PRAYERS.

Warwickshire Committee, &c.

ORDERED, That the humble Remonstrance of the Committee of Warwickshire to the honourable House of Commons, by way of Answer to certain Aspersions cast upon them by Petitioners of that County, be referred to the Committee of Lords and Commons for the Earl of Denbigh's Association: And that the Articles from the other Petitioners, and that other Matters concerning Warwickshire, be referred to the Consideration of this Committee.

Military Successes.

A Letter from Sir Wm. Brereton, from Montgomerie, of September 18, 1644; relating the great Success it has pleased God to give the Parliament's Forces under the Command of Sir J. Meldrum, upon relieving the Siege of Montgomerie Castle, wherein the Lord Herbert of Cherbery was besieged.

Prisoner of War.

Resolved, &c. That Serjeant Major General Tildesley, taken Prisoner at the Siege of Montgomery Castle, shall not be released, by way of Exchange, or otherwise, with out the Consent of this House: And Mr. Ashton is to take care to send down this Order.

LordHerbert.

Resolved, &c. That the Sequestration of the Estate of the Lord Herbert of Cherbery be forthwith discharged and taken off: And that the Goods and Books of the said Lord Herbert of Cherbery, now under Sequestration, be forthwith restored unto the said Lord Herbert: And the Sequestrators at Campden House are required to take Notice hereof.

The Lords Concurrence to be desired herein: And carried up by Mr. Holles: And all the Letters concerning the raising of the Siege at Montgomerie Castle, and the Action there.

Fairfaxe's Wardship.

Ordered, That it be referred to the Committee for Yorkshire, where Sir Tho. Widdrington has the Chair, to bring in an Ordinance for the granting the Wardship of the Body and Lands of Sir Wm. Fairfaxe's eldest Son (whose Father, at the Battle at Montgomerie in Wales, was slain in the Service of the Parliament) without Charges, yearly Rent, or Composition for Fine, to the Lady Fairfaxe his Mother; for the Use of the said Heir, and the rest of the Children. And it is further referred to that Committee, to bring in an Ordinance for the settling some Maintenance on the said Lady Fairfaxe, and her Children, for the Support of her and them; having lost her Husband in the Service of the Parliament. And Sir Tho. Widdrington is to acquaint the Lady Fairfaxe with this Order; and what Care this House hath taken of her.

Reward to Messengers.

Ordered, That the Committee of both Kingdoms do pay Twenty Pounds to the Two Scouts that came last from Sir W. Brereton; the one for bringing the News from Malpasse, and the other from Montgomerie Castle.

Hampden's Wardship.

Ordered, That it be referred to the Committee for Berks and Bucks, to bring in an Ordinance for the granting the Wardship of Mr. Hampden's Son and Heir to the Benefit of the Heir.

Military Successes.

A Letter was read, from Sir Tho. Middleton, and another from Sir Jo. Meldron, of the Eighteenth of September, informing the House of the great Victory God had given them near Montgomerie Castle; and sent a List of the Commanders and Soldiers taken; and informed of the Death of Sir Wm. Fairfaxe, who, they write, behaved himself valiantly in the Fight; and also sent up the Articles of the Rendition of the Castle of Montgomerie to Sir Tho. Midleton, by the Lord Cherbery: Which Articles were read; and, upon the Question, confirmed by this House.

Ordered, That, on Wednesday next, the Twenty-sixth of this Instant September, being the Day of publick Humiliation, publick Thanks shall be given in all the Churches and Chapels within the Line of Communication, to the Giver of all Victories; for the great Victory it pleased him to give the Parliament Forces over the King's Forces, at the Raising of the Siege of Montgomery Castle.

Duty on Merchandize.

An Ordinance for laying One Tenth more upon Merchandize imported and exported for the Service of Plymouth, St. Nicholas Island, Lyme, and Poole, was this Day read; and, upon the Question, assented unto; and ordered to be sent unto the Lords for their Concurrence.

Court of Wards.

