Dunglass Bridge, &c Road Bill.

The Earl of Marchmont reported from the Lords Committees, to whom the Bill, intituled, An Act for enlarging the Term and Powers granted by an Act, of the Twenty-third Year of His late Majesty, for repairing the Roads from Dunglass Bridge to the Town of Haddingtoun, and from thence to Ravens haughburn, in the County of Haddingtoun, was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment.

Gainsburgh Paving, &c. Bill.

The Earl of Marchmont made the like Report from the Lords Committees, to whom the Bill, intituled, An Act for the more effectual paving, cleansing, lighting, and watching, the Streets, Lanes, Alleys, and Public Passages, in the Town of Gainsburgh, in the County of Lincoln; and for laying a Duty on all Coals brought to the said Town to be sold, and for applying the same to such Purposes," was committed.

St.Catharine's End Enclosure Bill.

The Earl of Marchmont also reported from the Lords Committees, to whom .the Bill, intituled, An Act for enclosing and dividing several Woods and Wood lands and a certain Close or Parcel of Land or Ground, called West Coat Wood Close, and the Com mons and Waste Grounds, within the Manors of Saint Catharine End, in the Parish of Ryslip, in the County of, Middlesex, was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment.

Youlthorpe Enclosure Bill.

The Earl of Marchmont made the like Report from the Lords Committees, to whom the Bill, intituled, An Act for dividing and enclosing several Common Arable Fields, Common Pastures, and other enclosed Grounds, within the Township of Youlthorpe, in the East Riding of the County of York, was committed.

Ebberston Enclosure Bill

The Earl of Marchmont also made the like Report from the Lords Committees, to whom the Bill, intituled, An Act for dividing and enclosing several Open Fields, Grounds, Commons, and Wastes, within the Township of Ebberston, in the County of York, and for other Purposes therein mentioned, was committed.

Poppleton and Scaglethorpe Moor Enclosure Bill.

The Earl of Roseberry made the like Report from the Lords Committees, to whom the Bill, intituled, An Act for dividing and enclosing several Open Fields, Meadows, Ings, Stinted Pastures, and other Lands and Grounds, within the Manor of Poppleton, and a Piece of Waste Ground called Scaglethorpe Moor, in the Manor of Scaglethorpe, all in the County of the City of York was committed.

Grenville and E.Cornwallis lcr a Bill to quality for Vice Treasurers of Ireland,

Upon reading the Petition of the Right Honourable James Grenville and the Right Honourable Charles Earl Cornwallis; setting forth, That His Majesty, by His Letters Patent, under the Great Seal of Ireland,

bearing Date the 27th Day of February, in the 9th Year of His Reign, hath granted to the Petitioners, together with the Right Honourable Robert Lord Viscount Clare, in the Kingdom of Ireland, the Office or Offices of Vice Treasurer, Receiver General, and Paymaster General, of all His Revenues, Profits, and Casualties whatsoever, in the said Kingdom of Ireland, and to be Treasurer at War within the said Kingdom; that the Petitioners urgent Business requiring their Stay in England, they cannot at present go into the said Kingdom to qualify them selves for the Enjoyment of the said Offices; and therefore praying, That Leave may be given to bring in a Bill, to enable them to take in Great Britain the Oath of Office for the Employments above mentioned, and to qualify themselves for the Enjoyment thereof:

It is Ordered, That Leave be given to bring in a Bill, according to the Prayer of the said Petition.

Whereupon the Lord Sandys presented to the House a Bill, intituled, An Act to enable the Right Honourable James Grenville and the Right Honourable Charles Earl Cornwallis to take in Great Britain the Oath of Office as Vice Treasurer, and Receiver General, and Paymaster General, of all His Majesty's Revenues in the Kingdom of Ireland, and to qualify themselves for the Enjoyment of the said Offices.

