Dec. 2. Warrant from Treasurer Danby to the Customs Commissioners to observe an order of the King in Council as follows.
Prefixing : Said order in Council dated 1676, Nov. 24. Upon reading this day at the Board the petition of John Ariens van Ham, James Barston, Daniel Parker, John Campion, Richard Newnham and divers others using the manual occupation or trade of potters in and about London and suburbs thereof, shewing that notwithstanding the statute of 3 Ed. IV, prohibiting the bringing in of painted wares into England as merchandise for sale, and the King's edicts for preventing such importation, yet several persons, both subjects and foreigners, daily import several great quantities of painted earthen wares privately into London port and publicly into the outports, where there is little or no care taken to prevent it, to the inevitable ruin of petitioners and of many hundreds of poor men, women and children, whose subsistence depends thereon, and the total destruction of the manufactures here which [manufacture] is fully as well done as any foreign and with most materials of English growth, and therefore praying that such importation may be prevented and the said manufacture in this kingdom upheld : it was ordered by the King in Council that Treasurer Danby direct the Customs Commissioners [to give directions to the officers of London port] and the officers in the outports to cause the king's moiety of all such painted earthen ware as well white as blue or any other colour hereafter imported contrary to said statute to be forthwith broken and destroyed.

Dec. 4. Charles Bertie to the Auditor of the Receipt to issue as follows the 2,800l. which the Customs Cashier has brought into the Exchequer for the Secretaries of State, viz., 1,500l. to Secretary Coventry upon his order for secret service and 100l. for one year to June 24 last on his pension [sic for on his ancient fee] ; and 1,000l. to Secretary Williamson on his order for secret service and 200l. for two years on the like pension. Charles Bertie to the Auditor of the Receipt to pay (and same to the Customs Cashier to bring in with [due] regard to the weekly payments) 20l. 13s. 5d. to Sir William Scroggs for half a year to Sept. 29 last on his fee of 41l. 6s. 10d. per an. as one of the King's Serjeants at Law. Warrant from Treasurer Danby to the Customs Commissioners to order the Collector of Berwick port to admit corn to be brought out of Scotland to that port, Customs free, as follows, viz., 6,000 quarters of bigg, 4,000 quarters of oats, 300 quarters of wheat, 200 quarters of pease and 50 quarters of rye yearly until further order : the said collector keeping an account of the quantity so imported : all by reason that application has been made to Treasurer Danby on behalf of the town and garrison of Berwick for renewing the privilege which has been allowed them of importing certain quantities of Scotch corn. Customs free, the matter having been recently heard before Treasurer Danby when they alleged their necessity of being supplied with such corn. Out Letters (Customs) III. p. 250.
Same from same to same to deliver, Customs free, a seizure of three dozen of Roman gloves, lately brought in the John and Mary hoy from Dort, belonging to Signora Eleanora Battalia and seized by John Tombes, tide surveyor London port. Ibid, p. 251.
Same from same to same [sic for to the Attorney General] to enter a noli prosequi to discharge the information against Roger Hawkshead, Lieutenant of his Majesty's frigate Speedwell and volunteer under Sir Edward Spragg, concerning nine pieces of Holland [cloth] belonging to said Hawkshead and seized by Mr. Chetham and prosecuted in the Exchequer : the Customs Commissioners having reported favourably hereon in regard of said Hawkshead's good services in those employments as above. Treasurer Danby to Sir Thomas Davies, Lord Mayor, and to the Aldermen of London. About two years since there was deposited by your town clerk in your hands or in the Chamber of London by your order 165l. 10s. 0d., being moneys received for his Majesty's use from the several persons licensed to keep alehouses within the city at the Sessions of the Peace holden at Guildhall 1673, May 12, or which was received before 1674, May 19, in pursuance of the late Act for the Law duties. I desire you to pay the same to William Man, Esq., your sword bearer, one of the King's serjeants at arms, taking his bond in the King's name for payment thereof to the King's use as shall be directed by myself. Warrant from Treasurer Danby to Thomas, bishop of Lincoln, and to the Auditor of First Fruits and Tenths, upon the determination of the accounts of Benjamin Lany, late bishop of Lincoln, for the Tenths of that diocese, for the year ended 1666, Xmas (as rendered by John Lany his executor) there is due to said bishop a surplusage of 67l. 12s. 9d., as is certified by Sir Richard Langley, an Auditor of Imprests. Same from same to the King's Remembrancer to stay process against Richard, Lord Byron, on the super of 102l. 16s. 0d. set upon him by the High Collector of Aids and Assessments in the Hundred of Broxtow, as being unpaid for said Lord's manor of Newstead, co. Notts ; said Lord having informed me that it appears from the accounts of one who was formerly his servant that the said sum, or greatest part thereof, was duly paid, but that said servant being absent, said Lord desires time to satisfy Treasurer Danby herein. Entry of Treasurer Danby's signature of a docquet of] an assignment from the King to Bussy Mansel, and Michael Bebington ut supra p. 386, of divers rents and lands contained in a schedule annexed [missing] being part of Sir Robert Thomas's estate and in trust, to pay 695l. [by 100l. per an.] to Dr. John Butler and other annuities to John and Humphrey Thomas. Ibid.
