Lady Cranston et Mar.against Scott et al.:

After hearing Counsel this Day upon the Petition and Appeal of Sophia Lady Cranston, and Michael Lade Esquire, her Husband, for his Interest; complaining of Two Interlocutors of the Lord Ordinary in Scotland, of the 5th of July and 14th of November 1775; and also of Two Interlocutors of the Lords of Session there, of the 22d of February and 10th of August 1776; and praying, That the same might be reversed, varied, or altered, or that the Appellants might have such other Relief in the Premises, as to this House, in their Lordships great Wisdom, should seem meet;" as also upon the Answer of George Lewis Scott and other Creditors, ranked upon the Estates of Crailing and Wauchope, put in to the said Appeal, and due Consideration had of what was offered on either Side in this Cause:

Judgement.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal, in Parliament assembled, That the said several Interlocutors complained of in the said Appeal be, and the same are hereby Reversed: And it is hereby declared, That the Deed of Renunciation executed by Lady Cranston is not binding upon her, and that she is not bound to implement the same: And it is hereby further ordered, That the Court of Session in Scotland do give all proper and necessary Directions for carrying this Judgement into Execution.

Lawson against Lawson et al. Judges to attend.

Ordered, That the Judges do attend this House on Friday next, upon the Hearing of the Cause wherein Winifred Lawson Widow, is Appellant, and John Lawson and others, are Respondents.

Baldwyn's Bill.

Ordered, That the Committee to whom the Bill, intituled, "An Act for repealing an Act, made in the Twelfth Year of the Reign of His present Majesty, intituled,"An Act for vesting the Manors, Lands, and Tenements, both Freehold and Leasehold, comprized in the Marriage Settlement of Charles Baldwyn Esquire, in Trustees to be sold; and for laying out the Money arising by such Sale, in the Purchase of other Lands and Hereditaments, to be settled to the same Uses which are now subsisting with regard to the said Freehold Settled Estate;" and for settling the said Manors, Lands, and Tenements, to new and other Uses," stands committed, be revived, and meet on Thursday next.

Combe's Bill.

The Lord Scarsdale reported from the Lords Committees, to whom the Bill, intituled, "An Act for vesting the Freehold Estates in the Counties of Hereford and Monmouth, devised by the Will of Thomas Chamberlayne Esquire, deceased, in Richard Combe Esquire, in Fee-Simple; and for settling other Estates of the said Richard Combe, in the County of Somerset, of greater Value, in lieu thereof," was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Ordered, That the said Bill be engrossed.

Trattle's Bill.

The Lord Scarsdale also reported from the Lords Committees, to whom the Bill, intituled, "An Act for vesting certain Messuages, Lands, Tenements, and Hereditaments, in the Isle of Wight, the Settled Estate of Elizabeth Trattle of Cardiff, in the County of Glamorgan, Widow; and also a certain Messuage, and Lands and Hereditaments, of the Warden and Scholars, Clerks, of Saint Mary College of Winchester, near Winchester, in the County of Southampton, in Trustees, in Trust, to sell and convey Part of the said Settled Estate, and also the said Estate of the said Warden and Scholars, Clerks, to Sir Richard Worsley Baronet, and other Part of the said Settled Estates to the said Warden and Scholars, Clerks; and to apply Part of the Money arising from such Sale, in paying off an Incumbrance affecting Part of the said Settled Estate, and for laying out the Residue of the said Money, in the Purchase of other Lands and Hereditaments, to be settled to the like Uses; and to enable the said Warden and Scholars, Clerks, to take a Conveyance of that Part of the said Settled Estates, intended to be conveyed to them," was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and made One Amendment thereto;" which Amendment, being read Twice by the Clerk, was agreed to by the House.

Barnes's Bill:

Hodie 3a vice lecta est Billa, intituled, "An Act for vesting the Real Estates, late of Ann Phillips Spinster, now the Wife of Henry Barnes Gentleman, comprized in their Marriage Settlement, situate in the County of Salop, in Trustees, to be sold; and for applying the Purchase Money for the Purposes in the Act mentioned."

