PRAYERS.

Money for Army, &c.

ORDERED, That the Committee of Gloucester be added to the Committee of Shropshire, to consider of providing Monies for Sir Tho. Middleton's Forces; and to examine the Business concerning Mr. Crathorne, Sir Jo. Wolstenholme's Agent.

Prothonotary of Common Pleas.

Ordered, That the Profits of the Prothonotary's Place in the Common Pleas, become void by the Death of Mr. Gulston, be sequestred to the Use of Mr. Bernard of Lincolne's Inn; and that Serjeant Wilde bring in a Sequestration to this Purpose.

Assembly of Divines.

Ordered, That the Assembly of Divines shall have Liberty and Power to go to the several Libraries within the Power of the Parliament; and to have the free Use of such Books as they shall think fit; and to have such Books brought unto them, where they sit, as they shall appoint; provided that they leave Inventories of such Books as they shall remove out of any of the said Libraries, to the end they may be well and safely restored unto the said Libraries, and undefaced.

Major Gifford.

Resolved, &c. That Serjeant Major Gifford, sent up by my Lord Fairefaxe, be forthwith committed Prisoner to the Tower, there to remain during the Pleasure of the House.

Ordered, That the Examinations sent up concerning Serjeant Major Gifford, be referred to the Committee for the Examination of the Hothams: And they were accordingly delivered unto Mr. Millington.

Assembly of Divines.

Some Divines of the Assembly being at the Door, were called in; who presented an Answer to Two Orders of this House; the one concerning the tendring of the Oath in such Parishes as seemed backward; the other concerning those Members of the Assembly that have not yet received the Covenant.

Scotch Affairs.

A Letter from the Committee in Scotland, of the Eleventh of October, from Edinburgh, concerning the State of Affairs there, were this Day read; and Ordered, That Mr. Hatcher do send Copies of all the Votes and Occurrences that passed this House concerning Berwick, &c.

Army Committee.

Ordered, That Mr. Jo. Goodwyn and Sir Martin Lister, be added to the Committee for supplying of my Lord General's Army.

Ship John.

Resolved, &c. That the Ship the John of London, and Furniture, shall be forthwith seized, taken into the Service of the State, and valued; and such as are not elinquents, and Part Owners, shall have full Satisfaction; and that such Officers and Mariners of the said Ship as are ill-affected, be removed, and others put in their Places; and that if this Ship can be sooner made ready than the Swallow, that then she be employed to transport the Monies provided to be sent into Scotland: And it is referred to Mr. Holland, Mr. Hatcher, Mr. Ellis, and the rest of the Committee for Scotland, to take order that she be fitted with all convenient Speed.

Ship Swallow.

Ordered, That the Captain of the Swallow be summoned to attend the Committee of the Navy, to give an Account why the said Ship is not ready, according as it was informed to be.

Emyly's Petition.

The Petition of Edw. Emyly, Doctor in Physick, was this Day referred to the Committee for Irish Affairs.

Seizing Oil.

Ordered, That the Oil, informed to this House to belong to Mr. Masham, if it shall appear to belong to him, be forthwith seized, sequestred and sold; and the Proceed thereof employed to the Satisfaction of the Bills of Exchange from Berwick: And the Care of this Order is referred to Sir Gilb. Gerard, Mr. Hatcher, Mr. Blakiston, and the rest of the Committee for Scotland.

Irish Affairs.

The Committee of Citizens for Ireland being at the Door, were called in; and did prefer a Petition, with some Propositions, concerning Ireland, upon the Occasion of the Cessation in Ireland.

And it is Ordered, That the said Petition and Propositions be referred to the Consideration of the Committee for the Affairs of Ireland, where Mr. Jo. Goodwyn has the Chair: And the Committees for Ireland are required to take Order that no Provisions be as yet sent over into Ireland, till the House take further Order.

This Committee is to sit upon the Businesses To-morrow in the Afternoon, in the Exchequer Chamber.

Ordered, That the Copies of Letters, Declarations and other Papers, this Day received from Scotland, concerning the Cessation in Ireland, be referred to the Committee of this House appointed to consider of the Cessation in Ireland.

Sir Lewis Dive's Impeachment.

A Warrant from Sir Lewis Dive, bearing Date the Twentieth Day of October, to the chief Constables of the Hundred of Stoden, for the raising of Monies in that Hundred; in which Warrant he stiles the Parliament, The Pretended Parliament, was this Day read.

Resolved, &c. That Sir Lewis Dive be forthwith accused of High Treason, for being in, and levying, actual War against the Parliament: And that Mr. Hill do bring in the said Impeachment.

Repayment of Money.

Ordered, That an Ordinance be brought in for the Repayment of the Monies borrowed at Haberdashers Hall by Mr. Strode, for the present enabling of Sir Wm. Waller to march; to be repaid to the Parties, according to the Time assigned.

Irish Affairs.

Sir Walter Erle, Sir Nevile Poole, Mr. Trenchard, Sir Martin Lister, Mr. Lisle, Mr. Ashe, Mr. Knightley, Mr. Hatcher, Mr. Hodges, Mr. Tate, Mr. Pury, Mr. Herbert;

This Committee, or any Four of them, are appointed to take the Propositions, this Day presented from the Committee for the Affairs of Ireland, in London, to Consideration; and to report the Result of them To-morrow Morning: And are to meet this Afternoon at Three of Clock in the Court of Wards: And have Power to send for Parties, Witnesses, Papers, Records: And the Care hereof is especially recommended unto Mr. Lisle.

Raising Money.

