Callicoes to prohibit, Bill.

A Message from the House of Commons, by Mr. Bacon and others:

With a Bill, intituled, "An Act to preserve and encourage the Woollen and Silk Manufactures of this Kingdom; and for the more effectual employing the Poor, by prohibiting the Use and Wear of all printed, painted, stained, or dyed Callicoes, in Apparel, Household Stuff, Furniture, or otherwise, after the Twentyfifth Day of December One Thousand Seven Hundred and Twenty-two (except as therein is excepted);" to which they desire the Concurrence of this House.

The said Bill was read the First Time.

A Message from the House of Commons, by Mr. Lade and others:

With a Bill, intituled, "An Act for naturalizing Gilbert de Flines and Christian Friederick Zincke;" to which they desire the Concurrence of this House.

Earl and Countess of Jersey's Petition referred to Judges.

Upon reading the Petition of William Earl of Jersey and Judith Countess of Jersey his Wife; praying Leave to bring in a Bill, to vest the Manor of Squerryes, alias Squirries, alias Squires, and divers Messuages, Lands, Tenements, and Hereditaments, in the County of Kent, in Trustees, to be sold; and, with the Money arising by such Sale, to purchase other Lands, to be settled to the same Uses:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of the said Petition be, and is hereby, referred to the Lord Chief Justice of the Court of Common Pleas and Mr. Justice Blencowe; who are forthwith to summon all Parties concerned in the Bill; and, after hearing them, to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties that may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.

East India Company versus Callico Bill.

A Petition of the United Company of Merchants of England trading to The East Indies, was presented to the House, and read; praying to be heard, by their Counsel, touching the Subject-matter of the Bill depending in this House, intituled, "An Act to preserve and encourage the Woollen and Silk Manufactures of this Kingdom;" or that they may have such other Relief as may seem meet:

It is Ordered, That the said Petition do lie on the Table, till the said Bill be read a 2d Time.

Ordered, That the said Bill be read a Second Time on Thursday next.

Norwich Worsted Company, for Callico Bill.

A Petition of the Headmen, Wardens, and Assistants, of the incorporated Company of Worsted Weavers of the City of Norwich; praying, "That the Bill to preserve and encourage the Woollen and Silk Manufactures of this Kingdom, may pass," was likewise presented to the House, and read; and ordered to lie on the Table.

Mr. Phillips discharged.

A Petition of John Philips Clerk, in Custody of the Gentleman Usher of the Black Rod, was presented to the House, and read; expressing his deep Concern for his falling under their Lordships Displeasure, by his causing to be printed and published a Letter and Representation to the Right Honourable the Lord Harcourt; and begging Pardon of the House, and the Noble Lord therein mentioned; and praying to be discharged.

And the Lord Harcourt requesting, "That the Petitioner may be discharged, according to the Prayer of his Petition, without being brought to the Bar:"

It is thereupon Ordered, That the Petitioner be discharged accordingly (paying his Fees).

Message to H. C. for Mr. Jeffries and Sir Rich. Fowler to attend.

A Message was sent to the House of Commons, by Mr. Bennet and Mr. Godsrey:

To acquaint them, "That this House, having appointed to take into Consideration, on Saturday next, some Matters relating to a Trial at the last Assizes at Hercford, touching the Presentation to the Vicarage of Lempster; desire, that Edward Winningion Jeffries Esquire, and Sir Richard Fowler Baronet, Members of their House, may have Leave to attend the House of Lords, to declare their Knowledge concerning the same."

Carver to attend, concerning E. Coningesby's Book.

Ordered, That Benjamin Carver Attorney at Law; late Under Sheriff of the County of Hereford, do attend this House, on Saturday next, in order to be sworn, to give Evidence touching the Matter of the Book, intituled, "The First Part of Earl Coningesby's Case, relating to the Vicarage of Lempster, in Herefordshire, &c." appointed then to be taken into Consideration.

Chevers et al. versus Geoghegan.

This Day being appointed, to hear One Counsel of a Side, as well upon the Subject-matter of the Petition of Terence Geoghegan, Respondent to the Appeal of Andrew Chevers and others, as upon the Petition of the said Appellants, presented to the House on Wednesday last, relating to the putting off the Hearing the said Cause, which stands for Friday next:

Counsel were accordingly called in, and heard.