The Question was put, "Whether this Bill shall pass?"

It was resolved in the Affirmative.

Trattle's Bill:

The Lord Scarsdale reported from the Lords Committees to whom the Bill, intituled, "An Act for dividing and enclosing the Open and Common Fields, and other Commonable Lands, in the Parish of Weston under Wetheley, in the County of Warwick," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Magdalen College Leases Bill:

Hodie 3a vice lecta est Billa, intituled, "An Act to enable the President and Scholars of the College of Saint Mary Magdalen in the University of Oxford, to grant Building Leases of certain Ground, Messuages, Houses, and Buildings, in the Parish of Saint John Southwark, in the County of Surrey."

The Question was put, "Whether this Bill shall pass?"

It was resolved in the Affirmative.

Tibshelf Enclosure Bill:

Hodie 3a vice lecta est Billa, intituled, "An Act for dividing, enclosing, and improving, certain Commons, Lands, and Grounds, in the Township of Tibshelf, in the County of Derby."

With a Bill, intituled, "An Act for dividing and enclosing a Common or Moor, called Howtell Common alias Housedon, in the Parish of Kirknewton, in the County of Northumberland;" to which they desire the Concurrence of this House.

Low Gatherley Moor Enclosure Bill.

A Message was brought from the House of Commons, by Mr. Dundas and others:

With a Bill, intituled, "An Act for dividing and enclosing Three several Moors or Commons, called Low Gatherley Moor, Moor Holme, and The High Moor, situate in the several Townships of Kirkby Ravensworth, Ravensworth, and Whashton, in the Parish of Kirkby Ravensworth, in the North Riding of the County of York;" to which they desire the Concurrence of this House.

Wendover, confirming Exchanges of Land, &c. in, Bill.

A Message was brought from the House of Commons, by the Earl Verney and others:

With a Bill, intituled, "An Act for confirming Exchanges of Lands and Tythes, of, and in the Open and un-enclosed Common Fields, within the Manor and Parish of Wendover, in the County of Buckingham; and for establishing and securing certain annual Payments in lieu of Tythes;" to which they desire the Concurrence of this House.

The said Four Bills were, severally, read the First Time.

Message from H. C. to return Rugby Charity Bill.

A Message was brought from the House of Commons, by Mr. Skipwith and others:

To return the Bill, intituled, "An Act to enable the Feossees and Trustees of an Estate in the County of Middlesex, given by Lawrence Sheriff, for the founding and maintaining a School and Alms-Houses at Rugby, in the County of Warwick, to sell Part of the said Estate, or to grant Leases thereof, or of any Part thereof; and to effectuate the other Purposes therein mentioned;" and to acquaint this House, that they have agreed to the same, with some Amendments, to which they desire their Lordships Concurrence.

Market Lavington Enclosure Bill.

A Message was brought from the House of Commons, by Mr. Bouverie and others:

With a Bill, intituled, "An Act for dividing, allotting, and laying in Severalty, the Open Common Fields, Common Meadows, Common Downs, Waste Lands, and Commonable Places, within the Parish of Market Lavington, in the County of Wilts;" to which they desire the Concurrence of this House.

Wykeham and Caudwell Enclosure Bill.

A Message was brought from the House of Commons, by Mr. Hungerford and others:

With a Bill, intituled, "An Act for dividing and enclosing the Open and Common Fields, Common Meadows, Common Pastures, and other Commonable Lands, lying and being in Wykeham and Caudwell, in the Parish of Rothley, in the County of Leicester;" to which they desire the Concurrence of this House.

Shapwick Enclosure Bill.

A Message was brought from the House of Commons, by Mr. Buller and others:

With a Bill, intituled, "An Act for dividing and enclosing the Common or Waste Ground, called Shapwick Moor or Shapwick Turf Moor, in the Parish of Shapwick, in the County of Somerset;" to which they desire the Concurrence of this House.

Common Fields, Cultivation of, Bill.

A Message was brought from the House of Commons, by Sir Richard Sutton and others:

With a Bill, intituled, "An Act for the further advancing the Cultivation, Improvement, and Regulation of the Common Arable Fields, Common Meadows, and Commons of Pasture in this Kingdom;" to which they desire the Concurrence of this House.