Dec. 6. Warrant from Treasurer Danby to the Customs Commissioners to permit 50 barrels of corn powder to be shipped, customs free, for his Majesty's service in Jamaica ; same having been received by Sir John Griffith out of the stores in the Office of Ordnance, pursuant to the royal warrant of Nov. 28 last. Same from same to same to give directions to the Customs officers at Barbados and all other the King's Plantations in America not to permit any ships to go to sea on a trading voyage from any ports or places under their respective care till the master, owners or other proprietors thereof have given good security that they shall not go to any part within the limits of the Royal African Company's charter, that is to say from Sallee to Cape Bon Esperance, nor import any blacks, gold, elephants' teeth, Malagetta or other the commodities of those countries into any of the said Plantations contrary to the said Company's charter, according to the direction of the order in Council as below.

Royal warrant to the Attorney or Solicitor General for a privy seal for a grant to Bernard Greenville and Thomas Culpepper of the fine of 500l. imposed in the King's Bench upon Robert Moore, of Chesterfield, co. Derby, gent., on his conviction for violently taking away Hester Taylor, spinster, an heiress, with intent to marry her. King's Warrant Book V. p. 251.
Same to Sir Jonathan Atkins, Capt. General and Governor in Chief of Barbados, Sta. Lucia, etc., in America. By a judgment of the Admiralty Court in England in July, 1675, it appears that the ship Maria was made prize near Cape Lopus [Lopez] by the King's ship Phoenix (lately commanded by Capt. Watson and after his death by Capt. How) and carried into Barbados. The effects of said prize were 136 negroes and a certain quantity of dust gold. Said negroes and most of said gold were delivered to you, but you have rendered no account thereof. You are to state such accompt with all expedition, and to pay all the effects from the above to John Strode ; to the end a just apportionment and distribution thereof may be made to the captain, officers and seamen of the Phoenix, pursuant to our royal proclamation and according to the petition exhibited to us the King by William Crusoe, Roger Meryck, Nicholas Gerrard, Jeoffrey Baldock, Hen. Howard, John Morgan, Benjamine Aldridge and Samuell Davis in behalf of themselves and all other officers and seamen of said ship.
Followed by : a similar royal warrant to John Strode, Esq., Governor of Dover Castle, to pay over to said officers, etc., as above the said effects as above of the said ship Maria, captured 1674, Aug. 22 : all "according to an order formerly made in our Court of Admiralty as likewise since decreed by our Lords Commissioners of Appeals for Prizes in the case of Capt. George Gallop and the officers and seamen belonging to our late hired ship the Thomas and Francis, which ordered the share of the negroes and produce thereof formerly taken by them to be divided according to their several wages paid them at our pay table."

Warrant from Treasurer Danby to the King's Remembrancer for a Commission to issue to the following for setting out ports, wharves and keys in the port of Sandwich and the members and creeks thereof, viz., to the mayors of Sandwich, Dover, Rochester, and Faversham, Charles Osborne and Giles Dunstar, Surveyors General of Customs, Richard Breton and Tho. Veale, customers of Sandwich, Walter Breame, Comptroller of Sandwich, John Watson, Tho. Cooke, James Houseman, Hen. Shales, Rich. Brabant, Jno. Kennett, Jno. Johnson, Humph. Cave that no person get a licence to import pot-ashes from Holland, Hamburgh or Dunkirk, etc., contrary to the Acts of Navigation or Frauds without notice first given to Francis Asty, Esq., Deputy Governor of the Eastland Company : [said Asty] living in the Minorites near Aldgate, who desires to be heard on behalf of that Company. Sir Nicholas Armorer desires on behalf of himself and Mr. Savile of the Bedchamber that until one of them be heard no [Surveyor General's] report may pass the Lord Treasurer concerning a grant of Artaine alias Jartaine in Ireland to the Visct. of Granard or any other. Ibid, p. 23.

