Dec. 3. William Lowndes to the Earl of Portland. By my letter of the 30th ult., supra, p. 1248, my Lords only desired that you should send them an account of what was due to the Privy Purse at Michaelmas, 1695, since the time of your being keeper thereof. Out Letters (General) XV, p. 39.
Treasury reference to the Excise Commissioners of the petition of Charles Brawne, shewing that in 1682 he with James Bisse and John Hargrill became bound for John Allen, late collector of Excise, co. Somerset, for his due execution of that office and that said Allen is absconded 800l. in the King's debt and the rest of the security become insolvent; therefore praying relief, petitioner having been very industrious in giving timely notice to the Excise Commissioners of the bad circumstances of said Allen. Same to Mr. [Auditor] Aldworth of the petition of Richard Topham, executor of John Topham, late Serjeant at Arms attending the House of Commons, praying payment of 106l. 3s. 6d. for so much disbursed by his father in the Sessions of Parliament for the year 1691 and 1692, being for the House of Commons. Dec. 4. Royal warrant to the Clerk of the Signet for a privy seal for an allowance of 200l. per an. to Sir Galashiel Lovell, kt., as an addition to the profits of his place as one of the Justices of Chester, that sum having been added thereto upon the augmentation of all the salaries of all the Judges at Westminster and in North and South Wales: to be payable termly, the first payment at the last day of Hilary term next: and further for the payment of 6l. 4s. 3d. to him for 21 days from Nov. 7 on the said allowance. Dec. 4. William Lowndes to the Excise Commissioners to pay to the Queen Dowager's Treasurer 3,052l. 8s. 9½d. for last Sept. 29 quarter: paying same by 552l. 8s. 9½d. this week and the remainder by 500l. a week thereafter. Disposition Book XIII, p. 74.
Same to Mr. Francklyn. The creditors of James Thomas, deceased, late Lieut. to a Company in the Second Marine Regiment, have petitioned for payment of their several debts out of said Thomas's money in the hands of Mr. Balderston, late Agent to said Regiment. Thereon Balderston has reported to my Lords that he and the present Agent of said Regiment (in whose hands there is also money of the said Lieutenant) are ready to pay same provided it may be done with safety to themselves by reason the said Thomas hanged himself at Portsmouth and his pay (as they are informed) is thereby forfeited. My Lords have no objection on his Majesty's behalf, to the grant of administration to the said creditors. Out Letters (General) XV, p. 39.

Treasury warrant to the Surveyor General of Crown Lands for a particular of premises, ut supra, p. 1134 (two tenements in Austell Prior), in order to a lease thereof to Peter Godfry on terms as follows. Warrants not Relating to Money XV, pp. 58–9.
Prefixing: said Surveyor's report on said Godfry's petition for same. The last lease desired by petitioner was passed 1686, Dec. 18, to Andrew Came for the lives of the Bishop of Exeter and his brother, Charles Trelawney, in the first tenement and of Eliz. Vivian and Henry Trelawny in the second. They are small and valued at only 4l. each per an. and since the last lease Came has been forced to part with his interest to petitioner, Godfry. The desired reversionary lease is hardly worth a fine. I advise only a small acknowledgment of 50s.

William Lowndes to the Auditor of the Receipt to issue 50,000l. to Edward Russell on the unsatisfied order in his name as Treasurer of the Navy: to be issued out of loans on the Exchequer on the clause of credit in the Annuity Act: and to be applied to wages of seamen. Dec. 5. Treasury reference to Aaron Smith [Treasury Solicitor] of the petition of Sir Henry Bond, bart., shewing that being Vice Treasurer in Ireland, in the exercise of that place at the time of the King's going into Ireland and being afraid to return into England by reason of his said debts, he went into France, having some relations [there] by his mother's side: that being in France [he] hath been outlawed for high treason: that by reason of such outlawry he cannot safely without the King's leave and pardon come to England, where he desires to live with all duty and loyalty to the King and Government: therefore praying the King's pass to come to England and pardon of the said outlawry and reversal thereof, so that his estate may be the better sold to pay his said debts. Treasury reference to the Customs Commissioners of the petition of Thomas South, a landwaiter for 26 years past, and now incapable by age and indisposition, therefore praying leave to resign to John Gilbert, reserving a moiety of the established salary for his life” as hath been accustomed.” Reference Book VII, p. 120.
Same to same of the petition of Geo. Barber, deputy King's waiter, praying for the abovesaid South's place, “he allowing to the person superannuated.” Ibid.
Same to the Surveyor General of Crown Lands of the petition of Richard Topham, shewing that Charles II purchased of his father two closes which he held of the Dean and Chapter of Windsor in order to the making of the Avenue there, and the Crown now enjoys the profits of the said two closes, but there is a rent of 4l. 7s. 0d. payable out of same to the Dean and Chapter, which was never paid by the Crown, whereby there is an arrear of 48l. 11s. 8d. on petitioner, which he was forced to pay,” his father never assigning the said premises”: therefore praying to be reimbursed and that he may assign the premises in order to be discharged of the growing rent. William Lowndes to the Customs Commissioners to report on the copies of two Acts passed in the General Assembly of Massachusetts Bay, which have been sent to the Treasury by the Committee for Trade and Plantations: the one being an Act for coasting vessels within the Province; the other an Act to restrain the exportation of raw hides and skins out of the Province of Massachusetts Bay. Prefixing: (a) an order of the King in Council, dated Kensington, Dec. 5 inst., made upon reading a report from the Admiralty Lords on the petition of the merchants trading to Portugal, Spain and the Straits, praying that the time limited for the clearing of their ships at Gravesend on Dec. 1 may be lengthened to Dec. 15.
It is hereby ordered that the time limited for the petitioners' ships to be ready to sail with the convoy be prolonged to Dec. 15 and no longer.
Dec. 6. The like order on the like Order in Council, extending to Dec. 31 inst. the time for the sailing of the ships going to Jamaica. Out Letters (Customs) XIII, p. 224.