The said Four Bills were, severally, read the First Time.

Ordered, That the last-mentioned Bill be printed.

Felthorpe Enclosure Bill.

A Message was brought from the House of Commons, by Sir Edward Astley and others:

With a Bill, intituled, "An Act for dividing, allotting, and enclosing, the Dole or Heath Lands, Commons, and Waste Grounds, within the Parish of Felthorpe, in the County of Norfolk," to which they desire the Concurrence of this House.

The said Bill was read the First Time.

E. Tyrconnel's Divorce Bill.

The Lord Scarsdale (according to Order) reported the Amendments made by the Committee of the whole House to the Bill, intituled, "An Act to dissolve the Marriage of George Carpenter Esquire, Earl of Tyrconnel, in the Kingdom of Ireland, with the Right Honourable Lady Frances Manners, his now Wife, and to enable him to marry again; and for other Purposes therein mentioned."

And the same being read Twice by the Clerk, were agreed to by the House.

Ordered, That the said Bill, with the Amendments, be engrossed.

Rugby Charity Bill.

The House proceeded to take into Consideration the Amendments made by the Commons to the Bill, intituled, "An Act to enable the Feossees and Trustees of an Estate, in the County of Middlesex, given by Lawrence Sheriff, for the founding and maintaining a School and Alms-Houses at Rugby, in the County of Warwick, to sell Part of the said Estate, or to grant Leases thereof, or of any Part thereof; and to effectuate the other Purposes therein mentioned."

Dunlops et al. against Speirs et al. Cross Appeal.

Upon reading the Petition and Crofs Appeal of Thomas and William Dunlops, Robert Bogle and Thomas Scott, Merchants, in Glasgow, Trustees for the Creditors of John Carlyle and Company, Merchants in Glasgow; complaining of certain Parts of Two Interlocutors of the Lords of Session in Scotland, of the 4th of July and 9th of August 1776; and also of Part of an Interlocutor of the Lord Ordinary there, of the 5th of December 1776; and praying, "That the same may be reversed, varied, or altered; or that the Appellants may have such other Relief in the Premises, as to this House, in their Lordships great Wisdom, shall seem meet; and that Alexander Speirs, Andrew Blackburn, and Andrew Sym Merchants in Glasgow, Trustees for the Creditors of James Dunlop junior, late Merchant there, may be required to answer the said Appeal."

It is Ordered, That the said Alexander Speirs, Andrew Blackburn, and Andrew Sym, may have a Copy of the said Appeal, and do put in their Answer or respective Answers thereunto, in Writing, on or before Monday the 19th Day of May next: And Service of this Order upon the said Respondents, or on their known Counsel or Agents in the said Court of Session in Scotland, shall be deemed good Service.

Wilkinson against Allott.

The House being moved "That a Day may be appointed for hearing the Cause, wherein Pinckney Wilkinson Esquire, is Appellant, and Bryan Allott Clerk, is Respondent."

It is Ordered, That this House will hear the said Cause, by Counsel at the Bar, on the First vacant Day for Causes, after those already appointed.

Speirs et a against Carl. et al. et e con. Petition for a Bye-Day.

A Petition of Alexander Speirs and others, Appellants in a Cause depending in this House, to which John Carlyle and others are Respondents, et e contra, which stands appointed for Hearing, was presented and read; Setting forth, "That the Appellants are Trustees of the Estate of James Dunlop, Merchant in Glasgow, a Bankrupt; and when in the Course of paying a Dividend thereof among his Creditors, they were stopped by an Action brought in the Court of Session by the Respondents, claiming a Share of the Dividend; and their Title to such Share is the Subject of the present Appeal to their Lordships: That a large Sum of Money being locked up, till this Question be determined, it is the Interest of all concerned, that the Cause should be soon heard:" And therefore praying on Behalf of the numerous Creditors of Mr. Dunlop, "That their Lordships will be pleased to appoint this Cause to be heard on Thursday the 1st Day of May next, or on any other early Day, as their Lordships shall think proper."

