Arrest for Debt, & Insolvent Debtors, Petition of H. Thompson for Revision of Laws respecting.

Upon reading the Petition of Henry Thompson Doctor of Medicine, a Graduate of the Royal College of King James in the University of Edinburgh, late of the Borough of Lewes, in the County of Sussex; praying their Lordships, "That it may be enacted, that any Physician, Surgeon, Apothecary or Practitioner in Midwifery, belonging to and certified to be duly qualified for Practice by any of the Colleges in the Universities of the United Kingdom, or of any Public Medical Body licensed and authorized by Government to practise Medicine, shall be enabled to give a Certificate in Cases of Danger to Persons arrested for Debt (or any other Act their Lordships may think fit to include) that shall exonerate the Sheriff or his Officer from any Blame in not removing such Debtor, (or other Prisoner to whom their Lordships may extend the Indulgence,) and that it be peremptory on the Sheriff and his Officers to take and abide by such Certificate, the same being given on the Responsibility of the Medical Practitioners; Professional Testimonials to be confirmed on Oath, if required, before a Magistrate, at the earliest convenient Moment, the Patient not to be removed from Want of Form, or Absence of a Magistrate to take the Oath;" and further praying their Lordships, "That they will be pleased to add a Clause to the Act passed in the Reign of His present Majesty, intituled, "An Act to continue and amend the Laws for the Relief of Insolvent Debtors in England," to prevent the Power which merciless Creditors and Attorneys now possess, of keeping an honest Debtor in Prison at their Pleasure, by cancelling the Debt for which the Prisoner was arrested, even on the Day appointed by the Commissioners of Insolvent Debtors, (as in the Case of Thomas Akehurst, who was discharged from His Majesty's Prison of the Fleet on the Day before appointed for his Hearing,) and thus, being enabled to arrest the Debtor immediately on a new Action, (although he may have complied with every Requisite,) he may continue this Plan as it best suits his Purpose: The Petitioner having only One detaining Creditor, and believing that the Malice of the Attorney employed against him (for he is instigated by Malice in this Case) intends to act by the Petitioner in the Manner stated, unless the Petitioner gets a Detainer lodged against him, which Act of itself would be illegal, and subject him to further Imprisonment, and therefore prays their Lordships to enact, as an Amendment to the last-mentioned Act, that after a Debtor shall have received Permission of the Commissioners of Insolvent Debtors to file his Petition, no Creditor, or his or her Attorney, shall be enabled to discharge such Debt or Debtor, without the Consent of such Debtor previously obtained in his own Handwriting, if in Capacity so to do:"
