Calverley Common, Bill.

The Earl of Warwick reported from the Lords Committees to whom the Bill, intituled, "An Act for dividing and enclosing certain Wastes and Commons, in the Manor of Calverley, in the West Riding of the County of York," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and made some Amendments thereto."

Which Amendments, being read Twice by the Clerk, were agreed to by the House; and are as follow:

"Press 3. Line 37. After ["same"], insert ["and the Residue thereof"].

"Last Line of the same Press. After ["deducted"], insert ["shall be set out, assigned, and allotted."]

"Press 16. Line 23. After ["concerned"], insert Clause (A).

"(A) And whereas the setting out and allotting the said Common or Moor and Parcels of Waste Grounds into Shares, for the Persons to whom the same are to be allotted, and the ascertaining and determining any Claims or Disputes touching Right of Common in and upon the said Common or Moor and Parcels of Waste Grounds, may happen to be attended with great Trouble and Difficulty to the Commissioners herein before named; it is therefore hereby Enacted, by the Authority aforesaid, That, if the said Commissioners shall think it requisite and necessary to have any further Assistance for those Purposes, it shall and may be lawful to and for the said Commissioners herein before named, by Writing under their Hands and Seals, to nominate and appoint Two other Persons, to be joined with them as Commissioners, for the Purposes of setting out and allotting into Shares, for the Persons to whom the same are to be allotted respectively, such Common or Moor, and Parcels of Waste Grounds, and settling and determining such Differences and Disputes relating to Right of Common in and upon the same; and in that Case the Award of the said Commissioners nominated and appointed, and to be nominated and appointed, by and in Pursuance of this Act, or of any Three or more of them, shall be final and conclusive to all the Parties concerned."

Ratcliffe to Rotherith Ferry, Bill.

The Earl of Northumberland reported from the Lords Committees to whom the Bill, intituled, "An Act for establishing and maintaining a Ferry across the River Thames, between the Hamlet of Ratcliffe in the County of Middlesex, and the Parish of Rotherhithe in the County of Surrey," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Knighton Common Bill:

Hodie 3a vice lecta est Billa, intituled, "An Act to confirm and establish an Agreement, for dividing and enclosing several Fields, Meadows, and a Cow Pasture, in Knighton, in the County of Leicester."

The Question was put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Nunburnholme Common, Bill:

Hodie 3a vice lecta est Billa, intituled, "An Act for dividing and enclosing several Open Fields and Pastures, or Commons, in the Township of Nunburnholme, in the County of York."

The Question was put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Thirsk and other Roads, Bill.

A Message was brought from the House of Commons, by Sir Conyers D'arcy and others:

With a Bill, intituled, "An Act for repairing and widening the Road from Thirsk, over Skipton Bridge, through Baldersby, to Baldersby Gate adjoining to Hutton Moor, in the Way to Ripon, and through Ainderby, Quernhow, and Nosterfield, by Well Flashes Gate, to Masham in the County of York; and likewise for removing the Toll House and Turnpike Gates at Busby Stobb, in the said County, to some other convenient Place, in the Road leading from Boroughbridge to the City of Durham;" to which they desire the Concurrence of this House.

Sharpe against Maxwell: Writ of Error Non pros'd.

Upon reading the Petition of William Sharpe Esquire, Defendant in a Writ of Error depending in this House, in which John Maxwell Esquire is Plaintiff; praying, In regard the Plaintiff hath not assigned Errors within the Time limited by the Standing Order of this House for that Purpose; that the same may be Non pros'd, with such Costs as to their Lordships shall seem meet:"

It is Ordered, That the Petitioner do forthwith enter a Non pros. on the said Writ of Error, as desired; and that the Record be remitted to the Court of King's Bench, to the End Execution may be had upon the Judgement given in that Court, as if no such Writ of Error had been brought into this House: And further, That the Plaintiff in Error do pay, or cause to be paid, to the Defendant in Error, the Sum of Fifty Pounds, for his Costs by reason of the Delay of the Execution of the said Judgement.

Marsk and Redcarr Commons, Bill.

A Message was brought from the House of Commons, by Mr. Reynolds and others:

With a Bill, intituled, "An Act for the enclosing, dividing, and exchanging, the Common Fields, Common Meadows, and other Grounds, in the Townships of Marsk and Redcarr, within the Manor of Marsk, in Cleveland, in the North Riding of the County of York; and for providing a certain Recompense to the Vicar of Marsk, in Lieu of his Tithes and the greatest Part of his Glebe;" to which they desire the Concurrence of this House.

Houghton against West & al.

After hearing Counsel further, in the Cause wherein Arthur Houghton of the County of Wexford in the Kingdom of Ireland, Esquire, is Appellant, and Ann West and others are Respondents:

"A State of the National Debt, provided or unprovided for by Parliament, as it stood on the 11th Day of January 1754, and on the 11th Day of January 1755; together with an Accompt of the Produce of the Sinking Fund in that Year; and to the Payment of what Debts, contracted before the 25th of December 1716, the said Fund has been applied."

