June 21 Royal warrant dated Kensington to the Treasury Lords to pay 1,000l. to Francis Negus as imprest and upon account for the extraordinary expenses of the Stables. Same to same to pay to the Mayor and Corporation of Berwick 53l. 14s.d. paid into the Exchequer as the King's share on a second writ of appraisement for brandy seized at Holy Island (from the rebels) on board a ship lying near the Castle of Holy Island by William Hunter, one of the officers of the Customs: whereof the King's moiety, being 255l. 18s. 9d. on the full appraisement, was granted to the Mayor and Bailiffs of said Corporation to be by them distributed as follows, viz. one third thereof to the Officers and soldiers concerned in retaking the said Castle and the other two thirds to the volunteers who assisted them therein: the said Corporation having prayed that the said further sum of 53l. 14s.d. may be distributed in like manner and proportions as the former sum was: which the King is pleased to condescend to. June 21. This is the first List.
Warrant under the royal sign manual dated Kensington to the Lord Lieutenant of Ireland for paying to the Half Pay Officers in Ireland, as follows, “who have or shall produce proper certificates of their attendance,” their full pay from 19 Dec. 1715 to 19 April 1716, viz. by paying to them sums, detailed, to make up their half pay to the full pay for the said period as desired by the Address of the House of Commons in Ireland in the Session of Parliament there in 1715 [of date 13 Dec. 1715. Journals of the Irish House of Commons, Vol. III, p. 46] at the time of the late unnatural Rebellion, praying that in order to encourage such Half Pay Officers as were on the Establishment of Ireland to be aiding and assisting to the Standing Army and Militia there they might receive full pay: in consequence of which Address the Half Pay Officers were part of them commanded to stay in Dublin and others were sent to distant Garrisons by the then Lords Justices; notwithstanding which these Officers have not as yet received full pay for the time they were on duty: and on their petition the said House of Commons in the last Session of Parliament [27 Sept. 1717, ibid., p. 137] voted that such said Officers well affected to our person and Government as attended in the city of Dublin pursuant to the said orders or were commanded to Garrisons and not provided for ought to have full pay for the period 19 Dec. 1715 to 19 April 1716: whereupon the Muster Master General of Ireland has prepared a list of such Officers accordingly whereby it appears that the whole amounts to 3,743l. 11s. 6d., but that certain Officers whose pay amounts to 323l. 13s. 6d. have not returned proper certificates to the Muster Master of their attendance, which sum ought therefore to be deducted, but it is represented that since the making up the list such Officers may have such certificates to produce, wherefore they are to be empowered to be paid when so certified. Southants take on me the defence of John Coleman and George Bright, two of the officers of New Forest, against William Battin, gent., Lord of the Manor of Burley, who in Easter term 3 Geo. I. commenced an action against them for entering a close of his called Longwards in his said manor and there marking and endeavouring to secure for his Majesty's use three oak trees which had been cut by the said Battin: and at the trial at last Assizes it was plainly proved that two thirds of the close in question had been taken in within 30 years out of his Majesty's Forest and was an encroachment; and on the other hand the said Battin proved that one corner of the said close containing about 20 perches had been enjoyed by himself and his ancestors time out of mind, and the jury brought in a verdict for the plaintiff as to the entering his close and treading down his grass and acquitted the defendants as to the rest of the trespass, viz. marking the said trees.
I lately obtained an exact map of the said ground, which is hereunto annexed [missing], and have discovered the attorney who managed the trial for the defendants, and it appears that Mr. Battin hath so encroached in the Forest that it may be proper to prosecute him by Information of Intrusion whilst the witnesses are alive who can prove the ground to be his Majesty's.
In consequence of the verdict the petitioner's costs of the suit must be paid by the defendants Coleman and Bright, which costs have been reduced by taxation from 62l. 4s. 1d. to 35l. 0s. 4d.
Mr. James Willis, an attorney at law near the place, was employed by the defendants for a year before I was commanded to take care of the case. I continued to employ him therein. His bill is 89l. 0s. 4d., but most of it for work before the date of my orders. If not discharged by the Crown it must fall on the defendants. Money Book XXVI, pp. 375–6.

Treasury warrant to the Auditor of the Receipt, the Clerk of the Pells and the rest of the officers of the Receipt concerned, to innovate a lost annuity order dated 31 Oct. 1706, No. 2104, in the name of William Fish of Lincoln's Inn, Co. Middlesex, for an annuity of 20l. out of the Duties of Tonnage and Poundage, Coals &c. granted by an Act [4–5 Anne, c. 18] in 1705.
Prefixing: affidavit by said Fish that he delivered the said order to the proper Office at the Receipt of the Exchequer on June 22 “last” [1717] to the end to have the same directed for payment of half a year's annuity due at Midsummer 1717, since which time (on his going to the Exchequer to demand payment upon the said order) the same could not be found, but a forged receipt was produced for the said half year's annuity, “which order is since lost, being either delivered by the officer who paid the annuity to the party that received it or otherwise mislaid and cannot be discovered, although several times advertised in the public prints.” Order Book X, p. 137.

