entered Vigo Harbour) she was directed to join the Kent and
indeavour to intercept some Victuallers coming from France which
the Mary had chased under Cape Finisterre and that when he arrived
on the 12th at Vigo he found her Majesty's ships actually engaged
with the enemy and might have gone in and had share of the action
had there been occasion for all the ships of the Fleet to be engaged
therein and [if] the wind would have permitted him : on which petition
Sir George Rooke, who then commanded the Fleet, reported that if
it should appear that the Pembroke was within the Isles of Bayonne
at the beginning of the action or that she was as far up as any of
the great ships before the action was over he sees no objection to
adding her to the list ; and it appearing by the affidavit of some of
her Officers that she was actually within the aforesaid Isles of Bayonne

Same to the Customs Commissioners of the petition of John Lilly,
master of the pink Francis of Yarmouth, shewing that in January
1703-4 he laded at Newcastle 30 chaldron of coals Newcastle measure
being a winter voyage, but by direction of the Customs officers there
he took out a cocquet for 32 chaldron, "a summer voyage," intending
to land same at Yarmouth but was forced by a westerly wind to
Holland where he sold the coals and on return to Newcastle offered
to the officers the overseas Duty to discharge his bond but they
refuse : therefore praying an order to them to receive the [said] Duty
in order to the cancelling his said bond. Ibid.

of the petition of Capt. Gardner on behalf of the Earl of Donegal's
Regiment, shewing that a Company of said Regiment and 26 recruits
were taken prisoner and carried into Cadiz and lost accoutrements
to the value of 55l. 19s. 8d. (viz. 90 slings, 90 belts, 90 pouches, 90
flasks, 90 snapsacks, 16 kettles, and 4 Serjeants' swords) besides all

for stay of process against Viscountess Falkland on her late husband's

Coleby [Commissioners of Transports] of the petition of Sir Jos.
Woolfe et al. owners of the Joseph and Thomas now in the transport
service : shewing that the said ship in her passage from Gibraltar to
Lisbon met a Spanish privateer of 22 guns and 160 men which she
engaged 7 hours and at last got safe into Lisbon : therefore praying
an allowance for damage sustained in regard the ship was saved by
the courage and bravery of the mariners and the Queen hath thereby
saved 3000l. "which by a covenant in the charter-party, she was

Same to the Stamps Commissioners of the petition of John Butler,
Henry Collet and Benjamin Collet shewing that John Collet was
admitted into the Stamp Office soon after the erecting it and was
very serviceable in putting the accounts of the Office into a proper

Worcester and is now disturbed in his brain and a deficiency in his

Treasury reference to the Salt Commissioners of the petition of
Capt. Edmd. Clarke shewing that he bought a French prize at
Newfoundland with the cargo of 15,000 fish and sold the fish but
there remained some damaged salt shaken off the fish about 10 tons
for which the Salt officers demand 6d. a bushel but it is sold for but
4s. 2d. : "that the salt being only to the fish as cask is to wine to
preserve it he conceives it not chargeable with any Duty" : therefore

Same to the Victualling Commissioners of the petition of Woodes
Rogers shewing that he let Capt. Moody have a parcel of bread for
the garrison of St. Johns in Newfoundland this last year to the
value of 50l. 11s. 9d. for which he received bills on the Victualling

prays that he may not be a sufferer by his zeal, this being a service

Whitehall a little before the death of Wm. III and which have since

Palace ; and 119l. 3s. 7½d. for the like pipe furnished there
[in the gardens at Kensington] before the death of Wm. III
and since used there by her present Majesty : therefore praying
payment thereof ; as also for 75l. 12s. 0d. for 1703 April 1 to
1704 Dec. 31 for a man to turn the several brass cocks at Hampton
Court and to cleanse the several basons in the gardens there from
scum, which if not taken away constantly would stop the pipes and

Graver in the Mint loco said Harris with a salary of 200l. per an. ;
as from Aug. 3 last : and Samuell Bull who is now a probationer and
