Clearing the River Thames to Oxford.

HODIE 1a vice lecta est Billa, An Act for the Explanation and Execution of an Act of Parliament, made in the Third Year of His Highness's Reign of this Realm of England, intituled, An Act for clearing the Passage by Water, from London, to and beyond the City of Oxon.

Warrants to search Records for Privileges.

The Earl of Huntingdon declared, That the Lords Sub-Committees, for taking Consideration of the Customs, Orders, and Privileges, &c. had met; and, for their better Information, had begun to make Search and View of some Records; and, finding such Search to be intricate and tedious, do desire, that, for their Ease, and more speedy Proceeding in that Business, the said Lords Sub-Committees may, by Order of this House, be authorized, under the Hands of Three of their Lordships at the least, to depute, and give Warrant unto, certain Persons, to make Search, and have View, in all or any His Majesty's Records, touching the Matter and Subject aforesaid, in such Sort, as by Order of this Court, taken on Wednesday the Fourteenth of this Instant February, the said Lords Sub-Committees may or are authorized to do; which was generally agreed, by all their Lordships now present.

Rectifying the Journal Book.

It was likewise moved, That the said Lords SubCommittees shall and may daily, or as often as their Lordships shall think fit, peruse and rectify the Journal Book of this House, and the Entrances therein made, and hereafter from Time to Time to be set down, by the Clerk of the Parliament; which was Ordered accordingly.

Lords excus'd.

The Absence of the Lord Archbishop of Cant. excused by the Lord Chancellor, for Want of Health.

Lord Dacres excused, for the like Cause.

The Lord Bishop of excused, because he is Tomorrow to preach at Paules Crosse.

Judges doubtful to deliver Opinion concerning His Majesty's Prerogative.

The Lord Hunsdon shewed to the House, That the whole Body of the Committee, for taking Consideration of the Customs and Orders of this House, and Privileges, &c. did lately meet; and, on some Point then in Debate among them, did require the Opinion of Two Judges, formerly appointed to assist and attend them, and then present; which Judges, his Lordship further declared, were doubtful to deliver any Opinion, or thereof to enter into Discourse, for that the Matter proposed did, as the same Judges then alledged, touch His Majesty's Prerogative: But their Lordships conceiving, and being persuaded, that the same did not any way concern His Highness's Prerogative, therefore such Forbearance of the Lords the Judges, to satisfy them in a Matter demanded, and the Reason thereof given as aforesaid, was, as his Lordship further said, much disliking and distasteful to the said Lords Committees.

Unto that which the Lord Hunsdon had spoken, the Lord Houghton added, that what the (fn. 1) Earl which last spoke had delivered, did not proceed from Curiosity in the Lords Committees aforesaid, who had perused the Writs of Summons directed to the Lords the Judges, and find that they are thereby called, "Consilium impensuri." Lastly, his Lordship affirmed, that the said Lords Committees are all tender of His Highness's Prerogative, and know it to be so fitting.

Hereupon it was thought fit, that the Two Judges, whom the Matter next before handled and set down did concern, should be heard, to answer and speak thereunto. And, because one of them was not this Day present, nor did now attend the Court; therefore it was Ordered, That both the said Lords the Judges shall, at the next Sitting of this Court, be present, and attend the same.

E. of Bedford's Lands.

Hodie 1a vice lecta est Billa, An Act for the freeing and discharging of some Manors, Lands, and Tenements, late the Earl of Bedford's, of and from certain Rents and Fee-Farms, due and payable to the King's Majesty, and to impose and lay the same wholly upon other Manors, Lands, and Tenements, chargeable with the same.

Sir Philip Cary's, &c. Grant of Minster.

Hodie 2a vice lecta est Billa, An Act for the Confirmation of His Majesty's Letters Patents to Sir Phillip Cary, Knight, and others, of the Manor of Minster, in the Isle of Thanett, in the County of Kent.

Lord Scrope, E. of Berkshire.

This Day the Lord Scrope moved the Lords, for the Enlargement of the Earl of Berkeshire, who Yesterday was, by the House, committed close Prisoner to The Fleet, for such Contempt by his Lordship towards this Court as then appeared; upon which Motion, it was Ordered, and Agreed, that the said Earl shall presently be permitted to have the Liberty of the said Prison, and so to continue until this House shall take further Order therein.

Adjourn.
