Privilege.

IN the Time of Vacation of this Adjournment, a Suit was prosecuted in the Court of Wards against Nicholas Potts, Esquire, and Francis Wythered, Gentleman, Committees of Eliz. Potts, his Majesty's Ward ; which Suit did specially concern Mr. Nicholas Davyes, Servant to Mr. Speaker, as Assignee of the said Ward ; and, upon the Suit of Mr. Davyes, by former general Warrant of the House, Mr. Speaker did write his Letter, to this Effect:

SIR,

I am, by general Warrant of the Commons House of Parliament, to inform in Point of Privilege, where there is Question : And whereas I understand, that in a Cause depending in your Court, between Katherine Potts Widow, Mother of Eliz. Potts, his Majesty's Ward, Plaintiff, and Nicholas Potts, Esquire, and Francis Wythered, Gentleman, Committees of the said Ward, Defendants; it was the last Term informed, that the said Wardship was assigned, by Licence of the said Court, to Nicholas Davye, my Servant: and was thereupon ordered, that he should have Time to join in Commission with the Plaintiff, this Term; wherein as he was excused by his Counsel the last Term, so must, by Warrant from the House, make known to you, and the Court, his just Excuse at this Time, being One of my Clerks, and nearest Servants, a necessary and daily Attendant; and the Privilege being now as warrantable as in the Time of Sitting: Whereof I pray you take Knowlege. From my Chamber at the Temple, this second Day of February, 1606.
