19 January 1573–4.

Curia Capitalis post natale Domini.

The Heid Court, eftir Yule, of the burght and citie of Glasgw, haldin in the tolbuith thairof, be ane noble and michtie lord, Robert lord Boyde prouest, George Elphinstoun, Archibald Lyoun, and James Flemyng, baillies of the samyn, the xix daye of Januare, the yeir of God, jmvc lx threttene yeiris; the sutis callit; the court confermit; dempstare, James Speir.

The pointis of the heid court:— Scab.

James Andersone, millare, hes thre scabbit hors; Johne Gammyll hes ane; Thomas Scott hes ane; and Thomas Will hes ane scabbit hors. Quhilkis persones ar ordanit to be warnit to the nixt court to heir thame decernit to be handillit conforme to the auld statutis maid anent scab and fairsy, and to be sichtit be Archibald Muir and Thomas Watterston.

Lepir.

Marioun Gardiner, dochtir to Steyne Gardiner; Jonet Grhame, Jonet Steward, Robert (blank), fleschour. Quhilkis persounes ar dilatit as lepir, and ordanit to be viseit; and gif thai be fund sua, to be secludit of the toun to the hospitall at the Brigend.

Tailyoure, wrang.

The quhilk daye, Margaret Andro, spous to Johne Andersone, cordiner, is fund in the wrang and amerchiament of court, for trublance done be hir to Jonet Tailyour dochtir to James Tailyour, in stryking of hir and rugging furth of hir hair, vpone the hiegait of Glasgw, vpon Sondaye the viij daye of Januare instant, within the tyme callit of auld the proclamatioun of Yule girtht, and now of abstinence, and dwme gevin thairupone; and thairfor is decernit to mak the said Jonet ane amendis, be the sicht of tua nychtbouris; and William Andersone, maltman, is becumin cautioner for makyng of the said amendis.

The quhilk daye, Patrik Spreull, being persewit be Johne Boill, chepman, for trublance done be him, vpon the xi of Januare instant, within the tyme of the proclamatioun of feriat tyme and abstinence, in invadyng of him, and stryking of him with ane quhinger, and schutyng him on the wallis, throuch the quhilk the said Johnes neis wes voundit to the effusioun of his blude; grantit the premissis, and become in the prouest and baillies willis thairfore.

Johnesoun, lawsouerteis.

The quhilk daye, comperit Felane Johnesoun and maid fayth that he dred Johne Campbell, burges of Glasgw, of bodely harme, and desyrit lawsouertie, quhom for Dauid Howe, litster, become cautiouner that the said Felane suld be skathles of bodely harme of the said Johne and all that he may lett, vnder the panes contenit in actis of Parliament; and siclik, the said Johne maid fayth that he dred the said Felane of bodely harme, desyring souertie in likmaner, quha fand Williame Andersoun, cowper, lawsouertie that the said Johne suld be skaythles of bodelie harme of him and all that he may lett, vnder the said panes.

Johne Craufurd, tailyoure, is decernit, the allegatiounes of parteis being hard, to content and paye to Isabell Robesoun xvj s. restand for the fostering of ane barne, within xv dayis, with viij d. of expensis.

26 January 1573–4.

Alexander Scott, baxter, is fund in the wrang and amerchiament of court for stopping of George Young, dekyn, fra entering in his buyth to exerce the statute anentis the weying of his breid; and als Williame Neilsoun is fund in the wrang in likmaner for iniuryng of the said George his dekyn; and the said George is fund in the wrang for stryking of the said Williame Neilsoun; and als Williame Andersone and Thomas Glen ar fund in the wrang for baiking and haveing insufficient breid, contrar the statutis of the towne; and dwme gevin heirupon.

Thomas Browne, tailyour, is maid burges and freman of the burght and citie of Glasgw, and hes gevin his ayth of fidelite to the towne, quhais fynes wes remittit to him gratis at the requeist of maister Andro Haye, persone of Renfrew and commissionare of the kirk in west pairtis.

The baillies ordanis Dauid Lyoun to repair and big the dykis of ane yarde amang the new kirk yardis, and keip nychtbourheid to James Reid his nerrest nychtboure thairof.

William Browne is fund in the wrang and amerchiament of court for trublance done be him to Bartilmo Symsone in manassyng him and invading him with ane drawin quhynger vpone the hiegait, vpone Sondaye last, and dwme gevin thairupon.

Anent the mater movit be Michael Barde, commone procuratour, aganis Margaret Grhame, relict of vmquhill Matho Heriot, for non delyuering of the hewcht irne chenyeis had in keping of the toun be hir and hir said spous, the said Margaret allegit John Fowlar hir warrand, and desyrit ane terme to call him, quhilk wes grantit and assignit thairto the v of Merche nixt, partibus citatis.