Pulteney's Bill:

Hodie 3^a vice lecta est Billa, intituled, An Act to empower the Trustees of the Will of the late General Pulteney to purchase and exchange Lands and Grounds in the Manor of Bathwick, in the County of Somerset, for the Purpose of making certain Roads and Ways to and from a free Bridge by them intended to be built over the River Avon, in the said County; and also to empower the Persons in Possession of the said Estate, for the Time being, under the said Will, to grant Leases of certain Lands and Houses in the said Manor, and likewise to enable the said Trustees to grant certain Grounds and Springs of Water within the said Manor of Bath wick, to the Mayor, Aldermen, and Citizens of Bath, and for other Purposes therein mentioned.

Tring, &c. Road Bill.

With a Bill, intituled, An Act for repairing the Roads leading from the Turnpike Road in Tring, in the County of Hertford, through Dunstable, Hitchin, Baldock, and Royston, to the Turnpike Road at or near Bourn Bridge, and from the West End of Wellbury to the Turnpike Road at the South End of Barton, in the Counties of Hertford, Bucks, Bedford, and Cambridge;" to which they desire the Concurrence of this House.

Report on the Standing Order respecting Money for Purchases being lodged in the Bank, disagreed to.

The Order of the Day being read for taking into Consideration the Report made on Thursday last from the Committee appointed to consider of so much of the Standing Order. No 126, which directs the Money arising by the Sale of Lands as is to be laid out in a new Purchase, when no such Purchase is ready, to be paid into the Bank of England in the Name of the Accountant General of the Court of Chancery, to remain there without Interest until a proper Purchase can be got and approved of.

St. Botolph's Paving, &c. Bill.

The Lord Sandys made the like Report from the Lords Committees, to whom the Bill, intituled, An Act to amend and render more effectual an Act, passed in the Seventh Year of His present Majesty, intituled, "An Act for paving the Streets and other Places in that Part of the Parish of Saint Botolph, Aldgate, which lies in the County of Middlesex, and Part of a Street called East Smithfield, in the Precinct of Saint Catherine; and for cleansing, lighting, and watching the same, and preventing Obstructions, and Annoyances therein, was committed.

Bowe, &c. Road Bill.

The Lord Sendys made the like Report from the Lords Committees, to whom the Bill, intituled, An Act for continuing and rendering more effectual an Act for repairing the Road from Bowes, in the County of York, to Brough under Stammore, in the County of Westmorland; and for repairing and widening the Road from Maiden Castle to Kaber Cross, and also the Road from Maiden Castle to the Coal Works at Taylor Rig, and to Tan Hill and King's Pitts; and also the Road from Barrow's Brow to Middle Sell Dyke Nook, in the said Counties; and also from Tan Hill and King's Pitts to Beck Crooks, and Punchatt Pasture West Gate to Whaw Lane Head, and by Livy Jocks to Reeth, was committed.

Cranbrooke to Appledore Heath, &c. Road Bill.

The Lord Sandys made the like Report from the Lords Committees, to whom the Bill, intituled, An Act to repeal so much of an Act, passed in the Second Year of His present Majesty, for repairing and widening the Roads from the White Poll on Hasledon's Wood, in the Parish of Cranbrooke, to Appledore Heath, and other Roads, in the County of Kent, as relates to the Road from Golford Green to Tanner's Vent;" for enlarging the Term and Powers of the said Act, with respect to the other Roads therein contained; and for amending the Road from the Turnpike Road in the Parish of Tenterden, through Rolvenden, to the Turnpike Road in the Parish of Newenden, in the said County, was committed.

St Bartholomew the Great Paving, &c. Bill.

The Lord Sandys also made the like Report from the Lords Committees, to whom the Bill, intituled, An Act for repairing and widening the Road from Beverley to the Ferry at Hessle, and from the Malton Guide Post to the Gravel Pit at Cottingham, in the County of York was committed.

The Lord Walpole reported from the Lords Committees, to whom the Bill, intituled, An Act for indemnifying "Thomas Twisleton and Francis Twisleton Esquires, the Purchasers of certain Lands and Hereditaments, in the County of Oxford, belonging to James Ness Gentleman and Charlotte his Wife, as to the Payment of their Purchase Money, and settling the same for the Purposes therein mentioned, was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and made One Amendment thereto.