An Ordinance for enabling a Committee to free all Persons well affected, their Heirs and Children, and all descended from any of them, from the Jurisdiction of the Court of Wards and Liveries, and from all Wardships, Liveries, Primier Seisins, Ostr-les-mains, &c. arising by reason of certain Tenures of the King, and other Lords, &c. was this Day read the First time; and appointed to be read the Second time on Friday next.

Punishment of Waller.

The humble Petition of Edm. Waller, Prisoner in the Tower, was this Day read.

The Question being propounded, Whether Mr. Edmund Waller shall be put to the Fine of Ten thousand Pounds, and Banishment, and his Life saved;

The Question was put, Whether this Question should be now put:

It passed with the Affirmative.

And then the Question being put;

It was Resolved, &c. That Mr. Edm. Waller shall be put to the Fine of Ten thousand Pounds and Banishment; and his Life saved: And that Mr. White and Sir Rob. Harley do prepare an Ordinance to this Purpose.

Resolved, That this Fine of Ten thousand Pounds shall be employed for the present Setting-forth and Advance of the City Forces into the West.

Ordered, That Sir Robert Harley and Mr. White do speak with Mr. Edm. Waller; and take care, that the Monies of Mr. Waller's Fine may be paid in with the best Speed that may be.

Mr. White, Sir Robert Harley, Sir Hen. Vane jun. Mr. Solicitor, Mr. Maynard, Mr. Whitelock, or any Two of them, are appointed to prepare something, and present it to the House, for communicating of these Votes to the Commissioners for Martial Law.

Mediation of States Ambassadors.

A Message from the Lords, by Dr. Aylett and Dr. Heath;

The Lords having received Advertisement, That the States Ambassadors have this Morning, in Person to their Lordships Speaker, renewed their Desire of an Answer, concerning their Endeavours of a Mediation for Peace; do think fit, that the Committee of both Houses, formerly appointed to treat with the States Ambassadors concerning the Ships, as also to whom this Business concerning Peace was formerly referred, shall prepare a fitting Answer to be made to them, concerning their said Desire; and to present the same to both Houses: And the Lords desire this House to join with them herein.-

This Message was read; and, by Vote upon the Question, assented unto, and concurred in, by this House.-

Lady Drake.

The Lords have likewise received a Petition from Dame Hellen Drake; and have made an Order upon it, as to one Part of it: And do refer the Consideration of the rest of the Petition to this House.

The Lords upon the Petition of the Lady Ellen Drake, have assigned her the House of Sir Tho. Reynolds, in the Strand, ready furnished, for her Use: And their Lordships recommend the other Particulars of the said Petition to the Consideration of the House of Commons.

Ordered, That a House be provided for the Lady Ellen Drake, ready furnished and Rent-free: And that it be referred to Mr. Wheler: And he is desired to take care of providing this House, and furnishing it conveniently for her.

Resolved, &c. That the Committee of Lords and Commons, for Advance of Monies at Haberdashers Hall, do forthwith advance One hundred Pounds for Supply of the present Necessities of the Lady Ellen Drake, totally ruined and undone by the King's Forces.

The Lords Concurrence to be desired herein.

Ordered, That the Committee at Haberdashers Hall do advance an Hundred Pounds, by way of Loan, for the Lady Drake, until the Lords Concurrence can be obtained.

Resolved, &c. That Five Pounds per Week be allowed to the Lady Ellen Drake, for her present Support, out of the Monies that come in upon the Sequestrations in Middlesex and Westminster: And Mr. Wheeler is desired to take care that this Order may be complied with.

Answer to Lords.

Answer returned by the same Messengers; That this House has considered their Lordships Message: And as to the Order concerning the States Ambassadors, they have agreed to refer it, as is desired: And as to the Petition concerning the Lady Ellen Drake, they will send Answer by Messengers of their own.

Business to be done.

Ordered, That the House do sit To-morrow; and meet at the usual time: And that they do proceed with the Propositions, the first Business; and that then they proceed to the Consideration of the Declaration concerning the French Resident.

Ordered, That To-morrow the Irish Business be taken into Consideration; and the Ordinance concerning Sir Thomas Middleton; and the Letter concerning Basing.
