Dec. 16. Warrant from Treasurer Danby to Sir Francis Winnington, Solicitor General "by his Majesty's command in the presence of several of the Lords of his Majesty's Privy Council" to forthwith bring an action in his Majesty's name, to the value of 20,000l. by writ of Quo minus out of the Exchequer against John Baker, of Thistleworth, to answer the damages and loss received by his Majesty by the breach of his agreement lately made in the presence of several Lords of the Council for the management of the revenue of Excise under a certain salary to be received and several heads for covenants to be performed by him, and in case of failure to forfeit 10,000l. to the King : Baker having failed in the performance of his said undertaking, although the time to which he was first confined has been prolonged to him considerably ; by which failure the King's service has suffered great prejudice and loss. Royal warrant to Treasurer Danby to give warrant to Thomas Corbin, Surveyor General of Woods, Trent North, and to any two of the regarders of Sherwood Forest to fell 100l. worth of timber (not fit to be used in the building of shipping) to be employed towards the rebuilding of Kirklington Church, co. Notts : it being represented in a petition from Andrew Meires, minister, and from the churchwardens thereof that said church lies wholly demolished by a violent storm of wind, and that they are of themselves unable to rebuild it : the said Surveyor General having reported that he has viewed said church and finds that the parishioners have made some progress in the rebuilding thereof, but stand indebted for the materials used and for workmen's wages. Dec. 18. Report [to the King] from Treasurer Danby on the petition to the King from the Governor, etc., of the Plantation of Londonderry, (which said petition sets forth that the King did in Jan., 1675-6, by letter direct the Lord Lieutenant of Ireland to pay them the remaining 4,000l. in compensation for their right to the Custom of Londonderry, and by reason that no fund is appointed for the payment of the same prays that it may be paid either out of the surplusage of the revenue of the kingdom [of Ireland] after the civil and military lists are satisfied or otherwise, as the King shall think fit). Before I make a full report hereon I find it necessary to be informed from the Earl of Anglesey, late Vice Treasurer of Ireland (and accordingly have sent to his lordship) whether a conveyance has not been already made from the city of London of all their right and interest to the Customs of Londonderry upon the sum of 6,000l. paid by said Earl upon account of this matter. Memorandum. This warrant was for 1 years upon Mr. Mounteney's certificate that so much was due, but it appearing [that] no more than half a year is due, it is amended for 36l. 4s. 2d.

Warrant from Treasurer Danby to the Clerk of the Pipe for a lease to John Tooker of several parcels, as below, of the Duchy of Cornwall, except that parcel called Great Buckbarrow of the yearly rent of 3s. 4d. : all for 99 years, terminable on lives to be named.
Prefixing : The Surveyor General's ratal of a particular of parcels as follow(a). A parcel called Great Buckbarrow in the manor of Ryme, rated at 3s. 4d. (This is granted by copy of Court roll and the rent duly answered as Mr. Ward affirms, and so is not to be passed in this lease.) (b). The first parcel called Newmead or Burges Close for 99 years, terminable on the lives of James Hedges, junr., and Mary Hedges his sister and a third life : at the old rent of 13s. 4d. and fine of 20 marks. (c). A second parcel being several things within the manor of Midsomer Norton for 99 years, terminable on three lives at rents amounting to 13s. 4d. per an. (d). A third parcel called Buckbarrow, in the manor of Ryme Intrinseca for 99 years, or three lives at 2s. 6d. rent reserved.

