Royal sign manual for 315l. to John George Huke (Hugk), Secretary to Prince George of Denmark, to satisfy all fees & charges at the Treasury & Exchequer on the 6000l. to Prince Charles of Denmark for 1 ½ years to Oct 10 last on the allowance of 4000l. per an which her Majesty has agreed to contribute for her share of the damage he should suffer by the renunciation of the bishopric of Eutin as by the royal warrant of Nov 12 last. Same to Mr. St John. In yours of the 24th inst you desire the Lord Treasurer's directions whether Mr. King, Secretary to the late Comptrollers of Army Accounts, shall attend the General Officers of the Army who are to meet for the better regulating & inspecting the clothing and whether the General Officers may make use of the Office which the said late Comptrollers had. The Lord Treasurer is very willing thereto in regard the Queen pays a salary to said [Gregory] King & the clerks in said Office & also the rent of the Office & there is no other occasion for it at present. Jan. 27. Treasury reference to William Borret of the petition of Dr. Wells Master of Arts praying to be reimbursed the further sum of 321l. 8. 4 which he expended in prosecuting the Queen's right to the living [advowson] of St Botolph's Aldgate. Reference Book VIII, p. 291.
Same to the Officers of the Works of the petition of Robert Aldersey shewing that by the late king's command he rectified the river from Longford to Hampton Court, for which he provided brass works & other materials and also made one new engine for quenching fire & repaired another old one “all which are remaining there for the use of that Palace”: therefore praying to be paid 80l. 9. 6 for same. Same to the [Principal] Commissioners of Prizes of the petition of Capt. Vincent Cutter, Commander of the Newcastle, shewing that he took a French prize in 1706 called the Jean Du Grace with fish and oil and sent it into Barcelona where the produce thereof, amounting to 14000 dollars, was disposed of by Lord Peterborough's order and his Lordship drew bills on Mr. Brydges for 8000 dollars part thereof “which are not answered”: therefore on behalf of himself, officers & company the petitioner prays “the captors' proportions out of the said 8000 dollars drawn on Mr. Brydges & at the rate Mr. Vincent received them being 5s. each.” Ibid., p. 309.
Same to Mr. Borret of the petition of John Cunliffe of Leeds, Co Yorks, shewing that one Capt. Wheatley stole & conveyed away his wife & has since had several children by her and that thereupon he caused the said Wheatley to be apprehended & fined 200 marks which is paid into the hands of Robert Mitford then sheriff of York or his deputy: that petitioner has been at above 100l. charge: therefore prays that said fine may be paid to him. Jan. 28. Warrant by Treasurer Godolphin to the Customs Commissioners to repay to Anthony Merry, Richard Smith, Alexander Cleve & other merchants, dealers in tin, the Duty moneys deposited by them in January 1696–7 at the rate of 5s. 8d. per ounce on the encouragement of the Act of 8 Wm. III [8–9 Wm. III, c. 2] for the Coinage, they intending at the time to re-export said tin: but the Duty on tin exported was soon afterwards [by 8–9 Wm. III, c. 34] lowered from 7s. 4d. [as by the Book of Rates] to 3s. per hundredweight so that they could not make use of their cocquets without great loss. The repayment is to be made only for so much of the tin as still remains unshipped & is to be after the same rate their money was paid to the public, that is to say deducting 10 per cent from the gross sum payable to each merchant respectively. And whereas two of the entries for the said tin were made on the 2 May 1696 which was before the stop of clipped money & the Customs Commissioners are doubtful what rebate should be made for those entries (as the weight of the money which was then paid does not appear to have been recorded) “I think the merchants concerned in those entries should be very well satisfied to be repaid their money (which they find they cannot recover by law, having no tin at that time to ship) with the like deduction of 10 per cent as in the other case, [on their] making the same proofs.”

Same by same to same to pay John Cole, an officer of the Customs, London port, 60l. as a reward & for his charges, out of the money levied on William Murray on account of a parcel of foreign lustrings which he bought at a public sale in July 1705 & gave bond to export and not land them again in any part of England, pursuant to the Act of 8–9 Wm. III, c. 36, but he did not so export.

Jan. 28. Report from Treasurer Godolphin to the Queen on the order of reference in Council of the 18th inst of the proposal from the Commissioners of Trade that during the present war neutral ships be permitted to load tobacco here &c ut supra p. 54. I referred same to the Customs Commissioners & herewith submit their report with which I agree (struck through).
Appending (a) said report dated 27 Jan. 1707–8. We do not find any law that hinders the subjects of neutral Princes or States from loading tobacco here on neutral ships and when they have done so, from carrying it (being not a contraband commodity) where they think fit: but that any explicit direction for foreign ships to clear from hence immediately to France (although on appearance for foreign accompt) may yet give an opportunity for her Majesty's subjects to send goods to France under borrowed names, and when they are there may be under temptation to load wines or other French goods; which we presume may interfere with the intention of Parliament in prohibiting trade & correspondence with France: and therefore in our humble opinion may deserve a higher consideration, especially during the session.
(b) said order of the Queen in Council dated Kensington 18 January 1707–8.
(c) extract from said representation from the Commissioners of Trade “entered the 1 July 1707 relating to the tobacco trade.” There being at present no commerce with France by British shipping tis proposed that during the present war neutral ships be permitted to load tobacco &c ut supra. If this be approved it will be necessary that the present instructions to the Commanders of your Majesty's ships of war & privateers as to that point be altered, that suitable directions be given therein to the Customs Commissioners & that such your Majesty's pleasure be notified to “all” the States General to the end they may give the like instructions to their ships of war & privateers. Same by same to the Postmasters General to give directions to their agent for the packet boats at Falmouth to permit the stuffs as below to be put on board the said packet boats in order to their transport to Lisbon.

