Bill against Simony, formerly committed to Mr. Treasurer, Sir Edw. Coke, Sir Edm. Bacon, Sir H. Martyn, Sir Francis Seymor, Mr. Pymme, Sir Francis Barrington, Mr. Solicitor, Sir Tho. Hatton, Sir Edw. Lech, Burgesses of the University of Oxford: And all, that will come, to have Voice : - Moral Philosophy Schools, Two Clock this Afternoon. - Delivered to Mr. Witakers.

Proceedings against Mountagew.

Motion made, that Mr. Mountagew might now appear, according to the former Order. Mr. Serjeant, called in, saith, he hath taken Bond of 2000l. Bond; and that Mountagew hath written to him, he is sick of the Stone. He required to bring the Bond and Letter.

Sir Edw. Coke .- - That the ancient Brittons conquered, by reason of Want of united Counsels, for avoiding Dangers. Dum singuli pugnant, universi vincuntur. So it will be in Divinity, if every private Man may put out Books of Divinity. - This as dangerous a book as ever saw. - Wisheth, no Man may put out any Book of Divinity, not allowed by the Convocation.

Sir W. Heale wisheth a Bill, to that Purpose.

Mr. Mountagew his Letter to the Serjeant read.

Sir Ro. Phillippes ; - To send the Serjeant for him. Mr. Solicitor putteth the House in mind of his Majesty's Intimation by him, before the last Recess. Moveth to acquaint the King with the Particulars and Consequences of the Book; and doubteth not, but we shall have his Leave to send for him.

Mr. Alford putteth the House in mind of the Danger to exempt the King's Servants from questioning in Parliament. Moveth, a Committee, to consider, both of this Particular, and of the general.

Mr. Strode. - That our Proceedings against Mr. Mountagew for a Contempt to the House.

Sir Francis Seymor: - Not to lose this Privilege; but to desire the King to leave him, for this Contempt, to us.

Sir G. Gerrard putteth the Hcuse in mind of Sir Tho. Parry, a Privy Counsellor, whom the King desired to have left to him; but the House would not consent; but put him out.

Mr. Wentworth putteth the House in mind of the Lord Chancellor, and Treasurer, whom the House hath dealt with. - Mountagew reproacheth Bible-bearers: Which the Arms of this University. - To proceed to a Conference with the Lords, according to the former Order.

Sir Jo. Ellyott: - That this Man remaineth committed by the House to the Serjeant: Therefore we cannot send for him, as if he were, out of Prison. - To give the Serjeant a Time to bring him.

Sir Edw. Coke. - We meddle with him, only for his Contempt to this House; whereof we have Jurisdiction. We will not meddle ourselves alone with adjudging his Tenets; yet we may inform the Lords, where the Bishops are: and they are to judge it. This warranted by

the Words of the Writ; " Defensionem ecclesiae Anglicanae;" which are ancient, in H. IV. and H. V. Time, and before; and not brought in in H. VIII. Time. - Moveth. the Serjeant may bring in Mountagew at a Day to be prefixed to him.

Mr. Drake; - That this Book so dangerous to the Church and State, cometh out cum Privilegio : Which maketh it accounted the Doctrine of the Church of England; and so the Opposers Schismatiques. - The Danger to the Low Countries by Arminianism.

Sir Geor. More, accordant.

Sir Ro. Phillippes putteth the House in mind of the last King's last Speech to both Houses, that no Servant of his should be questioned.

The Serjeant commanded, at his Peril, to bring Mr. Mountagew to the House, with all convenient Speed ; and he to stand committed, until he be discharged by the House.

Sir Ro. More, Sir Ro. Phelippes, Sir Symon Weston, Sir Jo. Ellyott, Sir Ben. Rudyard, Sir Francis Seymor, Sir Francis Knollys, added to the former Committee for Mr. Mountagewe's Books: - To meet on Thursday in the Afternoon, Two Clock, in the Logick Schools.

Dr. Anyon not to peach before the House.

Mr. Treasurer and Sir Jo. Danvers, being Burgesses for the University, presently to desire the Chancellor, or, in his Absence, the Vice-chancellor, to take Order, that Dr. Anyon preach not To-morrow before the House.

General Fast.

Sir Nath. Rich: - That the Fast is not observed in divers Places, by reason the Books not sent unto them ; which the Default of the Bishops, or their Officers. - To send a Message to the Lords Bishops, that this may be reformed.

Sir Wm. Boulstreade affirmeth the same for Peterboroughe, Diocess.

Mr. Boswell: - That the Lord Keeper hath long sithence taken Order and sent down, to every Parish, Two Books; with Letters to the Commissaries, and other Officers, commanding them to see them duly executed.

Sir Jo. Ellyott: - That, in his Country, these Books not come. That some particular Persons have there engrossed these Books, and have demanded 3 s. 2 s. 6 d. and 2 s. a Book, for these. This so done at Plymouth,

Sir W. Earle: - That the Books sold at too high a Rate : - 10 d. and 12 d. a Book : Whereby, by Computation, above 1000 l. clear Gains.

Sir Ro. Hatton, Sir H. Martyn, and Sir Tho. Hatton, to acquaint my Lord of Canterbury with this Neglect; and, from the House, to desire he will take Order to help it.

Dr. Anyon.

Mr. Treasurer and Sir Jo. Danvers return Answer, that the Vice-chancellor told them, he had a Letter from Dr. Anyon, that he would not desist from preaching, except he were discharged by the Delegates : Which thereupon he had done; and caused them to appoint another in his Room.

Adjournment, &c.

The House adjourned till Thursday Morning, Eight of the Clock; and all Committees appointed, to sit this Afternoon.
