St. Paul's Cathedral, Bill.

The Lord Bishop of London reported from the Lords Committees, the Bill, intituled, "An Act for the finishing and adorning the Cathedral Church of St. Paul's, London," as fit to pass, without any Amendment."

Hodie 3a vice lecta est Billa, intituled, "An Act for the finishing and adorning the Cathedral Church of St. Paul's, London."

The Question was put, "Whether this Bill shall pass ?"

It was Resolved in the Affirmative.

ORDERED, The Commons have Notice, that the Lords have agreed to the said Bill, without any Amendment.

City of London, Lord Mayor & al. versus L. Wharton:

Upon reading the Petition of the Court of Lord Mayor and Aldermen of the City of London; shewing, "That King Charles the First, in the Fourth Year of His Reign, did grant unto several Persons, in Trust for the City of London, the Honour of Richmond, and Lordship of Middleham, in the County of York, with several Mesne Manors and Lordships within the said Honour; and that (fn. 1) in an Inquisition, taken by Virtue of a Commission issued in the Fifteenth Year of King James the First, are contained the Boundaries of the Honour of Richmond and Lordship of Middleham, which said Commission was duly executed, returned, and filed; but the same, some Years past being taken from the File, was, by Order of the Court of Exchequer, of the Fifteenth of July One Thousand Seven Hundred and One, directed to be allowed as a Record of that Court, and to be filed accordingly: That the Petitioners are informed, that the Right Honourable Thomas Lord Wharton hath petitioned this House, that the said Order of the Fifteenth Day of July One Thousand Seven Hundred and One may be discharged, and that the said Survey may be taken off the File: And praying, that they may be heard, by their Counsel, at the Bar of this House, what they have to offer in relation to the said Inquisition, or Survey, before this House give Judgement upon the Lord Wharton's Appeal:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Petitioners shall be heard, by their Counsel, separate, on Thursday next; at which Time the Lord Wharton's Appeal against Robert Squire shall be heard.

The Lord Bishop of London reported from the Lords Committees, the Bill, intituled, "An Act for continuing former Acts, for exporting Leather, and for reviving and making more effectual an Act relating to Vagrants," as fit to pass, without any Amendment.

The Question was put, "Whether this Bill shall pass ?"

Message from H. C. to return Sir T. Brograve's Bill.

A Message was brought from the House of Commons, by Mr. Freeman and others:

To return the Bill, intituled, "An Act to vest divers Lands and Tenements of Sir Thomas Brograve Baronet, in the County of Hertford, in Trustees, to be sold; and to settle other Lands and Tenements in Lieu thereof;" and to acquaint this House, that they have agreed to the same, with One Amendment, whereunto they desire their Lordships Concurrence.

Which Amendment was read Thrice, and agreed to; and ORDERED, That the Commons have Notice thereof.

Oath of Abjuration, Bill to enlarge the Time for taking.

The Lord Herbert reported from the Committee of the whole House, the Bill, intituled, "An Act for enlarging the Time for taking the Oath of Abjuration; and also for re-capacitating and indemnifying such Persons as have not taken the same by the Time limited, and shall take the same by a Time to be appointed," as fit to pass, with several Amendments and Clauses.

Which Amendments and Clauses were read Twice, and agreed to by the House.

ORDERED, That the said several Amendments and Clauses be engrossed.

Hayes versus Carrill: Judgement affirmed.

After hearing Counsel, upon the Petition and Appeal of John Hayes Esquire, against an Order or Decree of Dismission, made in the Court of Chancery, the Eight and Twentieth Day of July last, in a Cause there depending, between the Petitioner Plaintiff, and John Carill Esquire, Heir and Executor of Richard Carill Esquire, deceased, Francis Bruning and John Peacock Gentlemen, Defendants; and praying the Reversal of the said Decree of Dismission; as also upon the Answer of the said John Carill, Francis Bruning, and John Peacock, put in thereunto; and due Consideration of what was offered thereupon:

It is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal of John Hayes shall be, and is hereby, dismissed this House; and that the Decree of Dismission therein complained of shall be, and is hereby, affirmed.

Sutton versus West. in Error:

This Day the Lord Chief Justice of Her Majesty's Court of Queen's Bench brought up a Writ of Error, wherein W'm Sutton is Plaintiff, and Nicholas West Defendant:

Writ brought for Delay, not received.

Hereupon the House taking into Consideration, that the said Writ of Error was not brought in Time (as it might have been), according to the Standing Rules and Orders of this House, but only for Delay; it is therefore ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Writ of Error shall not be received; but returned to the Court of Queen's Bench, from whence the same was brought.

Who brought up a Bill, intituled, "An Act for providing, that no Persons shall be chose Members of the House of Commons, but such as have sufficient Real Estates," to which they desire the Concurrence of this House.

Queen's Answer to Address for a List of Persons arrived from France.

The Lord Steward reported Her Majesty's Answer to the Address; (videlicet,)

"That Her Majesty has given Order, that such a List shall be laid before this House, as desired: And Her Majesty believes this House will find, by the List, that very few Licenses to Persons to come out of France, since the Time mentioned in the Address, have been granted."

To return the Bill, intituled, "An Act to enable the surviving Trustees and Executors of the last Will and Testament of Thomas Fane Esquire, deceased, to pay an Annuity unto Mildmay Fane Esquire, for his Maintenance and Education, until he shall attain his Age of One and Twenty Years;" and to acquaint this House, that they have agreed to the same, with some Amendments, whereunto they desire their Lordships Concurrence.

A Message was brought from the House of Commons, by Sir Thomas Davall and others:

To return the Bill, intituled, "An Act for confirming and establishing a Partition made by Sir Edmund Fowler Knight and Dame Anne his Wife, and Elizabeth Buggin Widow, of certain Manors and Lands, in the County of Kent, in the Year One Thousand Six Hundred Thirty-four;" and to acquaint this House, that they have agreed to the same, with some Amendments, whereunto they desire their Lordships Concurrence.

Repair of Churches, Bill.

ORDERED, That the Bill, intituled, "An Act for the more easy Recovery of Monies for repairing Churches," shall be read the First Time To-morrow, at Eleven a Clock.

Richmond versus Lord Mayor & al. of London.

Whereas this Day was appointed, for hearing of the Cause wherein Richard Richmond and Peter De Lanoy are Appellants, and the Lord Mayor, Commonalty, and Citizens of the City of London, and others, are Respondents:

It is ORDERED, That this House will hear the said Cause To-morrow, at Eleven a Clock: And it is further ORDERED, That the other Causes appointed to be heard be removed in Course.

Adjourn.
