Mr. Page and Dr. Heath, sent with a Message on Monday last to the House of Commons, return with this Answer:

That they agree to the Ordinance concerning Commissions of Oyer and Terminer, and the Ordinance concerning Commissions of Sewers. (Here enter it.)

Johnson's House, on Lady Hatton's Premises, to be pulled down.

Ordered, That whereas (fn. 1) it was referred to the Justices of the Peace for Midd. to see the House of Johnson pulled down, built upon the Wall of the Lady Hatton: It is now Ordered to be referred to the Sheriff of Midd. to see the same done.

Message from the H. C. for referring the Management of the War in Ireland to the Committee of both Kingdoms;

A Message was brought from the House of Commons, by Mr. Niccolls; which consisted of these Particulars:

1. To desire their Lordships Concurrence, that the managing of the War of Ireland may be referred to the Committee of both Kingdoms.

and with Ordinances, &c. for Concurrence;

2. To desire Concurrence in an Order (fn. 2) to pay Fifty Pounds out of the Sequestrations, for the bringing up of Prisoners from Hull. (Here enter it.)

3. An Ordinance for Two Thousand Pounds Monthly to be paid out of the Excise, for Six Months, to make Provision for the Public Store. (Here enter it.)

Read Thrice, and Agreed to.

4. An Ordinance for enlarging the Quorum of the Commissioners for Martial Law. (Here enter it.)

Agreed to.

5. An Order for to pay One Thousand Pounds, out of Haberdashers Hall, for Barnstaple. (Here enter it.)

Agreed to.

with Deputy Lieutenants Names for Suffolk;

6. That Thomas Bacon and John Hodges Esquire shall be Deputy Lieutenants for the County of Suffolke.

Agreed to.

and with High Sheriffs Names for Bucks and Derby.

7. That Henry Beeke Esquire shall be Sheriff of the County of Bucks.

Agreed to.

8. That Sir George Greesly Knight and Baronet shall be Sheriff of the County of Derby.

Agreed to.

9. An Ordinance for One Thousand Pounds to be paid to the City Regiment in Warham. (Here enter it.)

Agreed to.

10. A Declaration upon the former Ordinance, concerning the Surprizal of Foreigners Ships trading to Ports in Defection from the Parliament.

The Answer returned was:

Answer.

That concerning the Order for referring the managing the Irish War to the Committee of both Kingdoms, and the Declaration concerning taking of Ships, their Lordships will send an Answer by Messengers of their own.

To all the rest of the Particulars of this Message, their Lordships do agree to them.

Declaration upon the Ordinance for taking Ships trading with the Enemies of the Parliament.

Next, the Declaration concerning the Surprizal of Ships trading to Ports in Defection from the Parliament, was read the Second Time; and the House was adjourned into a Committee during Pleasure, to take the same into Consideration.

The House being resumed, the said Ordinance was Agreed to, with some Alterations.

Committee to draw up a Letter to the Lord General.

Ordered, That these Lords following are appointed to meet with a proportionable Committee of the House of Commons, to consider of the drawing up of a Letter to be sent to the Lord General, according to the Effect of a late Conference with the House of Commons:

Any Two, to meet this Afternoon, at Three of the Clock, in the Prince's Lodgings.

Message to the H. C. to appoint a Committee to meet them.

A Message was sent to the House of Commons, by Sir Edward Leech and Dr. Heath:

To let them know, that this House hath nominated a Committee of Five Lords, to meet, at Three of the Clock this Afternoon, in the Prince's Lodgings, to consider of a Draught of a Letter to be sent to the Lord General, according to the Desire of a late Conference; and to desire them that they would nominate and appoint a Committee of their House, of a proportionable Number, to join with their Lordships therein, and to meet at the Time and Place aforesaid.

The Answer returned was:

That the Committee of the House of Commons will give a Meeting this Afternoon, as is appointed.

Letter from the Lord General, with an Account of the Armies in the West.

Prince Elector arrived at Margate.

The Earl of Northumb. reported from the Committee of both Kingdoms a Letter of the Lord General, directed to them, giving an Account of the State of the Armies in the West; also acquainted this House with a Paper presented to that Committee from Mr. Harrington, Agent to the Prince Elector, to give Information that the Prince Elector writ to him, that he is aboard the Ship called The Mary of John, at Margett, and intends to be at Gravesende this Night.

Lady Drummond, a Pass beyond Sea.

Ordered, That the Lady Drumund shall have a Pass, to transport herself and her Family beyond the Seas, according to her Petition; and that she may stay in Whitehall, where she is, for a Week, to prepare herself for her Journey.

Message to the H. C. to join in it, and with the Declaration upon the Ordinance for taking Ships trading with the Enemies of the Parliament.

A Message was sent to the House of Commons, by Sir Edw. Leech and Dr. Heath:

To desire their Concurrence in the Alterations in the Declaration concerning the taking of Ships of such as are in Defection from the Parliament, &c.

2. To desire their Concurrence, that the Lady Dromond may have a Pass, to go beyond the Seas, with her Family; and that she may have Liberty to stay a Matter of a Week in her Lodgings in Whitehall, until she provides herself for her Travel.

Dr. Colliden; to export Horses.