Thir persones vnderwrittin, viz., Johne Reid, James Frebarne, Johne Clwne, Andro Carmychell, James Bar, Niniane Syare, Thomas Syar, youngar, and Michael Gurlaw, ar fund in the wrang and amerchiament of court, for contravenyng of the statutis of the toun and disobeying of the watter baillie, in perforce at thair awin handis taking of killyng furth of the boytis, and dwme gevin thairon.

Margaret Alderstoun, spous to James Anderson is fund in the wrang and amerchiament of court, for trublans done be hir to Jonet Legat and Margaret Mwling, in stryking of thame with ane staff and hir neifis, vpone the ferd of Merche instant, and chasyng of thame diuers tymes, and dwme gevin thairupon.

Roger—Rankene, Granger, wrangis.

Johne Roger, fischer, is fund in the wrang and amerchiament of court, for contrauenyng of the statutis, in nocht presentyng of his salmond to the mercat and sellyng of the samyn in houssis, nocht beyng presentit to the mercat; and als Alexander Rankene and Patrick Graynger ar fund in the wrang for foirstalling of the mercat in bying of salmont within houssis in greit, or thai wer presentit to the mercat, and dwme gevin heirupone.

Johne Blakwod is fund in the wrang and amerchiament of court, for delvyng doun of the erd besyde St. Tenewis Woll, quhilk is commown, purposyng to appropriat the samyn to himself, and dwme gevin heirupon.

William Andersone, youngar, maltman, is fund in the wrang and amerchiament of court for stryking of Marione Graye, and the said Marione is lywkys fund in the wrang for iniuring and blasphemyng the said William be wordis, and dwme gevin thairon.

Jak.

James Andersoune, millare, is decernit and ordanit to content and paye to maister Thomas Jak the sowme of xviij merkis money for the few male of the place in Drygate of the termes of Witsoundaye and Mertimes in the lxxiij yeir, and that becaus the said James failyeit in prevyng of payment of the samyn, it beying referrit to his probatioun to this daye and comperit nocht, within xv dayis nixt.

26 March 1574.

William Glen, sone to Johne Glen, is fund in the wrang for casting of ane stane at Robert Rank and hitting him thairwith abone the ey to the effusione of his blude; and als Johne Glen, youngar, and Johne Glen, brethir to the said William, ar fund in the wrang for stryking of the said Robert and casting him doun violentlie to the erd; and als Laurens Hoge for trublans done to Johne Glen, youngar, in thrawing of his neis, and invadyng of the said Laurens with ane drawin quhinger, eftir the first tumult cesyng; and als George Layng for invadyng of Johne Glen with ane drawin suord; and dwme gevin thairon respectiue.

The baillies and counsale ordanis Thomas Craig to be callit for removyng of the gallows furth of the Loyne sett be him at his awin hand. And ordanis and deputis thir persones underwrittin to visie the lonys, that the samyn be nocht diminisit, viz., the baillies, William Conyghame, Johne Wilsoun, William Watt, Johne Flemyng, and Michael Barde. And als ordanit the inhabitantis of the baronie to be warnit to bryng in thair furlotis and mesouris to be justit and selit.

2 April 1574.

The quhilk daye, Thomas Craig, cordiner, is fund in the wrang for non-comperance; and als for the transportyng of the gallows at his awin hand furtht of the auld accustomat place sa neir hand the towne; and is ordanit to repone the samyn agane.

6 April 1574.

Statutum.

The quhilk daye, the baillies and counsale depute for modificatione of the entre siluer of the buythis vnder the tolbuyth, all in ane voce declarit, modifeit, and decernit ilk buyth to paye of entres siluer for ane lyferent tak, to the thesaurare xxti lib., quhilk salbe bestowit vpone the mendyng and reparyng of the tolbuyth and to na vther vse.

7 April 1574.

The quhilk daye, Margaret Hammiltoun is fund in the wrang for casting of stanes at Jonet Cowane and chasyng and manassyng of hir, on the ferd of Aprile instant, and als the said Margaret, and Robert Browne and Jonet Broun hir barnys, in the wrang in stryking and rugging of the said Jonet Cowanes hair and castyng her to the erd; and siclik, the said Margaret Hammiltoun in the wrang for invadyng of Jonet Moresone, spous to Johne Browne, and casting stanes at hir, and als for blaspheming be iniurious wordis and sclander the saidis spoussis, and dwme gevin thairon.

Statutum, Blackfreir kirk.; New kirk.

