Rochied against Kinloch et al.

After hearing Counsel as well on Thursday and Friday last as this Day, upon the Petition and Appeal of James Rochied of Inverleith, in the County of Edinburgh, and Darnchester, in the County of Berwick, in Scotland, Esquire; complaining of Two Interlocutors of the Lords of Session in Scotland, of the 2d of August 1788, and 13th of February 1789; and praying, "That the same might be reversed, varied, or altered, or that the Appellant might have such other Relief in the Premises, as to this House, in their Lordships great Wisdom, should seem meet;" as also, upon the Answer of David Kinloch of Gilmerton Baronet, and of Francis Kinloch, Archibald Kinloch Gordon, David Kinloch, Alexander Kinloch, and John Kinloch Esquires, and others, put in to the said Appeal, and due Consideration had of what was offered on either Side in this Cause:

Interlocutors reversed.

It is Ordered and Adjudged by the Lords Spiritual and Temporal in Parliament assembled, That the said Interlocutors complained of in the said Appeal be and the same are hereby reversed; and it is hereby declared and adjudged, That the Settlement of the Half of the Estate of Inverleith and Darnchester, belonging to Elizabeth Rochied, does not contain a sufficient Tailzie to fulfil the Condition imposed by the Settlement of Dame Mary Kinloch of her One-fourth of the said Estate, and consequently, the Pursuer is entitled to hold, possess, and enjoy the said One-fourth Part of the Lands and Barony of Inverleith and Darnchester Teinds, and others, contained in the said Deed of Settlement, and that in Fee Simple, as Heir Male of the deceased Alexander Rochied his Father, and Heir of Provision of the said deceased Dame Mary Kinloch his Grandmother, without being subject or liable to any of the Conditions, Provisions, Restrictions and Clauses, prohibitive, irritant, and resolutive, contained in the said Deed of Settlement executed by the said Dame Mary Kinloch.

Magistrates of Edinburgh against Erskine et al.

After hearing Counsel in Part in the Cause wherein the Lord Provost, Magistrates, and Counsel of the City of Edinburgh, and George McQueen are Appellants, and the Honourable Henry Erskine and others are Respondents:

It is Ordered, That the further hearing of the said Cause be put off till To-morrow.

Proceedings on East India Judicature Act.

The Lord Chancellor acquainted the House, "That the Clerk Assistant had prepared and laid on the Table, A List of the Names of all the Lords who have delivered in Lists in pursuance of the Directions of an Act passed in the 26th Year of His present Majesty, for the further Regulation of the Trial of Persons accused of certain Offences committed in the East Indies, and for other Purposes therein mentioned."

American Trade Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act to amend Two Acts made in the Twenty-eighth Year of the Reign of His present Majesty, the one intituled, "An Act for regulating the Trade between the Subjects of His Majesty's Colonies and Plantations in North America, and in the West India Islands, and the Countries belonging to the United States of America and between His Majesty's said Subjects, and the Foreign Islands in the West Indies;" and the other, intituled, "An Act to allow the Importation of Rum or other Spirits from His Majesty's Colonies or Plantations in the West Indies, into the Province of Quebec, without Payment of Duty under certain Conditions and Restrictions."

After some Time, the House was resumed:

And the Lord Cathcart reported from the Committee, "That they had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Scotch Terms Bill.

The Order of the Day being read for the House to be put into a Committee upon the Bill, intituled, "An Act for altering the Time appointed for holding the Summer Session in the Court of Session in Scotland, and for altering Whitsuntide and Lammas Terms in the Court of Exchequer in Scotland."

Ordered, That the House be put into a Committee upon the said Bill To-morrow.

Laurie's Petition referred to Judges.