And the Minutes in the Cause being read; and the Copy of the Enrolment of the Original Deed of Purchase from the Trustees for Sale of the forfeited Estates in Ireland to the Sword-Blade Company, and the Minutes of the Outlawry against Edward Chevers, being proved by a Witness sworn at the Bar; and due Consideration had of what was offered by Counsel thereupon:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the said Appellants may have Copies of the attested Copies of the Original Deed of Enrolment, and of the Outlawry in 1712, in the Respondent's Petition mentioned; and that the same, and the Minutes of the other Outlawry in 1696, made Use of at the Hearing the said Cause in the Court below, be admitted as Evidence at the Hearing in this House; and that the said Respondent do pay, or cause to be paid, to the said Appellants, Ten Guineas, for the Expences of this Day; and that this House will hear the said Cause, by Counsel, at the Bar, on Wednesday the First Day of March next, at Eleven a Clock; and that the Cause appointed for that Day be put off to the Friday following; and the other Causes removed One Cause-day in Course.

Lords to be summoned.

Ordered, That all the Lords be summoned to attend the House on Thursday next, on arguing the Errors assigned upon a Writ of Error, wherein John Thornby Esquire is Plaintiff, and Thomas Fleetwood Esquire and others are Defendants.

Ordered, That the said Bill be committed to a Committee of the whole House, on Tuesday next; and that the Petition of the East India Company, ordered to lie on the Table till the Second Reading thereof, be referred to the said Committee; and that the Petitioners may be then heard, by Counsel, against the said Bill.

Linen-drapers et al. Petition against Callico, Bill.

A Petition of the Linen drapers and other Dealers in printed, painted, stained, and dyed Callicoes, residing in and about the City of London, on Behalf of themselves and the rest of the Dealers therein, was presented to the House, and read; praying to be heard, by them selves or Counsel, upon the Subject-matter of the Bill depending in this House, intituled, "An Act to preserve and encourage the Woollen and Silk Manufactures of this Kingdom, &c." and, "That such Relief may be given, touching the Difficulties and Hardships which the Wearers of printed Callicoes and Linens will be subject to by the said Bill, and the great Loss and Damage which the Petitioners will inevitably sustain, in case the same should pass:"

It is Ordered, That the said Petition be referred to the Committee of the whole House to whom the said Bill stands committed; and that the Petitioners may be then heard, by themselves or Counsel, before the said Committee, so that no more Counsel than Two be heard against the said Bill.

Upholders and Quiltmakers, against Callico Bill.

A Petition of the Upholders and Quilt-makers in and about the City of London, in Behalf of themselves and many Hundreds of poor Families employed under them in making Quilts for Beds, was presented to the House, and read; praying, "That the Petitioners may be heard, by themselves or Counsel, against that Part of the said Bill, which restrains the making up or selling Household Stuff, or Furniture, made or mixed with printed, painted, stained, or dyed Callicoes, so far as relates to Quilts for Beds only; or that a Clause may be inserted in the said Bill, to preserve the making Use and Wear of Quilts made of printed, painted, stained, or dyed Callicoes, which shall be so done in Great Britain:"

It is Ordered, That the said Petition be referred to the Committee of the whole House to whom the said Bill stands committed; and that the Petitioners may be heard, by themselves or Counsel before the said Committee, so that no more Counsel than Two be heard against the said Bill.

Thornby versus Fleetwood et al.

Counsel were called in, to be heard, to argue the Errors assigned upon a Writ of Error brought into this House the Thirteenth of January last, wherein John Thornby Esquire, Lessee of the late Duke and present Dutchess of Hamilton, is Plaintiff, and Thomas Fleetwood Esquire and others are Defendants.

And the Counsel for the Plaintiff, and One of the Defendants Counsel, being heard; they were directed to withdraw.

And being withdrawn:

It is Ordered, That this House will proceed to the further Hearing the Errors argued in this Cause Tomorrow; and the Lords to be summoned; and the Judges to attend.

State of Public Credit.

