Hicks's Hall |
Free pardon. |
The prisoner had rooms in St. James's Palace, where he daily resided to execute an office relating to the Band of Pensioners, and had coals delivered to him to burn in these rooms, but not to sell nor purloin. He lodged at a Mrs. Neal's, who used often to come to the office and carry off coals in baskets to her own house. Continuing to do this after being reprimanded by Mr. Secker, she was carried before Sir John Fielding, where, though at first she took it wholly on herself, on further examination she owned that it was with Mr. Walker's consent that she took away the coals for his and her use in their apartments at her house. This Mr. Walker acknowledged to be true; towhich he added, "he thought it was no crime, as it had been done in a former reign." On account of his previous character the udge recommended him to mercy. |

Not a proper object of mercy. The things stolen were above the value of 40s., which made it a capital offence; but, under the circumstances, and the goods being of such a nature as to leave it in the power of the jury to set a value on them, on the recommendation of the judge, they found them of the value of 39s., which saved the prisoner's life. Annexed is the prisoner's petition. |

The prosecutrix made every effort to save the prisoner's life, going 30 miles to Baron Smythe's house in Kent to renew her entreaties. In a letter to him, annexed, she says that if the prisoner should suffer death on her account, the terrors of her mind would be in-expressible. There is also annexed a letter from the judge, enclosing his report, and a recommendation to mercy from the foreman and two of the jury. |

The prosecution was a favourable one, the offence, strictly speaking, being capital. The evidence was very clear, and the Court, out of compassion and to prevent them from further mischief, ordered her and her companion to be transported, it not appearing probable that they would get free from their bad connections. In other respects she certainly deserves mercy. |
