PRAYERS.

Customs.

AN Ordinance for Rating of the Fines of Seizures of uncustomed and prohibited Goods, was this Day read the First time; and ordered to be read the Second time on Wednesday Morning next.

Ordered, That the Commissioners and Officers for the ancient Customs, and petty Customs, due to the Crown, both in London and the Out Ports, do bring in their Accounts to the Committee of the Revenue.

Ordered, That the Commissioners of the Customs do forthwith bring in to the Committee of the Navy a full and perfect State of their Accounts; and the Names of their Deputies, Clerks, and Servants, with their Employments, Stipends, and Allowances; and the Bills for their casual Expences: Upon which the Committee is to make their Observations; and to report the whole State.

Hampshire Ministers.

An Ordinance for displacing of scandalous Ministers in the County of Hants, and placing others in their Places, was this Day read the Third time.

Northumberland, &c. Ministers.

Ordered, That the Four Ministers to be appointed for Northumberland, shall have likewise an Hundred and Fifty Pounds per Annum apiece allowed unto them, out of the Revenues of the Dean, Dean and Prebends, of the Cathedral of Durham: And that the Committee appointed to treat with the Assembly of Divines, do, with their Advice, take Order and Care, that Four Ministers may be sent down accordingly; and also the Ministers for the County.

Ordered, That Sir Anth. Irby and Sir Christ. Wray do confer with the Assembly of Divines, about sending of Two Divines to Lincolne, according to former Order.

Warwickshire Committee.

Ordered, That Mr. Noble do carry up to the Lords, the humble Remonstrance of the Committee of Warwickshire; and to desire, that they would concur with this House, in referring it to the Committee of Lords and Commons for the Earl of Denbighe's Association.

Butler committed.

A Letter from my Lord General from Portesmouth, of Septembris 26, concerning the sending up of Colonel Butler, was this Day read.

Resolved, &c. That Colonel Butler be forthwith committed close Prisoner to the Tower, for Suspicion of betraying the Army under the immediate Command of my Lord General; and to have none come unto him, or attend upon him, but such as he will be answerable for.

Taking of Monmouth.

A Letter from Colonel Edw. Massie from Monmouth, of Septembris 24 and a Letter from the Committee of Gloucester, of Septembris 24, concerning the taking in of Monmouth; were this Day read.

Resolved, &c. That it be referred to the Committee of Gloucester, Hereford, Glamorgan, Brecknock, Radnor, and Monmouth, with the Addition of Mr. Herbert, to meet, and consider of the Matter of the Letter of Septembris 24, from the Committee of Gloucester; and to consider of nominating a Governor of Monmouth, and additional Committees for those Counties.

Money for Ireland.

Upon Mr. Pierreponte's Report from the Committee of both Kingdoms, concerning the Ordinance for Monies for Ireland;

It is Resolved, upon the Question, That this House doth agree with the Committee of both Kingdoms, in nominating and approving of Alderman Kenrick, Alderman Foote, Alderman Bance, and Mr. Sam. Averye's Names to be inserted in the Ordinance for Ireland, as Persons whom they think fit to be continued Treasurers for the Monies that shall come in upon this Ordinance for Ireland.

Resolved, &c. That this House doth agree with the Committee of both Kingdoms, in nominating and approving of Mr. Gabriel Beck, of Lincolne's Inn, to keep the Cheque upon these Receipts.

Message to Lords.

Sir Robert Pye carried up to the Lords the Ordinance concerning Gloucestershire: The Order for Five hundred Pounds out of Haberdashers Hall for Colonel Massie's Forces: The Order for the Disposing of Sir Tho. Palmer's Jewels, &c.: The Order for the Commanders and Officers before Banbury to press Pioneers.

Necessaries for Army.

Upon Mr. Pierrepont's Report from the Committee of both Kingdoms, concerning the Supply of my Lord General's Army with Necessaries;

It was Resolved, &c. That Five hundred Saddles, with their Furniture, be forthwith provided for my Lord General's Army.

Ordered, That the Committee at Haberdashers Hall do forthwith furnish and pay the Monies that are to be paid for these Saddles for my Lord General's Army.

