Nov. 2. Same to the Solicitor General. Hasten your opinion on the bill concerning the Customs and the additional clauses thereto. Out Letters (General) IX, p. 177.
Same to the Customs Commissioners to report on the enclosed papers [missing] viz. a proposal of Thomas Forth; a memorial of the late Farmers of the 4s. per chalder on sea coals; and a third paper concerning the duties on tobacco. Ibid, p. 178.
Same to Mr. Peirse, enclosing the Customs Commissioners' presentment [missing] concerning their draft of the two bills. You are to attend Treasurer Rochester next Thursday [hereon]. Ibid.
Direction by Treasurer Rochester to the Customs Commissioners to observe an order of the King in Council dated Windsor Castle, Sept. 27, for a general licence to be granted for the importation of gum Seneca for six months to commence one month's time after date of this order: all upon reading the Customs Commissioners' report on the petition of Joseph Thompson of London, merchant, praying for licence for importation of gum Seneca. Report by same to the King on the petition of James Sartre, French minister, petitioner having set forth that he has in his hands an order of the late King for 15,000 French livres lent by his family and a bond of 7,000 livres furnished by the same family for the necessaries of five men of war belonging to the late King that were at Toulon under the command of Prince Rupert: said petition being referred by the King to Treasurer Rochester Sept. 21 last. Petitioner has produced to me said warrant dated Paris, 1654, June 2, directed to Sir Richard Forster for payment of 14,980 livres Tournois to Monsieur Hessing out of the arrears due to his said Majesty for the year 1652 upon the 600 pistoles per month assigned to his said Majesty by the French King, which warrant is signed Charles R. and I believe it to be his said Majesty's handwriting, but it is not countersigned by any person. I have likewise seen a testimonial under the hand of Prince Rupert dated Toulon, 1651, May 13, and attested by two public notaries which imports that John Burgues of Toulon, esq., did lend to said Prince 6,986 French livres for the victualling of five of said King's ships of war. Report to same by William Blathwayt on the petition of Bartholomew Price, administrator to Col. Herbert Jeffryes, late Governor of Virginia, praying for arrears of salary amounting to 900l.; the said petition having been referred to Blathwayt Jan. 17 last. Hereon Blathwayt reports that said 900l. salary for the last three quarters of said Col. Jeffries' government there, does not appear to have been paid him "which by his late Majesty's letter [missing] hereto annexed was to be paid out of the Exchequer in England: and I do well know that he was at great expence in the discharge of the Government without any other salary or perquisites in Virginia for that time, the same being otherwise disposed of by particular order from his Majesty." Nov. 2. Warrant by Treasurer Rochester to the Customs Cashier to pay 16l. 3s. 4d. to John Langwith, gent., for last Sept. 29 quarter as messenger attending the affairs of the Customs. Money Book VI, p. 171.
Allowance by same of said Langwith's bill of 16l. 3s. 4d. for said quarter as messenger attending the Lord Treasurer.
Nov. 3. Reference by same to the Auditors of Imprests of the petition of Sir Denny Ashburnham and partners, showing that process of distringas ad computandum has gone forth against them, although their accounts are already declared but not passed through the office because their interest account is not yet finished: therefore praying stay of said process. Reference Book III, p. 190.
Henry Guy to the Navy Commissioners. You are to enquire what timber suitable for the present or future works of the Navy is to be found in any of the King's forests, in order to the Lord Treasurer's orders for felling same. You are also to proceed, with what despatch the King's other works and the season of the year will admit, to erect the two storehouses, one at Chatham, the other at Portsmouth, proposed by you to the King in your two last estimates, you first presenting to the Lord Treasurer your opinion as to the most advantageous method of performing same, viz. whether by contract or upon account. The Lord Treasurer is ready to make good the payments proposed for it in your said estimates. You are to timely contract for such quantities of large English timber and plank (besides what the present market yields) as will be required for the repairs of the fleet next year. This will have to be felled and converted within the next season. You are to contract for same upon credit of the moneys given by the late Act of Parliament for repair of the Navy, but with the condition that the prices do not exceed those of the present market. You are also to seasonably secure competent supplies of such foreign [timber] as shall be necessary for the fitting forth of the King's ships to sea and for a magazine thereof to remain in store. Same to the Customs Commissioners, enclosing a list [missing] of the Customs officers who hold their places during pleasure and have not renewed their patents since the late King's death. Ibid, p. 179.