The quhilk daye, it is statute, thocht gude and ordanit, be the prouest, baillies and counsale, that the westir ruinous gavill of the Blackfreir kirk and the stanes thairof be tane doun, and be the skellat precedyng rowpit and sauld to the maist avale, and the price thairof conuertit and applying to the mendyng of the wyndois and ministeris sait in the said kirk; and to that effect appointit for performyng thairof thir persones, viz., Johne Wilsone, William Watt, William Strutheris, with ane baillie. Als thai ordanit the commoun procuratour to persew for the siluer work of the new kirk, Margaret Rankyn.

Comperit William Maxuell, merchand, in name of the merchandis, and sax dekynnis of craftis in name of the haill craftis and haill communite, and disassentit fra the geving furth or delyng of ony pairt of the commone muris to James Boyde, or to ony wtheris mair nor is ellis delt,and protestit that the partis thairof ellis delt and gevin furtht, by thair consentis in tymes bigane, suld nocht prejuge tham, bot that thai may have tym and place for recallyng and remeid thairof.

Bogill, Patersoun.

The baillies ordanis ane coit of mailye and ane hatt, laid in wod be Jonet Pattersoun, spous to Gilbert Scherinlaw, to Marione Henwell, spous to Thomas Bogill, vpone the sowme of xxxviij s. iiij d. money, to be rowpit be the officeris and thame to paye the said sowme to hir, and the rest to the said Jonet; and that becaus the said Jonet being thrys warnit to compeir and lows the samyn, be payment of the said sowme, or ellis to heir it rowpit, comperit nocht nor schew na caus in the contrar, with iij s. of expensis.

Wynzet.

Petir Lymburnare is becumin actit of his awin propir confessioun, as cautioner for Sir Johne Masoun, for vphalding of ane tenement at the Graye freir wynd pretening heritablie to Johne Wynzett, in lyk estaite as is now at the deceis of Jonet Masoun, moder to the said Johne, conforme to the sichting thairof maid be the lyneris of the towne; and Johne Steward of Bowhous is decernit to relief and keip skaithles the said Petir of the premissis.

Anent the mater movit be Archibald Stene, as factour and commissionare for James Blakburne, aganis Johne [Steyne] cordiner, for nocht delyuerance of ane pair walker scheris beyng in his handis, pertenyng to vmquhill Archibald Blakburne, and now to the said James as ane part of his movable airschip guddis contenit in bill; the said Johne comperand, nocht grantand the premissis, allegit that the scheris can nocht be airschip, as nocht vsit be the deid, bot ar ane part of his movable guddis; thairto answerit the said Archibald, that insafer as thai wer sett in hyring thai aucht to be airschip guddis; and to avise heirwith the baillies assignit the xiiij daye of Maij instant, partibus citatis.

Baxtare, wrang.

Williame Kyle is fund in the wrang for the taking and intrometting with at his awin hand, but ordour, ane kow gevin be him at Alhallovmeslast to Jonet Baxtare as tyde for the first calf and milk and being in hir possessione sensyne, and thairfore is decernit to delyuer to hir ane tyde kow, and to satisfe hir for the proffett of calf and milk thairof incontinent, and dwme gevin thairupon.

Eduard Pollok, skynner, is maid burges and freman of the burght and citie of Glasgu, and hes gevin his aitht of fidelite to the toun; quhais fynes wes gevin be the baillies and counsale be thair rolmont to Johne Moresone, in satisfactione of his hors tane fra him the tym of the truble, and for releving of travellouris hors tane be him thairfor lowsit be him at the townes requeist.

The quhilk daye, Archibald Legate, cordiner, is maid burges and freman of the burght and citie of Glasgu, and hes gevin his aith of fidelite to the towne; quhais fynes wes gevin be the baillies, counsale and dekynnis to George Burell, merchand, for his support, to releve his pouertie in tyneyng of his pack be the sey.

18 May 1574.

Marteyne, Dunlop, wrangis.

Jonet Dunlop is fund in the wrang for trublance done be hir to Agnes Martene, in castyng of dirt at hir wyndo and fyling hir stuff sett thair, viz., breid, cheis and buttir; and als the said Agnes is fund in the wrang for castyng furth of wesche at the said Jonet, and dwme gevin.

Anent the actioun persewit be the baillies aganis Johne Caulduell, custumer, for non payment of xiij s. yerly as pertenyng to tham; as ane dewite of the trone vsit and wont, the said Johne denyit the vse, and for previnge thairof the xxix of Maij is assignit.

Chalmerlane, Boyde, troyne.