Ordered, That Two hundred and Forty Pounds be forthwith provided, for furnishing the Surgeons Chests for my Lord General's Army: And that this Two hundred and Forty Pounds be paid in to the Master and Wardens of the Company of Barber Surgeons, to make Provisions for the Furnishing of these Chests: And that the Master and Wardens of the Company of Apothecaries do visit these Chests; and take care that they be furnished with good Medicaments, and at good Rates: And that Mr. Bell do take care of this Order.

It is further Ordered, That the Committee at Haberdashers Hall do forthwith furnish and pay this Two hundred and Forty Pounds for the Furnishing of these Chests.

Resolved, &c. That Sir Gilbert Gerard, Treasurer at Wars, do forthwith issue out of the weekly Assessments of London, Westminster, and Middlesex, Three thousand Pounds to the Lieutenant of the Ordinance, towards the Furnishing of a Train of Artillery for my Lord General's Army: And that the Remainder, over and above the Three thousand Pounds to be secured and paid for the Train of Artillery, be secured out of the Monies in Arrear upon the said weekly Assessments.

Exchange of Prisoners.

Resolved, &c. That this House doth approve and order the Exchange of Captain Robert Hatton, a Prisoner to the Parliament in Elye House, for Mr. Theodore Jennings, Scout Master to the Earl of Denbigh, a Prisoner to the King's Forces at Oxon, and suffered to come up hither, upon his Parole, to agitate this Exchange.

Contract for Horses, &c.

Whereas, by an Order of Augusti 3, 1644, it was appointed, that an Hundred and Thirty Pounds, contracted for at a Council of War aboard the Ship the Lyon, for Twenty Horse and Mares, with their Furniture, delivered in for the Service of the State in the County of Pembroke, it is this Day Ordered, That it be recommended to Mr. Recorder, Mr. White, Mr. Theloall, to consider of, and find out, some Ways and Means how this Hundred and Thirty Pounds, according to the said Contract, and former Order, may be forthwith paid and satisfied.

Money for Army.

Resolved, &c. That Ten thousand Pounds shall be forthwith provided for my Lord General's Army.

And it is Ordered, That the Committee for Excise do treat with the Commissioners of Excise for the Furnishing of this Ten thousand Pounds. And that the Care hereof be especially recommended to Mr. Long, Mr. Green, and Mr. Nicoll.

Navy, &c.

Ordered, That To-morrow, next after the Report from Goldsmiths Hall, Mr. Green make Report concerning the Navy and Customs.

Soldiers imprisoned by Police.

Whereas Henry Hunt and Hugh Cocks, Two Soldiers, that, in the late Mutiny at Lambeth, by Command, were set at the Gate of Lambeth House, to defend the same; then a Garison against the said Mutineers; in doing their Duty, Two Men were killed by Discharge of their Musquets, as, upon full Examination taken by this House, is found and voted; and thereupon the said Hunt and Cocks discharged out of Prison: And the Coroner that took Inquisitions upon the View of the Dead, finding it Murder, was referred to the Council of War; and the Coroner ordered to be sent for in safe Custody: It is this Day informed, That the Coroner hath now, at the Sitting of the Justices in the Borough of Southwark, brought the said Presentments taken by him before them; and, upon the same, the said Hunt and Cock are imprisoned, and Proceedings intended against them for their Lives: It is therefore this Day Ordered, by the Commons House of Parliament, That the said Justices be enjoined, and they are hereby enjoined, to stay all Proceedings against the said Hunt and Cocks before them; and not to proceed any further against them: And that the said Hunt and Cocks, be forthwith discharged out of Prison: And that the Coroner, and all Particulars concerning that Mutiny, be referred to the Commissioners for Matters of Military Cognizance, to whom the same doth properly belong.

Disaster in the West.

Ordered, That the Commissioners for Martial Law be desired to give Order to their Advocate, to examine upon Oath, in the Presence of the Committee for reforming my Lord General's Army, or any Two of them, such Persons as they shall think fit to be examined, concerning the late Disaster in the West; and the Examinations taken thereupon; and the Business concerning Colonel Butler; and the Instructions brought from the King, and dispersed by him.

Filling the House with Members.

Ordered, That, on Wednesday next, the House do take into Consideration some Way of filling the House with Members.

