A Message was brought from the House of Commons, by Mr. Sandys and others:

With a Bill, intituled, An Act for the Relief and Employment of the Poor, and for repairing the Highways, paving, cleansing, lighting, and watching, the Streets and other Places, in the Town and Parish of Richmond, in the County of Surrey; and for removing and preventing Annoyances, Obstructions, and Encroachments, therein; and for shutting up a Road from the late Harse Ferry at Kew to West Shoene Lane near Richmond Green; and for amending and keeping in Repair the Road from Kew Bridge to Richmond; to which they desire the Concurrence of this House:

The House was adjourned during Pleasure, to robe.

The King Present:

His Majesty, being seated on the Throne, adorned with His Crown and Regal Ornaments, and attended by His Officers of State (the Lords being in their Robes), commanded the Gentleman Usher of the Black Rod to let the Commons know, It is His Majestys Pleasure, they attend Him immediately, in this House.

Who being come, with their Speaker; he, after a short Introduction in relation to the Money Bills to be passed, delivered them to the Clerk, who brought them to the Table; where the Deputy Clerk of the Crown read the Titles of those and the other. Bills to be passed, severally, as follow:

1. An Act for raising a certain Sum of Money, by Loans or Exchequer Bills, for the Service of the Year One Thousand Seven Hundred and Sixty-six.

2. An Act for repealing the Duties granted upon Cyder and Perry by an Act made in the Third Year of His present Majestys Reign; and for granting other Duties on Cyder and Perry in Lieu thereof; and for more effectually securing the Duties on Cyderand Perry imposed by several former Acts.

To these Bills the Royal Assent was pronounced, severally, by the Clerk Assistant, in these Words; (videlicet,)

3. An Act for discontinuing the Use of several Roads leading into and over Fisherwick Park, in the County of Stafford; and for building and maintaining a publick Bridge, cross the River Tame, at or near Elford Mill Ford, in the said County; and for repairing and keeping in Repair the Road from such Bridge to Hademore Gate, in the Road leading through Whiltington to Litchfield.

4. An Act to enlarge and continue the Term and Powers granted by an Act, passed in the Fourteenth Year of the Reign of His late Majesty King George the Second, intituled, An Act for repairing the Roads from Doncaster, through Ferry-bridge, to the South Side of Tadcaster Cross; and also from Ferry-bridge to Weatherby, and from thence to Boroughbridge, in the County of York; as to so much of the said Act as relates to the said Roads from Doncaster, through Ferry-bridge, to the South Side of Tadcaster Cross.

5. An Act for repairing and widening the Road from Bawtry in the County of York, to East Markham Common in the County of Nottingham and from Little Drayton to Twiford Bridge in the said County.

6. An Act to enlarge the Term and Powers of an Act, made in the Twenty-fifth Year of King George the Second, for repairing the Roads from the North End of Mailing Street near the Town of Lewes, and other Roads in the County of Sussex; and for amending the Road from The Brod Park Gate to the West End of the Turnpike Road leading from the Turnpike Road on Hurst Green, through the Parishes of Etchingham and Burwash, and from the said Brod Park Gate to the Town of Battell, in the said County.

7. An Act for repairing and widening the Road from the Cross or Market Place in the Town of Wimborne Minster, to the Cross or Market Place in the Town of Blandford Forum, in the County of Dorset.

8. An Act for building a Bridge cross the River Thames, from Battersea in the County of Surrey, to Chelsea in the County of Middlesex.

9. An Act for the Support and Preservation of the Parish Church of Folkestone, and the lower Part of the Town of Folkestone, in the County of Kent.

10. An Act for the better maintaining, regulating, and employing, the Poor within the Parish of Saint Botolph Aldgate, in the City of London.

With a Bill, intituled, An Act for further continuing the Duty of One Farthing per Chalder on Coals, granted by an Act of the First Year of Queen Anne, and revived and continued by an Act of the Eighth of King George the Second, for improving and repairing the Piers and Harbours of Whithy, in the County of York; and for better regulating the Shipping there: to which they desire the Concurrence of this House.

