvedale, Sir John Jephson, Sir Daniel Norton, and the Mayor of Portsmouth, to accommodate the soldiers as they come to the rendezvous. They fear the soldiers will not rise without conduct money. If they can prevail on the country to disburse it, they pray the Secretary to be a means that it may be presently repaid.

8. Sergeant Major Kenythorpe to the same. Finds an inclination in the Deputy Lieutenants to send "my Lord's regiment" [? Lord Conway's] to Portsmouth. Desires his furtherance that they may be sent to Southampton.
July 25. 9. Sir John Drake to Nicholas. Sends inventory of goods received, and account of monies disbursed for corn which the Duke commanded him to send to Rochelle. Will send up the sugars which lie there by water, but desires the Duke's warrant for his discharge. Inclosed
9. i. Account of goods taken out of prizes at Weymouth and Bristol during May and June 1628, for the Duke's tenths.
9. ii. Account of monies laid out for corn to be sent to Rochelle. Total, 1,156l. 10s. 10d.
July 25. 10. Estimate for victualling various ships at Portsmouth for various periods, all at the rate of 8d. per man per day. Total, 3,119l. 9s. 6d.

11. Dr. James Meddus to Katherine Viscountess Conway. Mr. Slaney not unwilling to receive Lord Conway as a sharer in the Newfoundland business, but said that nothing could be done till the return of the ships thence that went thitherwards in March and May, which are expected back in August. The reason of this delay is, fear that the French may this fishing season have done some hurt amongst our shipping. Begs some of the Viscountess's plaister for sciatica.
July 26. 12. Estimate for one month's sea victuals for the whole fleet, being 5,500 seamen, and for 110 seamen, to be employed in 10 Flemish pinks. Total, 5,236l.

13. Edward Alford to Nicholas. Desires to know where he shall pay the rest of the money for the Dunkirkers' goods, and also his pleasure about selling the fish in the prize at Shoreham, and other matters about which Nicholas had been before applied to.

14. Lord Keeper Coventry and James Earl of Marlborough, Lord President, to the King. According to the King's reference, they had called before them the Viscountess St. Alban, Sir George Chaworth, and his late assignee, Mr. Henley, (parties interested in the farm of the Great Seal), and also the Officers of the Seal, and report, that, on Lord St. Alban's giving up the Great Seal, the officers petitioned the Commissioners who had the custody thereof for some fit allowance, whereupon there was paid 50l. per annum to the Sealer, and 30l. per annum to the Chafe Wax, both which payments were made by Sir George Chaworth for some time, but have now fallen into arrear. The writers think that the arrear should be paid, and that for the future, the payment should be increased to 200 marks per annum. They persuaded Lady St. Alban, who has 600l. per annum out of the profits of the Seal, being more than the farm yields beside, to have borne some proportion of that increase, but she, having a covenant from Sir George Chaworth, will not contribute thereto, whereupon they think fit that Mr. Henley should pay the former 80l., with an addition of 20l., to be divided according to the same proportion as the 80l.
July 27. 15. Petition of Grace Jones, a distressed prisoner in Newgate, to the King. She was convicted of taking 6l. out of a bag of 50l., belonging to her master, which 6l. was long since restored. She was reprieved by the judges, and prays a pardon. [Underwritten is a reference to the Attorney General to prepare the same accordingly.]

16. Sec. Conway to Buckingham. About four o'clock this day, got to the Court, and represented to the King what the Duke gave him in charge. His Majesty resolved on his journey to Beaulieu, for want of matter to move his stay there, or carry him to Portsmouth, wanting the materials which stay his Grace in London. The King will instantly return to Southwick, when he shall know of the Duke's coming. Portsmouth found "uncapable" of receiving the companies appointed to be received there, whereupon they are stationed at Fareham, Havant, and Ned Conway's regiment at Southampton. Has sent to Sec. Coke and Capt. Mason to have conference with them on the morrow morning at seven o'clock. The mariners run away to that excess that may hazard the service. Some order must be put forth to stop that course. Acquainted the King therewith, whose answer was that he must first pay and then punish. Will in all things apply faithful duty in what concerns the Duke's service. [Copy.]

18. Francis Gordon to the same. Sends a paper, the contents of which he requests may be urged upon the King. If our enemies are once masters of the eastern seaports [in Ireland ?], it will be the utter overthrow of these kingdoms. If the writer be not quickly despatched he will not be able to travel this year, for all the land passages are stopped by our enemies.

It being found that Portsmouth and the adjacent parts are not able to receive all the troops appointed to proceed thither, they are to give order that Colonel Courteney's regiment be drawn together into Chichester. 20. Deputy Lieutenants of Suffolk to the Council. The country long since absolutely refused to disburse more money for the billeted soldiers, wherefore some of them were enforced to engage themselves for the same. To pay the soldiers' arrears, and procure carts and horses to enable them to march away to Portsmouth, they had borrowed or undertaken to pay for the soldiers at Ipswich 68l. 10s., and 24l. 4s., for those at Woodbridge 68l. and 14l. 13s., and for those at Beccles 74l. 14s. 8d. Crave repayment out of the first two subsidies; the county also are humble suitors for the money formerly laid out by them.

