The House (according to Order) took into Consideration the Petition of Francis Foster Gentleman, and others, Respondents to the Appeal of Margaret Sankey Widow; praying, "That a short Day may be appointed, for hearing the said Appeal:"

It is Ordered, That this House will hear the said Cause, by Counsel, at the Bar, on Thursday next come Sevennight.

Bill against pulling down Turnpikes to be printed.

Ordered, That the Bill, intituled, "An Act to explain, amend, and render more effectual, an Act passed in the First Year of His present Majesty's Reign, intituled, An Act for punishing such Persons as shall wilfully and maliciously pull down or destroy Turnpikes for repairing Highways, or Locks, or other Works erected by Authority of Parliament, for making Rivers navigable," be printed.

Messages from H. C. to return Butwell's and Hortons Bill.

A Message was brought from the House of Commons, by Sir Nathanial Curzon and others:

To return the Bill, intituled, "An Act for vesting certain Lands and Estates, in the Counties of Stafford, Leicester, Rutland, and Northampton, late the Estates of Sir Eusebius Buswell Baronet, deceased, in Trustees, to be sold, for the Payment of his Debts;" and to acquaint this House, that they have agreed to the same, without any Amendment.

and Swinburne's Bill.

A Message was brought from the House of Commons, by Mr. Bowes and others:

To return the Bill, intituled, "An Act for raising Money, out of the Estate late of Surtees Swinburne Esquire, deceased, for compounding and paying the Portions charged thereon to his Younger Sons William and Robert Swinburne; and for paying the Debts of Cuthbert Swinburne Esquire, deceased;" and to acquaint this House, that they have agreed to the same, without any Amendment.

Haiiman, Leave for a Nat. Bill:

A Petition of Nicholas Haiiman, was presented to the House, and read; praying Leave to bring in a Bill, for his Naturalization:

It is Ordered, That Leave be given to bring in a Bill, as desired.

Then the Lord Delawarr presented to the House, pursuant to the said Order, a Bill, intituled, "An Act to naturalize Nicholas Haiiman."

And the same was read the First Time.

Woollen Manufacture, further Encouragement of, Bill.

Hodie 2a vice lecta est Billa, intituled, "An additional Act for the encouragement of the Woollen Manufactures of this kingdom, by the more effectual preventing the unlawful Exportation of the Woollen Manufactures of the Kingdom of Ireland to Foreign Parts."

Ordered, That the said Bill be committed to a Committee of the whole House, on Thursday next; and that the same be forthwith printed.

Representation of Commissioners for Trade, referred to Committee.

Ordered, That the Representation of the Commissioners for Trade and Plantations, delivered in to this House the 25th of February last, upon the proper Methods for preventing the Running of Wool from England and Ireland, be referred to the said Committee.

Message from H. C. with a Bill.

A Message was brought from the House of Commons, by Sir William Yonge and others:

With a Bill, intituled, "An Act to explain, amend, and render more effectual, an Act made in the Twelfth Year of the Reign of His late Majesty King George the First, intituled, An Act to prevent frivolous and vexatious Arrests;" to which they desire the Concurrence of this House.

Return and Report concerning Brandy, delivered.

The House being informed, "That Mr. Carkesse, Secretary to the Commissioners of the Customs, attended:"

He was called in; and delivered, at the Bar, pursuant to their Lordships Address to His Majesty of Wednesday last,

The Return of the Commissioners of the Customs, with a Copy of a Report to the Treasury, relating to the Importation of Brandy from Dunkirk."

And then he withdrew.

And the Titles of the said Return and Report were read, by the Clerk.

Obliging Justices to proceed at Quarter Sessions, Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act to oblige the Justices of the Peace, at their General or Quarter Sessions, to determine Appeals made to them, according to the Merits of the Case, notwithstanding Defects of Form in the original Proceedings; and to oblige Persons suing forth Writs of Certiorari, to remove Orders made on such Appeals into His Majesty's Court of King's Bench, to give Security to prosecute the same with Effect."

Ordered, That the said Bill be committed to a Committee of the whole House, on Monday next.

Justices of Peace Qualification, Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act for the further Qualification of Justices of the Peace."

And, after some Time spent therein, the House was resumed.

And the Lord Viscount Falmouth reported from the said Committee, "That they had gone through the said Bill, and made several Amendments thereunto; which he was directed to report, when their Lordships will please to receive the same."

Ordered, That the said Report be received on Monday next.

Bankrupts Bill.

The Order of the Day being read, for the House to be in a Committee upon the Bill, intituled, "An Act to prevent the committing of Frauds by Bankrupts:"

It is Ordered, That the House be put into a Committee thereupon, on Thursday next.