Message from H. C. to return Lord Mansel & al. Bill for Sale of Sir Thomas Stradling's Estate.

A Message was brought from the House of Commons, by Mr. Probyn and others:

To return the Bill, intituled, "An Act for Sale of Part of the Estate late of Sir Thomas Stradling Baronet, deceased, in the Counties of Glamorgan and Somerset, for discharging Encumbrances affecting the same; and for a Division and Settlement of other Part thereof; and for other Purposes therein mentioned;" and to acquaint this House, that they have agreed to the same, without any Amendment.

Breaston Cow Pasture Enclosure, Bill.

Ordered, That the Meeting of the Committee to whom the Bill, intituled, "An Act for dividing and enclosing Breaston Cow Pasture, in the County of Derby," stands committed, which is appointed for Friday next, be put off to Monday next.

Lord Middleton and Bird Exchange, Bill.

Ordered, also, That the Meeting of the Committee to whom the Bill, intituled, "An Act for confirming and establishing an Exchange of certain Lands in Little Lcake, in the County of Nottingham, pursuant to an Agreement between Francis Lord Middleton and Robert Bird; and for other Purposes therein mentioned," stands committed, which is appointed for Saturday next, be put off till Monday.

Bramston's Bill.

The Lord Sandys reported from the Lords Committees to whom the Bill, intituled, "An Act for vesting the settled Estates of Edmund Bramston Esquire and Henrietta Maria his Wife in Trustees, for raising several Sums of Money, for discharging Portions charged upon the same; and for other Purposes therein mentioned," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Ordered, That the said Bill be engrossed.

Kirkman's Nat. Bill.

Houghton against West & al.

After hearing Counsel, as well on Monday last as Yesterday and this Day, upon the Petition and Appeal of Arthur Houghton in the County of Wexford in the Kingdom of Ireland Esquire, complaining of an Order of the Court of Exchequer in the said Kingdom, of the 1st of December 1752, made in a Cause wherein the Appellant was Plaintiff, and Ann West, James West, Sir Henry Tuite, Anthony Malone, and Edmond Malone, were Defendants; and also complaining of a Decree of the said Court, of the 11th of May 1744; and of Two Reports, of the 19th of April 1746, and 3d of May 1748; and also of several Orders, of the 15th of November 1746, 8th of July 1748, 2d of June 1749, 15th of December and 5th of February 1749, and 20th of June 1750, made in another Cause, wherein the said Ann West and James West were Plaintiffs, and Sir Henry Tuite, Richard Malone, Thomas Magan, James Houghton, the Appellant, Euphenia Houghton, Nicholas Loftus, and Francis Annesley, were Defendants; and praying, "That the same, or so much thereof respectively as affects the Appellant, might be reversed, or varied and rectified; and that this House would grant the Appellant such further and other Relief in the Premises as the Nature and Circumstance of the Case might require, and as their Lordships in their great Wisdom should think proper:" As also upon the Answers of Ann West Widow, and James West Esquire, Sir Henry Tuite Baronet, Anthony Malone and Edmond Malone Esquires, put in to the said Appeal; and due Consideration had of what was offered on all Sides in this Cause:

Judgement.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Decree of the said Court of Exchequer of the 11th of May 1744, and the said Order of the said Court of the 8th of July 1748, be, and the same are hereby, affirmed: And as to the Orders of the 19th of April, 5th of May, and 2d of June, 1749, relating to the Application for re-hearing the Cause, it is hereby Declared, That there was not a sufficient Foundation for the said Court of Exchequer to require the Appellant to pay within a Week all the Costs incurred in Equity and at Law since the said Decree, as the Terms of granting such Re-hearing; but that it would have been sufficient for the said Court to have required the Appellant to give Security for, or to submit to pay, the said Costs, in case the said Decree should (fn. 1) have been materially varied upon such Re-hearing; but, considering the subsequent Proceedings, and that the Appellant hath appealed to this House against the said Decree, which is hereby affirmed, their Lordships do not think fit to reverse those Orders: And it is further Ordered and Adjudged, That the said Order of the 1st of December 1752, for setting aside the Appellant's Bill exhibited on the 12th of June 1752, be, and the same is hereby, reversed; it appearing that the said Bill, besides such Part thereof as prayed a Review and Reversal of the said former Decree and Orders, was also an Original Bill, praying Relief for the Appellant against the Respondents Sir Henry Tuite and the Representatives of Sir Joseph Tuite: And it is hereby further Ordered and Adjudged, That all the other Orders and Proceedings of the said Court of Exchequer, complained of in and by the said Appeal, be, and the same are hereby, affirmed.
