Earl of Thanet's Petition, for an Allowance out of the Sequestration of his Estate.

The Petition of John Earl of Thanett was read; shewing, "That he, being in France, had his whole Estate here in England, Real and Personal, seized and sequestered, his Houses rifled and unfurnished, One of them which cost many Thousands razed, his Quick Stock of a considerable Value taken away, his Woods to a great Value felled, and a Fall of Thirty-six Acres Friday last after an Order of Restraint, and his Rents for a Year and a Half past sequestered; and, in this Condition, a Ticket sent your Petitioner from Haberdashers Hall, for One Thousand Five Hundred Pounds, for a Twentieth Part.

"That the Petitioner, upon a late Declaration of both Houses of Parliament, returned within the Time thereby limited, being the First of March; and did then presently apply himself to this Honourable House by Petition, thereby submiting himself and his Cause to your Lordships; which Petition their Lordships were pleased to send to the House of Commons, where it depends.

That it is now Ten Weeks since the Petitioner's Return; in all which Time, by Reason of a Seizure and Sequestration upon his whole Estate, he neither hath nor can receive any Thing out of it, to supply him with Necessaries; besides that the same is charged with Debts for which his Friends and Servants stand engaged.

That there is now growing due for this Half Year to the Petitioner's Estate above Three Thousand Pounds.

"The Petitioner, for Support of himself in some Proportion to that Sum, and to his Degree and Quality, humbly beseecheth there may now timely be allotted him, according to the said Declaration, some fitting Part out of his Estate's now growing Rents; and that the said Assessment of a Twentieth Part (where all hath been taken) may be discharged."

Ordered, That this House will take this Petition further into Consideration on Monday next, and then communicate it to the House of Commons, at a Conference.

Walsingham and Baker.

Ordered, That the Cause between Sir Tho. Walsingham and Sir John Baker shall be heard, at this Bar, on Tuesday Morning next.

Archbishop of Canterbury's Trial.

Then this House proceeded upon the further Trial of the Archbishop of Canterbury, upon the Remainder of the Sixth Article of the First Charge.

The Evidence being given, the Archbishop desired Leave to have some Time allowed him to recollect himself, to make his Answer.

And this (fn. 1) House allowed him Time till Three of the Clock this Afternoon.

Message from the H. C. with an Ordinance.

A Message was brought from the House of Commons, by Mr. Nicolls and others:

To desire their Lordships Concurrence in an Ordinance for paying Five Thousand Pounds, for Sir Wm. Waller's Army.

The Answer returned was:

Answer.

That their Lordships will take this Ordinance into Consideration, and send an Answer by Messengers of their own.

1. To desire their Lordships Concurrence in an Ordinance for Advance of Ten Thousand Pounds, for the Lord General's Army. (Here enter it.)

Read Thrice, and Agreed to.

to expedite the One, for advancing Money for Sir William Waller's Army.

2. To desire their Lordships to give Expedition to the Ordinance brought up this Morning, for advancing Five Thousand Pounds for Sir Wm. Waller's Army.

This Ordinance was read Thrice; and Agreed, upon the Question, to pass.

The Answer returned was:

That this House agrees in the Ordinance now brought, and to the Ordinance concerning Advance of Five Thousand Pounds for Sir Wm. Waller.

Archbishop of Cant's Trial.

Next, the House heard the Answer of the Archbishop of Canterbury to the Evidence given this Morning against him.

And the Committee of the House of Commons replied.

Ordered, That this House will proceed further against the Archbishop of Canterbury on Thursday next, in the Morning.

Order for the Commissioners of Excise to re-pay themselves 10,000 l. advanced for the Lord General's Army.

"Whereas, by a former Ordinance, of the 22th of April last, the Commissioners of the Excise are desired, by both Houses of Parliament, to advance Ten Thousand Pounds, for the Use of the Lord General's Army, which Monies they are to reimburse themselves out of the successive Receipts on the Excise: It is hereby Declared, That the said Commissioners of Excise shall reimburse themselves the said Ten Thousand Pounds, or so much thereof as they shall advance of their own Monies, out of the First Receipt of the Excise; any Ordinance of Parliament to the contrary notwithstanding."

Order for 5000 l. for Sir William Waller's Forces:

"Whereas John Towse Esquire, Alderman of the City of London, and the rest of the Commissioners of Excise and new Impost, do advance and lend the Sum of Five Thousand Pounds, for the Service of the Army under the Command of Sir William Waller Knight: Be it hereby Ordained, That the said Commissioners of Excise shall and may (fn. 2) pay the said Five Thousand Pounds unto Charles Vaughan Esquire, whose Receipt for the same shall be a sufficient Discharge; and for Reimbursement of the said Commissioners of Excise, as well of this Five Thousand Pounds, as also of the like Sum of Five Thousand Pounds formerly by them advanced and lent for the same Service, together with Interest for the whole, it is hereby Ordained, That due Provisions shall be made for the same, upon perfecting of the Treaty between the Committee of the West and the said Commissioners of Excise; and the said Charles Vaghan is to dispose of the said Sum of Five Thousand Pounds as the Committee for the West shall direct."