Grant to Fane.

Whereas, by an Order of this House, of May the First One thousand Six hundred and Forty-four, Fifteen hundred Pounds, payable out of the growing Profits and Arrears of the Court of Wards, was granted and bestowed unto Mrs. Jane Fane, Daughter of Colonel Anthony Fane, slain in the Parliament Service, at the Taking in of Farnham Castle; to be paid to Feoffees, in Trust for the Use, Benefit and Advantage of the said Mrs. Jane Fane, Daughter of the said Colonel, out of the said growing Profits and Arrears of the Court of Wards, immediately after that the Assignments then made upon the said Revenue should be first satisfied and paid: And it was referred to the Committee of the King's Revenue to take Care, and give Direction, that this Order should be complied with: Notwithstanding all which, the said Fifteen hundred Pounds, nor any Part thereof, hath been paid to the said Mrs. Jane Fane, or to any Feoffees, for her Benefit: And whereas the said Mrs. Fane, Daughter to the said Colonel Anthony Fane, is since deceased: It is this Day Ordered, by the Commons in Parliament assembled, That the said Fifteen hundred Pounds, payable out of the growing Profits and Arrears of the Court of Wards, as aforesaid, be paid unto Mrs. Fane, late Wife of the said Colonel Anthony Fane, Mother to the said Mrs. Vane, Daughter of the said Colonel, and since married to the Right honourable the Earl of Kent, or to whom he shall appoint to receive the same for her Benefit, next and immediately after that the Assignments passed upon the Revenue of the Court of Wards before the said First of May shall be satisfied and paid: And it is referred to the Committee of the King's Revenue, to take care herein; and to give Directions, that this Order may be complied with, accordingly.

Master of Greetham Hospital.

Upon a special Recommendation to this House from Sir Wm. Armyn, and the rest of the Commissioners at Sunderland, of Mr. Samuell Rand Doctor of Physick, as a Person that hath approved himself a constant Friend to the Cause, and suffered great Losses by the Enemy; It is this Day Ordered, by the Commons House of Parliament, That the said Dr. Rand shall be Master of the Hospital of Greetham, in the County Palatine of Durisme; and have, hold, and enjoy, the said Mastership, with all the Rights, Privileges and Revenues thereunto belonging, in as large and ample Manner, as any Master of the said Hospital have lawfully heretofore enjoyed the same: And it is referred to the Commissioners of Parliament at Sunderland, to put the said Dr. Rand in Possession, accordingly.

Master of Sherborne Hospital.

Ordered, upon the special Recommendation of Sir Wm. Armyn, and the rest of the Commissioners of Parliament at Sunderland, That Mr. John Fenwick of Newcastle upon Tyne, a Person well affected to the Parliament, shall be Master of the Hospital of Sherborne, in the County Palatine of Duresme, and have, hold, and enjoy, the said Mastership, with all the Rights, Privileges and Revenues thereunto belonging, in as large and ample Manner, as any Master of the said Hospital have lawfully heretofore enjoyed the same: And it is referred to the Commissioners of Parliament at Sunderland, to put the said Mr. John Fenwick into Possession, accordingly.

Duresme, &c. Ministers.

Whereas, by a former Order, of the Nineteenth of August last, Sir Henry Vane, Sir Tho. Widdrington, and Mr. Blakiston, were ordered to confer with the Assembly of Divines, for Four fit and able Ministers to be sent down to the City of Duresme, to preach there; and to have the Allowance .. One hundred and Fifty Pounds per Annum apiece, out of the Revenues of the Deans and Prebends of the Church of Duresme: And also to confer about the sending down of able Ministers into the several Counties of Duresme and Northumberland, to preach there, for the Instruction and Edification of the People: It is this Day Ordered, by the Commons House of Parliament, That there shall be Four Ministers also appointed for the County of Northumberland, and Town Barwick upon Tweed; who shall have likewise One hundred and Fifty Pounds apiece Allowance out of the Revenues of the Deans and Prebends of the Cathedral Church of Duresme: And that this Committee appointed to treat with the Assembly of Divines, do, with their Advice, take Order and Care, that the said Four Ministers be sent down accordingly; and have also the said Allowance of One hundred and Fifty Pounds per Annum: And also that they take care to send down able Ministers to supply the Cures in the several Parishes in the Counties of Duresme and Northumberland, which are void, either by Death or Sequestration, and where the said Four Ministers are not appointed to preach.