For disarming the Highlands, Bill.

Whereas Monday next is appointed, for the 2d Reading of the Bill, intituled, "An Act for continuing an Act of the Eleventh Year of His late Majesty's Reign, intituled, An Act for more effectual disarming The Highlands in that Part of Great Britain called Scotland; and for the better securing the Peace and Quiet of that Part of the Kingdom:"

It is Ordered, That the said Bill be read a 2d Time on the Friday following; and the Lords to be summoned.

Copies of the several Commissions of the Peace, for the Shires of Dunbarton, Perth, Kincardin, Aberdeen, Inverness, Nairn, Cromarty, Argyle, Forfar, Bamf, Sutherland, Caithness, Elgin, and Ross, in that Part of Great Britain called Scotland.

And then he withdrew.

And the Titles thereof were read, by the Clerk.

River Ouze Navigation, Bill:

The Lord Malton reported from the Lords Committees to whom the Bill, intituled, "An Act for rendering more effectual an Act passed in the Thirteenth Year of the Reign of His late Majesty King George the First, intituled, "An Act for improving the Navigation of the River Ouze, in the County of York," was committed: "That they had considered the said Bill, and examined the Allegations thereof; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

The said Bill was read the Third Time.

And the Question being put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Tiverton Town to rebuild, Bill:

The Lord Viscount Falmouth reported from the Lords Committees to whom the Bill, intituled, "An Act for the better and more easy re-building of the Town of Tiverton, in the County of Devon; and for determining Differences touching Houses and Buildings burnt down or demolished by reason of the late dreadful Fire there; and for the better preventing Dangers from Fire for the future," was committed: That they had considered the said Bill, and examined the Allegations thereof; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

The said Bill was read the Third Time.

And the Question being put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Messages to H. C. that the Lords have agreed to the Two preceding Bills.

And Messages were severally sent to the House of Commons, by Mr. Allen and Mr. Edwards:

Conduits, &c. in Hyde Park, Bill.

The Lord Delawarr reported from the Lords Committees to whom the Bill, intituled, "An Act for vesting the Conduits, Springs, and Waters, in Hyde Park, in Trustees, for the Benefit of His Majesty," was committed: "That they had considered the said Bill, and examined the Allegations thereof; and that the Committee had gone through the Bill, and made several Amendments thereunto."

Which, being read Twice by the Clerk, were agreed to by the House.

Ordered, That the said Bill, with the Amendments, be engrossed.

Francis's Bill.

The Lord Bishop of Carlisle reported from the Lords Committees to whom the Bill, intituled, "An Act for charging the settled Estate of John Francis Clerk with the Payment of his Father's Debts and Legacies; and for settling another Estate, of greater Value, to the Uses of his Marriage Settlement," was committed: "That they had considered the said Bill, and examined the Allegations thereof; and that the Parties concerned had given their Consents; and that the Committee had gone through the Bill, and made some Amendments thereunto."

Which, being read Twice by the Clerk, were agreed to by the House.

Ordered, That the said Bill, with the Amendments, be engrossed.

Message from H. C. with a Bill.

A Message was brought from the House of Commons, by Sir Charles Turner and others:

With a Bill, intituled, "An Act to empower the Commissioners of His Majesty's Treasury, or the Lord High Treasurer, for the Time being, to make forth Standing Orders (according to an Act passed in the Eighth Year of the Reign of His late Majesty King George the First) in Lieu of Nevis and St. Christopher's Debentures, made out in the Names of certain Proprietors, for their Losses, to such Persons who have purchased the said Debentures of their Attornies or Agents; the original Proprietors thereof, their Heirs, Executors, or Administrators, not claiming and making out their Property to such Debentures within the Time limited in the Act;" to which they desire the Concurrence of this House.

Act for repairing Fulham, Kensington, &c. Roads, to explain, Bill:

Hodie 2a vice lecta est Billa, intituled, "An Act to explain, amend, and render more effectual, an Act passed in the Twelfth Year of the Reign of His late Majesty King George the First, intituled, An Act for repairing the Roads, in the Parishes of Kensington, Chelsea, and Fulham, and other Parishes, in the County of Middlesex."

Ordered, That the said Bill be committed to a Committee of the whole House, on Thursday next.

Instruction to receive a Clause:

Ordered, That it be an Instruction to the said Committee, "That they do receive a Clause, or Clauses, to repeal so much of the Act made in the Twelfth Year of the Reign of His late Majesty, intituled, "An Act for repairing the Roads, in the Parishes of Kensington, Chelsea, and Fulham, and other Parishes therein mentioned, in the County of Middlesex," which directed a Gate, or Turnpike, to be erected, Eastward of Hyde Park Gate, near Clay Hill; and to enact, that the same be taken down, and placed Westward of Hyde Park Gate aforementioned; and likewise further to enact, that the Gate, or Turnpike, erected to the Eastward of William Green's Brewhouse, leading to Chelsea, be removed to a more convenient Place."

