and having an opportunity of disposing of the salt there he tendered

Prefixing : (a) letter to William Lowndes, Secretary of the Treasury,
from J. Burchett, Secretary of the Admiralty dated Jan. 31. It
is the Queen's pleasure that the Captains concerned in the action
at Vigo shall have the proportion of plunder due to them by the
Queen's late Declaration and that those who were only Masters and
Commanders shall not come in for an equal share with those Captains
as was at first designed upon the report of the Attorney General :
this decision being arrived at on the Lord Admiral's report on the
petition of said Captains. A stop is therefore to be put to the
payment of those gentlemen who were then in ships and vessels
which did not give them the post of Captain, until this affair can be
adjusted.

Order by Treasurer Godolphin to the Prizes Commissioners to
observe (a) infra.
Prefixing : (a) Order of the Queen in Council dated St.
James's, Jan. 28, for distribution of the Prizes taken at
Vigo, said order being made on the report of the Lord Admiral,
Prince George of Denmark, upon the letter of Sir George Rooke and
the petition of Rear-Admiral Dilks and other the Captains of her
Majesty's ships of war appointed for the line of battle and battering
of the forts at Vigo, the said petition praying that the Declaration
of Dec. 19 last may be rendered effectual to them upon the list of the
said ships at Vigo on the 12 Oct., 1702, and upon no other ships of
war engaged or in any wise assisting in that action. Hereon the
Lord Admiral reported to the Queen that by Order in Council it
was declared that the distribution of the captors' moiety of said
prizes should be according to the list of the fleet to be transmitted
from the Admiral of the Fleet and according to lists of every such
ship from the Navy Board by due proportions in a particular ship
and that the Flag Officers are to have equal shares and all the ships
mentioned in the Admiral's list to have been at Vigo are to be considered
as principals and distribution to be made accordingly without
difference between those ships actually taking prizes and those which
were present and assisting. The said Declaration settles all matters
contained in the said petition except what relates to the Masters and
Commanders of small ships. As to these the petitioners insist that
such Masters have not the post of Captains in her Majesty's fleet
nor are to be taken as such within the said Declaration, otherwise
they would rank doubly for prize distribution firstly as Captains
and then again as Masters. Hereon the Lord High Admiral is of
opinion that such Masters are not Captains and cannot be rewarded
out of the captors' moiety but only (if the Queen so think fit) out of
the Queen's moiety for any eminent or extraordinary sea service
they may have performed.
The Queen hereby approves the said report from the Lord High
Admiral and accordingly orders that in the distribution of the
prizes and booty taken at Vigo such difference as above be made
between Captains and Masters or Commanders.

of the Assassination Plot in 1696 been informed that Capt.
Joseph Saunders had been hired by several ill-affected persons to
convey Cardwell Goodman (one of the conspirators), Col. Ingram
and William O'Brian into France and having seized the said Saunders
on his return into England he did prevail with him to disclose many
material things to the great satisfaction of the Secretary of State
to whom upon examination it also appeared that the said Saunders
had been a great agent for the French smugglers as well as for the
owlers : and the said Saunders on examination subsequently by
Henry Baker discovered several persons who had exported great
quantities of wool and brought back great parcels of French silks
whereupon informations for upwards of 30,000l. were filed in the
Exchequer Court : whereupon the said smugglers caused Saunders
to be arrested on execution for 146l. 13s. 4d. being the late King's
part of a penalty recovered upon him some time before for importing
French silks and for which they had promised to save him harmless :
whereupon the said Ford borrowed 150l. to pay off the said penalty
to save Saunders from them : and in the next two terms there were
seizure of French silks and other prohibited French goods to the
value of above 4500l. : but the said Saunders died presently after
without receiving any reward for his services and petitioner has been
lately arrested for the said 150l. : upon all which matters Henry
Baker has reported that the statements as above are exactly true.

Muschamp, Receiver of her Majesty's revenue in the District of

Maryland about Sept. last. In my report on the said Muschamp's
