The Order of the Day being read for the House to resolve itself into a Committee, to take into Consideration the State of the Nation, and the Resolutions of the Commons referred thereto on Tuesday last; and for the Lords to be summoned:

The House was adjourned during Pleasure, and put into a Committee thereupon.

After some Time, the House was resumed:

And the Lord Walsingham reported from the Committee, "That they had made a Progress therein."

Ordered, That this House do resolve itself again into a Committee To-morrow, to take into Consideration the State of the Nation; and that the Lords be summoned.

Complaint relative to Stoppages in the Streets:

Complaint was made to the House by the Yeoman Usher of the Black Rod, "That William Williams, Drayman, did this Day contrary to, and in contempt of their Lordships Order for preventing Stoppages and Obstructions in the Streets and Passages leading to this House, insult and obstruct William Distain, the Constable, then attending his Duty, pursuant to the said Order, in Breach of the Privilege of this House."

And thereupon, the said William Williams was ordered to be brought to the Bar.

And being brought accordingly;

William Distain, the Constable, was called in and examined upon Oath at the Bar, in relation to the Matter of the said Complaint; and the said William Williams was asked what he had to say in his Defence; and being withdrawn:

Williams committed to Tothill Fields Bridewell

Ordered, That the said William Williams be for his said Offence committed to Tothill Fields Bridewell, and there kept in safe Custody until the further Order of this House; and this shall be a sufficient Warrant in that Behalf.

To the Governor and Keeper of Tothill Fields Bridewell, his Deputy and Deputies, and every of them.

Committee on State of the Nation.

The Order of the Day being read for the House to resolve itself again into a Committee, to take into further Consideration the State of the Nation, and the Resolu tions of the Commons referred thereto on Tuesday last; and for the Lords to be summoned:

The House was adjourned during Pleasure, and put again into a Committee thereupon.

After some Time, the House was resumed:

And the Lord Walsingham reported from the Committee, "That they had gone through the said several Resolutions, and directed him to report the same to the House, without any Amendment."

Ordered, That the said Report be taken into Consideration immediately.

Report of Resolutions for appointing the Prince of Wales Regent, &c.

The said Report was read by the Clerk as follows; (videlicet)

"Resolved, That it appears to this Committee, that for the Purpose of providing for the Exercise of the Royal Authority, during the Continuance of His Majesty's Illness, in such Manner and to such Extent as the present Circumstances and the urgent Concerns of the Nation appear to require, it is expedient that His Royal Highness the Prince of Wales, being resident within the Realm, shall be empowered to exercise and administer the Royal Authority, according to the Laws and Constitution of Great Britain, in the Name and on the Behalf of His Majesty, and under the Stile and Title of Regent of the Kingdom, and to use, execute, and perform, in the Name and on the Behalf of His Majesty, all Authorities, Prerogatives, Acts of Government, and Administration of the same, which belong to the King of this Realm, to use, execute, and perform, according to the Laws thereof, subject to such Limitations and Exceptions as shall be provided."

"Resolved, That it appears to this Committee, that the Power so to be given to His Royal Highness the Prince of Wales, shall not extend to the granting of any Rank or Dignity of the Peerage of the Realm to any Person whatever, except to His Majesty's Royal Issue, who shall have attained the full Age of Twentyone Years."

"Resolved, That it appears to this Committee, that the said Powers should not extend to the granting of any Office whatever, in Reversion, or to the granting of any Office, Salary or Pension, for any other Term than during His Majesty's Pleasure, except such Offices as are by Law required to be granted for Life or during good Behaviour."

"Resolved, That it appears to this Committee, that the said Powers should not extend to the granting of any Part of His Majesty's Real or Personal Estate, except so far as relates to the Renewal of Leases."

"Resolved, That it appears to this Committee, that the Care of His Majesty's Royal Person during the Continuance of His Majesty's Illness, should be committed to the Queen's Most Excellent Majesty, and that Her Majesty should have Power to remove from, and to nominate and appoint such Persons as the shall think proper, to the several Offices in His Majesty's Household, and to dispose, order, and manage all other Matters and Things relating to the Care of His Majesty's Royal Person during the Time aforesaid; and that for the better enabling Her Majesty to discharge this important Trust, it is also expedient that a Council should be appointed to advise and assist Her Majesty in the several Matters aforesaid, and with Power from Time to Time, as they may see Cause, to examine upon Oath the Physicians and others attending His Majesty's Person, touching the State of His Majesty's Health, and all Matters relative thereto."

The First Resolution was again read by the Clerk.

Moved, "To agree with the Committee in the said Resolution."