Dec. 8. Report to the King from Treasurer Danby on the petition of Robert Fitz-Gerald and Adam Loftus. I have considered same and the Lord Lieutenant of Ireland's report thereon, and finding that your Majesty, notwithstanding said report, is inclined to gratify petitioners, I have nothing to object.
Prefixing : Note of said petition from Fitz-Gerald and Loftus for a grant to the longer liver of these of a pension of 300l. per an. [on the establishment] in Ireland formerly granted to Visct. Ranelagh for life [in reversion] after the decease of Ellen, Countess of Tyrconnel who still enjoys the pension, the said Visct. Ranelagh being willing to surrender [his revisionary right thereto]. Said petition was referred June 6 last by Secretary Williamson to the Lord Lieutenant of Ireland, who reported June 29 last that such a grant being for two lives will lessen the King's favour to Mr. Carre, Sir James Cuffe and Col. Cary Dillon, who have grants of pensions as soon as any pensions on the establishment fall void. Said report was referred Aug. 6 last to me Treasurer Danby, and on the 10th Nov. last again referred by Secretary Williamson to me Treasurer Danby in these words "his Majesty having been further moved upon this report, and continuing notwithstanding graciously disposed to gratify the petitioners in their suit" refers it to Treasurer Danby.

King Charles I. having in the 18th year of his reign granted to James Hoar the reversion of the offices of Clerkship of the Exchange and Mint and Surveyorship of the Melting Houses of Exchange, Coinage and Mint within the Tower of London for life in reversion after Thomas Swallow who died lately, said Hoar prays that without notice to him no grant [of the above] in reversion or otherwise pass to Mr. Evans or any other. Sussex, with the forges, furnaces, iron mine and liberty of taking Horsham stone, 250 load of coal and 30 cord of wood yearly for the use and maintenance of said iron mills, which are now in lease to petitioner, for which grant of the inheritance he offers to relinquish his pretensions as well to 10,000l. claimed to be due to him from the late King and so much of 1,200l. due to him for arrears of his pension as Physician in Ordinary to your Majesty and of 2,000l. due to him out of arrears of the pension of the late Earl of Norwich as your Majesty shall think fit. I find by the Surveyor General's report that a lease of 250 loads of coal and 30 cords of wood annually was granted him 1662, June 27, together with said ironworks, viz., for 31 years from the then following Michaelmas at 36l. 13s. 4d. per an. The said proportion of coal and wood is not to be augmented nor like[ly] to be improved in the yearly value thereof (which does not exceed 260l.) unless the importation of foreign iron should be inhibited by law or so imposed upon [taxed] that the ironworks of this kingdom may be encouraged and improved. The ironworks are decayed and disused and of no present profit to petitioner. Therefore the Surveyor General rates the inheritance as above at 2,373l. 6s. 8d., being at eight years' purchase. As to said debts there is due to him 1,100l. for 11 years to 1674, Michaelmas, on his fee of 100l. per an. as a Physician to your Majesty and 200l. for two years more since. From the will of George, late Earl of Norwich (remaining in the register of the Prerogative Court of Canterbury) it appears that said Earl appointed the payment of 2,000l. to one Mr. Calfe for Thomas Nevett, goldsmith, and therein prays the King to pay the 5 years' arrears of his pension to meet some particular payments, of which this to Nevett is one. Petitioner's right to said 2,000l. arises from his marriage to said Nevett's daughter, as her marriage portion, who was relect and sole executrix of said Calfe, who was executor to said Nevett. "And he further makes out by a patent under the great seal of England constituting him a baronet of England, that he was Physician General to the Army of your Majesty's royal father of blessed memory, by reason whereof he affirms that there remains due to him the sum of 10,000l. for moneys lent and otherwise [furnished for said King] but how the same becomes due to petitioner hath not appeared before me. Warrant dated Wallingford House from Treasurer Danby (with many corrections and interlineations) to Richard Derham, Esq., Receiver General of the fines as follow (altered to, to the present and late sheriffs and undersheriffs of Norfolk and Suffolk) to pay to William Battie, clerk, the King's share of the Conventicle fines levied and received within the said counties since 1670-1, Mar. 15, and now remaining in the hands of such sheriffs, etc., as above : all as reward for said Battie's activity in informations and procuring convictions of that kind and in accordance with the privy seal of Nov. 30 last, directing that such fines and moneys as above be disposed of to such persons and uses as the King should appoint by warrant under his sign manual ; in accordance wherewith the King has by such warrant of the 7th inst ordered payment as herein above