Whereas To-morrow is appointed, for the House to be in a Committee, to take into further Consideration the Causes of the unhappy Turn of Affairs, that has so much affected the Public Credit; and for the Clerks of the South Sea Company employed in taking in the Money on the Third Subscription, or paying back any Part of it, to attend:

With a Bill, intituled, "An Act for the better Preservation of the Harbour of Rye, in the County of Sussex;" to which they desire the Concurrence of this House.

Report from Commissioners of forfeited Estates in England delivered.

The House being informed, "That Mr. Martin attended, from the Commissioners and Trustees of the forfeited Estates:"

He was called in; and delivered, at the Bar, the further Report of the Commissioners and Trustees appointed to execute the several Trusts and Powers, in England, Ireland, and elsewhere (except Scotland), contained in several Acts of Parliament, for appointing Commissioners, to inquire of the Estates of certain Traitors and of Popish Recusants, and of Estates given to Popish and Superstitious Uses, in order to raise Money out of them, severally, for the Use of the Public; and for vesting the forfeited Estates in Great Britain and Ireland in Trustees, to be sold, for the Use of the Public; and for giving Relief to lawful Creditors, by determining the Claims; and for the more effectual bringing into the respective Exchequers the Rents and Profits of the said Estates, till sold.

And withdrew.

Then the Title of the said Report was read.

Thornby versus Fleetwood & al. in Error.

Counsel were called in, to be further heard, to argue the Errors assigned upon the Writ of Error wherein John Thornby Esquire, Lessee of the late Duke and present Dutchess of Hamilton, is Plaintiff, and Thomas Fleetwood Esquire and others are Defendants:

And being heard accordingly; and withdrawn:

And Four of the Judges having severally delivered their Opinions, with their Reasons at large:

It is Ordered, That the Delivery of the Opinions of the rest of the Judges be deferred till To morrow; and that all the Judges do then attend.

The Judges attending (according to Order), severally delivered their Opinions, with their Reasons at large, upon the Writ of Error wherein John Thornby Esquire is Plaintiff, and Thomas Fleetwood and others are Defendants.

And the following Order and Judgement was made; (videlicet,)

After hearing Counsel, as well on Thursday last as Yesterday, to argue the Errors assigned upon a Writ of Error brought into this House the Thirteenth Day of January last, wherein John Thornby Esquire, Lessee of the late Duke and present Dutchess of Hamilton, is Plaintiff, and Thomas Fleetwood Esquire, and several other Tenants in Possession of the Premises in Question, are Defendants, in order to reverse a Judgement given in His Majesty's Court of King's Bench, affirming a Judgement given in the Court of Common Pleas for the Defendants; and the Opinions of all the Judges, except Mr. Baron Page who was absent, having been severally delivered, with their Reasons at large; and due Consideration had of what was offered in this Cause:

Judgements affirmed.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Judgement given in the Court of Common Pleas, and the said Judgement of Affirmance in the Court of King's Bench, be, and are hereby, affirmed; and that the Record be remitted, to the End Execution may be had thereupon, as if no such Writ of Error had been brought into this House."

A Petition of the Manufacturers of, and Dealers in, Cotton Wool, in Manchester, and Places adjacent, in Behalf of themselves and many Thousands of poor People employed in the Cotton Manufactures in Lancashire, was presented to the House, and read; praying, That the Bill, intituled, "An Act to preserve and encourage the Woollen and Silk Manufactures of this Kingdom," may pass; but that a Clause may be inserted therein, that all Cloths and Stuffs manufactured in this Kingdom, of Cotton Wool of the Produce of His Majesty's Plantations in America, may be allowed to be printed, painted, stained, or dyed, and wore, in Great Britain; forasmuch as the Petitioners conceive, that, if the said Manufacture should be so allowed, it will effectually answer the Intent of the Bill, by employing great Numbers of His Majesty's Subjects; will greatly increase His Majesty's Revenue, be a very great Improvement to the said Plantations, and an Advancement to Trade and Navigation in general."

And being withdrawn:

It was proposed, "That the Charge against the present Lord Chancellor, contained in the Title Page of a Pamphlet, intituled, "The First Part of E. Coningesby's Case, relating to the Vicarage of Lempster, in Herefordshire, &c." which the said Ead did, in his Place, undertake to prove in every Particular thereof, is malicious, and utterly groundless; and that the said Pamphlet is a scandalous Libel."

And the said Earl being heard in his Place, and withdrawn:

A Question was stated on the said Proposition.

