Treasury reference to the Customs Commissioners of the petition of Michael Allais, master of the St. John Baptist of St. Malo, shewing that he came from France in April last with brandy, salt and other free merchandizes for Cork, where he sold and re-laded with beef, pork and butter for Placentia in Newfoundland; that one of his foremen deserting he was forced to take in another at Padstow: [that on the] 24 of the said month Hanibal Gammon and Stephen Hubbert seized the ship, securing the crew under the colour [charge] of running wool, which being examined only four squabs were found quilted or made of wool, on which the Customs Commissioners ordered his discharge, which the seizers have indirectly disobeyed. Nicholas Hebrand of The Two Beau-Frères of Calais, shewing that he was bound for Amsterdam, but was forced on the English coast by contrary winds, where on going on shore to buy provisions his ship was seized and sent into Orford by the Customs officers and he put in prison at Dunwich. April 23. Warrant by Treasurer Oxford to the Customs Commissioners to permit Arthur Foresight the liberty of his person on security to surrender.
Prefixing: report by said Commissioners on said Foresight's petition. He was bail for Gabriel Tonkin in the penalty of 1,537l. for a verdict of 732l. for exporting wool to France. John Valentine, Anne Jarvis and petitioner were bail for Tonkin. Valentine is broke and in the Mint [sic]. Ann Jarvis cannot be taken, but an estate of hers in Sussex of about 28l. per an. is seized and the inquisition is lately returned into the Exchequer. Petitioner is also failed, but was lately taken in execution and is now a prisoner in the Compter. Petitioner has counter–security from said Ann Jarvis and from John Prior of Bidenden in Kent, who is reputed a substantial man. If petitioner had his liberty and might go into the country he might recover her Majesty's debt. Out Letters (Customs) XVI, pp. 123–123b.
April 24. Same by same to the South Sea Company to permit Charles Cæsar, Treasurer of the Navy, to transfer 37,246l. 12s. 3d. of South Sea Stock to Sir Roger Mostyn, Paymaster of Marines, as imprest to pay the offreckonings of the six Marine Regiments from 1711 April 25 (the day to which they were paid) to 1712 Dec. 24: and to be assigned and transferred thereto by the said Mostyn as he shall be directed by warrant from the Lord Treasurer. Same to the Transports Commissioners. It is represented to my Lord Treasurer by the enclosed letter [missing] from Mr. [Consul] Baker that some slaves were carried off from Algiers by several transport ships which came thither to lade corn for the relief of her Majesty's Forces in Catalonia. Strict inquiry has been made at the Admiralty of the officers of her Majesty's ships who conveyed the said transports in order to find the offenders, but without success. Her Majesty's late Consul at Algiers has paid the ransom of those slaves and included it in his demands for extraordinary disbursements in that service. My Lord directs you to make the best inquiry you can to find out the persons concerned in carrying off the said slaves and to report to him thereon. Ibid., p. 190.
April 24. Same to the Customs Commissioners to instruct Thomas Sampson in the business of the Customs at the waterside. Ibid.
Same to the Comptrollers of Army Accounts. My Lord Treasurer is solicited by John Harrer and three others, who pretend to have been prisoners in Spain, for subsistence due to them during their imprisonment. Please report thereon; as also under whose care of payment they were and how it happens [that they remain unpaid] when such great sums have been issued from time to time to several hands for subsistence of all who were prisoners. Ibid., p. 191.
Warrant by Treasurer Oxford to the Customs Commissioners to permit Sir Robert Dunkly the liberty of his person for 12 months.
Prefixing: report by said Commissioners on said Dunkly's petition. He is indebted to the Queen on tobacco bonds of his own in 21,591l. 12s. 11½d. and he is also bound with others in several [tobacco Duty] bonds, viz. 37,774l. 12s. 2d. with Mr. Thomas Couts; 14,066l. 13s. 2d. with Thomas Corbin and 18,064l. 13s. 0d. with Richard Lee. Immediately on Dunkly's failing his goods were seized in London upon an extent and produced 23l. 9s. 6d. A part of the ship Josia belonging to him (which before his going off was assigned to Mr. Watkinson) was sold by Henry Ofley for 214l. 3s. 4d. Petitioner was taken on an extent in Surrey and is now a prisoner in the Marshalsea. Lee is broke and fled into Holland. Dunkly's lady has lately sold several parcels of her wearing apparel for the support of herself and children and to maintain him in prison. If he were at liberty he might get in some debts.