In repairing his Majesty's barge-houses, launches, wharves &c. pursuant to Treasury directions dated 27 July 1718 [sic for 1717] on an estimate for 450l. we found upon laying open the building several great defects and ruinous parts which could not be foreseen when the estimate was made. The timbers were decayed and unserviceable and damages appear to have been done by the unusual overflowing of the tides: which unavoidably occasioned a further expense of 150l. to complete the whole in a substantial and durable manner. Same to the Barons of the Exchequer in Scotland to prepare a draft signature to grant to Lady Panmure yearly rents or sums amounting to 555l. 11s. 1⅓d. out of the forfeited estates of her husband James, late Earl of Panmure: the Treasury Lords having laid before the King the report from the said Barons and the King being thereon pleased to grant as above in consideration of her case as represented in the said report and in pursuance of the power given to him by the late Act of Parliament [1 Geo. I, St. 2, c. 50]: the first half year's payment thereupon to commence at Martinmas 1715: and to hold during the term of the natural life of the said late Earl: the said yearly sum appearing to be the estate that was settled upon her in joynture and which she would have been entitled to in case her husband had been naturally dead.
And whereas it appears by the said report that the said Earl did by bond dated 15 June 1713 oblige himself and his heirs to pay to his said wife Margaret 10,000l. sterling at the first Whitsunday or Martinmas next after his decease, with common interest for the same till it was paid and thereby declares that it shall not be understood to be in satisfaction of any former joynture, provision or donation made to her, but is over and besides the same, his Majesty is further pleased that the said forfeited estate be charged and made subject to the payment of legal interest for the said bond debt from the term of Martinmas 1715 during the natural life of the said late Earl.
His Majesty is also pleased in favour of the petitioner to grant and confirm to her all other the matters and things so far as they are expressed in the said report as she would be entitled unto in case her said husband had been naturally dead.
But a special clause is to be inserted in the signature whereby the King, his heirs &c. may at any time revoke and vacate the grant of the said 555l. 11s. 1⅓d. per an. and the said legal interest or either of them or any part thereof when he shall think fit.
Appending: said report dated 23 Jan. 1717–18 from the Barons of the Exchequer in Scotland to the Treasury Lords on the order of reference of 1717 July 29 setting forth the terms of the contract of marriage dated 5 Feb. 1687 made in consideration of 1,666l. 13s. 4d. paid to said Earl by the Duke of Hamilton by virtue whereof and of the charter under the great seal of Scotland dated 1 March 1687 the Castle and Yards of Brichen and the rent charge of 10,000 marks Scots (being 555l. 11s. 1⅓d. sterling) were confirmed to Lady Margaret Hamilton, now Panmure, and she was enfeoffed and seized thereof 26 April 1687. The report further recites subsequent deeds of grant from said Earl to his said wife of 28 Oct. 1696, 31 Dec. 1703 and 27 Nov. 1710 and 7 Nov. 1712, and instruments of seizin thereupon and likewise his bond as above dated 15 June 1713, his said wife having by her frugal management disburdened his estate of 20,000l. sterling debts resting thereupon at the time of the intermarriage.

Prefixing: report by Auditor T. Foley on the account of said salaries and incidents of the Salt Duties, in accordance with the warrant of the late Lord Treasurer dated 25 June 1714 requiring the Auditors of Imprests to compare the same with the preceding [year's] accounts and to pass no augmentation thereof unless Treasury approval thereof had been obtained. There appears in this bill no augmentation [of staff] or increase of salary but what has been approved by the Treasury on due presentments from the Salt Commissioners. The incidents are increased by 145l. by means of a greater number of waiters kept on board ships laden with salt for exportation on debentures in order to prevent its being re-landed and the Commissioners aver that the service required it; and by the accompts it appears that the exports were larger in this than in the preceding year. Out of the total number of French Officers employed in the war under William III. and Queen Anne some became naturalized British subjects either under special Acts or under the General Naturalization Act of 7 Anne. These Officers were eligible for Half Pay when the Regiments were broken. The remainder of these Officers, i.e. those who were not naturalized, were not eligible for Half Pay: but they were provided by pensions on the Civil Establishment of Ireland of an amount exactly equivalent to the Half Pay due to their rank.