The Question was put thereupon?

It was resolved in the Affirmative.

Then the said Resolution was agreed to.

The Second Resolution was again read by the Clerk.

Moved, "To agree with the Committee in the said Resolution."

Then the said Resolution was agreed to.

The Third Resolution was again read by the Clerk.

Moved, "To agree with the Committee in the said Resolution."

The Question was put thereupon?

It was resolved in the Affirmative.

Then the said Resolution was agreed to.

The Fourth Resolution was again read by the Clerk.

Moved, "To agree with the Committee in the said Resolution."

Moved, "To agree with the Committee in the said Resolution."

Then the said Resolution was agreed to.

"DISSENTIENT.

Protest against agreeing to Report.

1st, "Because we firmly adhere to the Principles and Arguments on which we disapproved the Resolutions formerly passed by this House, especially when the Legislative Power of the Two Houses of Parliament, unconstitutionally assumed by those Resolutions, is meant to be employed to restrict or suspend many important and essential Branches of the Royal Power at the Moment of the declared Incapacity of the King."

2dly, "Because we think the Power of conferring the Rank and Privileges of the Peerage as a Reward to Merit, is necessary to the Royal Authority, in order to afford an Incitement to vigorous Exertions in the Service of the State, and is more peculiarly necessary (like all other Parts of the Prerogative) when the Regal Power is to be exercised by a Substitute, with an Authority uncertain and precarious in its Duration; but especially on the present Occasion, as it is the only Branch of the Prerogative sufficiently powerful to afford a Remedy against such a Combination in this House, as other Parts of this System of Restriction and Mutilation have a natural and obvious Tendency to produce.

"And because we conceive that this Restriction may create an Interest in the Members of this House, to withhold their Assent to restore the antient Power of the Crown in this respect."

3dly, "Because we conceive that by the subsisting Law of the Land, His Majesty's Property is sufficiently secured from any undue Disposition and Alienation, and the Resolution on that Subject can have no other Effect but to convey to the Public injurious Suspicions and unjust Imputation on the Character and Intentions of His Royal Highness the Prince of Wales."

4thly, "Because we are of Opinion that, in order to maintain the proper Dignity of the Crown, and preserve the due Influence and Respect which arises from the great Offices of State, it is necessary that the Person exercising the Royal Authority in the Name and on the Behalf of His Majesty, should be attended by those distinguished Servants, whose Functions have been established for the Purpose of adding Weight and Splendor to the Regal Office; we cannot agree to a Division of the Royal Power, to the Creation of a fourth Estate unknown to the Constitution of the Country.

Williams discharged out of Custody.

Upon reading the Petition of William Williams, setting forth, "That the Petitioner having justly incurred the Displeasure of this House by his offensive and riotous Behaviour, and by assaulting a Constable appointed to keep the Peace, is heartily sorry for having so done;" and most humbly intreating their Lordships, "That in Consideration of his innocent and helpless Family, whose sole Dependence is upon his Labour and Industry, he may be discharged from his present Confinement:

It is Ordered, That the said William Williams be discharged out of Custody, paying his Fees.

Message to H. C. for a further Conference:

A Message was sent to the House of Commons, by Mr. Holford and Mr. Leeds:

To desire a present Conference with that House in the Painted Chamber, upon the Subject Matter of the Conference on Tuesday the 20th of this Instant January.

Managers appointed:

Ordered, That the Managers of the last Conference be the Managers of this.

Conference agreed to:

The Messengers sent to the House of Commons, to desire a Conference this Day with that House, acquainted the House, "That the Commons do agree to a Conference with their Lordships, as desired."

And the House was adjourned during Pleasure, and the Lords went to the Conference.

And the Lord President reported, "That the Managers for the Lords had met the Managers for the Commons at the Conference, which on their Part was managed by the Marquis of Worcester;" and had acquainted them, "That the Lords have taken into their Consideration the Resolutions of the Commons communicated to their Lordships at the said Conference; and that their Lordships have agreed to the same without any Amendment."

And the Lord President reported, "That they had met the Managers for the Commons at the Conference, which on their Part was managed by the Lord Belgrave; who acquainted the Managers for the Lords, That the Commons have desired this Conference, to acquaint their Lordships, that the Commons having again read the Five last Resolutions communicated by them to their Lordships, and to which the Concurrence of their Lordships was signified to the Commons, at a Conference on Monday last, have thereupon come to Two other Resolutions, to which they desire the Concurrence of their Lordships."