Warrant from Treasurer Danby to [the King's Remembrancer] for a commission of inquiry as to wastes, spoils and abuses since 1660, June 24, in New Forest, to be issued to the following, viz., the Honble. Edward Noell, Lord Warden [of said forest] ; Sir Francis Roll ; William Strode ; Gyles Eyre ; Oliver St. Johns ; Thomas Agar and Charles Strode, Surveyors General of Woods, Trent South ; Francis Poulet, Jonathan Rivet, George Stanley, Phillip Percival, Robt. Roll, James Lynch, Roger Clavel and William Tulce.
Prefixing : Articles of inquiry. (2). Wood taken under the name of fuelwood and whether same has been only dead wood and kite boughs, and whether any having common of estover in said forest can have the same longer than there is dead wood and kite boughs, and what such dead wood and kite boughs amount to yearly. (3). Keepers' and under-keepers' fuelwood. (4). Felling (branching, hewing, spalling, chopping, girting) of trees by borderer inhabitant or others within or near said forest other than taking dry, dead, sere boughs, which bear no manner of vert or green leaves. (5). Accounts of sale of timber offal. (6). What coppices, woods, trees and woodlands are in lease, and what allowance of timber is claimed by the tenants. (7). What browsewood is cut in every walk, and whether same is bigger than as a buck may turn with his horn or as will butt ene [? end] carry an inch bore through it. (8). Quantity of house boot, cart boot, estovers and fuelwood belonging to the tenants of the manor of Lyndhurst and others. (9). Timber or moneys appointed for the building or repairing the King's houses, lodges, stables, pales, rails, fences, etc., in said forest. (10). The charges exhibited by Sir William Jones, Attorney General, against Barnard Knapton, late underwoodward of said forest as to his accounts.

Warrant from Treasurer Danby to the Customs Commissioners to admit Sir John Frederick and Company (on payment of Customs and on security for re-export) to enter a case of ribbons laden on the ship Providence at Leghorn and consigned to Cadiz, where said ship being denied pratique was forced to bring said goods to England, where it was put in the king's warehouse : the Customs Commissioners having reported favourably the 7th inst. hereon, although said ribbons are a prohibited commodity, and in strictness liable to a forfeiture. Dec. 22. Same for 3,660l. to Charles Bertie, without account ; "the same being for new year's [gifts] to be given by his Majesty on 1st Jan. next." Ibid, p. 8.
Charles Bertie to [the Navy Board]. The King has directed that Mr. Bayley who built the Edgar and Oxford should be paid what you in your report judge reasonable. You are to assign him a bill signed by you for 5,666l. 1s. 3d. for payment in course to clear his imprests and [to] pay for the Papenburgh, according to your appraisement, and the remainder to be paid him in [ready] money. Also you are to make him out perfect bills for 201l. 16s. 9d. and 24l. 1s. 0d. for overworks on the Oxford, and for 50l. for the incidental charges of the Papenburgh, and to assign the said bills for payment equal with his bill abovesaid and in the same course abating the 50l. imprest for the charges of the Papenburgh. Charles Bertie to [the Navy Board]. On Mr. Francklin's petition Treasurer Danby directs speedy payment of his bill, and desires you to assign the bill of 211l. for payment upon Mr. Maddocks out of money in his [said Maddocks'] hands for payment of ships. Out Letters (General) p. 8.
Same [to same] to similarly pay Capt. Christopher Gunman's bills of 50l. and 10l. forthwith out of any of the weekly money in the [Navy] Treasury or that shall first come in. Ibid.

Royal warrant to the Attorney or Solicitor General for a great seal for a grant to James (Thomas) Halsall of extension of lease of the Park, Outwoods, and Moshey (Moss Hey) of Myerscough, co. Lancs., parcel of the Queen's jointure, said Halsall having lately contracted with Edward Tildesley, Esq., for his term and interest of about 26 years therein : no rent to be payable during the Queen's lifetime : after her death the present rents (of 25l. per an.) to be paid. Royal warrant to the Attorney or Solicitor General for a privy seal for a grant to Thomas, Lord Howard, of the unanswered arrears of the monthly assessment received or levied by John Williams, Receiver General thereof in co. Glamorgan, or by his deputy within or before the year 1652 or [similar moneys remaining] in the hands of Col. Phillip Jones, Major Evan Lewis, Capt. Robt. Thomas, Ensign Thomas Williams, Thomas Williams of Swansea and John Howell or some of them : said arrears being since then by Act of Parliament or otherwise vested in the King. Ibid, p. 261.