April 24. Treasury reference to the Comptrollers of Army Accounts of the petition of Col. Tho. Chudleigh in behalf of the Foot Regiment late under his command shewing that the Regiment was continued in Flanders to 24 Aug. 1713 before they embarked for Ireland and mustered and subsisted to that time at the same rates and numbers they consisted of according to the Establishment in Flanders though placed on the Irish Establishment the 24th of June preceding: that in Ireland they were accounted with on that Establishment: by which [means] they are 662l. 17s. 8d. in debt [by being charged for the difference between the said two Establishment rates for] 62 days from 25 June to 24 August: therefore praying to be allowed same. Same to same of the petition of Col. Cha. Churchill and [his] Officers shewing that the [his] Regiment continued in England from 25 March 1713 (the time it was placed on the Irish Establishment) to 12 Dec. following [and] were paid according to the English Establishment for that time, which amounts to 1,570l. 8s. 2d. more than Irish pay; that they were obliged to allow the banker for exchange of money from Ireland to England 8 per cent., which amounts to near 450l.: therefore praying relief therein. Same by same to Sir Edward Northey, Attorney General, to give warrant to the Clerk of the Petty Bag for a Commission of inquiry into the estate of Mary Saltmarsh and Mary Crispe, supposed to be forfeited by their entering themselves into a nunnery in Flanders in order to profess the Catholic religion.
Prefixing: report by the Attorney and Solicitor General on the case. They were indicated at the Assizes at Maidstone in Kent 31 July 1699 for that they did on the 1st June 1698 leave the realm to go to Brussels with the said intent: which indictment was founded on an Act of 3 Charles I. [c. 2]: which indictment was removed into the Queen's Bench and thereupon the defendants were waived and thereby forfeited: and the offence was not pardoned by the General Pardon of 6 Anne [7 Anne, c. 22]. April 25. Treasurer Oxford to the Lord Lieutenant of Ireland to report on the enclosed memorial [missing] of Lord Windsor, Lord Ashburnham and Col. Thomas Chudleigh in behalf of the Officers of the Regiments late under their commands, setting forth their miserable condition by not being put upon the Half pay Establishment of Ireland upon their disbandment. Royal warrant dated St. James's to the Receiver of the Salvage Money in the Court of Admiralty to pay 237l. 19s. 8d. to Sir John Lambert et at., owners of the ship Squirrel, which was re–taken by her Majesty's ships Plymouth and Assurance: [this payment to be] as in full recompense of all damages which they have suffered by embezzlements committed on board the Squirrel by the sailors of her Majesty's said ships; the Admiralty Lords having reported that the late Act for convoys and cruizers [6 Anne, c. 65] “have” so far taken away the most valuable perquisites and droits of the Crown and Admiralty arising from prizes that there is hardly enough left to answer the necessary charges of the Admiralty officers, but that Capt. Hanway, Commander of the said ship Plymouth, believes that there might be embezzlements committed on board the Squirrel, and is therefore willing to renounce any pretensions to the salvage money for re–taking her. Warrant by Treasurer Oxford to the Customs Commissioners to accept 982l. 19s. 5d. from Micajah Perry as in full for the interest on the bonds due from Daniel Park of London, merchant, for whom he became collateral security in 1706 (when said Park went to the Leeward Islands) for 3,231l. 14s. 0d. for the Customs due for tobacco imported by him [Parke]: which sum the petitioners has since on the 23 Aug. 1707 paid, the said Park having been murdered by the inhabitants of Antigua in her Majesty's service and having made no provision for said debt, [petitioner] “being only secured by an estate he [Park] had in Virginia and an uncertain security of part of a lease in England, which would not in ten years at least make good his [petitioner's] losses on the principal money.” In regard of Park's being beyond sea at the time, no application was made for relief from the interest charge in accordance with the Act of Parliament [4–5 Anne, c. 18, cl. 27] (made since Mr. Park's debt) for relief against interest [on such bonds]. He [petitioners] has paid above a million of money to the Crown for Tobacco Duties and is in danger of suffering greatly by the general calamity on the tobacco trade.
