L. Leigh takes the Oaths.

This Day Thomas Lord Leigh took the Oaths, and made and subscribed the Declaration, pursuant to the Statutes made in that Behalf.

Sir H. Forester's Bill.

The Earl of Craven reported, "That the Lords Committees have considered the Bill to enable Sir Humphrey Forester to settle and dispose Lands, and have heard all Persons concerned; and the Opinion of the Committee is, the said Bill is fit to pass, with some Amendments."

Which, being read Twice, were Agreed to; and ordered the said Bill to be engrossed, with the Amendments.

Harris versus Osbolston.

Upon reading the Petition of John Harris and Elizabeth Harris; praying, "That Robert Osbolston may give the Petitioners an authentic Copy of a Deed Tripartite, between David Spicer, Henry Paules, and Jeremiah Blackman, which was produced at the Hearing at the Bar of this House; which will be necessary and material in the Prosecution of the Order of this House; and that the Deed may be delivered to the Clerk of the Parliaments:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Rob't Osbolsion do deliver, or cause to be delivered, to the Clerk of the Parliaments, or his Deputy, the said Deed, to the End they may have a Copy of it accordingly.

Law, Practice of, Bill for regulating.

After hearing Counsel this Day, at the Bar, against some Part of the Bill, intituled, "An Act for Benefit of the Subject, in relation to the Practice and Execution of the Law:"

It is ORDERED, That this House shall be put into a Committee, to proceed on the said Bill, on Saturday next, at Ten of the Clock in the Forenoon, the First Business.

Dashwood versus Champante.

Whereas this Day was appointed for hearing of Counsel at the Bar, upon the Petition of Sir Robert Dashwood Knight and Baronet, Sir Samuell Dashwood Knight, John Bery, and Edward Noell, surviving Executors of the last Will and Testament of George Dashwood Esquire deceased, in Trust for Minors, the Younger Children of the said Mr. Dashwood; as also upon the Answer of Sir John Champante:

The Counsel for the Respondent objected, "That the Cause came not regularly before this House."

And the Counsel for the Appellants were heard to that Point, and the Point of Notice to Sir John Champante of Dashwood's Assignment.

After due Consideration had of what was urged by the Counsel on either Side thereupon, it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Barons of Their Majesties Court of Exchequer do proceed to examine the Witnesses for Sir Robert Dashwood, and the other Appellants therein concerned, as to Mr. Dashwood's Assignment, and Sir John Champante's having Notice thereof: And that the Court of Exchequer do allow Time for the producing and examining those Witnesses until Michaelmas Terme next; and that the Accompts be understood, by the said Court, to be open Accompts to the Appellants and Defendant.

ORDERED, That the Lord Steward of His Majesty's Household do humbly move His Majesty, from this House, "That He will be graciously pleased to procure an Exchange for the Lord Mountjoy, now Prisoner in France, and such other Persons as His Majesty shall think fit, for the Priests and Jesuits now in Prison here."

Fountain versus Coke.

The House being this Day moved, "That the Words ["by any other Deed or Writing than by the Releases"] may be inserted in the Judgement of this House made the Ninth of January, 1689, in the Issues directed to be tried at a Trial at Bar, in the Cause then before this House, wherein A'drewe Fountaine Esquire Plaintiff, and John Coke Esquire Defendant:"

It is this Day ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Words ["by any Deed or Writing than by the Releases"] shall be inserted in the said Judgement after the Words ["Andrew Fountain"], and before the Words ["in which Issues"].

Bill for vacating several Letters Patents.

ORDERED, That the Committee for the Bill for vacating several Letters Patents therein mentioned be, and is hereby, adjourned to Saturday next, at Five of the Clock.

Sir H. Forester's Bill.

Hodie 3a vice lecta est Billa, "An Act to enable Sir Humphrey Forester to settle and dispose Lands."

The Question being put, "Whether this Bill shall pass into a Law?"

It was Resolved in the Affirmative.

Message to H. C. with it.

A Message was sent to the House of Commons, by Sir Rob't Le Guard and Mr. Merideth:

To deliver the Bill concerning Sir Humphrey Forester, and desire Concurrence therein.

Adjourn.
