Dutchess Albemarle versus E. of Bath.

Upon Report made this Day by the Speaker, of what was said by the Counsel and Civilians at the Bar, in the Case upon the Petition of the Dutchess of Albermarle, and the Petition of the Creditors of the late Duke of Albermarle, as also for the Right Honourable the Earl of Bath:

And, after Debate thereupon, and upon what the Earl of Bath offered therein, it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear Counsel on both Sides, on Saturday next, at Ten of the Clock in the Forenoon, to what the Earl of Bath hath offered this Day; (videlicet,) "That if the Counsel for her Grace the Dutchess of Albermarle, and the Creditors of the late Duke of Albermarle, will allow the last Allegation put in by the Earl of Bath to be true, that then he will not insist upon his Privilege, but proceed in the Cause."

Harris versus Osbolston.

Upon reading the Petition of John Harris and Elizabeth Harris; shewing, "That, by an Order of the Three and Twentieth of April last, Robert Osbolston was ordered to account for Eighty Pounds per Annum to your Petitioners, from the Decease of Elizabeth the Relict of David Spicer, and that the Court of Chancery proceed to take the said Accompt; that, pursuant thereunto, the Master in Chancery hath prepared his Report; but the Report carries in it a Doubt whether the said Eighty Pounds per Annum be to be accounted for with or without Interest; and praying either to direct Interest, or hear Counsel on both Sides touching that Point only:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Master in Chancery doth proceed to the said Report for the Eighty Pounds per Annum, with Interest for the same.

Gwynnes versus Rowe.

Upon hearing Counsel this Day at the Bar, upon the Petition and Appeal of Anthony Rowe Esquire, from a Decree made in the Court of Chancery, in a Cause there depending, between Dorcas Gwynne and Rees Gwynne Defendants, and the Petitioner Plaintiff; as also upon the Answer of the said Dorcas Gwynne and Rees Gwynne put in thereunto:

It is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal of Anthony Rowe Esquire be, and is hereby, dismissed this House; and that the Decree made by the Court of Chancery, from which he appealed to this House, be, and is hereby, affirmed: And it is further ORDERED, That the said Dorcas and Rees Gwynne shall deliver, or cause to be delivered, unto the said Anthony Rowe (at his Cost and Charge) a Copy of the Deed, dated the Twentieth of November, 1654, Part whereof was read this Day at the Bar.

Adjourn.
