Message from H. C. to return Heskeths Bill.

A Message was brought from the House of Commons, by Sir Ellis Cunliffe and others;

To return the Bill, intituled, An Act for vesting Part of the Estates in the County Palatine of Lancastar, settled upon the Marriage of Fleetwood Hesketh Esquire with Fronces his Wife, in Trustees, to be sold; and for applying the Monty arising from such Sale in paying off divers Debts and Encumbrances affecting the same; and for other Purposes therein mentioned; and also for substituting in Lieu thereof a certain Estate in the said County called Burne, lately purchased by the said Fleetwood Hesketh; and to acquaint this House, that they have agreed to the same, without any Amendment.

Account of Plate Duty, delivered.

The House being informed, That Mr. Paton, from the Excise-office, attended:

He was called in; and delivered, at the Bar, pursuant to Order,

An Account of the Nett Produce of the Duty on Siver Plate, imposed by an Act of the Twenty-ninth Year of King George the Second, from the Commencement of the said Act to 5th July 1766; distinguishing each Year.

And then he withdrew.

And the Title thereof being read by the Clerk:

Ordered, That the said Account do lie on the Table.

Bromley ana Farnborough Roads, Bill.

The Lord Botetourt reported from the Lords Committees to whom the Bill intituled, An Act for repairing, widening, and keeping in Repair, the Road leading from the High Road between Bromley and Farnborough in the County of Kent, to Beggars Bush in the Turnpike Road leading from Tunbridge Wells to Maresfield in the County of Sussex, was committed: That they had considered the said Bill, and examined the Allegations thereof, which were; found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment.

After hearing Counsel in Part in the Cause wherein the Reverend Arthur Saint George and others are Appellants, and Sir Richard Saint George is Respondent:

Kensington Hounslow, &c. Road, Bill.

Hodie 2a vice lecta est Billa, intituled An Act tol continue and render more effectual several Acts of Parliament, for repairing the Highways from that Part of Counters Bridge which lies [ (fn. 2) in the Parish of Kensington,] in the County of Middlesex, leading through the Towns of Brentford and Hounslow to The Powder Mills in the Road to Staines and to Cranford Bridge in the said County, in the Road to Golnbrook; and for repairing, turning, or altering, the Highway leading from the said Road at or near the End of Sim Lane, to the Town of Isleworth in the said County, and from thence to a Gate on the South Side of Tedington Field; and also the Highway leading out of the said treat Road near Smalberry Green Turnpike, to a House known by the Sign of The George in the Town of Isleworth aforesaid; and for lighting and watering Part of the said Highways.

Upon, reading the Petition and Appeal of the Right Honourable John Earl of Darnley in the Kingdom of Ireland, and Baron Clifton in England; complaining several Parts of several Decrees, Order, Report, and other Proceedings, of the Court of Chancery in Ireland, of the 27th of February 1755, 24th of April 1766, and the 11th of March 1767, made in a certain Cause, wherein Hugh Stafford Gentleman and William Brabazon Esquire were Plaintiffs, and Samuel Epwell Lapidary, the Right Honourable John Earl of Darnley, Thomas Bligh Esquire, John Curtis the Younger Esquire, Thomas Curtis a Minor, by the said John Curtis his Father and Guardian, Robert Tighe, Charles Cauldwell, Mary Curtis the Younger Spinster, Sophia Forbes Widow, Mable Kennedy Widow, Burdett Worthington Esquire and Fredisweed his Wife, Ann Bellingham Spinster, and Edward Smith Stafford a Minor, by Robert Stafford his Uncle and Guardian, were Defendants; and praying, That the same may be reversed and set aside, or that the Appellant may have such Relief in the Premises as to this House in their Lordships great Wisdom shall seem meet; and that Hugh Stafford Gentleman and William Brabazon Esquire may be required to answer the said Appeal:

It is Ordered, That the said Henry Stafford, and William Brabazon may have a Copy of the said Appeal; and do put in their Answer or respective Answers thereunto, in Writing, on or before Wednesday the 20th Day of May next; and Service of this Order upon the Clerks in Court or Agents of the said Respondents in the said Court of Chancery in Ireland shall be deemed good Service.

Upon reading the Petition and Appeal of Patrick Everard; complaining of several Parts of several Decrees, Orders, Reports, and other Proceedings, of the Court of Chancery in Ireland, of the 5th of July 1760, 14th of December 1762, 12th of February, 4th of March, 18th of March, 8th of June, and 1st of July, 1763, the 1st of March 1765, 11th of June 1766, and 14th of March 1767, made in a certain Cause, wherein Thomas Dillon, Bridget Dillon otherwise Everard his Wife, and Elizabeth Costello otherwise Everard Widow, were Plaintiffs, and the Appellant Patrick Everard and others Defendants; and praying, That the same may be reversed or set aside; or that the Appellant may have such other Relief in the Premises as to this House in their Lordships great Wisdom shall seem meet; and that Thomas Dillon, Bridget Dillon otherwise Everard his Wife, and Elizabeth Costello otherwise Everard Widow, may be required to answer the said Appeal:

Upon reading the Petition and Appeal of George Rochfort of Rochfort in the County of Westminster Esquire and Alice his Wife, and of Gustavus Rochfort their only Son and Heir Apparent, an Infant under the Age of Twenty-one Years, by the said George Rochfort his Father and next Friend; complaining of Three Orders of the Court of Chancery in Ireland, of the 5th of January, 11th of February, and 13th of March, 1767; and praying, That the same may be reversed or set aside; or that the Appellants may have such further or other Relief in the Premises as the Nature and Circumstances of the Case may require; and that Henry Loftus, Nicholas Earl of Ely, and Philip Tisdall Esquire His Majestys Attorney General of Ireland, may be required to answer the said Appeal:

It is Ordered, That the said Henry Loftus, Nicholas, Earl of Ely, and Philip Tisdall, may have a Copy of the said Appeal; and (fn. 3) do put. in their Answer or respective Answers thereunto, in Writing, on or before Wednesday the 20th Day of May next; and Service of this Order upon their Clerk in Court or Agents of the said Respondents in the said Court of Chancery in Ireland shall be deemed good Service.

Kerwan to enter into Recognizance on Everards Appeal.

The House being moved, That John Kerwan of the City of London Merchant may be permitted to enter into a Recognizance for Patrick Everard, on account of his Appeal depending in this House; he living in Ireland:

It is Ordered, That the said John Kerwan may enter into a Recognizance for the said Appellant, as desired.

Nesbit to enter into Recognizance on Rochforts Appeal.

The House being moved, That Arnold Nesbit Esquire may be permitted to enter into a Recognizance for George Rochfort Esquire and others, on account of their Appeal depending in this House; they living in Ireland:

It is Ordered, That the said Arnold Nesbit may enter into a Recognizance for the said Appellant, as desired.