(b) report to said Postmasters by Zack. Rogers, their said agent at Falmouth. There is no objection, provided petitioners ship within 12 hours notice of advice, that they ship not more than 500 pieces at a time & that they pay 2s. per piece with primage & average according to custom. Warrant by same to the Surveyor General of Crown Lands to purchase for 100 guineas the inheritance of a piece of ground on Castle Hill at Windsor & now used as a garden by Edward Locket being next the timber yard & belonging to Sir John Francklin who last winter refused to take 100 guineas for it of a gentleman employed by the said Surveyor General to buy it: but the said Sir John being since dead & the premises to be disposed of.

Jan. 29. Letter of direction for 60000l. to Harry Mordaunt, Treasurer of the Ordnance: out of loans on Land Tax or Malt anno 1708: half thereof for land services & half for sea services of the Ordnance. Disposition Book XIX, p. 98.
Jan. 29. J. Taylour (in the absence of William Lowndes) to the Commissioners of Transports. At your attendance on the Lord Treasurer yesterday you asked to whom you should consign the corn now sending to Spain for the use of the Forces there. You are to consign same to John Mead, Deputy Paymaster of the Forces, & Henry Vincent, Commissary of Stores & Provisions there; & to the end that due care may be taken of the disposal thereof and of her Majesty's reimbursement for the same you are to send an invoice of the corn so shipped and an account of the prime cost and other charges relating thereto and a like invoice and account to the said Deputy Paymaster and Commissary, so that care may be taken of the disposal thereof & of the Queen's reimbursement. Treasury reference to the Agents for Taxes of the petition of Thomas Brougham, Receiver General of Taxes for Cumberland & Westmorland, praying payment of 684l. 15. 1 for the extraordinary charges of his receipt, due to him upon 4 reports [missing] from said Agents. Reference Book VIII, p. 291.
Warrant by Treasurer Godolphin to the Stamps Commissioners to make out a copy of the particular omissions and defaults charged upon the sworn attorneys of her Majesty's Courts of law at Westminster and to deliver same to them respectively; and upon their submitting to pay such charge, all proceedings on the informations against them are to be stayed.
Prefixing: report by Sir Simon Harcourt, Attorney General, & Sir James Montague, Solicitor General, on the petition of the said sworn attorneys. In Hilary term last 1139 several informations were filed in the Exchequer against so many several attornies of the Queen's Bench & Common Pleas in the name of 2 informers who are servants of the Stamps Commissioners: all being founded on the Act of 1 Anne, st. 2, c. 19 for preventing frauds in Stamp Duties. A clause was inserted in the Low Wines Act [6 Anne, c. 2, clause 31] of last session for their indemnity, whereupon they applied to said Commissioners shewing them the hardship of their case & the impossibility of their complying with the conditions of said clause & therefore desired of the Commissioners the like favour which had been granted to all Town Clerks & officers of inferior Courts, to wit a charge of their several & respective omissions but the same was refused them. Whereupon they applied to you, the Lord Treasurer. The offences number 3079 whereof 2503 were for not entering common bail or filing an appearance & the remaining 576 were for proceeding further in cases before the defendants' attorney had done his duty by entering appearance or filing common bail. These latter, being prosecutions of the plaintiff's attornies for default of the defendants' attornies, we conceive are not warranted by the Act. The Duty defrauded by the former 2503 amounts to 125l. 3. 0 which we suppose is scarce the twentieth part of the charge of preparing 1139 informations even if no further proceedings be had thereon, many of them being for 1s. Duty for one single omission only. Neither the Attorney General nor any of the Queen's Counsel have advised the filing of these prosecutions. But the Stamps Commissioners did it upon the many informations they had received of a general practice to defraud the Crown of these Duties. We submit whether such procedure is not more likely to prejudice the Duty by creating a general dislike & opposition thereto. The Commissioners refused the request for a charge because all the offences laid in the several informations were committed in the space of 2 or 3 terms only & they were satisfied that many more frauds had been committed than had yet been detected & that therefore the attorneys ought at their peril to comply with the terms of the indemnity as in said Act, to wit by paying before Nov 23 last all the Duties they ought to have paid from the first imposition thereof. The attornies reply they cannot make such discovery & payment because many of the frauds were done by young clerks or by persons who are not sworn attornies practising without their consent. The Commissioners distinguish these cases from those of the Town Clerks &c whose offences they supposed to proceed from ignorance of the law whereas the sworn attorneys of the Court at Westminster must have known & acted voluntarily for the sake of gain. We cannot reasonably imagine this in any person of tolerable circumstances or of any reputation or business in his profession, the penalty being so high viz 20l. for every single shilling Duty. Royal sign manual for 500l. to Francis Palmer, Envoy Extraordinary to the Duke of Savoy, for the extraordinary charges he must necessarily be at in attending the said Duke in the ensuing campaign.
