Lunae, 4 Maii, 1607

Privilege - Subpoenaing a Member.

IT was informed, on the Behalf of Sir Richard Pawlett, One of the Members of the House, that a Subpoena, issuing out of his Majesty's Court of Exchequer, was served upon him, at the Suit of William Sylver and Robert Folwell, contrary to the Privilege of the House, as was conceived by the Mover; and therein he prayed the Direction of the House.

The Writ was delivered into the House, and read, in this Form :

JACOBUS, Dei gratia, Angliae, Scotiae, Franciae, et Hiberniae Rex, fidei defensor, etc. Richardo Pawlett, militi, Salutem. Praecipimus tibi, firmiter injungendo, quod, excusatione quacunque cessante, in propria persona tua sis coram Baronibus de Scaccario nostro, apud Westm. a die Paschae prox. futur. in tres septimanas, ad respondendum nobis de certis articulis tibi tune ibidem ex parte nostra [a] objiciendis. Et hoc nullatenus omittas, sub poena 100l. quas de bonis et catallis, terris et tenementis tuis, si ad dictos diem et locum non veneris, ad opus nostrum levari faciemus. Et habeatis ibi tune hoc breve. Teste Thoma Fleming, milite, apud Westmonasterium, 11 die Februarii, anno regni nostri, Angliae, Franciae, et Hiberniae, quarto. et Scotiae quadragesimo. Per bill. Upon this Writ, the House thought fit to grant Privilege to the Party grieved, and that the same Course should be taken, as in other the like Cases is usual ; scilicet,

the Serjeant, by his Mace, to attach the Parties delinquent, and to bring them to the Bar, to receive the Judgment of the House.

Logwood.

L. 1a. B. For the utter Abolishing of Logwood, alias Blockwood, and for prohibiting the same to be imported, or used within the Realm.

Baro's Nat.

B. For the Naturalizing of D. Baro, &c. being formerly reported, and, upon some Questions and Doubts arising in the House, re-committed, was brought in again from the Committee, as agreed on; and, upon the Question, ordered to be ingrossed.

Bastards.

L. 1a. B. For the Punishment of the Parents of Bastard Children, and the Discharge of the Parishes where they be born, and to prevent the unnatural Murders of such Children, committed by the Mothers.

Cardinall's Estate.

Ordered, To hear Counsel in the Bill touching Cardinall and Delabroch, on Wednesday Morning next.

Union with Scotland.

Mr. Speaker remembereth a Caution in his Majesty's Speech, that we should not spend the Time in idle Discourse: - A Direction, that we should proceed to something, that may give Furtherance to the Business. To that Purpose, he said, he had received a Bill, ready framed, which the Clerk was directed to read, with this Title

L. 1a. B. For the Continuance and Preservation of the blessed Union of the Realms of England and Scotland, and for the Abolishing and Taking away of all the hostile Laws, Statutes, and Customs, that might disturb or hinder the same.

Members not to go out.

The House gave special Order that no Man should go forth.

Mr. Attorney-general went forth, without Leave of the House.

Exception was taken; and said, it was a great Contempt : - That he ought to be sent for by the Mace.

Much was spoken, pro et contra ; and at last grew to a Question,

Whether he should be sent for.

Marshalsea Court.

Whereas the Counsel on both Parts in the Bill touch

ing the Abuses of the Court of Marshalsea, &c. hath, sundry Days, by Order of the House, attended to be heard ; it was this Day thought fit, and so ordered, that Tomorrow should stand, as a peremptory Day, as well for the Hearing of the said Counsel, as for the Determining the Question of the Bill, touching the Jurisdiction of the Court, and for putting the Bill to the Question of Ingrossing.