23. Sir Allen Apsley to Buckingham. The ships pressed for transport of victuals are for the most part either discharged or stolen away, insomuch that he shall not be able to transport the month's victuals for supply of the whole fleet, being about 1,100 tons, in time. Prays the Duke's warrant to Capt. Tinker, a deputy of the Marshal of the Admiralty, to go to Harwich, to bring the masters of the Elizabeth, of Harwich, and the Alice, of Aldborough, to answer their contempt, and to give order that those ships be sent hither. If these men are not punished, no obedience can be expected to his Majesty's service.

24. Sec. Conway to the Deputy Lieutenants and Commissioners of Hants. Sends list of the places where the several regiments are to be lodged until they be called aboard. They are to direct them accordingly as they come into the county. His son Conway's regiment is to be drawn into Southampton. Capt. Mason, paymaster of the army at Portsmouth, has orders to pay the billet money for the future until they are shipped. [Copy.]

26. The same to Sir Henry Whitehead. There being a regiment void in that county [Hants] by the death of the Lord de la Warr, offers the command of the same to Sir Henry.
July 28. 27. Lord Keeper Coventry to Sec. Conway. States reasons why he cannot grant a Habeas Corpus to Sir Richard Haughton, a prisoner in execution in the Fleet for debt, on pretence of his levying a fine at Lancaster Assizes. The reasons are, first, Sir Richard's abuse of previous similar favours, and second, a solemn determination of the Judges that the practice of granting such writs was against law, and a novelty brought in by some particular judges at chambers, and in Chancery little or rather not at all used, save in the Lord of St. Alban's and Lord of Lincoln's time. Humbly desires of his Majesty that he may forbear granting any such writs in such cases.
July 28. 28. Sir Edward Bishop to Endymion Porter. If the King grant the suit for the duchy lands, he should not take the patent in his own name, but in some others, whom he should signify by letter, which he may send to the Glover at the Temple Gate. Begs to be commended by letter to Lord Goring, that he may have recourse to him in anything that concerns Porter. Wishes him a prosperous voyage.

Sir Charles Morgan attending his Majesty at Southwick, put him in mind that the officers of the re-formed companies that came with him from Stade would shortly come hither out of the Low Countries, and moved for the satisfaction of their pay. Calandrini, their paymaster, comes over with them, and Burlamachi is to be called for clearing of those reckonings, which being done, the Lord Treasurer is to furnish them with monies so far as other pressing occasions will permit. 31. John Ellzey to Nicholas. Wrote last week of a Dutch ship brought in by Capt. William Scras with fruit, wines, shumack, and aniseed. The goods are being landed for preservation, the hold being extreme hot. Has received letter from the Duke to render an account which he is preparing. Shall he send it to Nicholas in London, or attend him with it at Portsmouth at the Duke's coming ?

[July 30 ?] 32. Petition of George Newton, Master of Arts, to the King. The vicarage of Bovey Tracey, co. Devon, is void by death. The inhabitants earnestly desire that the petitioner might serve the cure. Prays the King to confer the same upon him; see Vol. cix., No. 31.
July 30. 33. Petition of the Company of Dyers of London to the Council. In the 20th year of King James the Council granted a warrant to the petitioners for the better execution of their charter in searching for deceitful work appertaining to the same mystery. Having been withstood in their search by persons who keep their doors locked, and set their servants and mastiff dogs upon the petitioners, they pray for a renewal of their warrant. [Granted this day.]
July 30. 34. Deputy Lieutenants, co. Warwick, to the Council. Send charges of billeting half a regiment of soldiers in that county under letter of February 16 last, and removing the same to Portsmouth under letter of the 18th inst. Pray for speedy payment, lest a great number of poor billeters, upon whom the burthen chiefly rests, be utterly undone. Send also account of coat and conduct money remaining unpaid.

35. Sir Richard Tichborne and Sir Henry Whitehead to Sec. Conway. Offer comments on the disposition of the soldiers in that county, and suggestions for various alterations. Soldiers, coming from Romsey on their passage to Portsmouth yesterday through Botley, killed one man and dangerously hurt divers others.

36. Sec. Conway to Sir Richard Tichborne and Sir Henry Whitehead. Trusts to their judgment and affection to the pending service to provide for the commodiousness of the lodging, conveniency of embarkation, and good government of the soldiers. They are also to place strong watches in all parts of the county to stay all mariners, soldiers, and vagrants. Has given order for apprehending the offending soldiers. [Copy.]

