Treasury warrant to Mr. Agar and Mr. Strode to fell dotard trees, not fit for ship timber, in Whittlewood and Salcey forest, to the value of 50l. for defraying the charge of taking out, executing and returning the Commission to Sir William Farmer et al. for enquiring into wastes and spoils in said forest. Same to the Receipt (out of Customs moneys to be paid into the Receipt by Richard Kent, Customs Cashier, above the weekly 3,600l.) to issue 10,000l. to the Treasurer of the Navy to be by him paid over to said Kent and Charles Duncombe, as repayment: they having agreed to advance the said sum to the said Treasurer of the Navy for the service of the Navy. Same to the Customs Commissioners to observe an order of the King in Council of July 15 last for giving further time till September 29 next for the admeasurement of ships and keels employed in the coal trade, without taking advantagement by their non admeasurement within the time limited by the late Act of Parliament: it being represented to the King in Council that several such ships and keels have not been admeasured by reason of the shortness of the time thereby limited, whereby they are become liable to the penalties of said Act. Treasury instructions to same in answer to their representation of the 13th inst. You desire that the Treasury letter authorising you to make allowances to discoverers of French wines may be made into an order "in regard it is to be an authority for issuing of money." This is hereby done. As to your proposals for establishing officers for the borders of Scotland to prevent the great frauds there your solicitor is to attend the King's Counsel for their opinion whether the clause in the Act of Frauds which provides that all goods passing to and from Scotland shall go by way of Berwick and Carlisle (in regard it was a law made for the advantage of his Majesty's Customs) may be dispensed with by the King in order to the settling a collection at Wooler. Till this can be settled William Selby, the Surveyor of Berwick (who has 35l. per an. to keep a horse and survey the borders), is to remove to Wooller at his present salary, and the Searcher of Berwick port for his patent salary and fees is to do Selby's duty at Berwick. Some fit person is to be established as waiter at Morpeth at 10l. per an., another as waiter at Falstone at 8l. per an. and another at Norham at 8l. per an. Elias Scott, the present waiter at Wooller, is to be moved to Norham and his salary of 5l. is to be increased to 8l. per an. To meet this 21l. increase in the establishment 15l. per an. is to be retrenched out of the 60l. salary of the Collector of Berwick and 6l. per an. out of the 30l. salary of Bazill Fielding, waiter at Carlisle. Upon the dismission of Josias Walker, late Collector of Minehead port, Andrew Worth, the patent Customer there, is to take upon him the collection of said port for his patent salary with the allowance of 10l. per an. for a clerk. Henry Guy to Mr. Nurse for an estimate of all the Post Fines for 3 years from 1676, Michaelmas term to the end of last Trinity term. If you can you are to distinguish those of the Duchy [of Lancaster] and other liberties from the rest or give a medium for the same as near as on your observation you can guess. Send it on Friday as the Treasury Lords have present use for it. Out Letters (General), p. 130.
Same to the Navy Treasurer to pay out of weekly money the bill of 129l. 18s. 0d. due to John Lockwood, commander of the Richard and James, of London, which was hired to transport soldiers to Berwick. The Admiralty Lords desire that same may be satisfied because 90l. thereof is for wages and victuals of the said ship's company, and the ship lies at great charge for want of money to pay the men. Ibid, p. 131.
Same to same. Mr. Duncombe has undertaken to advance 10,000l. to you forthwith. It is to be thus applied, viz., 2,000l. for pay of the Bristol and Kingfisher (which with 8,000l. in cash will pay off these ships); 5,000l. calculated for repairs of the Crown, London and Gloucester; 400l. in part of the 2,180l. for building in the yard at Sheerness; 1,000l. for pay of the inferior officers of the ships lately paid off at 500l. a week; and the remaining 800l. to several persons now appearing and widows of those which belonged to the ships lately. Ibid.
Same to Mr. Stephens to attend the Treasury Lords at the Earl of Essex's house in St. James's Square this day week at 8 in the morning, "and that you let nobody know of their lordships' meeting there, for they desire to be private." Ibid.
Same to the Farmers of the Law Duty. The Cofferer of the Household has a tally stricken upon you to pay off some of the King's servants who are in great necessity for want of their money. This tally should have been paid by you in May last but is still unsatisfied. You are to forthwith discharge it. Ibid, p. 132.
Same to the Customs Commissioners not to remove William White, a landwaiter in London port, to any other place till the Treasury Lords speak with you concerning him. Ibid.
Same to Mr. Hayter. The Treasury Lords have taken such care that money is already provided to pay off the three ships mentioned in yours of the 23rd to me, viz., the Bristol, King Fisher and Pearle. It will be issued to the Navy Treasurer forthwith and you are to represent same to the Admiralty Lords that they may issue their orders thereupon. Ibid.
Aug. 26. Henry Guy to the Admiralty Lords. Lieut. Sidman [Sydenham] is penitent for his fault and promises to do no more frauds or ill practices relating to the Customs. The Treasury Lords signify to you his submission that, if you think fit, he may be restored. Out Letters (General), p. 133.
Same to Mr. Kingdom. Bring to me forthwith the tallies for 3,000l. of those which are first payable in course out of the Excise to complete those for 10,000l. for which the privy seal is now passed to discharge you. Also hasten your account with the Auditor. Ibid.
Same to the Auditor of the Receipt to bring to the Treasury Lords at the Earl of Essex's house in St. James's Square at 8 a.m. this day week a particular list of all fees payable at the Exchequer upon the issuing or receiving any sums of money for any service whatsoever. Ibid.
