Nisbet's Bill.

A Petition of Philip Carteret Webb, Solicitor for Alexander Kincard and others, Respondents to the Appeal of Andrew Millar and others, was presented, and read, setting forth, "That Monday next is appointed, for hearing the Cause upon the said Appeal, but that the Proceedings in the Court of Session in Scotland, from whence the same is brought, are very lately come to the Petitioner's Hands, and of so great Length, that it is impossible for him to be ready by the Time appointed, and that he apprehends it will be necessary to bring a Cross Appeal against Part of an Interlocutor in the Appellant's Favour," and praying, "That the hearing this Cause may be adjourned to such Time as this House shall think proper"

And thereupon the Petitioner and the Agent for the Appellants were called in, and heard at the Bar.

And being withdrawn.

Ordered, That the said Hearing be put off to the First vacant Day for Causes after those already appointed.

The Lord Willoughby of Parham reported from the Lords Committees to whom the Bill, intituled, "An Act for establishing a Partition, made between Dame Mary Lake and others, of divers Estates, in the Parishes of West Thorock and Stifford, in the County of Essex, in Pursuance of several Orders of the High Court of Chancery," was committed "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment"

Ordered, That the said Bill be engrossed.

Trevor's Bill.

The Lord Delawarr reported from the Lords Committees to whom the Bill, intituled, "An Act for empowering Trustees to cut down and sell Timber upon the Estate late of John Trevor Esquire, in the Counties of Denbigh and Flint, for discharging his Debts, and also to make Leases of Mines in the said Counties," was committed "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true, that the Parties concerned had given then Consents, and that the Committee had gone through the Bill, and made some Amendments thereunto"

Which, being read Twice by the Clerk, were agreed to by the House.

Pownoll's Ballast Engine, Bill.

His Lordship made the like Report from the Lords Committees to whom the Bill, intituled, "An Act for securing the sole Property, Benefit, and Advantage, of an Engine invented by Israel Pownoll, deceased, for raising Ballast, Sullage, and Sand, and for removing Banks, Shelves, and Shoals, in Rivers and Harbours, to the Children of the said Israel Pownoll, for a certain Term of Years," was committed.

Foord's Petition, about the Place of Necessary Woman.

Upon reading the Petition of Mary Foord (Wife of Charles Foord, One of the Door-keepers at ending this House), appointed Necessary Woman to their Lordships by the late Sir Charles Dalton, Gentleman Usher of the Black Rod, setting forth a Proceeding had in this House in the Year 1747, upon an Application of the Petitioner then made, in relation to her said Office, and praying, "In regard a Proof is lately found out that may serve to set this Matter in a new Light, that this Affair may be re-heard"

This Day being appointed, for hearing Counsel, upon the amended Petition and Appeal of Julia, Mary, Barbara, and Jean Hog, Infants, Daughters of the deceased John Hog the Younger of Cammo, in the County of Edinburgh, and Sir Philip Musgrave of Edenhall in the County of Cumberland Baronet, Uncle to the said Infants, by their Mother, and Henry Scrymgeor Writer to the Signet at Edinburgh, Tutor ad Litem to the said Infants complaining of Part of an Interlocutor of the Lords of Session in Scotland, of the 1st of December 1748, and also of Part of an Interlocutor of the same Lords, of the 12th of July 1749, and likewise of Two subsequent Interlocutors of the said Lords, of the 25th of the same Month and 1st of December last, and likewise of Part of an Interlocutor of the Lord Ordinary, of the 16th of the same December, and praying, "That the same might be reversed, and such other Relief given the Appellants as to this House in their great Wisdom and Justice should seem meet," to which Appeal, John Hog and Margaret his Daughter were ordered to put in their Answer.

Counsel were accordingly directed to be called in.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That that Part of the said Interlocutor of the 1st of December 1748, reserving to the Defender to be heard how far he is entitled to plead the Benesicum Competontræ, be, and the same is hereby, reversed, and that that Part of the said Interlocutor of the 12th of July last, reserving to the Petitioner Margaret Hog to be heard upon her Claim, for the Interest of the Three Thousand Merks after her Father's Death, be also reversed And it is further Ordered and Adjudged, That the said Interlocutors of the 25th of July and 1st of December 1749 be, and are hereby, likewise reversed And it is also Ordered and Adjudged, That so much of the said Interlocutor of the 16th of the same December, whereby the Lord Ordinary found the said John Hog preferable to the Pursuers, in virtue of his Life-rent Enfeoffment on the aforesaid Houses in Edinburgh, to the Extent of the said Sum of Thirty Pounds Sterling of Aliment Yearly, commencing from Martinmas 1744, during his Life time, and found the said Margaret Hog also preferable to the said Pursuers, to the Extent of the said Hundred Pounds Scots, in virtue of the Bond of Provision from her Father, in Favour of her and his other Younger Children, upon the Principal Sum of One Thousand Pounds Sterling, and Annual Rents thereof, in Watson of Sauchton's Bond, also commencing from Martinmas 1744, during her Life time, and decerned in the said Preference, and afsoilzied the Defendants from the Reductions in so far as concerned the aforesaid Life-rents, be, and the same is hereby, also reversed, but without Prejudice to any Remedy the said Respondent Margaret Hog may be entitled to, in respect of any Claim she may have to the Annual Rent or Interest of Three Thousand Merks, under the Marriage Agreement and Bond of Provision in the Appeal mentioned, after the Death of the said John Hog her Father.

After hearing Counsel, as well Yesterday as this Day, upon the amended Petition and Appeal of Sir Thomas Hay of Alderston Baronet, complaining of Two Interlocutors of the Lord Ordinary, of the 22d of July and 9th of December 1749, and also of an Interlocutor of the Lords of Session in Scotland, of the 2d of January following, whereby they adhered to the Lord Ordinary's said Interlocutors, and likewise of a subsequent Interlocutor of the Lord Ordinary, of the 12th of the same Month, made on the Behalf of Thomas Hay of Mordington, and praying, "That the said Interlocutors might be reversed or varied, and that the Appellant might have such Relief as to this House should seem meet" As also upon the Answer of the said Thomas Hay, and likewise the Answer of His Majesty's Advocate for Scotland, put in to the said Appeal, and due Consideration had of what was offered on either Side in this Cause.

Judgement.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal be, and is hereby, dismissed this House, and that the said Interlocutors therein complained of be, and the same are hereby, affirmed.
