New York.

The Earl of Hillsborough being present, signified to the Board, that his Majesty had approved of the Earl of Dunmore to be Governor of New York in the room of Sir Henry Moore, deceased, and that it was his Majesty's pleasure, that this Board should prepare and lay before his Majesty in Council, draughts of a Commission and of such instructions as it might be proper to give his Lordship on that occasion.

Ordered, that the draught of a Commission be accordingly prepared with all convenient dispatch.

Newfoundland.

fo. 184.

Read an order of the King in Council, dated May 3rd, 1769, approving a report of the Lords of the Committee of Council on a representation of this Board, and the draughts of a Commission and instructions for the Governor of Newfoundland; and directing the Board to prepare and lay before a Committee of Council (so as to be ready for the consideration of Parliament at the next session) a plan for the better regulating the government, and encouraging the fishery of Newfoundland.

Their lordships took the subject matter of the said reference into consideration, and made some progress therein.

Trade.

Read a letter from Dr. McBride to the Secretary, dated Dublin, November 23rd, 1769, in answer to one from him of the 17th of said month, relative to his method of tanning leather.

It appearing that Dr. McBride expressed a wish of having his secret art of tanning tryed, if the Board desired it, the Secretary was ordered to write again to him to explain to him, that it was not for their lordships, as a Board, to have any desire in respect to this business one way or the other, but that they would direct the experiment to be made if he desired it, for that his own wish and inclination to submit his secret to trial must be the foundation of the first step to be taken.

Proprieties.

Read a petition of Mr. Life to the Board, praying that copies may be made for him of the reports of two of the Commissioners appointed to determine on the case of the Moheagan Indians.

Ordered, that Mr. Life have copies of the papers referred to in his petition.

New York.

Read a report of his Majesty's Attorney and Solicitor General, dated December 4th, 1769, on a Bill passed by the Council and Assembly of New York for emitting one hundred thousand pounds in paper bills of credit, &c.

Their lordships took the said report, together with the Bill, into consideration, and Mr. Charles, agent for the Assembly of New York, attending, was called in, and being made acquainted with the opinion reported by the Attorney and Solicitor General, he moved their lordships that, as the question of law was left by that report upon a doubtful ground, they would be pleased (if they thought fit to report that point, specially) to state in their report the arguments urged by the late Governor and present Lieutenant Governor in favour of the Bill, on the ground of necessity.

Mr. Charles being withdrawn, it was ordered, that the draught of a report to the Lords of the Committee of Council should be prepared, in consequence of their order of reference of the 10th of November last.

The draught of a representation to his Majesty in Council, proposing the confirmation of two private Acts passed in the colony of New York, having been prepared pursuant to order on the 24th of last month, was approved, transcribed and signed.

The draught of a Commission appointing the Earl of Dunmore to be Governor of New York, having been prepared pursuant to order on the 1st instant, was approved; and a representation to his Majesty thereupon was signed.

West Florida.

The Secretary laid before the Board a memorial, prepared by the agent for West Florida, to be presented to the Lords Commissioners of the Treasury, praying their directions in respect to certain demands relative to the service of that colony; whereupon their lordships thought fit that it should be certified to the Lords Commissioners of the Treasury that, though they did not see any objection to its being presented to that Board, for their consideration, yet they did not mean thereby to convey any approbation or opinion with respect to its contents, which appeared to be of a very particular and extraordinary nature.

East Florida.

Read an order of the Lords of the Committee of Council for Plantation Affairs, dated November 20th, 1769, referring to this Board, for their consideration and report, the petition of John Todd, mariner, William Stratton, merchant, and John Eagle, Esquire, praying the King to grant to each of them ten thousand acres of land in the province of East Florida, or any other colony.

Messieurs Todd and Stratton, two of the persons subscribing the above mentioned petition, attended and were heard thereupon; but it not appearing to their lordships, that they were of ability to carry the settlement of the lands into effect, nor having any thing particular to propose, that might induce a deviation from the ordinary method of granting lands by the Governor and Council upon the spot, the further consideration of the said order of reference was postponed.

New Jersey.

The Earl of Hillsborough, by his Majesty's command, communicated to the Board of Trade a letter to his Lordship from the Governor of New Jersey, advising him of the death of Mr. Ashfield, one of the Council of the said colony, which being taken into consideration, together with the names of the persons recommended to supply vacancies, it was ordered, that the draught of a representation to his Majesty should be prepared, proposing that Stephen Skinner, Esquire, may be appointed to supply the vacancy occasioned by the death of Mr. Ashfield.