Also, a Petition of the Retailers of Callico, living in and about the City of London, in Behalf of themselves and others; praying, "That in case the beforementioned Bill should pass, that they may be relieved as to the Time for selling and wearing of Callicoes which are already printed, and now in the Hands of the Retailers, as being only fit for a Home Consumption; whereby they may be enabled to preserve their Substance, by disposing of their Goods, in order to undertake some other Trade or Business, to get a Livelihood for theirselves and Families, to preserve them from utter Ruin:"

And severally ordered to be referred to the Committee of the whole House to whom the said Bill stands committed.

University of Oxford, Leave for a Bill.

Upon reading the Petition of the Chancellor, Masters, and Scholars, of the University of Oxford; praying Leave to bring in a Bill, for purchasing certain Houses and Ground, between the Church of St. Mary's and the Schools within the said University, for building a Library, pursuant to the Will of John Radcliffe Doctor in Physic; and to permit the Petitioners to purchase Ground or Houses adjacent to them, within the said University and City, from any Corporation, Person, or Persons, now incapable by Law to sell and dispose of the same; and that Provision may be made, that the Money arising by such Sale, or Sales, may be disposed of to the same Uses and Purposes as the Houses and Ground so sold or disposed of, were settled at the Time of such Sales, and to no other Use and Purpose whatsoever:

It is Ordered, That Leave be given to bring in a Bill, according to the Prayer of the said Petition.

River Weaver navigable, Bill.

The Order of the Day, for the House to be in a Committee upon the Bill, intituled, "An Act for making the River Weaver navigable, from Frodsham Bridge to Winsford Bridge, in the County of Chester," being read:

Manufacturers in Cotton, Pet. touching Callico Bill.

A Petition of the Manufacturers, Factors, Dealers, and other Traders, concerned in the Cotton Manufacture of this Kingdom, residing in and about the City of London, on Behalf of themselves and many Thousands of Poor employed therein, was presented to the House, and read; praying to be heard, by their Counsel or otherwise, in order to have a Clause, or Clauses, inserted in the Bill, intituled, "An Act to preserve and encourage the Woollen and Silk Manufactures of this Kingdom," that Cloths and Stuffs made of Cotton Wool, or mixed therewith, of the Produce of the British Plantations, and manufactured in Great Britain, may be printed, painted, stained, dyed, used, and wore here as usual:

It is Ordered, That the said Petition be referred to the Committee of the whole House to whom the said Bill stands committed; and that the Petitioners may be then heard, by themselves or Counsel, before the said Committee; so that no more Counsel than Two, and Two of the Petitioners, be heard on the several Petitions against the said Bill.

Causes put off.

Whereas To-morrow is appointed, for hearing the Cause wherein Sir Edward Leighton Baronet is Appellant, and William Leighton Esquire and others are Respondents:

It is Ordered, That this House will hear the said Cause, by Counsel, at the Bar, on Friday next; and that the Judges of the Court of King's Bench, and Barons of the Court of Exchequer, do then attend; and that the other Causes be removed One Cause-day in Course.

Callico Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee on the Bill, intituled, "An Act to preserve and encourage the Woollen and Silk Manufactures of this Kingdom; and for the more effectual employing the Poor, by prohibiting the Use and Wear of all printed, painted, stained, or dyed Callicoes, in Apparel, Household Stuff, Furniture, or otherwise, after the Twenty-fifth Day of December One Thousand Seven Hundred and Twenty-two (except as therein is excepted)."

After some Time spent therein, the House was resumed.

And the Earl of Clarendon reported from the said Committee, "That they had made some Progress in the Bill; and that he was directed by the Committee to move, that they may have Leave to sit again."

Ordered, That the House be put into a Committee, to proceed further on the said Bill, on Thursday next.

State of Public Credit.

Whereas Thursday next is appointed, for the House to be put into a Committee, to take into further Consideration the Causes of the unhappy Turn of Affairs, that has so much affected the Public Credit; and for the Clerks of the South Sea Company employed in taking in the Money on the Third Subscription, or paying back any Part of it, to attend:

It is Ordered, That the House be put into the said Committee on Saturday next; and that the said Clerks do then attend.

River Kennet navigable, Time enlarged, Bill:
