Oct. 2 Privy Seal for 2,808l. 12s. 0d. out of the arrears of Excise to Sarah Gardiner, relict of Maurice Gardiner, merchant, for money due as stated by the Committee of the Navy for the service of said Gardiner's ship called the "Greene Knight," and allowed by the late Parliament and the then Council: all as by the vote of the Commons of July 13 last. Money warrant for 100l. to Sir Thomas Tirrell one of the Judges of Common Pleas, husband of Jane, relict of Francis Winde-bank, for six months' to said Jane on her pension of 200l. per an. Oct. 10 Warrant from Treasurer Southampton to the Customs Commissioners for the discharge of the seizure of the ship "Joseph," of London Richard Cox master, bought by Sir William Warren. Vincent Delabar, and John Shorter, merchants, for 350l. in 1654, from the Dutch prize officers at Dover, and which, after having been seized about 2½ years since by the Biscuayans and regained from them, is now seized in London port on return from Norway for being navigated contrary to the Navigation Act. Oct. 14 Treasurer Southampton's commission to Sir Gilbert Gerrard. Sir Nicholas Throgmorton, Miles Morgan, Capt. William Jones, Jo. Price, and William Clayton, to repair to Kingswood Forest, co. Gloucester, to view same and take consideration of the survey thereof made under the late pretended Parliament, and to treat and agree with the pretended owners and commoners for an improvement to be forthwith made of the waste ground and soil of the said forest so as His Majesty may have a full third part thereof for his own use in discharge of his right and interest therein, and the rest apportioned amongst them the pretended owners and commoners and deafforested in such manner as they shall desire: all in view of information which has been given that divers pretended lords and owners of soil within the said forest or chace have intruded upon the King's inheritance, destroyed his deer, cut down the trees and underwoods and broken up a great part of the ground of said forest or chace by making and opening coalpits and quarries of stone there found, to His Majesty's apparent damage. Warrant from Treasurer Southampton to Thomas Warner, Sergeant at Arms attending the Treasurer. to arrest John Tibbey of St. Peter Chalfont, co. Bucks, and Thomas Francklin and—Smith to answer objections against them touching the Excise. Ibid, XI. p. 57.
Royal warrant countersigned by the Lord Treasurer to the Exchequer to levy tallies of loan at the Receipt for the 60,000l. lent by the city of London in April last, on the security of letters patent of April 19 last. and to cause same to be discharged as issued and paid to the persons who have received and ought to accompt for same according to the several letters patent or letters of Privy Seal already passed or to be passed for those services, for which the said persons received said moneys. "And for that upon leavying the said tallies of loane in our said Receipt wee shall there stand charged with the said debt of three score thousand pounds and by our said letters patents not only with the principal but the interest thereof it is necessary for our security and discharge that the payment of the said debt when it shall be paid should likewise there appeare." Therefore when the Chamberlain of London, as Receiver General and Treasurer of the month's tax, shall have received so much of the 70,000l. contribution as will satisfy the said loan of 60,000l. and interest thereon, tallies are to be levied at the Exchequer [as] for so much recovered from him: said tallies to be discharged as issued and paid out of the Receipt to him as Chamberlain of the City of London to be by him paid over to the respective persons who lent the 60,000l.: the said interest being first calculated and certified to the Lord High Treasurer and the Exchequer by the joint certificate of the said Chamberlain of London, and of one of the Auditors of Imprests. To prevent any doubt as to the date from which interest shall be paid "for any time before the said tallies of loane for that it will not appear by any act of record that the said monies were before that time receaved for our use," therefore the said Auditor and Chamberlain are hereby authorised to compute said interest at the rate of 6 per cent. from the date of the acquittance given upon the receipt of the money so lent until repayment of the principal. Oct. 18 Report to the King from Treasurer Southampton on the petition of Lady Mabella Norton, wife of Sir Henry Norton, Bart., and daughter to Sir Richard Norton, Bart, praying restoration of the remainder of her husband's estate, he having been disinherited by his father, Sir Gregory [Norton], who had his hands in the blood of his sovereign. Oct. 19 Letters patent by Treasurer Southampton appointing Nathaniel Wellen to be the officer in London port for making the bills of entries inwards for the stranger merchants in and about the city of London, the said merchant strangers having been used to having such a particular officer appointed thereto by the Lord Treasurer with a fee of 1d. for every bill; the former executors of that office, William Powell and Philip Constantine, being dead, and sundry of the merchant strangers of the best accompt now residing in the city having by writing desired the revival of said office. Oct. 22 Treasurer Southampton to [the Customs Commissioners] to pursue the directions contained in two orders of the Privy Council of the 11th inst., prefixed in detail, the one to prevent stealing Custom, the other concerning searching foreign ships. Ibid, pp. 109–10, 114.
Appending:—A copy of one of the said orders made upon a memorial from the Customs officers intimating the many insolent abuses daily committed by sundry ill-disposed merchants, factors, wharfingers, cranekeepers, lightermen, watermen, porters, and a sort of people called smucklers in conspiring to defraud the King of his Customs, notably by means of arresting the inferior officers when in attendance so as to get them temporarily out of the way; all in spite of the letter sent by the House of Commons through their Speaker to the Lord Treasurer, and the King's proclamation for discovering and preventing the many fraudulent practices of under officers and others in stealing His Majesty's Customs.
Money warrant for 247l. 7s. 3d. to Henry Hunt and Thomas Raymond, of London, merchant, for a like sum disbursed by them for the redemption and ransome of Philip Major, of Fowey, Cornwall. Jo. Warrant from Treasurer Southampton to the Excise Commissioners to pay to Dorothy Seymour, one of the maids of honour to the Queen Mother, 3,571l. out of the arrears of Excise in course, and after the other sums wherewith those arrears are before charged shall be satisfied: all as by the order of the late Parliament of 1660, Dec. 19. Oct 22 Money warrant for 100l. to William Legg for 1661, Lady Day quarter, on his wages, &c., of 400l. as Master of His Majesty's Armoury for the well keeping, &c., the Armoury and other furniture remaining in the Tower, Hampton Court, Windsor Castle, Greenwich, Westminster, Portsmouth and Woolwich. Oct. 23 Same, dormant, for 6d. a day to John Wynyard from 1660, Sept. 29, as keeper of His Majesty's royal house of Westminster within His Majesty's Palace of Westminster, as by the letters patent of 1634–5, March 19. Ibid, p. 17.
Report to the King from Treasurer Southampton on the petition of Thomas Carleton, of His Majesty's Equerries, praying a grant of a concealment, being sums borrowed by divers gentlemen of Yorkshire upon an engagement for His Majesty, for which they gave their bonds, which fell into the hands of the Commissioners for Sequestrations, who prosecuted them thereon. Thinks it most unfit to make such a grant, which would have to be levied out of loyal gentlemen unless the King is prepared to repay them what they borrowed for his royal father. Ibid. VII. p. 90.
