Prayers.

Herbert's Petition.

ORDERED, That the humble Petition of Mr. John Herbert, younger Son to the late Earl of Pembroke, deceased, be read on Saturday Morning next, the first Business.

Mynhead Writ.

Mr. Richard Hutchinson, being chosen to serve as a Member in this present Parliament for the City of Rochester, in the County of Kent, and also for the Borough of Mynhead in the County of Somerset, declared, That he made his Choice to serve for the City of Rochester; and waved his Election for the Borough of Minhead.

Ordered, That a new Writ be issued, for the Election of a Burgess to serve in this present Parliament for the Borough of Mynhead in the County of Somerset, in the place of Mr. Richard Hutchinson, doubly elected: And that Mr. Speaker do send his Warrant unto the Clerk of the Commonwealth in Chancery, for the Issuing of a new Writ, for the Election of a Burgess for the Borough of Mynhead, accordingly.

Carmarthen Election.

Mr. John Goodwyn reports from the Committee for Elections and Privileges, the State of the Case, concerning the Election of Burgesses to serve in this present Parliament for the Town and County-Borough of Carmarthen.

The humble Petition of John Vaughan and Griffith David, Sheriffs of the Town and County-Borough of Carmarthen, concerning the aforesaid Election, was also delivered in, and presented to the House: And . . is thereupon

Ordered, That Monday next be appointed, for this House to take into Consideration the Report of the State of the Case, concerning the Election of Burgesses to serve in this present Parliament for the Town and CountyBorough of Carmarthen: And that the Petition of the Sheriffs of the said Town and County-Borough, now presented to the House, be read at the same time.

Privilege- Case of Nevill and Strowde.

Ordered, That Saturday next shall be a Sevennight be appointed, for this House to take into Consideration, and to determine, the Cause depending here before them, concerning Mr. Henry Nevill, one of the Members of this House, and Mr. Strowde, late Sheriff of the County of Berks.

Tiverton Election.

Mr. Knightley reports from the Committee for Elections and Privileges, the State of the Case, concerning the Election of Burgesses to serve in this present Parliament for the Borough of Tiverton in the County of Devon: That, upon the View of Two several Indentures, one of them under the Hand of the Mayor and the CommonSeal of the said Borough, together with twelve others of the Capital Burgesses and Assistants of the same Town; whereby Sir Coplestone Bampfield Baronet, and Francis Warner Alderman of London, are returned to serve for the said Borough: And the other, under the Hands and Seals of Thirteen others, said to be Capital Burgesses and Assistants of the said Borough; whereby the said Sir Coplestone Bampfield, and Robert Shapcott Esquire, are also returned to serve for the said Borough; together with the Opinion of the said Committee, upon the Examination of Witnesses, and hearing of Counsel on either Side, of what appeared to them: Namely,

That the said Francis Warner is duly elected and returned, and ought to sit in the House: And that the Indenture, by which Sir Copplestone Bampfield, and Robert Shapcott, are returned, ought to be taken off the File; and withdrawn; the said Sir Coppleston Bampfield being duly chosen, and returned by both the Indentures: And,

The Question being propounded, That this House doth agree with the Committee, That Francis Warner is duly elected and returned to serve as a Member in this present Parliament for the Borough of Tiverton in the County of Devon;

The Question was put, That this Question be now put;

And it passed with the Affirmative.

And the main Question being put; It was

Resolved, &c. That this House doth agree with the Committee, That Francis Warner is duly elected and returned to serve as a Member in this present Parliament for the Borough of Tiverton in the County of Devon.

Resolved, &c. That the Indenture, whereby Sir Copplestone Bampfield, and Robert Shapcott Esquire, are returned to serve for Burgesses in this present Parliament for this Borough of Tiverton in the County of Devon, be taken off from the File; and be withdrawn.

Scotch Members.

Resolved, &c. That the Matter of the Debate of this House, at their next Meeting, shall be concerning the Sitting of the Members returned for Scotland.