Accompt of Money raised by the Toll to be brought.

Ordered, That the Trustees for putting the Act abovementioned in Execution do lay before this House, an Accompt of what Money has been received for the Tolls and Duties required to be taken by the same Act; how the same has been paid or applied, when, and to whom; and that the said Accompt be delivered in to this House upon Oath.

Causes put of.

Whereas this Day is appointed, for hearing the Cause wherein Ralph Norton is Appellant, and William Kyffia and Elizabeth Heron are Respondents:

It is Ordered, That the hearing the said Cause be put off till Wednesday next; and the other Causes on Cause-days removed in Course.

Blandford Town to rebuild, Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act for the better and more easy rebuilding of the Town of Blandford Forum, in the County of Dorset; and for determining Differences touching Houses and Buildings burnt down or demolished by reason of the late dreadful Fire there."

Pilots Pet. for the Bill to regulate Pilots.

A Petition of the Persons who are thereunto subscribed, licensed Pilots of the Corporation of Trinityhouse of Deptford Strond, in the County of Kent, on Behalf of themselves and others, licensed Pilots of the said Corporation, was presented, and read; praying, That the Bill for the better Regulation and Government of Pilots may pass:"

It is Ordered, That the said Petition do lie on the Table till the said Bill be read a 2d Time.

Account of Arms in the Highlands delivered.

The Duke of Greenwich (by His Majesty's Command) presented to the House, pursuant to their Lordships Address of Wednesday last,

"An Account of the Quantity, Sorts, and Condition, of Arms, received into His Majesty's Stores, and at what Time, in Pursuance of the Acts for the more effectual disarming The Highlands in Scotland."

And the Title thereof was read, by the Clerk.

Address for an Accompt of Money issued for Schools in the Highlands.

Ordered, That an humble Address be presented to His Majesty, "That He will be graciously pleased to order the proper Officer to lay before this House, an Accompt of what Sums of Money, arising our of the Sale of the forfeited Estates in Scotland, have been issued, for erecting Schools in The Highlands of Scotland, in Pursuance of a Clause in an Act made in the Fourth Year of the Reign of King George the First, intituled, "An Act for vesting the forfeited Estates in Great Britain and Ireland in Trustees, to be sold, for the Use of the Public;" in which said Act it is provided, that a Sum, not exceeding Two Thousand Pounds Sterling, be appropriated and applied towards erecting and maintaining Schools in The Highlands of Scotland."

Ordered, That the said Address be presented to His Majesty by the Lords with White Staves.

To explain the Black Act, Bill.

A Message was brought from the House of Commons, by Mr. Towers and others:

With a Bill, intituled, "An Act to explain and amend an Act made in the Ninth Year of the Reign of His late Majesty King George the First, intituled, "An Act for the more effectual punishing wicked and evildisposed Persons going armed in Disguise, and doing Injuries and Violences to the Persons and Properties of His Majesty's Subjects; and for the more speedy bringing the Offenders to Justice;" to which they desire the Concurrence of this House.

The said Bill was read the First Time, and ordered to be read a 2d Time on this Day Sevennight; the Lords to be summoned; and the Judges to attend.

It is Ordered, That the Petitioners may be heard, as desired, at the 2d Reading of the said Bill.

Witnesses to attend Pilots Bill.

Ordered, That George Westgarth, John Cotes, Henry Bull, Robert Ludgate, Henry Blommart, Harman Poolman, Collet, Hans Grinbar, Thomas Smith, Richard Jenkins, John Vousden, W'm Whitehall, and Alexander How, do attend this House, in order to be examined, as Witnesses, at the 2d Reading of the said Bill.

Ordered, That the Information, Proceedings, and Verdict, together with the Judgement given thereupon in the Court of Exchequer, in a Cause there lately depending, wherein Thomas Ellis was Defendant, relating to the Seizure of a Parcel of Brandy, be laid before this House.

Nevis and St. Christopher's Debentures, Bill.

Moved, "That it be an Instruction to the said Committee, That they do receive a Clause, That no Person shall be capable of being a Justice of the Peace, in that Part of Great Britain called Scotland, or of acting as such, who is not qualified to be a Commissioner of Supply in one or other of the Counties of that Part of Great Britain; excepting always the Magistrates of Royal Boroughs, and His Majesty's Advocate and Solicitor General, for the Time being."