Lady Harecourt, &c.

SIR Gilbert Gerard, Mr. Maynard, Mr. Pelham, Mr. Whitlock, Serjeant Wilde, Sir Tho. Widdrington, Sir Antho. Irby, Mr. Ellys, Sir Chr. Wray, Lord Grey;

This Committee, or any Four of them, is to consider of the humble Petition of the Lady Harecourt, the Relict and Executrix of Sir Symon Harecourt; and to present their Opinions to the House, what is fit to be done for the Petitioner's Relief: And also to bring an Ordinance for the granting the Wardship of her Son, without Fine, Composition, or Rent.

Hay's Bail.

Resolved, upon the Question, That Sir James Hay shall be forthwith bailed.

Roode's Petition.

Ordered, That the Petition of Mrs. Margaret Roode, Widow, be recommended to the Committee for plundered Ministers, for the Relief of the Petitioner.

Officers Widows.

Resolved, &c. That Two thousand Pounds be forthwith advanced, out of the Monies that come in upon the Receipts of the Excise, unto Sir Gilbert Gerard, Mr. Scawen, Sir John Francklyn, Mr. Pelham, and Mr. Gourdon; to pay thereout such Proportions of Monies, due unto the Persons underwritten, or their Husbands, slain in the Parliament's Service, as they shall think fit; not exceeding a Hundred Pounds to any Person, upon this Reference: And they are to take care, that they see the Debentures to the particular Persons, before they Order any Money unto any of them.

They have likewise Power to receive such Petitions, from others, of the like Nature, as they shall think fit; and to order them Monies, according to their Necessities.

The Persons named are these following; Captain Bladwell, Captain Grey's Widow, Captain Ballard's Wife, Lady Lucretia Barclay, Mrs. Meldrum, Mr. Burrell, Mr. Froome, Mr. Lyons, Mr. Harecourt, Mr. Harford, Mrs. Huncks, Mr. Hatcher, Lieutenant Smyth, Mrs. Richardson, Mr. Melins, Abigaell Wife of Captain Marmaduke Cowper.

Apsley's Bail.

Resolved, &c. That Colonel Apsley be bailed, upon Condition not to go Five Miles out of Town: And that the Business informed against him be referred to the Committee for the Association of Sussex, and * * * *.

Davison's Petition.

Ordered, That the Petition of Lieutenant Colonel Davison, &c. be referred to the Consideration of the Committee for the Association of Sussex, Hants, Surrey, and Kent.

Privilege.

Resolved, &c. That Robert Hurt, Robert Ward, and Christofer Budd, be forthwith sent for, as Delinquents; to answer their Contempt in entering upon the Possession of Mr. Maynard, a Member of this House, contrary to the Privilege of Parliament.

Petitions from Staffordshire, &c.

The House being informed, That divers Gentlemen of Staffordshire were at the Door, who desired to prefer a Petition to the House;

They were called in: And did prefer a Petition, desiring the Earl of Denbigh, their Major General, to be sent down to them: The which was read: And likewise another Petition from divers Gentlemen of the several Committees of the several Counties of Warwick, Stafford, and Salop:

Which was read. And

It is Ordered, That the Lords be desired, To-morrow, by a Message, to concur with this House, in referring these Two Petitions to the Consideration of the Committee of Lords and Commons for the Earl of Denbighe's Association: And that the Lords be desired, That that Committee may meet To-morrow in the Afternoon peremptorily: And that their Lordships would be pleased to make some Addition to their Committee, that the Business of that Association may receive a Dispatch, by the frequenter Meeting of that Committee.

The Gentlemen of Staffordshire were called in; and acquainted, by Mr. Speaker, with the Order the House has taken, for their speedy Dispatch of their Business.

Reformadoes.

Ordered, That the Lords Concurrence be desired in an Order to the Commissioners of Excise, to issue out One thousand Pounds for the English Reformadoes: And that their Entertainment be no longer continued.

Person sent for in Custody.