After hearing Counsel, as well on Wednesday and Friday last as this Day, upon the Petition and Appeal of the Right Honourable the Lady Mary Herbert, One of the Daughters of the Most Noble William late Marquis of Powis, deceased; complaining of an Order of the Court of Chancery, of the 11th of December 1764, made in a Cause wherein the Appellant was Plaintiff, and the Right Honourable Henry Arthur Earl of Powis and Barbara Countess of Powis his Wife, Thomas Wyld, Robert Pardoe, Edward Herbert Esquire, and James Barker Son and Heir of James Barker deceased, were Defendants; and praying. That the same might be reversed; or that the Appellant might have such men other Relief in the Premises as to their Lordships should deem meet: As also upon the Answer of Henry Arthur Earl of Powis and Barbara Countess of Powis his Wife, Thomas Wyld, Robert Pardoe, Edward Herbert, and James Barker, put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

Judgement.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Decree complained of in the said Appeal be, and the same hereby, reversed: And it is hereby Declared, That the Respondent the Earl of Powis ought, in Performance of his Agreement, to pay to the Appellant, during her Life, the Annuity of Two Hundred Pounds a Year, left her by the Will of the Marquis of Powis her Father; and also another Annuity Of Two Hundred Pounds a Year, from the 5th of December 1749: And it is hereby Ordered, That it be referred to a Master, to take an Accompt of what is due for the Arrears of the said Two Annuities: And it is hereby further Ordered and Adjudged, That the said Respondent do pay the Same, together with her Costs of Suit in the Court of Chancery: And it is hereby also further Ordered and Adjudged, That the said Respondent do pay to the Appellant, during her Life, the said Two Annuities, as they shall severally become due: And it is hereby further Ordered, That the Court of Chancery do give all proper and necessary Directions for carrying this Judgement into Execution.

Henleys Estate Bill.

The Lord Sandys reported from the Lords Committees to whom the Bill, intituled, An Act for vesting the Freehold and Leasehold Estates late of Robert Henley Esquire, deceased, in Trustees, to be sold, to raise Money, to be applied to pay off Debts and Encumbrances, and Legacies, charged upon and affecting the same, under the Direction of the Court of Chancery; and for laying out the Surplus Money in the Bank of England, subject to the further Order of the said Court, was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committed had gone through the Bill, and directed him to report the same to the House, without any Amendment.

Tuffnells Estate, Bill.

The Lord Sandys also made the like Report from the Lords Committees to whom the Bill, intituled, An Act to enable George Forster Tuffnell Esquire to grant Building Leases of Estates devised to him by Sir William Halton Baronet, in the County of Middlesex, was committed.

Sir Thomas Gooches Estate, Bill.

The Lord Sandys also reported from the Lords Committees whom the Bill, intituled, An Act to enable Sir Thomas Gooch Baronet, and his Sons Thomas Gooch, William Gooch, and John Gooch, and their Guardians, and the Guardians of their Sons during their Minority, to grant Building Leases of certain Lands in Birmingham, in the County of Warwick; and to grant a Piece of Land, lying in the same Town, for the Purposes of building a Church, and making a Church Yard; and to exchange some Lands there, was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and made some Amendments thereto.

Which Amendments, being read Twice by the Clerk, were agreed to by the House.

The Lord Sandys also reported from the Lords Committees to whom the Bill, intituled, An Act to remove and regulate the publick Markets in the City of Bath; for widening certain Streets, Ways, and Passages, within the said City, and the Liberties and Precincts thereof; and for opening certain new Streets and Ways within the same; for better paving, cleansing, lighting, watching, and regulating, the Streets, Lanes, Ways, and Passages, there; to remove all Nuisances and Obstructions therein, and to prevent the same for the future; and for better supplying the Inhabitants of the said City, Liberties, and Precincts, with Water, was committed: That they had considered the said Bill, and examined the Allegations; thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment.

Knutsford and Macclesfield Navigation Bill.

The Order of the Day being read, for the Second Reading of the Bill, intituled, An Act for making and maintaining a Navigable Cut, or Canal, from Witton Bridge to the Towns of Nether Knutsford, Macclesfield, and Stockport, in the County of Chester, and to Manchester in the County of Lancaster;and for hearing Counsel for and against the same:

Counsel were accordingly called in.

And the said Bill was read a Second Time.

And Mr. Ruffhead was heard, on Behalf of the Petitioners, against the Bill.

Mr. Dunning heard on the Behalf of the Duke of Bridgewater, a Petitioner against: the Bill; and called,

Mr. James Brindley, a Surveyor, who was sworn, and examined as to the Utility and Practicability of the intended Navigation, the Number of Locks there must necessarily be made upon it, the Nature of the (fn. 5) Manufactures of the several Towns near or adjoining to it, the Difference there will be in the Price of Carriage on the Duke of Bridgewaters Navigation and the new one, the great Injury the Dukes Navigation is likely to receive by the taking of certain Streams into the new Canal which the Duke hath at a great Expense and Difficulty brought into his Navigation, the Impracticability of carrying on the new Navigation, without taking in those Brooks; and as to the depriving of several Mills for grinding Corn of Water, by the taking in of those Streams, and the Impossibility of his Graces extending his Navigation any farther, in case the said Streams should be taken in.

