Instructions to the Customs Commissioners [in the form of
Treasury resolutions on papers submitted by said Commissioners]. The salary of the collector for Plymouth port is to
be reduced to 140l. per an. As to the matters relating to the
Prizage Duty you are to take counsel of such K.C's. as Sir
John Maynard, Sir William Ellis and Sir William Jones. All
such prize goods as belong to the seamen ought to be entered
and duty paid as for other prize goods or else to be forfeited.
As for coals exported by natives in foreign-built ships made
free or licensed by His Majesty we think fit that they should
not pay aliens' duty. The salary to the two boatmen at Newcastle is to be 30l. per an. each. You are not to sign any
clearing cocquets where the ship's master shall refuse to take
sufferance cocquets (as is directed by the Act of Frauds) for
passing goods coastwise, and if any action by reason hereof
shall be brought against the Customs officer it shall be
defended at His Majesty's charge. On perusal of your report
on the case of Mr. La Pearle and the papers thereto annexed
we do not think that any favour ought to be shown, but that
the forfeiture of the goods ought to be taken according to law. |

We have yours of the 18th ult. in reply to ours of March 5
last as to your care concerning the arrears of assessments in
your county. We observe a misconstruction on your part of
some clauses of the Act for the Royal Aid, to which the
subsequent Acts refer. In the cases of John Stafford, Richard
Harmer and John Sorrell you apprehend you have fully
executed your powers under said Act when you have
imprisoned the person and sold the estates of such head
collectors and sub-collectors as have made default and
when you have paid the money arising therefrom
into the Exchequer. "But if you please to compare
the clause directing a reassessment beginning folio 103 of that
Act printed single by itself (for the numbers of the folio there
do differ from the book of Statutes at large) with the clause
directing imprisonment and sale which begins folio 106,"
you will find that a reassessment is enjoined wherever by any
means the assessment fails to be paid in time. As to the
moneys alleged by you to be paid into the Exchequer from
such sales in discharge of supers on such collectors we can find
none so paid, so that if the money were paid it was to the
Receiver before the declaring of his account so that the supers
stand the same. As to the cases of Thom. Whiteing, William
Gay, John Clerk and William Bell we find that process has
issued out of the Exchequer for recovery of the debts, and that
nichils have been returned by the sheriffs, so that the supers
remain to be reassessed by you. We are enquiring as to the
case of Andrew Leake, whose arrear is certified by you to be
paid to Andr. Verdon, late deputy undersheriff. As to the
arrear on the town of Thetford we shall send to those [local]
Commissioners concerning it. But in all other cases, except
Leake's and the town of Thetford, the process already issued
has produced no effect. If the moneys be not speedily raised
by reassessment Exchequer process will be issued against the
Commissioners. |

By the Act of 22 and 23 Car. II., the planting of tobacco in
England is prohibited, "which should the same not be strictly"
observed would bee very prejudiciall to His Majesty's revenue

lessened by endeavouring to have the laws in that behalf duely
executed." You are to take care to put same in execution and
give us an account of your proceedings herein, we having
information that some persons in your county have contrary to
the said Act presumed to plant tobacco. |

to lay them in chains, notwithstanding they produced their
deputations: and further that on April 15 last said Martin

ship was seized on its arrival at Hull on the 9th inst. as
forfeited by the Act of Navigation, notwithstanding the

any persons in said county may be paid to George Wharton,
Treasurer of the Ordnance, for His Majesty's service: we,