Upon reading the Petition of Mrs. Margaret Laurie, of Redcastle, Widow of Andrew Sloan Laurie, of Redcastle, praying Leave to bring in a Bill, for the Purposes in the said Petition mentioned:

It is Ordered, That the Consideration of the said Petition be and is hereby referred to the Lord Chief Baron of the Court of Exchequer and Mr. Justice Grose, who are forthwith to summon all Parties concerned in the Bill, and after hearing them, are to report to the House the State of the Case, with their Opinion thereupon, under their Hands; and whether all Parties who may be concerned in the Consequences of the Bill, have signed the Petition; and also, that the Judges having perused the Bill, do sign the same.

Colhoun et al. Petitions referred to Judges.

Upon reading the Petition of William Colhoun, of East Wrotham, in the County of Norfolk, Esquire, and Grace his Wife, and of the Provost and College of Eton, (nigh Windsor), in the County of Bucks, praying Leave to bring in a Bill, for the Purposes in the said Petition mentioned:

Laing against Watson and Mollison.

Upon reading the Petition and Appeal of Patrick Laing, Tanner and Burgess of Brechin; complaining of an Interlocutor of the Lords of Session in Scotland of the 2d of March 1790; and praying, "That the same in so far as it decerns for the Sum of One hundred and twenty Pounds Sterling, only of Damages and Expences, including Agent Fee, may be reversed, varied, or altered, or that the Appellant may have such other Relief in the Premises, as to this House, in their Lordships great Wisdom, shall seem meet; and that James Watson, Merchant and Weaver in Brechin, and Thomas Mollison, eldest Son and Heir of John Mollison, deceased, late Provost of Brechin, may be required to answer the said Appeal:"

It is Ordered, That the said James Watson and Thomas Mollison may have a Copy of the said Appeal, and do put in their Answer or respective Answers thereunto in Writing, on or before Monday the 19th Day of April next; and Service of this Order upon the said Respondents, or upon any of their known Counsel or Agents in the Court of Session in Scotland, shall be deemed good Service.

His Majesty's Advocate against Milne, in Error.

A Petition of the Advocate General of Scotland, Plaintiff, in a Writ of Error depending in this House, to which John Milne is Defendant, was presented and read; setting forth, "That this Cause came on to be heard ex-parte in the last Session of Parliament, when their Lordships were pleased to put off the further Hearing to the present Session, and to signify that it might be proper for the Judges to attend: That no Appearance having been yet made for the Defendant in Error, the Plaintiff is desirous, that this Cause be put off till after all the Causes appointed;" and therefore praying their Lordships, "To put off the Hearing of this Cause till after all the Causes already appointed."

And thereupon the Agent for the Petitioner was called in, and heard at the Bar; and being withdrawn,

Ordered, That the Hearing of the said Cause be put off till after all the Causes already appointed.

Hamilton and Co. against Allans et al:

Upon reading the Petition and Appeal of Messieurs Hamilton, Garden, and Company, Merchants in Edinburgh; complaining of Two Interlocutors of the Lord Ordinary in Scotland, of the 10th of August 1789, and 28th of January 1790; also, of an Interlocutor of the Lords of Session there, of the 18th of February 1790; and also of another Interlocutor of the said Lord Ordinary of the 6th of March 1790; and praying, "That the same may be reversed, varied, or amended, or that the Appellants may have such Relief in the Premises, as to this House, in their Lordships great Wisdom, shall seem meet; and that Messieurs Allan and Gow, Hosiers in Glasgow, Alexander Allen and Archibald Newbigging, Merchants there, and Hugh Moodie, Merchant in Greenock, may be required to answer the said Appeal:"

It is Ordered, That the said Messieurs Allans and Gow, Alexander Allen, Archibald Newbigging, and Hugh Moodie, may have a Copy of the said Appeal, and do put in their Answer or respective Answers thereunto in Writing, on or before Monday the 19th Day of April next; and Service of this Order upon any of the Counsel or Agents of the said Respondents in the Court of Session in Scotland, shall be deemed good Service.

Wilson to enter into Recognizance on said Appeal.

The House being moved, "That John Wilson, of Northumberland Street, Gentleman, may be permitted to enter into a Recognizance for Messieurs Hamilton, Garden, and Company, Merchants in Greenock, on account of their Appeal depending in this House, they living in Scotland:"

It is Ordered, That the said John Wilson may enter into a Recognizance for the said Appellants, as desired.