Treasury reference to Samuell Travers, Surveyor General of Crown Lands, of the petition of the inhabitants of East Stockwith in co. Lincoln, praying direction to the Auditor of the Duchy of Cornwall to discharge the 6l. per an. which is by mistake overcharged and reserved in the recent grant to them of several small things in co. Lincoln. Reference Book VII, p. 120.
Same to same of the petition of Peter Knight for extension of lease of a tenement in the Duchy of Cornwall. Ibid.
Same to the Customs Commissioners of the petition of Simon Hitchcock, shewing that he was a Customs officer in Lyme port under James II, but was dismissed for not consenting to the taking off the penal laws and Test: therefore praying to be restored to some equal place. Ibid, p. 121.
Treasury warrant to the Surveyor General of Crown Lands for a particular of premises, ut supra, p. 1140 (several small parcels of land in the Honor of Penrith and Forest of Inglewood, co. Cumberland), in order to an extension of lease thereof to Lancelot Simpson for 99 years at the old rent of 5l. and fine of 50l. Warrants not Relating to Money XV, pp. 57–8.
Prefixing: said Surveyor's report on said Simpson's petition for same. In July, 1687, petitioner obtained a lease from the Queen Dowager (as part of her jointure) of the said several small parcels called Keldrick Moor and Keldrick (which petitioner alleges should be Weldrick) Myre on the west side of the old castle at Penrith containing 30 acres; some other little pieces of land there containing five acres and 20 acres of land in the Forest of Inglewood belonging to the same Honor, at a rent of 5l. per an. from the date he should recover the premises, they being a concealment from the Crown, which recovery was to be effected within five years. He met with such trouble in obtaining possession that in 1692, Dec, he was forced to apply to the Queen Dowager's Council for extension of time for recovery of the premises and was granted two years more, and in 1692 he obtained a decree in the Exchequer Court to the effect that after three trials at Common Law he had obtained a verdict and that he should hold the premises during his term with reversion to the Crown thereafter,” with a perpetual injunction against the plaintiffs who prosecuted on behalf of all the townsmen and inhabitants of Penrith: yet it is alleged that since the decree the fences made by petitioner have been thrown down and that petitioner is still liable to the same usage.” The premises were not valued in the Parliament's survey in 1650 nor were they particularly sold in those times amongst the many severals expressed to belong to the said Honor, though some parts of the demesne lands of the manor are bounded by these accounted as wastes. They are worth but 30l. a year on improvement.
Dec. 6. Treasury warrant to the Surveyor General of Crown Lands for a particular of premises, ut supra, p. 1134 (a small burgage in the borough of Fowey), in order to a lease thereof to John Manly. Warrants not Relating to Money XV, pp. 59–60.
Prefixing: report by said Surveyor General on said Manly's petition for same. Since the death of Richard Hoblin petitioner has been, by the Earl of Bath, appointed as steward of the manors within the Duchy and County of Cornwall. The premises have been detained from the Crown a long time and only the old rents of 12d. and 8d. answered for the same. The improved value by the Parliament's survey [in 1650] is but 11s. 4d. per an., which being so inconsiderable no person has desired renewal since 1660 till now.
As for his petition for quarries of Moor Stone [moor stone] within the manors of Stoke Clinsland and Calstock, being part of the ancient Duchy of Cornwall, the same do belong to the Crown, but no profit thereof appears hitherto made to the Crown. He may be granted a 31 years' lease with covenant to assert the Crown's title and on reservation of a sixth of the profits, and with an exception of any customary right which the tenants of either of these manors may have of digging or taking stone out of the said wastes for the necessary building or repairing of the anoient Duchy tenements, fences or enclosures.

Russell's, broke in Ireland, praying the same allowances on the cheques as have been granted to other Regiments and that what has been paid for clothing of the said Regiment over and above the offreckonings may be struck out of the account and that certificates which he has from the Commissioners for Accounts, Ireland, “may be allowed out of the county charge”; and likewise praying payment of their arrears; he having stated the accounts of the said Regiment with the Commissioners of Accounts in Ireland.
