Wade versus Heath, in Error.

Upon reading the Petition of Sir Edward Baesh Knight and Dame Anne his Wife; shewing, "That the Petitioners, in the Name of Charles Heath their Lessee, have recovered a Verdict and Judgement in Ejectment, upon a Trial had at the King's Bench in Easter Terme last, for the Manor of Battleshall, and other Lands and Tenements, in the County of Essex; and that Anne Wade, for Delay, and to prevent the Petitioners from taking out a Writ of Possession, hath brought a Writ of Error into this House, and not assigned Errors thereon, as by the Rules of this House she ought to do; and praying a Day may be appointed for the said Anne Wade to assign Errors, or, in Default, the Record be remitted:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Anne Wade shall peremptorily assign Errors, in this Case, on or before Monday the Three and Twentieth Day of this Instant November, at Ten of the Clock in the Forenoon; and, in Default thereof, the said Record to be remitted to the Court of King's Bench.
