The Lord Bishop of Norwich reported from the Lords Committees to whom the Bill, intituled, "An Act for Sale of Part of the Estate of William Kinaston Esquire, and for settling other Part thereof to the Uses therein mentioned," was committed: "That they had considered the said Bill, and found the Allegations thereof to be true; that the Parties concerned had given their Consents; and that the Committee had gone through the same, with some Amendments."

Which, being read Twice by the Clerk, were agreed to by the House.

It is Ordered, That the said Bill, with the Amendments, be engrossed.

Birmingham Roads to repair, Bill:

Hodie 3^a vice lecta est Billa, intituled, "An Act for repairing the several Roads leading from Birmingham, through the Town of Wednesbury, to a Place called High Bullen, and to Great Bridge, and from thence to the End of Gibbet Lane next adjoining to the Township of Bilson, and from Great Bridge, through Dudley, to King's Winsford, and to the further End of Brittell Lane, in the Counties of Warwick, Stafford, and Worcester."

The Question was put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Message to H. C. that the Lords have agreed to the Bill.

A Message was sent to the House of Commons, by Mr. Burroughs and Mr. Yard:

To acquaint them, that the Lords have agreed to the said Bill, without any Amendment.

Transportation of Felons, Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act to enforce the Laws for the Transportation of Felons, and for preventing their Return to Great Britain; and for carrying on Criminal Prosecutions at the Expence of the County where the Offence is committed."

And, after some Time spent therein, the House was resumed.

And the Lord Bishop of Norwich reported from the said Committee, "That they had made some Progress in the Bill; and directed him to move, That another Time may be appointed, for the House to be in a Committee again, to proceed further therein."

Ordered, That the House be put into a Committee again, to consider further of the said Bill, on Monday next; and that the Judges, or some of them, do then attend this House; and that the Cause appointed for that Day be put off to Tuesday; and the other Causes removed one Day in Course.

Message from H. C. to return the D. of Manchester's Bill to vest Rectories, &c. in new Trustees.

A Message was brought from the House of Commons, by Sir John Rushout and others:

To return the Bill, intituled, "An Act to vest several Rectories, Parsonages, Churches, and Chapels, of Breamore, South Charford, Hale, Rockbourn, Whitsbury, and Quidesley, with the Glebe Lands and Appurtenances thereunto belonging, in new Trustees, to put in Execution certain Trusts and Powers contained in an Indenture, dated the Fifteenth Day of May One Thousand Six Hundred and Eighty-three;" and to acquaint this House, that they have agreed to the same, without any Amendment.

S. S. Company to deliver Negroes at Buenos Ayres, Bill.

A Message was brought from the House of Commons, by Sir John Eyles Lord Mayor of London and others:

With a Bill, intituled, "An Act to enable the South Sea Company, with the License and Consent of the East India Company, to take in Negroes within their Limits of Trade, and to deliver the same at Buenos Ayres;" to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Message from H. C. to return the Addington Rectory Exchange of Tythes, Bill.

A Message was brought from the House of Commons, by Mr. Moore and others:

To return the Bill, intituled, "An Act for exchanging the Tithes and Glebe Lands of and belonging to the Rectory of the Church of Addington, in the County of Bucks, for other Lands in Addington aforesaid, to be settled on the Rector of the said Church and his Successors; and for other Purposes therein mentioned;" and to acquaint this House, that they have agreed to the same, without any Amendment.

Roads from Wigan to Preston, to repair, Bill:

Hodie 3^a vice lecta est Billa, intituled, "An Act for repairing, widening, and amending, the Roads from Wigan to Preston, in the County of Lancaster."

The Question was put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Bromsgrove Roads, to repair, Bill:

Hodie 3^a vice lecta est Billa, intituled, "An Act for repairing the Roads leading from the Town of Bromsgrove, to the Town of Dudley, in the County of Worcester; and from the said Town of Bromsgrove, to the Town of Birmingham, in the County of Warwick."

The Question was put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Messages to H. C. that the Lords have agreed to the Two preceding Bills.

Chevers' Petition, for Deeds and Writings to be produced:

Upon reading the Petition of Andrew Chevers, and Hyacinth Chevers his only Son and Heir Apparent; praying, "That the Respondent John Chevers may produce, at the Hearing the Petitioners Appeal, all Deeds, Papers, and Writings, confessed by him in his Answer to the Petitioners Bill, to be in his Hands or Custody:"

And thereupon the Petitioner, as also Michael Chevers, being called in, and examined at the Bar:

And the said Michael alledging, on Oath, "That One of the Deeds above-mentioned was lost, so that he had not the same to produce:"

And being withdrawn:

It is Ordered, That the Respondents to the said Appeal do produce, at the said Hearing, all the Deeds and Writings in their Custody, or Power, desired by the said Petition; and that they do forthwith deliver, or cause to be delivered, to the Petitioner, a true Copy of the Deed alledged by the said Michael Chevers to be lost, as aforesaid.

Salt Owners at Northwich, &c. versus River Weaver:

Upon reading the Petition of the Proprietors and Dealers in Rock and White Salt, in and about Northwich and Middlewich, in the County of Chester; praying, "That no larger Duty may be laid on Trade, than what is necessary for perfecting and supporting the Navigation of the River Weaver:"

It is Ordered, That the said Petition be, and is hereby, referred to the Consideration of the Lords Committees to whom the said Bill stands committed.

Petition of all the Proprietors of Salt, for River Weaver, Bill.

Upon reading the Petition of all the Proprietors of Salt Rock and White Salt, inhabiting in and near the Town of Northwich, Middlewich, and Nantwich, in the County of Chester; praying, "That the Bill for repealing an Act passed in the Seventh Year of His present Majesty's Reign, for making the River Weaver navigable, may pass:"

It is Ordered, That the said Petition be, and is hereby, referred to the Consideration of the Lords Committees to whom the said Bill stands committed.

Jevers versus Barker:

The House was informed, "That a Person attended at the Door, and desired to deliver in several Papers and Proceedings, in the Cause wherein Thomas Jevers Esquire is Appellant, and Sir William Barker Baronet Respondent:"

And thereupon Rosse Fox Esquire being called in, and sworn; he delivered in, at the Bar, the said Papers and Proceedings; and attested, "The same were true Copies, he having examined them with the Originals in the proper Offices in Ireland:

And then he withdrew.

Barker versus Gyles & al.

After hearing Counsel, upon the Petition and Appeal of Robert Barker Gentleman; complaining of a Decree of the Court of Chancery, made about the Fourth Day of June One Thousand Seven Hundred and Twentyfive, in a Cause, wherein the Appellant was Plaintiff, and Nathaniel Gyles and Lawrence Smith Executors of Robert Barker Esquire deceased, Martha Barker, John Blake and Penelope his Wife, were Defendants; and praying, "That the same may be reversed:" As also upon the several Answers of the said Nathaniel Gyles, Lawrence Smith, and the other Defendants put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

Decree affirmed, with a Direction.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Decree complained of in the said Appeal be, and is hereby, affirmed, with this Direction; That the Appellant may be at Liberty to apply to the Court of Chancery, for to receive to his own Use the Surplus of the Rents and Profits of the Real Estate, over and above what shall be sufficient, together with the Personal Estate, to pay off the Testator's Debts and Legacies, and other Payments directed by the Will, in case it shall appear upon the Accompt, that there is, or before Sale shall be, any such Surplus; and likewise to apply to the said Court, that no more of the said Estate be sold than is necessary to make good the Payments aforesaid; whereupon such Direction shall be given as shall be just.