Same to the present Commissioners of Hearthmoney with Auditor Aldworth to report on the enclosed paper [missing] relating to the produce of the Hearthmoney in several counties during the late [farm or] management. Report from William Blathwayt to Treasurer Rochester on the petition of Robert Smith, praying payment of his arrears as Major General of Virginia and a pension: said petition having been referred Oct. 15 last by the King to Treasurer Rochester and Oct. 26 last by Treasurer Rochester to said Blathwayt. Hereon said Blathwayt offers a copy of his former report of 1684, Nov. 22, and of the Treasury Lords' report to the King (Calendar of Treasury Books, Vol. VII, p. 1492). Since that time Lord Howard of Effingham, Governor of Virginia, has by letter signified to your Lordship that because of the late season when the King's orders touching the quit rents of Virginia arrived he could not settle the collection of them in so good a method as he intended nor certify the true yearly value of them, but that he had nevertheless caused 531l. 15s. 7d. to be collected for his Majesty and to remain undisposed of till the King's further orders. Nov. 5. Warrant by Treasurer Rochester to the Receipt to take in and vacate the tally for 20,000l. struck 1684, Dec. 3, on the Excise, which tally is now in the hands of Charles Duncombe and in lieu thereof to strike tallies for 15,000l. and 5,000l. of the same date upon the same fund: all at said Duncombe's desire. Money warrant for 955l. to Charles Scarborough as Envoy Extraordinary to the King of Portugal; 500l. thereof as equipage and 455l. thereof for three months on his ordinary of 5l. a day in advance. (Money order dated Nov. 11 hereon.) Ibid, p. 170. Order Book I, p. 64.

Nov. 5. Warrant by Treasurer Rochester to the Customs Commissioners to continue till further order the [additional] allowance of 6d. a day to each of the watchmen in London port during the four winter months from Nov. 1 to Mar. 1 in regard of the coldness of the nights and hardship of the duty: as allowed by the late Treasury Lords' order of 1683, Nov. 26. Report to the King from Treasurer Rochester on the petition of John Rix, supra, p. 246, as by the reference of June 4 last from the King. The Attorney General certifies me that the personal estate may be granted to petitioner, but the copyhold estate will go to the Lord of the Manor and the freehold estate will escheat to the immediate lord of whom same is held. The grant may be made to Sir John Holland in trust for petitioner. Warrants not Relating to Money XI, p. 131.
Henry Guy to the Customs Commissioners to open in the presence of Lady Tyrconnell's servants such of the goods which came in the Charlotte yacht as are for the Queen or Lady Tyrconnell, including a small parcel of wool. Out Letters (General) IX, p. 180.
Same to the Wine Licence Commissioners. Send Treasurer Rochester notice what sum you think fit to demand yearly of Thomas Hammond, Robert Brocke, Robert Davy, Matthew Simpson, Robert Smyth, William Wiley, John Johnson, Edward Taylor, Benjamin Parrott, and Benjamin Couley for selling wine. Ibid.

Reference by Treasurer Rochester to the Auditor of the Receipt of the petition of the Clerks of the Council et al. attending the Committee for Trade and Foreign Plantations concerning the arrear of 2,374l. 13s. 5d. of [due to] the Plantation Office and praying to be paid in course in the Exchequer on the Act of Parliament (1 James II, c. 4) for the debts due to the late King's servants. Same by same to the Lord Warden of New Forest et al. of the petition of Henry Slingsby for leave to make 150,000 bricks in said forest for repair of Boldroad Lodge in Fratham forest which is in his custody: with a grant of so many fuses as will be necessary to burn said bricks. Ibid.
Same by same to the Customs Commissioners of the petition of Benjamin Gauden, son of Sir Dennis Gauden: shewing that he was partner with his father et al. in the Victualling of the Navy and did in 1677 by command of Charles II go to Tangier for the settlement of the garrison and Navy there, but in his passage there was taken by five Algerines and kept in slavery by them near a year, notwithstanding the King's directions to the Admiral then in the Straits for his speedy redemption and exchange: that he parted with a considerable sum for his liberty and on his return to England found a change in the Victualling [contract] whereby he became and remains bereft of employment: therefore prays a landsurveyor's place, London port. Same by same to same of the petition of John Gallays, shewing that being fled from the persecution abroad with his wife and eight children he has nothing left him but four tons of vinegar which he brought over and which has been seized: prays for remission of the duty thereon as the value of the vinegar is less than the Customs. Same by same to Richard Graham of the petition of Daniell Moody, shewing that his sister, Eliz. Moody, married John Hicks, a Nonconformist preacher, who together by sinister and clandestine artifices did so far prevail upon the weaknesses of petitioner's father as to make a will unfavourable to petitioner his only son, and there by got the estate being 100l. per an. and 2,000l. in goods, although petitioner never displeased his father but often opposed Hicks's fanatical principles. Petitioner has been a gunner in Portsmouth garrison 20 years, and since as master gunner in the train of artillery in the late expedition against the rebels: whereas said Hicks has continued to be a very pernicious person to the government and was lately executed for treason at Glastonbury, whereby his estate is forfeit. Therefore prays a grant of said estate. Ibid, pp. 196–7.
Nov. 5. Reference by Treasurer Rochester to the Navy Commissioners of the petition of John Taylor, shewing that in the method proposed by him he supplied the Navy last year with considerable quantities of hemp, pitch and tar at very much cheaper rates than such goods were formerly provided: therefore prays some reward. Same by same to the Surveyor General of Crown Lands of the petition of Sir Robert Clayton for extension of lease of a parcel of the demesnes of the manor of Kennington in Lambeth parish, parcel of the Duchy of Cornwall. Ibid, p. 207.
Nov. 6. Henry Guy to the Auditor of the Receipt to issue to Treasurer Rochester the 1,500l. which is paid into the Exchequer by Mr. Graham et al. out of the profits of the late Lord Grey's estate: as in part of 16,000l. granted to Treasurer Rochester thereout. Disposition Book IV, p. 95.
Same to the Customs Commissioners. There are three Spaniards come from Jerusalem in an English ship from Scanderoon for Cadiz, but prevented landing at Cadiz by contrary winds and so brought on to England. They desire that their baggage may be transhipped for Cadiz except such parts as they intend to present to the Spanish ambassador. You are to open the latter and to permit the remainder to be transhipped as desired. Out Letters (General) IX, p. 182.
Reference by Treasurer Rochester to William Hewer of the petition of Paul Harris for 200l. due to him for wine and necessaries supplied for maintenance of the workmen employed on the mole and fortifications at Tangier: or for so much thereof as may fit him for his voyage to Gibraltar and so save a whole family from starving. Direction by Treasurer Rochester to the Customs Commissioners to observe an order of the King in Council dated Whitehall, Oct. 30 last. Out Letters (Customs) X, p. 60.
Prefixing: said order for revoking the freedom granted 1684, Oct. 24, to Samuel Walton, purveyor of fresh fish for the late King, for the two vessels or well boats called the Hope and Adam and Eve, built by said Walton in Holland for importing fresh cod, quick eels, lobsters and fresh river fish exclusive of all other merchandise and fresh fish whatsoever; complaint having been made to the Privy Council by Sam Heron, Peter Martell and William Miles of London, merchants, that by means of the said freedom the end of their undertaking for bringing over Dutchmen to set up and teach his Majesty's subjects the art of catching and curing cod is subverted and destroyed; which complaint was appointed to be heard Oct. 21, but neither side appeared: but the King considers said freedom is contrary to the intents of the Acts for Trade and Navigation "which he is resolved shall be inviolably kept."
Nov. 7. Henry Guy to Rupert Browne. Col. Vernon has promised the Lord Treasurer to pay the 3,300l. due to you within six months from Nov. 1 inst. provided you pay the 900l. Out Letters (General) IX, p. 182.
Same to the Lord Chamberlain. Mr. Phil. Ryley's patent as serjeant at arms to attend the Lord Treasurer became void by the late King's death. It is the King's pleasure that he be continued. You are to swear him in. Ibid.
Nov. 9. Money order for 1,542l. 11s. 7½d. to Richard Beavoir as assignee of Nicholas Charlton et al. for clothing by them furnished to the additional Company and recruits of the late Regiment of Foot, then Duke of York's, [of the late New Raised Forces]; as by a certificate dated 1679, May 31, from two of the Commissioners for Disbanding said Forces: to be paid out of the remains of the last Six Months' Assessment for the said Disbanding. Same for 1,672l. 0s. 3d. to Robert Penney, salesman, for clothing similarly furnished by him to Sir Lionell Walden's Regiment of Foot, the Earl of Roscommon's Troop of Horse and Lord Frescheville's Independent Company of Foot [part of said late New Raised Forces] as by a like certificate dated 1679, May 31. It is the King's pleasure that ten children of the Chapel have the winter liveries they used to have, viz. for each, one coat and breeches of scarlet cloth, the coat to be lined with sky coloured shaloone; a vest of scarlet cloth made up and trimmed with silk lace as formerly; three whole shirts; three half shirts; six plain bands and cuffs; three pocket handkerchiefs; three pairs of gloves; 2½ pieces of ribbon to trim each of their liveries and to make garters and shoe strings; two pair of worsted stockings; six pair of shoes; two hats and hat bands; a coat of ordinary red cloth lined with sky coloured shaloon to cover over their clothes in case it should rain.

Nov. 9. Report to the King by Treasurer Rochester on the petition presented to the late King by Capt. Alexander Makenny and the rest of the officers of the Troop of Horse late under him in Tangier ut supra, Calendar of Treasury Books, Vol. VII, pp. 1191–2. I find that the late Treasury Lords referred same 1684, July 1, to William Hewer, who reported Aug. 6 following that the 30 horse formerly borne on the establishment of Tangier with one officer only at Lieutenant's pay were about April, 1682, formed into a Troop under their then Commander, Capt. Makenny and Francis Delarne was appointed Lieut. by commission dated 1682, April 25, John Chappell as Cornet by commission dated April 26, and John Dennix as Quarter-Master by commission dated April 27: that from the muster rolls it appears they were mustered only from 1683, April 1, the time of their appearance at Tangier, but that it appeared from certificates of the Earl of Inchiquin, Col. Sackvile and Col. Kirke, late Governors of Tangier, that the custom and practice of that garrison has always been to pay officers from the dates of their Commissions. Their pay from the dates of their commission to 1683, April 1, if allowed will be 136l. to Mackenny at 8s. a day to make up his 6s. on the establishment into 14s. a day; 170l. to Delarne on 10s. a day; 152l. 11s. 0d. to Chappell on 9s. a day; 101l. 8s. 0d. to Dennis on 6s. a day. Report to the King by Treasurer Rochester on the petition of Sir Samuel Morland. I find that, by direction of the late King, Morland did in 1681 undertake to make an engine to convey water from the Thames to the Castle of Windsor which was at first estimated at 800l. but afterwards, by alterations therein, the charge amounted to 2,990l. 4s. 5¼d. whereof he has received 1,550l. from Mr. Roberts, Receiver of the Honor of Windsor. Likewise on his several pensions amounting to 800l. per an. for life there is 2,800l. due plus another 200l. on same for last Sept. 29 quarter. But at several times there has been paid to him for the late King's secret service, 200l. (1681, Dec. 24) and 200l. (1684, Aug. 9) and by the privy seal of 1682, June 30, he was granted 664l. 4s. 5d. of the Tenths of the diocese of Gloucester due from the executors of Dr. Nicholson, late Bishop of Gloucester, and William Warner, his subcollector; whereof Morland has received a decree for 371l. 3s. 6d. and is in suit for the rest, but he swears that his expenses therein come to 303l. 15s. 0d. so that this grant of Tenths can only yield him 360l. 9s. 5d. By the great seal of 1682, Sept. 12, Charles II granted him 700l. at the Exchequer which was paid 1682, Oct. 14. These sums of 200l., 200l., 360l. 9s. 5d. and 700l. reduce his claim of 3,000l. to 1,539l. 10s. 7d. or his total claim, including the said engine account, to 2,979l. 15s. 0¼d. Appending: (a) said Morland's petition shewing that he has been lately dismissed by Monsr. de Louvoy with the real loss of above 1,400l. and yet hopes he has done nothing during his abode in France to lessen the reputation of an Englishman: that on his return home he finds a stop put to all his pensions on which arrears as above are due, petitioner not having a shilling of any other revenue in the world to subsist upon. Before his going over [to France] petitioner toiled for above a year at Windsor to please his late Majesty, where it was proposed at first only to raise the water out of the mill river, but the King finding tanners' skins and other nastiness in that river petitioner was forced to make a water house and a new engine and be at many unforseen expenses about sinking the river, the mill, well etc. and being in a hurry and for want of ready money [had] to make bad bargains all which trebled the first estimate, although nothing was done without his Majesty's privity and approbation: but the Treasury Lords being displeased referred it to petitioner's enemies and upon their report left an arrear of 1,464l. [unpaid on said account] to the undoing of many poor families. Before the Restoration petitioner had 1,500l. a year and afterwards had promises of great preferments and was commanded ever since to rely upon the King's word for a real and suitable fortune, but now in his old age petitioner is left in a position worse than that of a beggar in the street, and hardly dares to return to London for fear of arrest, his house and goods having been long since sold "to whom they were mortgaged for money to finish the engine": desires only to pay his debts and see his son, who is now of age, provided for. (b) An account of the charge of the mill, engine, waterhouse, pipes etc. at Windsor (including Mr. White, the Castle plumber; Mr. Hawks, the millwright; George Pyle, the Castle bricklayer; "the model I made for preventing fire in the Castle by his late Majesty's command"). (c) A note of the payments to Morland by Mr. Roberts ut supra. (d) An account of the privy seal of 1682, June 30, which granted the abovesaid arrears of Gloucester Tenths. Being near my journey into France and being indebted to Mr. Fowl, goldsmith, I put the privy seal into his hands in trust to sue for me. He has been ever since in suit with Dr. Nicholson; and now with one Brigstock and Mansell. As to the charges Mr. Bretland, the counsel, must be paid. As to the 700l. granted at my going over I look upon it as a free gift in order to my journey into France. (e) Certificate by William Roberts of his payment of 1,550l. ut supra.