After hearing Counsel, as well Yesterday as this Day, upon the original Petition and Appeal of John Goodere Esquire, complaining of several Orders of the Court of Chancery of the 26th of June 1766, and 30th of April 1767, made in certain Causes; in the One of which Trevor Borrct and Edward Borret Esquires, surviving Executors of John Borret Esquire deceased, who was the surviving Executor of Thomas Frederick Esquire deceased, were Plaintiffs, and the Appellant John Goodere Esquire, Administrator of John Goodere Esquire deceased, who was surviving Assignee under a Commission of Bankrupt awarded against Sir Stephen Evance Knight, was Defendant; and in the other of which Causes the said John Goodere was Plaintiff, and the said Trevor Borret and Edward Borrct were Defendants; and praying, That the same might be reversed, so far as the same over-ruled the Petitioner's Thirteenth Exception to the Mailer's Report, therein particularly mentioned; and likewise upon the Cross Appeal of Trevor Borret and Edward Borrct Esquires, surviving Executors of John Borret Esquire deceased, who was surviving Executor of Thomas Frederick deceased, complaining of Three Orders of the Court of Chancery of the 25th of January 1765, 26th of June 1766, and 30th of April 1767, so far as the same allowed the Defendant's Third, Fourth, and Fifth Exceptions to the Matter's Report, therein particularly mentioned, made in certain Causes; in the One of which the said Appellants, Trevor Borret and Ed ward Borret Esquire were Plaintiffs, and John Goodere Esquire, Administrator of John Goodere deceased., who was surviving Assignee of Sir Stephen Evance a Bankrupt, were Defendants; and in the other of which Causes, the said John Goodere was Plaintiff, and the said Trevor Borret and Edward Borret were Defendants;" and praying, That the same might be reversed, and the said Exceptions over-ruled;" as also upon the Answer of the said Trevor Borret and Edward Borret, put in to the said original Appeal, and the Answer of the said John Goodere put in to the said Cross Appeal, and due Consideration had of what was offered on either Side in these Causes:

Judgement.

It is Ordered and ADJUDGED by the Lords Spiritual and Temporal, in Parliament assembled, That the Orders of the 26th of June 1766, and 30th of April 1767, complained of in the original Appeal, so far as they over-rule the Appellants Thirteenth Exception be reversed: And it is hereby further Ordered, That the Parties do proceed to a Trial at Law in the Court of Common Pleas, at the Sittings after this Term, or at such other Time as the Lord Chief Justice of the said Court shall appoint upon the following Issue: Whether Thomas Frederick Esquire deceased, was damnified to the Amount of Four thousand Pounds, or any other and what Sum, by Sir Stephen Evance having torn a Paper at the Castle Tavern, in Fleet Street, some Time after the Suits between the said Sir Stephen Evance and the said Thomas Frederick were be-o-un; and if the Jury shall find that the said Thomas Frederick was damnified to a less Amount, that the Postea be indorsed accordingly: And it is also further Ordered, That the Respondent in the original Appeal be Plaintiff at Law, and that the Appellant be the Defendant, who is forthwith to name an Attorney to accept a Declaration, appear and plead to Issue, and that the Issue be settled by a Master, in case the Parties differ about the same: And it is also hereby further Ordered, That the Consideration of the Order made by his Honor the Master of the Rolls, allowing the said Thirteenth Exception, and also of all further Directions and Costs, be reserved till after the said Trial: And it is hereby further Ordered and adjudged, That the Orders complained of by the Respondents in their said Cross Appeal be, and the same are hereby affirmed: And it is further Ordered, That the said Court of Chancery do give all necessary and proper Directions for carrying this Judgement into Execution.

Bishop Wilton Enclosure Bill.

The Lord Delamer also reported from the Lords Committees, to whom the Bill, intituled, An Act for dividing and enclosing several Open Fields, Common Pastures, and Parcels of Land and Grounds within the Township of Bishop Wilton, in the East Riding of the County of York, was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and made several Amendments thereto.