The said Resolutions are as follow; (videlicet)

"Resolved, That a Committee be appointed to attend his Royal Highness the Prince of Wales with the said Resolutions which have been agreed to by the Lords and Commons, for the Purpose of supplying the Defect of the Personal Exercise of the Royal Authority during His Majesty's Illness, by empowering his Royal Highness to exercise such Authority in the Name and on the Behalf of His Majesty, subject to the Limitations and Restrictions which the Circumstances of the Case appear at present to require; and that the Committee do express the Hope which the Commons entertain, that His Royal Highness from His Regard to the Interests of His Majesty and the Nation, will be ready to undertake the weighty and important Trust proposed to be invested in His Royal Highness, as soon as an Act of Parliament shall have been passed for carrying the said Resolutions into Effect."

Resolved, That the Resolution agreed to by the Lords and Commons respecting the Care of His Majesty's Royal Person and the Direction of His Majesty's Household, be laid before Her Majesty, with an humble Address, expressing the Hope which the Commons entertain, that Her Majesty will be graciously pleased to undertake the important Trust proposed to be invested in Her Majesty, as soon as an Act of Parliament shall have been passed for carrying the said Resolution into Effect."

And the said Resolutions being read by the Clerk:

The House proceeded to take the same into Consideration.

And the first Resolution being again read:

It was moved, "That the Blank therein be silled up with ("Lords Spiritual and Temporal, and")"

The same was agreed to.

Then the following Words were proposed to be added to the said Resolution at the End thereof, in Addition thereto; (videlicet)

("And to inform His Royal Highness that so much of the said Resolutions as tend to limit the Regent in the Exercise of the Powers belonging to the Crown, or to separate the Establishments hitherto united in the Crown, are formed upon the Supposition that His Majesty's Illness is only temporary, and may be of no long Duration")

Prince of Wales's Answer to Resolutions and Address.

The Lord President acquainted the House, "That he and the Lord Privy Seal had (pursuant to the Order on Thursday last) attended his Royal Highness the Prince of Wales with the several Resolutions agreed to by both Houses of Parliament, for the Purpose of supplying the Defect of the Personal Exercise of the Royal Authority during His Majesty's Illness; and that His Royal Highness was pleased to return the following Answer:

"My Lords, and Gentlemen,

"I thank you for communicating to me the Resolutions agreed to by the Two Houses, and I request you to assure them in my Name, that my Duty to the King my Father, and my anxious Concern for the Safety and Interests of the People, which must be endangered by a longer Suspension of the Exercise of the Royal Authority; together with my Respect for the united Desires of the Two Houses, outweigh in my Mind every other Consideration, and will determine me to undertake the weighty and important Trust proposed to me, in Conformity to the Resolutions now communicated to me. I am sensible of the Difficulties that must attend the Execution of this Trust, in the peculiar Circumstances in which it is committed to my Charge, of which as I am acquainted with no former Example, my Hopes of a successful Ad ministration cannot be founded on any past Experience. But confiding that the Limitations on the Exercise of the Royal Authority deemed necessary for the present, have been approved by the Two Houses only as a temporary Measure, founded on the Loyal Hope in which I ardently participate, that His Majesty's Disorder may not be of long Duration, and trusting in the mean While that I shall receive a zealous and united Support in the Two Houses, and in the Nation, proportioned to the Difficulty attending the Discharge of my Trust. In this Interval, I will entertain the pleasing Hope, that my faithful Endeavours to preserve the Interests of the King, His Crown, and People, may be successful."

Ordered, That the said Resolutions, together with the Answer of His Royal Highness the Prince of Wales thereto, be forthwith printed and published.

The Queen's Answer to Resolutions and Address.

The Earl Waldegrave acquainted the House, "That he and the Earl of Ailesbury had (pursuant to the Order on Thursday last) attended Her Majesty with the Resolution and Address agreed to by both Houses of Parliament, respecting the Care of His Majesty's Royal Person, and the Direction of His Majesty's Household; and that Her Majesty was pleased to return the following Answer:

"My Lords, and Gentlemen,

"My Duty and Gratitude to the King and the Sense I must ever entertain of My great Obligations to this Country, will certainly engage My most earnest Attention to the anxious and momentous Trust intended to be reposed in Me by Parliament; it will be a great Consolation to Me to receive the Aid of a Council of which I shall stand so much in Need, in the Discharge of a Duty, wherein the Happiness of My future Life is indeed deeply interested, but which a higher Object, the Happiness of a great, loyal, and affectionate People, renders still more important."

Ordered, That the said Resolution and Address, together with Her Majesty's Answer thereto, be forthwith printed and published.