Resolved, &c. That Mr. Charles Vaughan be forthwith sent for in safe Custody, by the Serjeant at Arms attending on this House; to answer his Contempt in not obeying an Order of the House of the Eleventh of September, enjoining the Delivery of certain Pearls and Jewels, in his Custody, upon Account, to Mr. Philip Francis, late Mayor of Plymouth.

Irish Adventurers.

The humble Petition of the Committee of Adventurers in London, for Lands in Ireland, subscribed by the Hands of divers of the Committee, was this Day read; and ordered to be referred to the Consideration of the Committee appointed 27 Septembris for the Petition then presented in the Name of the Committee of Adventurers in London, for Lands in Ireland.

Exchange of Prisoners.

The humble Petition of Thomas Temple, desiring the Release of his Brother Sir John Temple, a Prisoner in Dublyn, was this Day read. And

It is Resolved, &c. That this House doth approve of and appoint, the Exchange of Sir Thomas Mallett, a Prisoner to the Parliament, for the said Sir John Temple.

Canterbury Archiepiscopal Library.

Upon the humble Petition of the President and Fellows of Syon College, London, desiring, That the publick Library, belonging to the Archiepiscopal See of Canterbury, may be removed, and settled in the Library at Syon College;

It is Ordered, That Mr. Recorder do bring in an Ordinance for removing the said Library, and settling it in Syon College; and making the Library publick, and fit to receive the said Books.

Grant to Augier.

The humble Petition of Rene Augier, late his Majesty's Agent, and Secretary of his Extraordinary Ambassage to the French King, was this Day read. And

It is Ordered, That the first Thousand Pounds that shall accrue to the State, arising upon the Ordinance of both Houses, of Augusti 26, 1643, granted unto Dominick Petit, Peter Deleyns, and Claudius Faucaut, for the Space of Seven Years, for drawing, out of the Seas and Rivers of this Kingdom, all overwhelmed Ships, their Lading, Cannon, &c. preserving one Moiety thereof to the Use of the Parliament, as by the Ordinance doth at large appear, shall be bestowed by this House upon the Petitioner Mr. Rene Augier.

The Lords Concurrence to be desired herein.

Deputy Lieutenant of Essex.

Upon the Certificate and Desire of the Committee in Essex;

It is Resolved, &c. That this House doth nominate and approve of Sampson Sheffield, of Mastock in the County of Essex, Esquire, to be added to the Deputy Lieutenants of that County.

Private Petitions.

Ordered, That the House do sit on Thursday next, at Eight of Clock, purposely to take into Consideration the private Petitions this Day delivered in.

Transporting Lead, &c.

Ordered, That the humble Petition of Grace Heathcott, Widow, be referred to the Committee of the Navy; to give Licence to the Petitioner to transport her Lead, &c. upon the Cautions specified, and such other Conditions, as they shall think fit.

Bromefield's Claims.

Ordered, That the humble Petition of Serjeant Major Bromefield be recommended to Sir Gilbert Gerard: Who is ordered to satisfy the Petitioner out of the first Monies, that shall come in upon the Excise, designed to defray Debts of this Nature.

Blakiston's Petition.

Ordered, That the humble Petition of Thomas Blakiston, Vicar of the Parish of Northallerton, in the County of York, be referred to the Committee of Lords and Commons for Sequestrations; to give Order, according to the Desire of the Petitioner, for the effecting of so good a Work, in the most convenient and fit Manner that may be.

Jennings' Petition.

Ordered, That the humble Petition of Susanna Jennings Widow, now read, be referred to the Consideration and Examination of the Committee for Examinations.

Army Cloathing.

Whereas, by an Order of Septembris 18, it was ordered, that Eight hundred of the Suits of Cloaths provided for my Lord General's Army, shall be sent and disposed of, to cloath the Soldiers of Plymouth; it is this Day Declared, That the House doth intend, by Suits of Cloaths, Suits, Shirts, Stockings, and Shoes.

Grant to Lynold.

Ordered, That the humble Petition of Edward Lynold, Rector of Heling in the County of Lincoln, this Day read, be referred to the Committee for Examinations; to allow unto the poor Petitioner Twenty Pounds out of the first Monies that shall come in at the Committee; and likewise a Horse to carry him into his own Country.