39. The King to Attorney General Heath. Lord President Marlborough gave warrant for granting certain coppices within the Forest of Whittlewood, co. Northampton, to the Earl of Northampton, in consideration of 5,500l. in money, and 10l. rent. The Earl is to enjoy those coppices free from all manner of liberty of forest, and with power to cut down woods and convert the land into arable.

40. The Council to the Commissioners for Subsidies for the several counties in England and Wales. To call upon the collectors, and see that they perform their duties, and cause the monies to be sent up to the Exchequer with all possible expedition, not attending the term, as has been done heretofore, in regard that the present estate of his Majesty's affairs can in no sort endure so great a loss of time. [Copy.]

July 31. 43. Lord President Marlborough to Sec. Conway. At his departure from London delivered him a bill ready for signature for a pension during life unto the Lord President's youngest son. Beseeches him to present it to his Majesty on the first opportunity.

The Strand.
44. Sir Francis Nethersole to Sec. Conway. Reminds him of a letter from the King of Bohemia to Nethersole, which Conway undertook to show King Charles, and procure him to take notice of. The town every day fuller than other of a bruit that his Majesty is entering into treaty with Spain, which he can do no less than communicate to his mistress. Would be glad that his letters might be discredited by others from his Majesty or his Lordship for prevention of the inconveniences which may ensue on the belief of this noise of a peace with Spain.
[July 31 ?] 45. Certificate of Capt. John Heydon and Sir Paul Harris, Master and Surveyor of the Ordnance, that they had found 40 barrels of powder in the storehouse of Mr. Felgate, of Hounsditch, 20 of which were marked with the broad arrow, and were said to be part of 100 barrels sold by Mr. Evelyn to the Lord Chamberlain. The 40 barrels are kept in safe custody until further order.
July 31. 46. Number of men serving in the corn, fire, and victualling ships at Portsmouth, total 101; with the names of the masters of those ships.
July ? Instructions to the Commissioners for the revenue arising by the forfeitures of recusants convict. Setting forth the particular relaxations of the law which the King in his moderation authorized the Commissioners to allow to all recusants who within three months after proclamation should accept his Majesty's grace. [See Coll. Sign Man., Car. I., Vol. ix., No. 57.]

[July ?] 48. Petition of Thomas Metcalfe, prisoner in the Marshalsea, to the Council. Being committed to the gaol of Lancaster on an unjust and causeless accusation that he is a priest, he continued there two years without any indictment being preferred against him. Having caused himself to be removed to the Marshalsea, where he has lain two months and more, he prays that he may be released on bail.

[July ?] 51. One stanza, and part of another which preceded it, of a poem condemnatory of the Duke of Buckingham, and his influence and that of other persons over the King. On the back of it is written the name "Gill," which seems to connect it with Alexander Gill, respecting whom see 1628, Vol. cxvi., No. 56, and several subsequent papers. The lines are in the form of a prayer for the preservation of the King's sight and other senses. The following is the one complete stanza :—
"And now, just God ! I humbly pray
That thou wilt take that slime away
That keeps my Sovereign's eyes from viewing
The things that will be our undoing.
Then let him hear, good God ! the sounds
As well of men as of his hounds;
Give him a taste, and timely too,
Of what his subjects undergo;
Give [him] a feeling of their woes,
And then, no doubt, his royal nose
Will quickly smell those rascals' savours
Whose blacky deeds eclipse his favours,
Though found and scourged for their offences:—
Heavens bless my King and all his senses!"

52. Order of the King in Council for preparation of a proclamation prohibiting the going or returning of any ship from Newcastle without a convoy. [Probably draft of a suggested order.]
[July ?] 53. Petition of Robert Delabarre to the Council. Petitioner and Isaac Van Peen obtained an order on May 19 last for landing certain French goods which are useful to this kingdom, and Lord Treasurer Marlborough granted a warrant to the officers of the Customs accordingly. Those officers now refuse in regard the office of Lord High Treasurer is conferred upon another honourable man, and because the goods must be specifically inserted in the warrant. Prays for permission to import certain quantities of lockram, Vitry canvas, Rouen canvas, thread, plushes, cards, and French wines.
[July ?] 54. The like of the same, with James Hope and Abraham Jennings, to the same. Petitioners had freighted two Scotch ships, the Christian and the Gift of God, and also the Grace, of Plymouth, for a voyage to Ireland, for pilchards. The ships being laden with corn, and the petitioners having bought the pilchards in Ireland, they pray that their ships may be released from their restraint at Plymouth, on giving security that they shall sail to Ireland, and no other place.

July. 58. Statement, addressed to Buckingham, of the present state of the victuals for the fleet for Rochelle. 16,288l. was necessary to be paid before the victuals could be laid aboard.
July. 59. Memorial to [Sec. Conway], that he would speak to the Duke of Buckingham, to direct that his former order be executed concerning the restitution of the Black Dog, of Rotterdam.