The Question was put, "Whether this Bill shall pass?"

It was resolved in the Affirmative.

Messages to H. C. that the Lords have agreed to the Two preced- Bills.

And Messages were, severally, ordered to be sent to the House of Commons, by Mr. Pepys and Mr. Walker:

To acquaint them, That the Lords have agreed to the said Bills, without any Amendment.

It was moved, "That so much of an Act made in the 26th Year of His present Majesty's Reign, for the further Regulation of the Trial of Persons accused of certain Offences committed in the East Indies, and for other Purposes therein mentioned, as relates to the Nomination and Appointment of Members of this House, in order to the constituting in Part a Court of Judicature, might be read."

The same was accordingly read by the Clerk:

Stump Cross Roads Bill.

Ordered, That the Committee to whom the Bill, intituled, "An Act for enlarging the Term of several Acts made, for repairing the Roads from Stump Cross to Newmarket Heath, and from Stump Cross aforesaid, to the End of the Town of Trumpington, next to Shelford, and from Shelford Pound to Wittlesford; and for making more effectual Provision for repairing the said Roads, and also One Mile of the Road between Trumpington and Cambridge, commencing at the South End of Trumpington aforesaid; and for amending the Road from Chesterford Bridge to the End of Wittlesford, next to Shelford, all in the County of Cambridge, stands committed, be revived, and meet To-morrow."

Dorchester Roads Bill.

Ordered, That the Committee to whom the Bill, intituled, "An Act to enlarge the Term and Powers of so much of an Act made in the Ninth Year of the Reign of His present Majesty, as relates to the amending, widening, altering, clearing, and keeping in Repair, several Roads leading from the Borough of Dorchester, in the County of Dorset, stands committed, be revived, and meet To-morrow."

Stowmarket and Ipswich Navigation Bill.

The Lord Cathcart reported from the Lords Committees, to whom the Bill, intituled, "An Act for making and maintaining a Navigable Communication between Stowmarket and Ipswich, in the County of Suffolk," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Then it was moved, "That the Clause in the said Act directing that the Names of such Persons who shall appear to hold or to have held any of the Offices or Employments therein specified shall be struck out of the said Report, be now read:"

The same was accordingly read by the Clerk.

Ordered, That the said Titles be referred to a Committee, to report the Names of those who shall appear to hold or to have held any of the Offices or Employments specified in the said Act.

Newport and Caerleon Bridges Bill.

The Lord Cathcart reported from the Lords Committees to whom the Bill, intituled, "An Act for rebuilding the Bridges over the River Uske at Newport and Caerleon, in the County of Monmouth," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and made some Amendments thereto."

L. 30. Leave out from ("Hereditaments") to ("and") in Line 33. and insert ("adjoining to or lying near any Turnpike erected by virtue of the said recited Act, the same not being a Public Highway")

Upon reading the Petition of Sir Robert Sinclair Baronet, Respondent in a Cause depending in this House, to which James Sinclair Esquire and others are Appellants, which stands appointed for hearing; setting forth, "That the Petitioner having presented his Claim to be enrolled as a Freeholder of the County of Caithness, at the last Michaelmas Head Court, held for that County, the Majority of the Freeholders upon the most frivolous Objection refused to enrol him: That the Petitioner having exhibited his Complaint to the Court of Session, their Lordships by repeated Interlocutors declared, that the Freeeholders had done wrong, and ordered the Petitioner's Name to be enrolled: That to defeat this Order, or delay its Operation, (the Petitioner being a declared Candidate to represent the County), the Appellants have presented their Appeal to their Lordships; and as in these summary Proceedings, their Lordships have been in use for the furtherance of Justice, to hear such Appeals upon Bye-days;" the Petitioner humbly prays, "That their Lordships will be pleased to appoint this Cause to be heard on Tuesday the 30th Day of March Instant, or on such other Day as the House thinks most proper:"