New York.

The Earl of Hillsborough, one of his Majesty's principal Secre taries of State, being present, their lordships resumed the consideration of the Journals of the Assembly of New York in their last session of Assembly, and after deliberation, it was ordered, that the draught of a representation to his Majesty in Council upon several parts of the said proceedings should be prepared.

New Jersey.

The draught of a representation to his Majesty, recommending that Mr. Skinner may be appointed of the Council of New Jersey, in the room of Mr. Ashfield, having been prepared pursuant to order, was approved and signed.

New York.

The draught of a report to the Lords of the Committee of Council upon the petition of the Assembly of New York by their agent relative, to the Bill for emitting one hundred and twenty thousand pounds in bills of credit, having been prepared pursuant to order, was read and approved.

Grenada, Dominica.

Read an order of the Lords of the Committee of Council for Plantation Affairs, dated November 20th, 1769, referring to this Board, for their consideration and report, the memorial of Sir George Colebrooke and others to the King, praying that the island of Dominica may be erected into a distinct government, independent of Grenada.

Ordered, that the draught of a report thereupon to the Lords of the Committee of Council be prepared [vide minutes of January 12th, 1770].

Virginia.

Read two orders of the Lords of the Committee of Council for Plantation Affairs, dated November 20th, 1769, referring to this Board, for their consideration and report, the petition of Thomas Walpole and others, praying the King to grant to them two millions four hundred thousand acres of land, and of Nathaniel Falconer and others, praying for a grant of two hundred thousand acres of land, lying on the back of Virginia.

Their lordships agreed to take the said orders of reference into consideration on this day se'nnight, and the Secretary was ordered to give notice thereof to the parties interested therein.

After some consideration of the several papers above mentioned, it was agreed to take them into further consideration on Thursday, the 21st instant, and it was ordered, that notice should be given to the Committee of the Company of Merchants trading to Africa to attend.

South Carolina.

The Secretary acquainted the Board, that, he was desired by Mr. Moore, one of the Council of South Carolina, to signify to their lordships his resignation of the office of one of his Majesty's Council for the province of South Carolina, in consequence of his having been removed from his office of Collector of the Customs in that colony.

Their lordships took into consideration several laws passed in the colony of Nova Scotia in the years 1768 and 1769, the titles of which are as follows, vizt.
An Act for taking special bails in the country upon actions depending in his Majesty's Supreme Court of this province.
An Act for discharging the penalties and forfeitures in bonds, contracts and agreements on payment and satisfaction of the principal sum and damages due upon the same.
An Act for enabling the sale of goods distrained for rent.
Nova Scotia.

An Act for the convenient and speedy assignment of dower.
An Act in addition to, and further amendment of an Act made in the 32nd year of his late Majesty's reign, intituled, 'an Act relating to treasons and felonies'.
An Act for giving like remedy upon promissory notes as is now used upon bills of exchange.

An Act for the rating and levying of the charges for conveying malefactors and offenders to the goal.
An Act for suppressing unlicensed houses, and for granting to his Majesty a duty on persons hereafter to be licensed.

An Act in amendment of an Act made and passed in the 7th year of his Majesty's reign, intituled. 'an Act for partition of lands in coparcenary, jointenancy and tenancy in common, and thereby for the more effectual collecting his Majesty's quitrents in the colony of Nova Scotia'.

The said laws appearing to be of great importance, and to require consideration in point of law, it was ordered, that they should lye by. until his Majesty should think fit to direct to which of his Counsel at Law the business of this office, requiring such consideration, should be referred.

West Florida.

The Earl of Hillsborough, one of his Majesty's principal Secretaries of State, being present, his Lordship signified to the Board, that his Majesty had been pleased to approve of Peter Chester, Esquire, to be Governor of West Florida, and that it was his Majesty's pleasure, that this Board should prepare the draughts of a proper Commission and instructions with all convenient dispatch; whereupon it was ordered, that such draughts should be accordingly prepared.

New York.

The draught of a report to the Lords of the Committee of Council upon the petition of the Assembly of New York, on the subject of the Bill for emitting one hundred and twenty thousand pounds in paper bills of credit, having been transcribed pursuant to order, was signed.

The draught of a representation to his Majesty on certain proceedings of the Assembly of New York in their last session, having been prepared pursuant to order, was approved and ordered to be transcribed.

