Mercurii, 8 die Decembris, 1680.

JOHN Woder and John Oart did this Day take the Oaths of Allegiance and Supremacy at the Clerk's Table, in order to their Naturalization.

Woder's, &c. Nat.

Ordered, That the Names of the said John Woder and John Oart be inserted in the Bill of Naturalization.

Committees.

Ordered, That all Committees that are discontinued, be revived; and do sit this Afternoon, in the respective Places formerly appointed.

Taunton Election.

The House being informed, that Sir John Cutler, who is returned as One of the Burgesses to serve in this Parliament for the Borough of Taunton in the County of Somersett, is satisfied that he is not duly elected a Burgess to serve for the said Borough; and that his Counsel was attending at the Door, ready to acknowledge the same;

The Counsel for the said Sir John Cutler, as likewise the Counsel for Edward Prideaux Esquire, and the Counsel for the said Borough, being called in;

And the Counsel for the said Sir John Cutler admitting That Edmund Prideaux Esquire is duly elected a Burgess to serve for the said Borough;

Resolved, That Sir John Cutler is not duly elected a Burgess to serve in this present Parliament for the said Borough of Taunton.

Resolved, That Edmund Prideaux Esquire is duly elected a Burgess to serve in this present Parliament for the said Borough of Taunton.

The Clerk of the Crown being called in, amended the Return for Taunton, by rasing out the Name of Sir John Cutler; and inserting the Name of Edmund Prideaux Esquire, in the room thereof, in the Indenture.

Leave of Absence.

Ordered, That Mr. Bridstock Hartford, and Mr. John Booth, both Members of this House, have Leave to repair into the Country.

Call of the House.

Resolved, That this House be called over on the First Tuesday in January next: And that such Members as shall then make Default in attending the Service of the House, be sent for in Custody of the Serjeant at Arms.

Ordered, That Mr. Speaker be desired to send his Letters to the several Sheriffs of the respective Counties, and to the several Mayors, Bailiffs, and other proper Officers in the several Cities, Boroughs, Corporations, and Cinque Ports of this Kingdom; requiring them to give Notice to all such Members of this House that serve for such respective Places, as have absented themselves from the Service of this House without Leave, to attend the House within Ten Days after this Day.

Agmondesham Election.

Ordered, That the Chairman of the Committee of Elections and Privileges do report the Matter touching the Election for the Borough of Agmondesham in the County of Bucks, To-morrow Morning.

Address- Fine for a Misdemeanor.

Sir Trevor Williams reports from the Committee appointed to prepare an Address to his Majesty, desiring his Majesty to remit the Fine set upon Benjamin Harris, for which he continues in Prison, an Address agreed upon by the Committee: Which he read in his Place; and afterwards delivered the same in at the Clerk's Table: Where the same was read.

And some Exceptions being taken thereto;

Ordered, That the Address be re-committed to the same Committee: And that Sir John Trevor be added to the said Committee: Who are to proceed upon this Business at Three of the Clock this Afternoon.

Privilege- a person discharged.

A Petition of Sampson Birch, in Custody of the Serjeant at Arms attending this House, was read.

Ordered, That the said Sampson Birch be brought to the Bar; and do receive the Censure of this House, upon his Knees, from Mr. Speaker; and be then discharged, paying his Fees.

Which was done accordingly.

Eye Election

Sir Richard Corbett reports from the Committee of Elections and Privileges, to whom the Matter touching the Election and Return for the Borough of Eye in the County of Suffolk was referred; That the Committee, having taken the same into Consideration, had agreed upon Four Resolves: Which he read in his Place; and afterwards delivered the same in at the Clerk's Table: Where the same being read, are as followeth; viz.

Resolved, That Sir Charles Gaudy is not duly elected a Burgess to serve in this present Parliament for the Borough of Eye in the County of Suffolk.

Resolved, That Sir Robert Reeve is not duly elected a Burgess to serve in this present Parliament for the said Borough of Eye.

Resolved, That Charles Fox Esquire is duly elected a Burgess to serve in this present Parliament for the said Borough of Eye.

Resolved, That George Welsh Esquire is duly elected a Burgess to serve in this present Parliament for the said Borough of Eye.

The First of the said Resolves being read a Second time, to the House;

Resolved, That this House doth agree with the Committee, That Sir Charles Gaudy is not duly elected a Burgess to serve in this present Parliament for the said Borough of Eye.

