The Answer of the Reverend Henry Leslie Clerk and Catherine his Wife, Two of the Respondents to the Appeal of Thomas Meredyth Esquire and others;

Kymer to make a Navigable Canal from Gwendraeth River, Bill.

The Lord Sandys reported from the Lords Committees to whom the Bill, intituled, An Act to enable Thomas Kymer Esquire to make a Navigable Cut, or Canal, from Little Gwendraeth River, near the Town of Kidwely, to the Great Forest and Pwll Llygod in the County of Carmarthen, was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment.

Tunbridge Wells, Road Bill.

The Lord Botetourt reported from the Lords Committees to whom the Bill, intituled, An Act for repairing, widening, and keeping in Repair, the Road leading from Tonbridge Wells in the County of Kent, to the Cross Ways near Maresfield Street, in the County of Sussex was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment.

Tufnells Petition referred to Judges.

Upon reading the Petition of George Forster Tufnell Esquire; praying Leave to bring in a Bill, to enable him to grant any Lease, or Leases of certain Estates in the Petition mentioned, to any Person or Persons, for such Term of Years, and under and subject to such Conditions and Restrictions, as shall be thought requisite and expedient:

It is Ordered, That the Consideration of the said Petition be, and is hereby, referred to the Lord Chief Baron of the Court of Exchequer and Mr. Justice Bathurst who are forthwith to summon all Parties concerned in the Bill; and, After hearing them, are to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties who may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.

Blackheath &c small Debts, Bill.

Hodie 2a vice lecta est Billa, intituled, An Act for extending the Provisions of an Act, made in the last Session of Parliament, for the more easy and speedy Recovery of small Debts, within the Hundreds of Blackheath. of Bromley and Beckenham, of Rokesley otherwise Ruxley, and of Little and Lessness, in the County of Kent, to the Hundred of Wallington in the County of Surrey.

Dean and Chapter of Canterbury Petition referred to Judges.

Upon reading the Petition of the Dean and Chapter of the Cathedral and Metropolitical Church of Christ of Canterbury; praying Leave to bring in a Bill, to enable them and their Successors to make and grant a Lease or Leases of several Pieces or Parcels of Ground, and the Houses and Buildings erected thereon, in the Petition mentioned, for a longer Term of Years than they are at present enabled to grant:

It is Ordered, That the Consideration of the said Petition be, and is hereby, referred to Mr. Justice Clive and Mr. Justice Wilmot; who are forthwith to summon all Parties concerned in the Bill; and, After hearing them, are to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties who may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.

Upon reading the Petition of the most Noble Harry Duke of Bolton; praying Leave to bring in a Bill, to enable any Woman to whom certain Castles, Manors, Lands, and Hereditaments, in the Petition mentioned; and also to enable every Husband to whom any Woman inheritable to, and in Possession of, the said Lands and Hereditaments, by virtue of an Act in the Petition mentioned, shall limit or appoint any of the said Lands or Hereditaments for Life, from Time to Time, during her or his Life when in Possession and entitled, to make Leases, for One, Two, or Three Lives, or for Years determinable on One, Two, or Three Lives, in Possession or Reversion; and for other Purposes therein mentioned:

Malt Bill.

A Message was brought from the House of Commons, by Mr. Pattison and others:

With a Bill, intituled, An Act for continuing, and granting to His Majesty, certain Duties upon Malt Mum, Cyder, and Perry, for the Service of the Year One Thousand Seven Hundred and Sixty-six; to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Bridges against Shirley:

Upon reading the Petition of William Bridges, Appellant in a Cause depending in this House; and also of Lewis Shirley and others Respondents to the said Appeal, which Appeal stands appointed to be heard; prayings; In regard the Difference between the Parties has been settled, that they may be at Liberty to withdraw the said Appeal, without Costs:

Appeal withdrawn.

It is Ordered, That the Petitioners be at Liberty to withdraw their Said Appeal, as desired.

Wilson against Lang.

The House being moved, That a Day may be appointed, for hearing the Cause wherein Alexander Wilson and Robert Pollock Merchants in Paisley are Appellants, and William Lang is Respondent, ex Parte; the Respondent not having put in an Answer, though peremptorily Ordered so to do:

It is Ordered, That this House will hear the said Cause ex Parte, by Counsel, at the Bar, on the First vacant Day for Causes After those already appointed, unless the Respondent put in an Answer in the mean Time.

E. of Portsmouths Petition referred to Judges.

Upon reading the Petition of the Right Honourable John Earl of Portsmouth; praying Leave to bring in a Bill, for Sale of certain Lands, Tenements, Hereditaments, and Tithes, in the Petition mentioned; and for laying out the Money arising thereby in the Purchase of other Lands, Tenements Hereditaments, and Tithes, to be settled to the same Uses:

It is Ordered, That the Consideration of the said Petition be, and is hereby, referred to the Lord Chief Baron of the Court of Exchequer and Mr. Justice Clive; who are forthwith to summon all Parties concerned in the Bill; and, After hearing them, are to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties who may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.

Mathews Divorce Bill.

The Order of the Day being read, for the Second Reading of the Bill, intituled, An Act to dissolve the Marriage of John Mathews with Ann Mathews his now Wife, and to enable him to marry again; and for other Purposes therein mentioned; and for hearing Counsel for and against the same.