Comperit James Boyde, chalmerlane of Glasgw, and Matho Boyde, takisman to my Lord Archbischop of Glasgw of the troyne, and requirit the baillies to caus Johne Caulduell, personaly present, to deliuer to himthe mettis, mesouris, and wechtis of the trone; comperit the said Johne and desyrit the copie of the clame; allegit the persewaris, that he aucht to have na copie, becaus the actioun is commone and aucht nocht to have delaye; thaireftir the said Johne wes content to delyuer sa mony wechtis, weyis, balkis, and messouris, as he ressauit fra Robert Millar his predecessour; the chalmerlane and takisman acceptis the confessione, and desyris the baillies decreit, accordyng to the confessioun; the baillies continewit thair pronunciatioun to the xxix of Maij instant, partibus citatis.

Crawfurd, Conynghame.

The thre baillies and ane parte of the counsale past to vise and decyde the questione of lyneyng and nychtbourheid betuix Thomas Crawfurd of Jurdanhill, fewar of the persone of Glasgwis mans, on that ane part, and maister Dauid Conyghame, fewar of the subdeynes mans, on that wther part; and eftir the sichting thairof, with consent of bayth the saidis parteis, ordanis the said Thomas to big wp the pece mantale wall wpone the said maister Dauidis ground, and the samyn wall witht the ground to appertene to the said maister Dauid in tymes cumyng, the said maister Dauid fyndand stanes thairto; and that the said Thomas stank to be maid rys na hichtar nor the said maister Dauidis seller flure, quhairthrocht the said maister Dauidis tenement and houssis be nocht damnefeit be the watter or wtherwyis in tymis cumyng, and the droppis and eismentis that the said maister Dauidis hous had of before, to be reserwit and kepit intymes cuming; and als ordanis the commone synk to haue fre passage, for the commone wele of the haill towne, as passit of befoir; and ordanis the said maister Dauid to tak awaye the erd abone the mantle wall; and als thai fynd the castyng of the stank be the said Thomas on na wyis to be hurtfull to the dounfallyng of the said maister Dauidis turnepyk.

Item, it is statute and ordanit that gif ony maltman sellis his malt to vnfre persones within the burght he sall nocht have to persew the samyn befoir nowther provest nor baillies.

The prouest, baillies and counsale, vnderstandand the contagious seiknes callit the pest to be newlie rissin within this realme, and for awaye halding and preseruation of this gud town thairfra, hes witht ane consent diuisit and maid thir statutis and ordinances eftirwrittin. In the first, it is statute and expreslie inhibit and forbiddin that na maner of persones, induellaris or that cumis furtht of Leyth, Kirkcaldy, Dysart, Brwnteland, quhilkis ar ellis infectit and suspect of the said pest, nor yit of ony wther townes or placeis that heireftir sall be suspect or fylit, presume to resort and trawell to this town, or vse trafficque witht the inhabitantis thairof; and that nane of the inhabitantis of this town trawell towart ony of the saidis placeis or vse ony kynd trafficque witht thame, vnder the pain of deid.

Edinburght.

Item, becaus that Edinburght as yit is nocht suspect of the said pest, except Bellis Wynd, thairfor it is statute and ordanit that na persone inhabitant of this toun to pas to Edinburght without ane testimonial, and that thai report ane fra the baillies of Edinburght that thai haue nocht hantit nor trafficque with suspect persones; and that nane be resauit furtht of Edinburght or wther vnsuspect place but ane sufficient testimoniall specifeand quhairfra thai cum, vnder the pane of ten pundis; and gif ony inhabitantis of this toun trauellis to ony suspect place and bringis hame ony merchandis or wairis quhairthrow ony infectioun salhappin to cum in this toun, thai nocht reportand ane sufficient testimoniall as said is, the saidis persones bringand the said infectioun to suffer the deid, and thair guddis to fall in eschete alsua.

Item, it is statute and ordanit that na maner of persones induellaris in this towne ressait in their houssis ony maner stranger reparand thairto, except that thai cum first to the prouest and baillies, or thair deputtis, and present thair testimoniales, that it maye be knawin quhairfra thai come; and that nane within this towne ressaue ony persone that cumis about the toune or att thair backyardis; and that na induellar of this toune entir bot at the portis and foirgate, vnder the pane of x lib. ilk falt, and that ilk persone clois his awne yard end, as he will ansuer on his lyf; and gif ony beis apprehendit cumand about the toune, the samyn to be tane and presonit and handilit as suspect persoun.

Item, that na persone duelland outwitht the portis resaue ony persone stranger in lugeing, but licence of the prouest and baillies, vnder the pane of x lib., nor na guddis debarrit at the portis.