The Second of the said Resolves being read a Second time;

Resolved, That this House doth agree with the Committee, That Sir Robert Reeve is duly elected a Burgess to serve in this present Parliament for the said Borough of Eye.

The Third of the said Resolves being read . . . . . ;

Resolved, That this House doth agree with the Committee, That Charles Fox Esquire is duly elected a Burgess to serve in this present Parliament for the said Borough of Eye.

The Fourth of the said Resolves being read a Second time;

Resolved, That this House doth agree with the Committee, That George Welsh Esquire is duly elected a Burgess to serve in this present Parliament for the said Borough of Eye.

Ordered, That the Clerk of the Crown do attend Tomorrow Morning, to amend the Return for the said Borough.

The House taking notice of several Abuses and Misdemeanors committed in the Borough and Corporation of Eye relating to Elections, and otherwise;

Ordered, That a Committee be appointed to examine into the said Abuses and Misdemeanors; and report the same, with their Opinions therein, to the House.

And it is referred to Sir Robert Carr, Sir John Moreton, Mr. Wright, Sir Rowland Guynn, Sir Roger Hill, Mr. Palmes, Mr. Mansell, Mr. Head, Mr. Colt, Sir William Yorke, Sir Gervase Elves, Sir John Newton, Sir John Hobbart, Lord Sherrard, Mr. Gray, Sir Peter Gleane, Sir William Bastard, Mr. Banks, Sir Joseph Tredenham, Sir Richard Temple; and all the Members that serve for the Counties of Norfolk and Suffolke; or any Five of them; And they are to meet at Three of the Clock this Afternoon, in the Speaker's Chamber: And they are impowered to send for Persons, Papers, and Records.

Ipswich Election.

Ordered, That Mr. Speaker do issue out his Warrant to the Clerk of the Crown to make out a new Writ, for the Election of a Burgess to serve in this present Parliament for the Borough of Ipswich in the County of Suffolk, in the room of Gilbert Lindfeild Esquire, deceased.

Privilege- a person discharged.

A Petition of Sir Thomas Whitgrave, in Custody of the Serjeant at Arms attending this House, was read.

Ordered, That the said Sir Thomas Whitgrave, be brought to the Bar; and do receive the Censure of this House, upon his Knees, from Mr. Speaker; and be then discharged, paying his Fees.

Which was done accordingly.

A Petition of John Hutchinson Esquire, in Custody of the Serjeant at Arms attending this House, was read.

Ordered, That the said Mr. Hutchinson be brought to the Bar; and do receive the Censure of this House, upon his Knees, from Mr. Speaker; and be then discharged, paying his Fees.

Mr. Vaughan, Clerk of the Peace for the County of Devon, was called in.

Ordered, That the said Mr. Vaughan be discharged from any further Attendance upon this House.

A Petition of Henry Walrond, in Custody of the Serjeant at Arms attending this House, was read.

Ordered, That the said Mr. Walrond have Time to appear at the Bar of this House to the Third Day of January next.

A Petition of Samuel Gibbs, late Mayor of Westbury in the County of Wilts, in Custody of the Serjeant at Arms, was read.

Ordered, That this Petition be taken into Consideration on Saturday Morning next, at Ten of the Clock.

Ordered, That William Tyler Esquire be sent for in Custody of the Serjeant at Arms attending this House, to answer, at the Bar, for a Breach of Privilege by him commited against this House.

Ordered, That the Consideration of this Petition, as also of the Matter of the Consideration, for which the said Richard Thompson stands committed, be referred to Colonel Birch, Sir John Moreton, Mr. White, Mr. Papillon, Mr. Upton, Sir Thomas Player, Mr. Pilkington, Sir William Bastard, Mr. Arnold, Sir Trevor Williams, Mr. Wandesford, Sir William Roberts, Sir John Hartup, Sir William Cooper, Sir Jonathan Keate, Mr. Duboys, Mr. Hamden, Sir Robert Clayton, Mr. Love, Mr. Trenchard, Serjeant Seys, Sir Henry Calverly, Sir Henry Foord, Sir Gilbert Gerald, or any Five of them, to examine the Matter thereof; and to report the same, with their Opinions therein, to the House: And they are to meet this Afternoon at Three of the Clock, in the Speaker's Chamber: And are impowered to send for Persons, Papers, and Records.