particularly. Dec. 15. Warrant from Treasurer Danby to the Clerk of the Pipe for a lease to Col. Robt. Phillips of a messuage known by the name "de la Black rodd" situate in the parish of St. Paul's, Covent Garden, now or late in the occupation of John Allison and of the annual value of 30l., being parcel of the lands and tenements of Paul Williams, late of the parish of St. Martins in the Fields, tailor, and escheated to the King : the lease to be for 99 years at the rent of 12d. per an., and without fine : all in consideration of the faithful services of said Col. Prefixing : Draft [privy seal] for the sum of 20,000l. per an. (reserved upon the present establishment of Ireland to be for such uses or persons as the King should appoint by his sign manual) to be paid and returned yearly from Ireland to England into the hands of William Chiffinch, to be employed in the King's buildings at Windsor Castle ; and as the charge of returning [the loss by exchange on] the said money to England will be considerable, it is hereby also appointed that the remainder of the sum of 2,218l. 17s. 5d. as follows be applied to meet such charges, so that said 20,000l. may be entirely received in England without abatement or defalcation : the said sum of 2,218l. 17s. 5d. arising as follows, viz., by the royal sign manual of 1674-5, Feb. 10, it was ordered that for the ease of the office of sheriff in Ireland, no such sheriff after Dec. 25 then next ensuing should during the time of the Assizes for any county keep any table for entertainment of persons resorting to such Assizes other than for his family and retinue, nor should make any present to any Judge of Assize for his provision, nor bear any part of such Judge's charges, nor give any gratuity to such Judge's officers or servants, and that no Barons or officers of the Exchequer, their deputies, clerks or servants should on any pretence whatever demand any fee or present whatsoever of any sheriff for or upon the passing his account : and in consideration hereof said [sign manual] did further declare that the King did resolve in the new establishment for Ireland to commence from said Dec. 25 to increase the Judges' allowances to 100l. each for each circuit, and that the salaries of persons to whom fees were then payable by any sheriffs upon passing their accounts should be by so much increased as the fees due from all the sheriffs of Ireland according to the late reducement did amount to : but the King having thought fit that the said establishment should commence only from March last, and the Judges of Assize having in obedience to the above gone the last Lent circuit on their own charges, and the officers of the Exchequer being suddenly to pass the sheriffs' accounts for last year without fees, and so will lose a half year's payment of that allowance, therefore the King is hereby pleased to make up the said defect ; "and therefore upon examination of the present state of the charge of that our kingdom [Ireland] for this year beginning the 25th of Dec., 1675 and ending the 25th of Dec., 1676, we finding that if all the payments were computed according to the rate of our establishment for the whole year there will be saved the sum of 2,218l. 17s. 5d., yet undisposed of" therefore it is hereby ordered that out of the said saving there be paid 500l. to and among the Judges of Assize for the last Lent circuit (viz., 100l. each) and 194l. 3s. 1d. to the officers of the Exchequer concerned in passing said sheriffs' accounts.

Northampton, with the rights, members and appurtenances and all those two lodges with the small closes to them belonging and the land there enclosed or fenced in containing by estimation 13 acres and within said walk ; and of all those two places called Langley and Hassocks and all those roads, ridings and other "plaines" by estimation 190 acres of commonable ground ; and of all the game of deer there, with such free chase and free warren as the Crown has in and upon the said walk : to hold as of the manor of East Greenwich in free socage : with other clauses for granting him a free chase and free warren upon and within said walk and the circuit and bounds thereof, and for deafforesting the said walk : and with non obstantes that it is in or was within the royal forest of Rockingham or any other royal forest : all by reason that the coppices within the said walk and the ground and soil thereof were by patent of 1627-8, Feb. 26, granted to Edward, Lord Montagu, deceased, and his heirs under the fee farm rent of 10l. [per an.], which rent is [now by the sale of fee farm rents of the Crown] granted away. From the Surveyor General's report [on Edward, Lord Montagu's petition for same] it appears that the premises contain only said 13 acres of enclosed ground lying in severalty, and said 190 acres of commonable ground wherein the Crown has only right of soil and feeding of deer, open and subject to the feeding of the commoners' cattle of divers adjacent towns, and that no prejudice is like to arise to any part of Rockingham Forest to have the said Walk taken out of it.