Counsel were accordingly called in;

And Mr. Dagge appearing as Counsel for the Bill; but no Counsel appearing on Behalf of Mrs. Mathews against it:

Edward Hales was called, in order to prove Service of the Order; who, being sworn, acquainted the House, That he served Mrs. Mathews personally with the Order of the House, for the Second Reading of the Bill, at Compton in Berkshire, on Monday the 3d of this Instant February; and, at the same Time, delivered to her a true Copy of the Bill.

And then he was directed to withdraw.

Then the said Bill was read a Second Time.

And the Counsel was heard, in Support of the Bill; and to make out the Allegations thereof; and, in order to prove the Marriage, called,

Edward Hales; who, being sworn, produced a Copy of the Register of the Marriage, in the Parish of West Isley, in the County of Berks, 1753, whereby it appeared, that John Mathews was married to the said Ann Mathews on the 27th of February, 1753.

He was directed to withdraw.

Then Mr. John Green, Register of the Arches Court of Canterbury, was called in; and, being sworn, produced the original Definitive Sentence of Divorce of the said Court against the said Mrs. Mathews, for Adultery.

And the same was read.

And then he withdrew.

Then William Cripps, Servant to the Father of Mrs. Mathews, was called, in order to prove the Adultery; who, being sworn, acquainted the House, That Mrs. Mathews lived at her Fathers House for about Half a Year After the was married to Mr. Mathews; that he (the Witness) having a Suspicion of an unlawful Intercourse between the said Mrs. Mathews and one Thomas Palmer, who took her Fathers Farm, and lived in her Fathers House; upon missing them one Day from a Room below Stairs, he went into an Upper Room which had not any Floor, and was over a Bedchamber, and peeped through an Hole in the Cieling of the Bedchamber, and saw the said Mrs. Mathews and the said Thomas Palmer in the Act of Adultery; that he went and called Edward Cullum, a Servant of the said Mr. Palmers, who came, and also saw them in the Act of Adultery.

He is directed to withdraw.

Then the said Edward Cullum was called in; and, being sworn, gave an Account of his going up Stairs with the said William Cripps, and there seeing the said Mrs. Mathews and Thomas Palmer in the Act of Adultery.

He is directed to withdraw.

Then Moses Kislingborough Glazier was called in; and, being sworn, acquainted the House, That Mrs. Mathews lodged and boarded at his House, at The Worlds End in Hampstead Norris; and that he had seen the said Mrs. Mathews and one John Pocock a Gentleman Farmer naked in Bed together at his House.

He is directed to withdraw.

The Evidence being finished; the Counsel was directed to withdraw.

Ordered, That the said Bill be committed to a Committee of the whole House.

Ordered, That the House be put into a committee upon the said Bill, To-morrow.

Ordered, That the proper Officer do lay before this House, an Account of all Ships arrived in their Ports of this Kingdom, which have been cleared out from any of the British Colonies in America, since the First of November last; specifying the Colonies from whence they have been respectively cleared out, and Also whether any, and which, of the said Ships, have offered to make Entries here without having their Clearances, or other Papers, properly stamped agreeably to an Act passed in the last Session of Parliament, and what has been done in Consequence thereof.

Accompt of Bullion brought to the Bank from America, to be laid before the House.

Ordered, That Mr. Daniel Race, Cashier of the Bank of England, do attend this House on Friday next, to the with an Accompt of Bullion imported and brought to Bank from the British Colonies of North America, in every Year, from 1748 to 1765, both inclusive; specifying the several Colonies from whence the same was imported, the. Ships in which it was brought, and the Totals thereof; together with the like Accompt of Bullion imported and brought to the Bank, from Jamaica and the other West India Islands, in every Year during the same Period.

Address for an Accompt of Expense of the British Colonies in America.

Ordered, That an humble Address be presented to the Expense His Majesty, That He will be graciously pleased to of the give Directions to the Commissioners for Trade and Plantations, to prepare and lay before this House a State of the Annual Expense of the several Establishments of the British Colonies in North America and The West Indies, with the Amount thereof, distinguishing each Colony respectively; and likewise a State of the Debts of the British Colonies in North America The West Indies, as they stood at the End of the late War, distinguishing what Part of the said Debts remain undischarged, and the Provision made for such Discharge; according to the latest Accounts received of the several Matters above mentioned.

Aldcrost Divorce Bill.

The Lord Delamer (pursuant to an Order of Leave of Monday last) presented to the House a Bill, intituled, An Act to dissolve the Marriage of Charles Aldcrost Gentleman with Sarah Shewell his now Wife; and to enable him to marry again; and for other Purposes therein mentioned.

The said Bill was read the First Time.

Ordered, That the said Bill be read a Second Time on Thursday the 6th Day of March next; and that Notice thereof be affixed on the Doors of this House; and the Lords to be summoned; and that the said Charles Aldcrost may be heard, by his Counsel, at the said Second Reading, to make out the Truth of the Allegations of the Bill; and that the said Sarah Shewell may have a Copy of the said Bill; and that Notice be given her of the said Second Reading; and that she be at Liberty to be heard, by her Counsel, what the may have to offer against the said Bill, at the same Time.
