Turner versus Henly.

Upon reading the Petition of Gawen Turner Esquire, and Anne his Wife; praying, "That a Day may be appointed, to hear Counsel, upon their Appeal depending in this House, to which Sir Robert Henley hath put in his Answer:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear Counsel at the Bar, upon the said Appeal and Answer, on Wednesday the First Day of December next, at Nine of the Clock in the Forenoon; whereof the Petitioners are to cause timely Notice to be given to the said Sir Robert Henley for that Purpose.

Order for sitting in the Forenoons only, and hearing Appeals.

ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will sit only in the Forenoons for Ten Days, and not in the Afternoons; and that all the Causes upon Appeals be heard in the Forenoons, in the same Course as they now stand.

Bampfield versus Vaughan.

Upon reading the Petition of Warwick Bampfield Esquire; praying, "That a Day may be appointed, to hear Counsel, upon his Appeal depending in this House, to which Hugh Vaughan hath put in his Answer:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear Counsel at the Bar, upon the said Appeal and Answer, on Thursday the Second Day of December next, at Nine of the Clock in the Forenoon; whereof the said Warwick Bampfield is to cause timely Notice to be given to the said Hugh Vaughan for that Purpose.

The Duke of Monmouth, Lord Lovelace, and Lord Herbert, are added to the Committee for the Bill to be prepared for the Association.

The Archbishop of Cant. the Bishop of Peterborough, and the Bishop of Chester, are added to the Committee about Dissenters.

The Bishop of Winton and the Bishop of Hereford were excused for their Absence.

Att. General, Leave to go to H. C.

Mr. Attorney General, desiring this Morning to go to the House of Commons, desired Leave of this House so to do.

Which this House gave him Leave to do, for this Morning only.

E. Strafford excused.

This Day Thomas Verney and Nicholas Eberson, upon Oath, at the Bar, testified, "That the Earl of Strafford is so ill, as he is not able to attend this House."

The House hereupon excused the Earl of Strafford.

Sir E. Turner versus Ly. Turner.

The House being moved, on the Behalf of Sir Edward Turner and Anne Gardiner Widow, "That the Recognizance by him or them entered into, in the Court of Chancery, for Performance of a Decree of that Court made on the Behalf of Dame Mary Turner, from which they have appealed to this House, may be vacated; forasmuch as the said Decree, upon hearing Counsel on both Parts, is reversed by this House:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Recognizance entered into by the said Sir Edward Turner and Anne Gardiner, or either of them, as aforesaid, be, and is hereby, vacated, and made null and void.

Grosvenor. versus Cartwright.

Upon reading the Petition of Fulke Grosevenour and others; praying, "That a Day may be appointed, to hear Counsel, upon his Appeal depending in this House, to which Ursula Cartwright and her Children have put in their Answer:"

It is thereupon ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear Counsel, at the Bar, upon the said Appeal and Answer, on Friday the Tenth of December next, at Nine of the Clock in the Forenoon; whereof the Petitioners are to cause timely Notice to be given to the said Ursula Cartwright and her Children for that Purpose: And it is further ORDERED, That the said Fulke Grosevenor shall, within Three Days after the Date of this Order, enter into Security, by Recognizance to His Majesty, in this House, for Payment of Costs, in case the Decree from which he hath appealed be not reversed by this House.

Harris's Complaint of an exorbitant Fine imposed by the Court of King's Bench.

A Petition of Benjamin Harris Stationer, was read; complaining, "That, for causing a Book to be printed, he hath been fined, by the Judges in the Court of King's Bench, in the Sum of Five Hundred Pounds, and lies in Prison for the Payment thereof; which tends to his utter Ruin."

Committee to consider of Fines on Delinquents.

Lords Committees appointed to consider of the Fines lately imposed on Delinquents, and whether the said Fines have been regularly imposed according to Law, and in particular in the Case of Benjamin Harris Citizen and Stationer of London, now a Prisoner in The King's Bench, and to make Report to this House:

Adye versus Eversden & al.

Upon reading the Petition of John Adye Esquire, being an Appeal from a Decree made in the Court of Exchequer, on the Behalf of Edmond Eversden, concerning the Redemption of a House and Land in Kent, mortgaged by one Thomas Brett to the Petitioner's Father, and after purchased of the said Thomas Brett by the Petitioner, who enjoyed the same from 1667 till 1677, and other Matters in the said Appeal suggested; and praying, that the said Edmond Eversden, and Martha Brett Widow of the said Thomas Brett, may put in their Answers thereunto:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Edmond Eversden and Martha Brett be, and are hereby, required to put in their Answer, or several Answers, in Writing, to the said Appeal, on Tuesday the 14th of December next, at Ten of the Clock in the Forenoon; whereof the said John Adye is to cause timely Notice to be given to the said Edmond Eversden and Martha Brett for that Purpose.

Bill for an Association.

ORDERED, That Mr. Attorney and Mr. Solicitor are to assist the Judges, in drawing the Bill for an Association.