Virginia.

Their lordships, pursuant to their resolution on the 13th instant, took into consideration the petitions of sundry members of Parliament and others for grants of lands in the country lately ceded to his Majesty by the Indians, and several of the principal persons interested in that petition, which relates to a grant of two millions four hundred thousand acres, attending, they were called in, and, having been desired to explain to the Board, more particularly than is set forth in their petition, the nature of their proposals, their plan of settlement, and in what part of the country they desired to have the grant petitioned for. they stated, that, as the ground of their application was a proposal to purchase the lands of the Crown, they wished, before they entered into any such particular explanation, to know, whether the Crown would or would not be disposed to consent to such purchase.

It appearing to the Board, that this was a matter for the determination of the Lords of the Treasury, it was proposed, in order to save the gentlemen the time and trouble of multiplied references, to take immediately the sense of the Treasury upon that proposition, and the gentlemen being withdrawn, the Board was adjourned for a short time.

The Board being after some time resumed, the gentlemen were again called in and acquainted, that, upon application to the Treasury Board, now sitting, their lordships had declared, that, as to the political part of the consideration respecting this application, they considered it as belonging to this Board, but that as to the purchase of lands in the country ceded to the Indians, their lordships had no doubt about advising his Majesty to consent to any reasonable proposition for that purpose.

Upon this ground it was recommended to the gentlemen to lay their proposals of purchase before the Lords Commissioners of the Treasury, after which the political part would remain for the consideration of this Board, upon such explanatory proposition, as they should think fit to offer, respecting the object and advantages of the settlement proposed, or the utility of having a government in that part of the country, either by Charter or other ways, in case that should be thought advisable, and the same could be done, consistent with the rights of others.

No persons appearing to answer to the petition of Falconer and others, it was ordered, that the same should lye by for consideration, when the parties interested therein should make application for that purpose.

Trade, Africa.

Their lordships, pursuant to their resolution on the 15th instant, took into consideration the several papers relative to our commerce and interests on the coast of Africa, mentioned in the minutes of that day, and several of the Committee of the Company of Merchants attending as desired, they were called in, and their lordships stated to them the steps which had been taken by this Board respecting the two matters contained in their memorial, vizt.

Trade, Africa.

The refusal of the officers of the Dutch West India Company to allow a free passage to Cape Appolonia, and their obstructing the Portuguese vessels in their commerce with the British forts and factorys.

fo. 302.

Their lordships also acquainted them with the negotiation which had been opened with the States General on the subject of the last head of complaint, and the ground on which the Dutch West India Company endeavoured to support their pretensions.

Upon this occasion reference was had to a treaty made in 1707, and since enlarged and confirmed between the Royal African Company of England and the Dutch West India Company, respecting this matter, the particulars of which treaty were read and explained to the Committee, and they were asked whether, if the affair of the Portuguese vessels could be re-established upon the basis of that treaty, it would be for the interest of the trade in its present situation, they said, they apprehended it would, but desired further time to consider thereof, and then they withdrew.

Proprieties, Pennsylvania.

A draught of the instructions for the observance of the laws of trade, usually given to the Proprietaries of Pennsylvania, upon the King's approbation of their Deputy Governor, having been prepared pursuant to order of the 17th ultimo, was approved, and a representation to his Majesty thereupon was signed.

West Florida.

A draught of a Commission, appointing Peter Chester, Esquire, Governor of West Florida, having been prepared pursuant to to order, was approved, and a representation to his Majesty thereupon was signed.

Plantations General.

A draught of a representation to his Majesty, recommending that the Superintendent for Indian affairs in the Southern district may be appointed an extra member of the Council in each colony within his district, under certain limitations, having been prepared pursuant to order, was approved and signed.

Read an order of the King in Council, dated November 29th, 1769, approving the report of the Lords of the Committee of Council for Plantation Affairs on Captain Carver's case, and declaring his intention to bestow his bounty on him, provided he delivers up to this Board all maps, charts. plans, discoveries and observations made during the expedition mentioned in his petition; and directing the Lords of the Treasury to give proper directions therein.

The Secretary having presented to the Board certain journals and charts, delivered to him by Captain Carver, and which Captain Carver declared to be all that were taken and delineated by him of his discoveries, it was ordered, that the Secretary should certify to the Lords Commissioners of the Treasury the delivery thereof, pursuant to the said order.