Cross-examined, by the Counsel for the Bill, as to the Possibility of carrying on the new Navigation without taking in those Brooks; as to the said Navigations running through a Country improved by Lime; as to its being carried Toll-free on the Dukes Navigation; and as to the Damage his Graces Navigation will receive by the new one in case the said Brooks are not taken into it; and as to the Time when he made his Observations upon the new Navigation, and how he came by his Knowledge of the Commodities that may be carried upon it; and also as to the Price of Lime in that Country.

Then John Simpson was called in, and sworn; and examined as to the Damage the Mills for grinding Corn will receive by the new Navigation.

Cross-examined, as to there being other Mills sufficient to supply the Country in case the Water of the Brooks should be taken in.

Mr. James Wainwright was called in, and sworn; and examined to the same Effect as the last Witness.

Cross-examined, as to the Owners of the Mills in Question.

Thomas Cash was called in, and affirmed to the same Effect as the last Witness.

Francis Mason was called in, and sworn; and examined to the same Effect.

Mr. Graham was heard, in Support of the Bill; and called

Hugh Oldham, a Land Surveyor; who, being sworn, was examined in relation to the Practicability of carrying on the new Navigation without taking in the Three Brooks belonging to the Duke of Bridgewater, or taking any of his Water; as to the great Expense and Inconvenience that would attend the taking in of the said Brooks; as to the Number of Locks that must be made upon this Navigation; and as to the Damage the Dukes Navigation may receive by making the intended new Navigation.

Cross examined, by the Counsel against the Bill, as to his ever having made a Navigable Canal before; as to the Water that will be taken from the Mills by Lockage; as to the general Character of Mr. Brindley as an Engineer; and as to his own Knowledge in those Matters.

John Golbourne of Chester, Engineer, was called in, and sworn; and examined as to the Estimate he had made of the Expense of the new Navigation, the Number of Locks that must be necessarily made upon it, and as to the Practicability and Utility of it in general.

Cross-examined, by the Counsel against the Bill, as to his Experience in these Matters; as to his Knowledge of Mr. Brindley as an Engineer; as to his having taken Levels of the said Navigation; and as to the Price of Labour in that Country; and also as to the Depth of Ground that must be cut in different Places in the Course of the new Navigation.

Charles Roe Copper Merchant was called in, and sworn; and examined as to the Utility of the intended Navigation, the Quantity of Copper Ore and other Commodities that may be carried upon it, and the Difference of Expense in Point of Carriage to the Owners as to the Nature of the Manufactures at Macclesfield and the Benefit the intended Navigation will be to that and the other Towns, the Quantity of Lime that may be brought from the Kilns at Buxton and Forest by this Navigation, and the Advantage it will be to the Collieries which lie near the same; and as to the Number of Vessels that may pass upon it every Day, and as to the Time it will take in passing each Lock.

Cross-examined, by the Counsel against the Bill as to the Manner, and by what Rule, he made his Calculations of the Quantity of Copper and other Commodities that may be carried upon the new Navigation as to Lime being carried Toll-free on the Duke of Bridgewaters Navigation, as to his Knowledge of Mr. Brindley as an Engineer; as to his Application to his Grace for a Canal to be made between Macclesfield and Sale Moor; and as to what Security he would give that the intended Navigation should not prejudice the Duke of Bridgewaters.

Henry Richards was called in, and sworn; and examined as to the Want of Coals at Macclesfield, and what Quantity may be brought by the intended Navigation.

Samuel Green was called in, and sworn; and examined as to the State of the Stone Quarries near the said intended Navigation, and as to the Price of Lime.

Robert Bagshaw was called in, and sworn; and examined as to the State of the Lime Kilns at Buxton and Forest, and the Quantity of Lime made there upon a Medium every Day, and as to the Convenience of carrying it from the Kilns to Macclesfield and other Places in the new Navigation.

Cross-examined, by the Counsel against the Bill, as to the Lime being carried by Water-carriage any farther than Macclesfield.

The Evidence on both Sides being finished; the Counsel were directed to withdraw.

Ordered, That the further Hearing of Counsel be adjourned till Monday next.
