The Earl of Rochester reported from the Committee, the Bill, intituled, "An Act to bar a Remainder limited to Dudley Bagnall Esquire, in the Estate of Nicholas Bagnall Esquire, in Ireland," without any Alteration or Amendment.

The Question was put, "Whether this Bill shall pass into a Law?"

It was Resolved in the Affirmative.

E. of Salisbury's Bill.

The House went into Debate upon the Amendments made by the Commons to the Bill, intituled, "An Act for limiting the Power of James now Earl of Salisbury to cut off the Entail of his Estate."

The Provisos (A and B) were read, and agreed to; the Proviso (C) agreed to, with some Amendments to be delivered at a Conference.

Message to H. C. for a Conference on their Amendments to it.

A Message was sent to the House of Commons, by Sir Miles Cooke and Doctor Edsbury:

To desire a present Conference, upon the Subjectmatter of their Amendments to the said Bill.

East India Goods, &c. Duty on, Bill.

Hodie 2a vice lecta est Billa, "An Act for granting to Their Majesties certain Impositions upon all East India Goods and Manufactures, and upon all Wrought Silks, and several other Goods and Merchandizes, to be imported after the Five and Twentieth Day of December, One Thousand Six Hundred and Ninety."

ORDERED, To be committed to a Committee of the whole House, presently.

The House adjourned during Pleasure, and put into a Committee upon the said Bill.

The House was resumed.

And the Lord Viscount Newport reported, "That the Committee had passed the Bill, without any Amendment."

The Commons being come to the Conference, the Lords following were named Managers:

Burrows Pet. for Leave to proceed against Dod & al. at Law.

Whereas this Day was appointed for taking up the Debate upon the Petition of Thomas Burroughs; praying, "That he may be at Liberty to try his Title at Law;" upon reading also a Petition of Anne Dod, Magdalen Johnson, and others, praying, "That they may be heard, by their Counsel, in the Premises, at the Bar, before any Order be made therein:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Thomas Burrows shall be heard, by his Counsel, as also Anne Dod, Magdalen Johnson, and others, upon this single Point only [whether the said Tho. Burrows ought to have Liberty to try his Title at Law] To-morrow, at Ten of the Clock in the Forenoon.

Allen & al. versus Fox & al.

Upon hearing Counsel this Day, at the Bar, upon the Petition of John Allen and Mary his Wife, being an Appeal from several Decrees and Orders made in the Court of Chancery, on the Behalf of Thomas Fox and Stephen Fox Infants, and their Mother, and Jonas Clarke and his Wife; as also upon the Answers of Jonas Clarke and Anne his Wife, and the Answer of Stephen Fox an Infant of the Age of Sixteen Years and under the Age of Eighteen Years, by Hester Fox Widow, his natural Mother and Guardian, and of the said Hester Fox and Thomas Fox, put in thereunto:

After due Consideration had of what was offered by Counsel on either Side thereupon, it is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the Decrees and Orders made on the Behalf of Jonas Clarke and Anne his Wife, complained of in the Petition and Appeal of the said John Allen and Mary his Wife, shall be, and they are hereby, reversed: And it is further ORDERED, That the Third Part, that is decreed unto Jonah Clarke and Anne his Wife, shall contribute its Proportion to the making up the Legacies of Five Hundred Pounds; and the Twenty-five Pounds a Year Maintenance, and the Legacy unto Sarah Nottingham Widow.

Adjourn.