After the Word [Chattels] at the End of the Clause, insert the following Proviso: [ Provided nevertheless, that all and every the Claim and Claims of Right of Common, or other Property, Right, or Interest, in any of the Fields, Ings, Common Pastures, and Parcels of Land and Grounds above mentioned, except as to the Allotments for Tythes and Ecclesiastical Dues which shall appear doubtful to the said Commissioners, or any Two of them, or to which any Objection shall be made by any of the Parties interested, or their respective Agents, at the next Meeting of the same Commissioners, pursuant to this Act, after such Claim shall be delivered in, shall be heard, examined, and finally determined by Peter Johnson of the City of York Esquire, and Richard Beatniffe of the Town and County of the Town of Kingston upon Hull Esquire, who are hereby appointed Arbitrators for the Purposes aforesaid; and the said Arbitrators, or such Umpire as they shall appoint, in case of Disagreement between them, which they are hereby authorized and directed to elect and appoint, shall, with all convenient Speed, proceed to hear and determine all such Claims and Objections upon their own View, the Examination of Witnesses upon Oath, (which Oath either of the said Arbitratois is hereby empowered to administor), or by such other Evidence, Proof, Ways, or Means, as by them the said Arbitrators shall be thought proper; and the said Arbitrators shall make and execute their Award in Writing, under their Hands and Seals, concerning the Matters so referred to them, within Six Months next after passing of this Act, or as soon thereafter as conveniently may be; and such Award shall be conclusive to all Parties whatsoever, and shall be enrolled, together with the other Award hereby directed to be made; and the same, or the Enrollment thereof, or a Copy of such Enrollment respectively, shall be allowed as Evidence in all Courts whatsoever; and if either of the said Arbitrators shall die, or refuse to aft, the said Commissioners, or any Two of them shall, and they are hereby required, by Writing under their Hands and Seals, from Time to Time, to elect and appoint One fit Person, being a Barrister at Law, in the Place of such Arbitrator so dying or refusing to act; which Person so elected and appointed shall and may aft in the Premises as fully, to all Intents and Purposes, as if he had been hereby appointed and named Arbitrator; which Writing or Writings of Appointment shall be enrolled, and the Evidence thereof given in the same Manner as herein-before is enacted concerning the Award to be made by the said Commissioners].

And the said Amendments, being again read by the Clerk, were agreed to by the House.

Danish Minister's Petition, against Ramsgate Harbour Bill.

Upon reading the Petition of Frederic de Hanneken Secretary to the King of Denmark, setting forth, That an Act of Parliament, passed in the Twenty-second Year of the Reign of His late Majesty King George the Second, intituled, An Act for enlarging and maintaining the Harbour of Ramsgate, and for cleansing, amending, and preserving, the Haven of Sandwich, by which Act certain Rates and Duties are laid upon every Ship or Vessel, as well British as Foreign, above a certain Burden, from, to, or by, Ramsgate, or coming into the Harbour there; that the Petitioner begs Leave humbly to represent to their Lordships, that no Ships or Vessels belonging to any of the Subjects of His Danish Majesty, which are only navigated to or from any Part of His Dominions to or from any Port or Place West or South West of The South Foreland, ever come into The Downs, or can receive any Benefit or Advantage from the said Harbour at Ramsgate; that no such Ships or Vessels are subject or liable to pay any of the Rates or Duties directed to be paid by virtue of the said Act; that a Bill is now depending before their Lordships, intituled, An Act to explain and amend an Act, made in the Twenty-second Year of the Reign of King George the Second, for enlarging and maintaining the Harbour of Ramsgate, and for cleansing, amending, and preserving, the Haven of Sandwich" which, if it should pass into a Law, would subject many of His Danish Majesty's Subjects to certain Rates and Duties, which they are not liable to by the said recited Act, and for the Payment of which they receive no Benefit or Advantage; and therefore praying, Their Lordships, on Behalf of many of His Danish Majesty's Subjects, that he may be heard by his Counsel against the said Bill, and that the same may not pass into a Law:
