Elections.

THE Drawing a Bill for Elections, &c. - Mr. Hackwyll, Mr. Glanvile, Mr. Recorder, Sir Geor. Moore, Sir Jo. Davies, Sir James Perrott, Mr. Brooke, Sir Francis Barrington, Mr. Chancellor of Duchy, Mr. Noye, Sir Ed. Mountague, Sir Wm. Herbert, Sir Jo. Walter, Mr. Solicitor, Mr. Crew, Sir H. Poole, Mr. Taylor, Mr. Mallett, Mr. Carvyll, Mr. Shervile, Mr. Digges: - To bring in this Bill by this Day sevennight. - To meet in Lincolne's Hall, Monday next, after the Rising of the Court. The Lawyers of Lincolnes Inn first to agree of a Meeting, and to prepare the Bill, then to acquaint the House with it; and to have a Time appointed, for the Meeting of the general Committee.

Heale's Bill.

Mr. Glanvyle reporteth Sir W. Heale's Bill with Amendments.

Mr. Mallett: - That this Power to Sir W. Heale, a Matter of 10,000 l. - Doubteth, whether Sir Francis Heale his Consent be to the Bill, or not. Moveth, it may stay, till his Assent certified.

Sir Edw. Gyles; - Knoweth Sir Francis Heale did, last Meeting in Parliament, and at divers other Times, consented. -

Thanks to Lords.

Sir Edw. Coke hath Power to give the Lords Thanks for their good Correspondency with this House. -

Hele's Bill.

Mr. Hele affirmeth his Brother's Consent.

Sir Edw. Coke: - The general Assurance of the Realm is, the Father Tenant for Life, Remainder to his first Son, &c. - Will never consent to bind any Infant.

Sir W. Earle; - That it concerneth an Infant of 12 Years old. - To recommit it.

Sir H. Poole: - Against all Bills of this Nature, where the Inheritance taken away from an Infant, upon the Conveyance made by his Ancestor; but here being but to make Leases, as Tenant in Tail, thinketh it reasonable.

Mr. Wentworth: - That this Bill giveth more Power for making Leases, than Tenant in Tail hath.

Upon the Question, this Bill re-committed : And Sir W. Earle, and Mr. Wentworth, Sir Rich. Bulwer, Sir Edw. Coke, Mr. Christofer Earle, Mr. Chancellor of the Duchy, added. - Thursday next, in the Exchequer Court.

Hall and Fuller's Case.

Sir John Jephson moveth for a Day, for Counsel between Sir Jo. Hall, and Mr. Fuller : - To assign him One of the Three, whose Names he hath; and a Page, that made an Affidavit, to be present.

Mr. Dr. Gooch : - To have it heard here.

Mr. Finch, accordant. - To hear it, but as it concerneth the Publick, and not as a private Cause.

Sir Geor. Moore, accordant; because cometh in by Report from the Committee for Courts of Justice.

Upon Question, Resolved, Counsel shall be heard in this Cause, upon Tuesday next.

Mr. Crew : - To have a less Sum, and made certain.

Mr. Towerson: - To have Whipping set down for some, that are poor, and yet care not for the Stocks.

Mr. Denny : - To define what an Oath is, that shall be punished by this Act, for not to have a passionate Word to be counted an Oath.

Mr. Glanvyle : - The fittest Time to speak to a Bill, before the Committing , for none knoweth, who shall be a Committee, or who can be present. - To have a Time limited within which to be questioned.

Sir Geor. Moore : - The Offence great, yet no Provision against it. - A certain Penalty, not arbitrary. - Fit to have a Law against it.

Sir Edw. Mountague: - An Hour spent here, better than Ten at a Committee. - That a Law hath passed this House, wherein Distinction of Degrees for the Penalty.

Sir Edw. Sands : - That more Swearing in England, than in all Christendom. - Not to sit here, to reform Grievances of the Commonwealth, and leave those, which concern God. - Swearing of Children great: No Money to be had from them ; nor Stocks. - Every Master, and Father, to take care of it. - That the Example of the great ones hath occasioned this great Abuse. That the Penalty of 10s. not so fit: Too little for some, too great for others.

Conference.

Sir Edw. Coke: - That he told the Lords, his Message of Two Parts: 1. Thanks for their affectionate and patient Hearing of us ; and for their Procuring the Papers, which had given us much Light; and for their great Correspondence with this House. - Desired; sithence divers Things discovered, sithence the last Conference, there might be a Re-conference.

Agreed; and that they would be ready against Two of the Clock this Afternoon.

Mr. Cooke: - Great Care to be taken for preparing. - That a concluding and applying Part necessary now. - Nominateth, for this, Sir Edw. Coke.

Sir Edw. Coke excuseth himself, as not fit for him.

The Conference to hold this Afternoon. - Resolved.

Memorandum: After Debate about it, Resolved, Mr. Attorney should come up to the Table; and Mr. Speaker, and the whole House, to be bare, whilst the Message was delivering.

Message from the King - Subsidy, &c.

A Message from the King, by Mr. Attorney: - Doubtful, the Conference this Afternoon may hinder the Bill of Subsidy ; therefore, to have it deferred till Monday, except both may be this Afternoon; and that his Majesty stayeth the Answer of the House.

Answer: They will attend both; and hope, they may dispatch both; and will sit till Ten of the Clock at Night, but they will dispatch both.
