E. Maclesfeld and E. Sussex, concerning Leave to apply to H. C.

The Earl of Rochester reported from the Committee for Privileges, "That they have considered the Order referred unto them Yesterday, concerning the Earl of Maclesfeld and the Earl of Sussex; and the Committee are of Opinion, That the Lords shall have Liberty to make their Application to the House of Commons in their own Concerns."

Upon Consideration hereof, the House thought fit, not to make any Order in this Business.

Message from thence, for a Free Conference on the Succession Bill.

A Message was brought from the House of Commons, by the Lord Viscount Colchester and others:

To desire a Free Conference, concerning the Amendments delivered at the last Conference on the Bill for settling the Succession of the Crown.

The Answer returned was:

Answer.

That this House agrees to a Free Conference; and appoints the same to be To-morrow, at Twelve of the Clock, in the Painted Chamber.

The same Lords that managed the former Conserence are to manage this Free Conference.

Lords to inspect the Minutes Books concerning Ireland.

ORDERED, That the Committee appointed, on the 15th of June last, to look into the Miscarriages of Ireland be, and is hereby, revived; and that they do meet To-morrow, at Nine of the Clock in the Forenoon, in the Prince's Lodgings; and have hereby Power given them to name a Sub-committee, to inspect the Minute Books of the Committee of Council for the Affairs of Ireland; and to report to the House.

Wiseman versus Terry, in Error.

Whereas, by virtue of Their Majesties Writ of Error, returnable in the House of Peers in Parliament assembled, a Record of the Court of King's Bench was brought into this House, on the Sixth Day of July Instant, with the Transcript thereof, wherein Judgement is entered for Stephen Terry, against Sir Richard Wiseman of Terrells Hall in the County of Essex Knight, upon which Errors were assigned and Issue joined, and this Day Counsel heard at the Bar, to argue the Errors thereupon:

It is ORDERED, and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Judgement given for the said Stephen Terry, against the said Sir Richard Wiseman, be, and is hereby, affirmed; and that the Transcript of the said Record, wherein Judgement is entered as aforesaid, be remitted.

The Tenor of which Judgement followeth:

"Postea, scilicet, 6° Die Julii, Anno Regni Domini Gulielm. et Dominæ Mariæ nunc Regis et Reginæ Angliæ, &c. Primo, Transcript. Record. et Process. præd. inter Partes præd. cum omnibus ea tangent. Prætextu cujusdam Brevis de Errore corrigend. per præsat. Ricardum Wiseman in Præmissis prosecut. dict. Anno Domini Regis et Dominæ Reginæ in præsent. Parliamento a præd. Cur. dicti Domini Regis et Dominæ Reginæ hic transmiss. suit; prædictusque Ricardus Wiseman, in eadem Cur. Parliamenti comparens, diversas Causas et Materias pro Error. in Record. et Process. præd. pro Revocatione et Adnullatione Judicii præd. assignavit; et postea, scilicet, Decimo Nono Die Julii, Anno dicti Domini Regis et Dominæ Reginæ supradict. et in præd. Cur. Parliamenti præd. visis et per Cur. ibidem diligenter examinatis et plenius intellectis tam Record. et Process. præd. ac Judicio super iisdem reddit. (fn. 1) quod præd. Erroribus superius assignat. pro eo quod videtur Cur. Parliamenti prædicti quod Record. ill. in nullo vitiosaut defect. existit, et quod in Recordo illo in nullo fuit Erratum, ideo ad tunc et ibidem consideratum est per eandem Cur. Parliamenti prædicti, quod Judicium præd. in omnibus affirmetur, et in omni suo Robore stet et Effectu."

Adjourn.