And thereupon the Agents on both Sides were called in, and heard at the Bar:

York Buildings Co. Estate Bill, Motion for shortening the Committee.

The House was moved, "That the Standing Order, requiring Fourteen Days Notice to be given of the Meeting of Committees upon Private Bills, may be so far dispensed with, as that the Committee to whom the Bill, intituled, "An Act for expediting the Sale of the Estates in Scotland, belonging to the York Buildings Company, for the Relief of their Creditors," stands committed, may meet on the said Bill, on an earlier Day than is appointed."

Ordered, That the said Motion be taken into Consideration To-morrow, and the Lords summoned.

After hearing Counsel, as well on Friday last as this Day, upon the Petition and Appeal of Winifred Lawson Widow and Executrix of Hylton Lawson Esquire, deceased; complaining of a Decree of the Court of Chancery of the 7th of March 1772; and also of another Decree of the said Court of the 18th of May 1776; and praying, "That the same might be reversed, and the Plaintiff's Bill dismissed, or that the Appellant might have such other Relief in the Premises, as to this House, in their Lordships great Wisdom, should seem meet:" As also upon the joint and several Answer of John Lawson Esquire, and Francis Stuart Esquire, and Mary his Wife, put in to the said Appeal, and due Consideration had of what was offered on either Side in this Cause:

Judgement.

It is Declared, by the Lords Spiritual and Temporal in Parliament assembled, That the Appellant is entitled to the Residue of the Personal Estate to her own Use: And it is hereby further ordered and adjudged, That the said Decrees of the 7th of March 1772, and 18th of May 1776, complained of in the said Appeal, be, and the same are hereby Reversed: And it is further ordered, That the Cause be remitted back to the Court of Chancery, to set aside the Order of the 18th of December 1771, and to make such further Order as shall be just.

Upon reading the Petition of James Peirson of the Parish of Saint Mary-le-bone, in the County of Middlesex, Carpenter and Builder, taking Notice of a Bill depending in this House, intituled, "An Act for vesting Part of the Estates, late of Bradshaw Peirson Esquire deceased, in the County of York, in Trustees, to be sold; and for purchasing other Estates to be settled to the same Uses, subject to the Annuity charged thereon; and for other Purposes therein mentioned;" and humbly praying their Lordships, "That he may be heard, by himself, or Counsel, against the said Bill; and that he may have such Relief in the Premises as to their Lordships, in their Wisdom, shall seem proper.

Wilkinson against Allott. Petition for a Bye-Day.

A Petition of Bryan Allott Clerk, Respondent, in a Cause depending in this House, to which Pinckney Wilkinson Esquire, is Appellant, was presented and read; setting forth, "That this Cause is set down for hearing before their Lordships after those appointed; that in regard the Petitioner cannot (till after this Cause is heard), proceed in the said Court of Exchequer to have the Glebe Land, in the Possession of the Appellant and his Tenants, belonging to the Petitioner, properly set out and bounded, so as to get into the Possession and Enjoyment thereof; and the Petitioner not having received any Rent or Satisfaction whatever from the Appellant for the Use and Enjoyment of the said Glebe Lands for Eleven Years, and upwards, last past: And the Petitioner also having a large Demand on the Appellant for Small Tythes and other Ecclesiastical Dues, and the Rents and Profits of the said Glebe Lands; and the Small Tythes and other Ecclesiastical Dues so due from the Appellant to the Petitioner being by much the greatest Part of the Profits arising from the Petitioner's Living, the Petitioner is thereby rendered unable to support himself and Family, as he otherwise might do: And as it will be some considerable Time before this Cause can possibly be heard on Account of the Number of Causes already appointed; and especially as the Petitioner apprehends this Appeal is merely for Delay to prevent him coming at his Right:" The Petitioner therefore humbly prays their Lordships, "That this Cause may be appointed to be heard on Tuesday the Sixth Day of May next, or any other early Day their Lordships shall please to appoint."

And thereupon the Agents on both Sides were called in, and heard at the Bar.
