Cary versus White.

A Petition of John Cary Esquire, was presented to the House, and read; praying, "That a Time may be appointed, for John White to put in his Answer to the Petitioner's Appeal, which was received by this House the Twentieth of May 1713, and not since proceeded on; the Petitioner's urgent Occasions requiring his Continuance in Ireland:"

Ordered, That the said Petition do lie on the Table; it not appearing thereby, that the said John White hath ever been served with the Order made by this House, for his answering the said Appeal, when the same was received.

Eversfield's Petition refered to Judges.

Upon reading the Petition of Charles Eversfield the Elder, of Denn, in the Parish of Horsham, in the County of Sussex, Esquire; praying, "That Leave may be given to bring in a Bill, for Sale of several Lands in the Petition mentioned, for raising Money, for the Payment of the Petitioner's Debts, and for making a Provision for his Eldest Son; and other Purposes therein expressed:"

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of the said Petition be, and is hereby, referred to Mr. Justice Tracy and Mr. Justice Prat; who are forthwith to summon all Parties concerned in the Bill; and, after hearing them, to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties that may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.

E. of Exeter & al. Petition referred to Judges.

Upon reading the Petition of John Earl of Exeter and Elizabeth Countess of Exeter his Wife, Francis Lord Guilford and Alice Lady Guilford his Wife, Peregrine Lord Willoughby commonly called Lord Marquis of Lindsey, and Sir John Brownlow Baronet and Dame Eleanor his Wife; praying, "That Leave may be given to bring in a Bill, to make a Fine and Recovery of a Fee Farm Rent of Twenty Pounds per Annum, issuing out of Lands in Hertfordshire, when levied and suffered, effectual, the same having been omitted; and for confirming Articles and Conveyances for a Partition of the Estate late of Sir John Brownlow Baronet, deceased, between the Petitioners:"

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of the said Petition be, and is hereby, referred to the Lord Chief Baron of the Court of Exchequer and Mr. Baron Price; who are forthwith to summon all Parties concerned in the Bill; and, after hearing them, to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties that may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.

Ash's Petition for Money to carry on the Cause, rejected.

A Petition of Mary Ash Widow, Respondent to the Appeal of Simeon Ash Clerk and others, was offered to the House; desiring a further Sum of Fifty Pounds may be ordered her, to enable her to carry on her Cause directed to be tried on hearing the said Appeal:

Ordered, That the said Petition be rejected.