Same to the Auditors of Imprests to expedite Mr. Slingsby's account of Coinage money and such other accounts as are depending before you. Ibid, p. 134.
Treasury reference to Tho[mas] Raban, deputy Auditor for co. Lincoln, of the petition of Charles Leare, gent. Petitioner sets forth his family's services to the late King, his uncle slain, his father lost an arm, leg and eye and all their estate. Petitioner disbursed his wife's portion in Sir George Booth's attempt and has ever since served under the Earl of Oxford and now the Duke of Monmouth both in England and at Maestricht and other places until the said Duke's return for England brought petitioner into the King's own Guard. The Earl of Falmouth particularly recommended petitioner to the King upon his [said Earl's] going to sea, when the King promised petitioner some discovery. In September, 1675, had a grant of an arrear of a fee farm rent due out of Sutton Marsh in co. Lincoln, but when it came to the Lord Treasurer he disposed the greatest part of it to pay a debt due to the Duke of Richmond, deceased, so that petitioner's part was very little. Now there is another thing discovered to petitioner, viz., the fee farm rent of Gedney Marsh, co. Lincoln, which has been of the value of 100l. per an. and lost to the sea this 40 years and more, and was never profit to the late or present King nor accompted to the revenue, but the said Marsh being now like to be recovered from the sea by the inhabitants of Gedney petitioner therefore prays a grant of said fee farm. Said petition was referred to the Treasury by order of the King dated Windsor the 14th inst., his Majesty being graciously disposed to same. Ibid, pp. 134–5.
Treasury warrant to Bartholomew Fillingham and Nicholas Dering, Esqrs., deputy to Sir William Doyly, one of the Tellers of the Receipt, to account and pay to Henry Coventry the said Teller's fees from the 8th inst. in pursuance of the privy seal of the 11th inst. ut supra, p. 175. The profits received of the said Teller's fees from April 19 last to the 8th inst., being as follows, are to be paid into the Exchequer, as in part of said Doyly's debt to the King: viz., 140l. 2s. 4½d. of fee farm money, 40l. 17s. 0½d. of the fifth payment of the Eighteen Months' Assessment, 4l. 9s. 0d. of the Poll, 1l. 0s. 1½d. of the Royal Aid, 104l. 9s. 6½d. of Coinage money, which with 6l. 3s. 0d. expenses disbursed, and half a year to Lady day last on said Doyly's fee as a Teller, make in all 311l. 1s. 1d. Treasury warrant to the King's Remembrancer for a Commission to the following of enquiry as to Dean Forest: viz., Henry, Marquess of Winchester, Charles, Lord Herbert of Raglan, Sir Baynham Throckmorton, Kt. and Bart., Sir Duncombe Colchester, Kt., William Harbord, Thomas Agar, Charles Strode, William Cook, Hen. Norwood, Tracy Catchmay, Herbert Westfaling, Robert Codrington, John Fitz Herbert, William Morgan, William Paulett, William Wall, Abraham Clerke, William Wolseley, John Wade, Col. Edward Cooke. Prefixing: articles of instructions for said Commission, articles (1) and (2) being on the same lines as those supra, p. 184. (3) Spoils or abuses by firing the young wood or gorse, chopping or browsing the trees, levying or setting open the gates of the enclosures and driving in cattle to depasture, digging for mine, earth, tile, cinder or stone; what wood hath been delivered to colliers and miners for their pits and by what right, and what wood the keepers use for browse for deer in the winter and for the fences. (4) What young wood, timber trees and old trees are growing in the Lea Bailiwick. (5) What timber was left to the King by Sir John Wintor at the passing of the Act of Parliament concerning said forest and how it has been disposed of and what is left. (6) What repairs are or have been necessary at St. Briavels Castle and how the six lodges and walks of the forest have been built and laid out and how in repair and how to be kept so. (7) How the keepers' 30 acres are set out with respect to the said Act of Parliament, whether to the prejudice of the woods. (8) What persons since said Act have been concerned in receiving any money for wood, for fines at the forest Courts, or [for] any buildings, repairs, enclosures or other charges in said forest. (9) How duly the forest Courts are kept, and where and how all sorts of officers discharge their duties in the preservation of the coverts, woods and enclosures, how trespassers' fines are accompted for, extortions of officers, and rescues or pound breaches. (10) Cutting furze, burning fern, depasturing sheep and keeping pigs, digging pits, quarries of stone, building lime kilns, burning lime, trespasses on the Common of the Forest. (11) What store of cabins are there and how best they may be disposed of. (12) What necessity of cutting the overhangings in the highways; and to what value and how the forest ironworks have been demolished. (13) To raise money forthwith out of decayed wood, viz., for the enclosures, for 210l. to the Lord Warden, for keepers, etc., and for the charges of this Commission, for making a complete map of the forest, for pounds, and for sowing acorns to the amount of 5l.
The Treasury Lords to the Lord Privy Seal. An information of seizure made by Robert Chambers, qui tam, etc., was exhibited in the Exchequer Court against the ship Recovery, of Milford, and her lading of tobacco for unlading in Ireland from the Plantations contrary to the law; same being claimed by Hen. Bowen, merchant, was appraised at 421l. 5s. 1d., for answering which appraised value bail was taken by the Court in 600l., viz., Devereux Browne, gent., Hen. Bowen, merchant, and William Estwick, mariner. The cause came for trial in Hilary term 1677, and the verdict was for the King. Since the said security given, the said Bowen and Eastwick are failed and not to be found, and Mr. Browne the remaining security insists on his privilege as a servant to your lordship. If he be privileged, as he insists, please leave him liable so that the King may have the benefit of the law against him. Ibid, p. 72.