Ordered, That Dr. Colliden shall transport his Gelding and Mare, Custom-free, into France.

Ordinance to execute Commissions of Oyer and Terminer.

"It is this Day Ordered and Ordained, by the Lords and Commons assembled in Parliament, That the Serjeants and Counsellors at Law, in the several Counties of this Kingdom within the Power of Parliament, shall execute the Commissions of Oyer and Terminer and Goal Delivery, wherein they are nominated Commissioners, notwithstanding any Statute or Clause therein to the contrary."

Order for 50 l. to Somerscales, for bringing Prisoners from Hull.

"It is this Day Ordered, by the Lords and Commons in Parliament assembled, That Fifty Pounds shall be allowed and paid unto Mr. Thomas Somerscales, for his Charge and Pains in bringing up Prisoners at Two several Times from the Army in the North; and that this Money be paid out of the Estates of Sir Charles Lucas, Mr. John Bellasis, and Sir John Ramsden; and that the Treasurers for the Sequestrations at Guildhall do forthwith advance the said Sum of Fifty Pounds, and re-pay themselves out of the Estates of the Gentlemen aforesaid."

Order for 1000 l. for Barnstaple.

"It is this Day Ordered, by the Lords and Commons assembled in Parliament, That the Committee for Advance of Monies at Habberdashers Hall do forthwith issue to the Committee of the West, or such as they shall appoint to receive the same, upon Accompt, a Thousand Pounds, for the Service of Barnestaple."

Order for 2000 l. Monthly out of the Excise, for Provision for the Public Stores.

"The Lords and Commons in Parliament assembled, taking into Consideration that a timely Provision ought to be made for Arms and Ammunition, do Ordain, That the Commissioners of Excise, out of the Receipts, do Monthly pay (accounting Eight and Twenty Days to the Month) unto Sir Walter Erle Knight, Lieutenant of the Ordnance, the Sum of Two Thousand Pounds, for the Intents and Purposes beforementioned; the said Payment of Two Thousand Pounds by Month to begin from the 9th of July last past, and so from thenceforth to be constantly paid unto the said Sir Walter Erle, or his Assigns, for and during the Space of Six Months, whose Receipts shall be a sufficient Discharge unto the Commissioners of Excise for the same and every Part thereof."

Ordinance to amend the One for Martial Law.

"Whereas, by an Ordinance of the Lords and Commons in Parliament assembled, for the establishing of a Court Martial, amongst other Things, it is Ordained, That the Persons therein nominated, or any Twelve or more of them, whereof such of the Members of either House of Parliament as have Commissions and Commands in any of the Armies or Garrisons and Sir Nathaniell Brent always to be Three, shall be Commissioners: Be it now Ordained, That the said Clause shall be amended, and established in Manner following; (that is to say) that any Twelve or more of the Persons in the aforementioned Ordinance named, whereof the Members of either House of Parliament and Sir Nathaniell Brent, or Three of them, always to be present, shall be Commissioners, to do all and every Thing and Things as in and by the said Ordinance is limited and appointed."

Order for issuing Commissions of Sewers.

"It is this Day Ordered and Ordained, by the Lords and Commons assembled in Parliament, That (fn. 3) Commissions of Sewers shall be granted, by the Commissioners of the Great Seal, for the several Counties of this Kingdom within the Power of the Parliament, although the Lord Treasurer or Lord Chief Justice be absent."

Order for 1000 l. for the Regiment in Wareham.

"Whereas the Lords and Commons in Parliament assembled have, by Ordinance of the 10th of this present Month of August, Anno Domini 1644, assigned and secured the Sum of Two Thousand Pounds to the Committee of the Militia of the City of London, to enable them to continue their Forces at Abington, out of the Monies that come in upon the Excise, to be paid unto them next after the Twenty Thousand Pounds formerly secured unto them out of the said Excise; and whereas the said Committee of the Militia have advanced the said Two Thousand Pounds for the Supply of the Forces at Abington, and other Services of the State: Be it therefore Ordained, by the Lords and Commons in Parliament assembled, That the said Committee of the Militia shall be repaid the said Sum of Two Thousand Pounds, with Interest after the Rate of Eight Pounds per Cent. for so long Time as they shall be out of the same, or any Part thereof, out of the Receipts of the Excise, next after the Twenty Thousand Pounds formerly secured as aforesaid shall be paid and satisfied: And it is hereby further Ordained, That the Commissioners for the Time being shall make Payment of the said Two Thousand Pounds, with Interest as aforesaid, unto the said Committee of the Militia, or to such Persons as advance the said Money, at such Time, and in such Order and Course, as is before Ordained; for Payment of which Two Thousand Pounds with Interest, or any Part thereof, the Receipt of the Chairman of the said Committee for the Time being, or such as lent the Money, or their Assign or Assigns, or an Order of the said Committee signed by the Chairman, shall be a sufficient Discharge unto the said Commissioners of Excise, and every of them: And whereas One Thousand Pounds of the said Two Thousand is already paid to the Forces at Abington, it is now Ordered, That the other Thousand Pounds shall be paid to the Regiment under the Command of Colonel Owen, at Weymouth, for the Service of the West."