A Message from the Lords, by Sir Edw. Leech and Dr. Ailett;

The Lords have sent down this Ordinance for the raising of Monies within the Line of Communication; and do adhere to the Proviso they formerly sent down.

Dawes' Sequestration.

Ordered, That all and singular Manors, Messuages, Lands, Tenements and Hereditaments, Fees, Tythes, Leases, Offices, Debts, Specialties, and all other the real and personal Estate whatsoever of Sir Thomas Dawes Knight, and John Dawes Gentleman, Sons of Sir Abraham Dawes, late of London, Knight, deceased, shall be, and by Force and Virtue hereof are, sequestred into the Hands of Sir Robert Pye Knight, Cornelius Holland Esquire, Sir Richard Onslowe, Sir Christopher Wray Knights, and John Goodwin Esquire, and Sir Anthony Irby Knight, Members of the House of Commons; Stephen Sedgwick, Robert Haughton, Francis Burt, John Graunt, Wm, Garland, and Leonard Stockdale, Gentlemen: And the said Sequestrators, or any Two or more of them, are hereby enabled and authorized, not only to seize and possess themselves of the Estates aforesaid; but also to receive the Rents, Issues, and Profits, Arrears of Rents, Fees, Annuities and Debts, arising, growing, and accruing, and already grown due from, by, and out of the Estates aforesaid: And the Tenants, Farmers, and Occupiers of the said Manors, Messuages, Lands, Tenements, and all other the Premises, and the Debiters to the several Estates aforesaid, are hereby required and enjoined to pay their several and respective Rents, Sums of Money, and Debts, to the said Sequestrators accordingly: And the said Sequestrators, or any Two or more of them, are farther enabled hereby to lett, sett and dispose of all such Manors, Messuages, Lands, and Premises, which now are, or hereafter shall fall in Hand, to such Person and Persons, and for such yearly Rent only, as they shall think fit; and shall and may sell, and dispose of all the Goods, Cattle, Corn, Hay, and other personal Estates aforesaid; and further, shall and may fell and cut, or cause to be felled and cut, all the Timber, Wood, and Underwood, standing, growing, or being upon the Premises, without Destruction or Waste thereof; and the same to sell and dispose of to the best Advantage, according to their Discretion. And it is further Ordered, That all and singular the Sum and Sums of Money, arising by any the Ways and Means aforesaid, shall be paid into the Hands of the said Cornelius Holland, and Sir Anthony Irby; who are appointed Treasurers for the same: Which said Treasures shall not issue out, or dispose of any such Monies, raised as aforesaid, to any other Person or Persons, or to any other Uses, than to such Persons and Uses as the said House of Commons shall, from time to time, order and appoint the same.

Exchange of Prisoners.

A Letter from the Earl of Forth to my Lord General, concerning the Exchange of Sir Hen. Barkley, and Colonel Hungerford, was read.

Ordered, That my Lord General be made acquainted with the Information given unto this House, That Lieutenant Col. Hungerford, as he came from Bristoll, upon the Surrender of that Town, to Andevour, he told a Servant of Mr. Ashe's, then at Andevour, that he would go to Oxforde; and that he went accordingly thither: However, this House doth leave it to my Lord General to do as he thinks fit about the Exchange of Sir Hen. Berkley.

Martial Law.

Mr. Strode reports, that my Lord General is willing to grant a Commission, to whom this House shall nominate, for the Trial of such Offenders by martial... as are no Part of his Army: And, for the Trial of Sir Jo. Hotham, and his Son, he will grant a Commission, when this House pleases.

Assembly of Divines.

Resolved, That Mr. Nicholson shall be discharged of the Assembly.

Resolved, &c. That Mr. Rathebone shall be nominated to be of the Assembly, instead of Mr. Morley.

Resolved, &c. That Mr. Tho. Clendon shall be nominated to be of the Assembly, in the stead of Mr. Nicholson.

Bishop of Bristoll.

Ordered, That Dr. Westfeild, Bishop of Bristoll, be summoned to attend the Assembly.

Prisoner to be examined.

Upon the humble Petition of Mr. Richard Uther; it was Ordered, That Alderman Bachus, now Prisoner in the Tower, be brought, with his Keeper, before the Committee of Obstructions, on Thursday next come Sevennight; to be a Witness in the Cause of the said Mr. Uther; and after he hath given his Testimony, to be brought back again to the said Tower, there to remain a Prisoner, as before.

Tythes.

Ordered, (according to the Petition of the Inhabitants of Nayland) That Mr. * Mott Clerk, Minister of Stoke and Nayland, shall have the Moiety of the impropriated and sequestred Profits and Tythes of Stoke and Nayland; And the Sequestrators are to take notice hereof, that the Payments be made accordingly.

Assembly of Divines.

Upon Report of the Committee of this House of the Assembly; it is Ordered, That Mr. Hanniball Gammon, Mr. Wm. Mew, Mr. Richard Capell, Mr. George Morley, Dr. Robert Sanderson, Mr. John Jackson, Mr. Rob. Crosse, Mr. Franc. Cooke, Mr. Samuel Hildersham, Mr. Henry Hutton, Mr. Richard Bulkley, Mr. James Weldy, Dr. Pashley, Mr. Henry Teser, Mr. Wm. Lyford, Mr. John Earle, Mr. Henry Painter. Dr. Westfeild, Bishop of Bristoll, and Dr. Wincope of Elsworth, be forthwith summoned to make their personal Appearance in the Assembly of Divines, at Westminster, within Fourteen Days at the farthest.