Treasurer Danby has directed me to pay to Sir Edward Griffin, Treasurer of the Chamber, 1,000l. out of the [French King's] money received by me of Mr. Chiffinch, "which I desire you to pay accordingly, taking an acquittance for the same and this 1,000l. his Lordship directs Mr. Griffin to repay me out of the first money that shall be received by him upon his tallies for 7,500l. struck upon the Law duty." It is my Lord Treasurer's pleasure that you forthwith repay unto me the 8,000l. which I advanced unto you (by the hands of Mr. Stephens) by my Lord Treasurer's particular directions : which sum I desire you will please to pay to Mr. Stephens." Dec. 30. Same to the Navy Board. Application has been made to Treasurer Danby for 400l. to be paid to the Commissioners for distributing his Majesty's bounty to the widows and orphans of seamen slain in his Majesty's service at sea during the late war with the Dutch. You are to pay same out of any of the weekly money that is in the Navy Treasury or that shall be received from the Customs Cashier and you are to assign their [the said Commissioners'] bills for payment accordingly. Same to the Receivers of Excise. The King has been pleased to allow Mr. Percy Goring a pension of 200l. per an. during the present farm of the Excise, for which pension he [Goring] desires to deal with you for the advance of the remaining two quarters, and has moved Treasurer Danby that if you shall see fit to deal with him you may be assured payment [thereof to yourself] in his stead. I am to tell you that if you advance the said two quarters' pension Treasurer Danby will give direction for your due payment. Ibid.
Privy seal for 100l. a week as ordinary to John, Lord Berkeley as one of the Ambassadors Extraordinary and Plenipotentiaries for the Treaty of Peace at Nimuegen : to commence from Oct. 7 last and to be payable quarterly in advance : with the usual clause for his extraordinaries as and when allowed by the Secretaries of State : the present privy seal to cancel as from Oct. 7 last the privy seal of 1675, Aug. 9 for the like ordinary to him as Ambassador Exraordinary to France. Same for payment to Richard Kent of the several sums of 3,825l. 11s. 3d., 3,972l. 5s. 3d. and 1,686l. 13s. 5d for interest upon the several accounts as follow made up by Auditor Richard Aldworth, viz., one account declared Jan. 28 last for six per cent. interest on 158,770l. 7s. 0d., advanced and lent to the King by said Kent from the several dates of such loans to 1675, July 1 (interest 3,825l. 11s. 3d.) ; another account declared June 9 last for the like on 178,571l. 13s. 2d. from 1675, July 1, to 1675-6, Jan. 1 (3,972l. 5s. 3d. interest) ; and another account declared April 27 for the like on 67,666l. 13s. 4d. from the several days of lending until the said 1st Jan., 1675-6 (interest 1,686l. 13s. 5d.). "And whereas the said Richard Kent hath advanced the sum of 8,565l. upon the credit of a tally struck on the Excise to be satisfied in or about Dec., 1677, which said 8,565l. was paid to Sir William Godolphin, our Ambassador Extraordinary to Spain, for our service, and hath also advanced and lent and undertaken to advance and lend several sums of money on the credit of tallies struck and to be struck for the quarterly payment of 1,500l. to Sir Allen Apsley for the Duke of York" until the 20,000l. to said Duke as by the order of 1670, June 22, be paid ; "and whereas we may have occasion to borrow several other sums of money of the said Richard Kent from time to time for the accommodation of our affairs "he is to be hereby granted the additional allowance of 2 per cent. per an. as gratuity for the loan and procuring the said several sums of 158,870l. 7s. 0d. and 178,571l. 13s. 2d. He is therefore hereby to further receive 1,275l. 3s. 9d. and 1,324l. 1s. 9d. as such gratuity on said sums and such 6 per cent. interest and 2 per cent. gratuity on 8,565l. paid as above to Sir William Godolphin and on the moneys paid to said Apsley as above as may appear due to him upon [statement of] account thereof. All the above sums so due for interest are to be paid by tallies on the Excise. "And whereas we have cause[d] several tallies to be levied on our said revenue of Excise for the sum of 250,580l. of the moneys advanced and lent to us by the said Richard Kent and by our letters patent under our great seal of England we have directed the payment of the said tallies as they are mentioned in a schedule annexed to the said letters patent according to the precedency of the date of such tallies" in gracious consideration of Kent's services in having very seasonably advanced and lent same for our immediate service he is hereby allowed 2 per cent. per an. [as gratuity] for the moneys unpaid upon Jan. 1 last of the tallies in said schedule, such gratuity to be paid quarterly as it grow due till the respective times of the repayment of the said unpaid moneys.
