Pleading: John, abbot of Lilleshall states that on 14 July 1440, at Lilleshall, with the consent of the whole convent of his abbey, by an indenture of which he shows the part sealed by Richard Stowe in court, he granted and demised at farm to Richard Stowe, now deceased, a garden with appurtenances in 'Woderouelane' (Woodroffe Lane, later Cooper's Row) in St Olave parish, tower ward, London, being that garden enclosed by a certain wall measuring 58 yards and 1 foot in width from the king's highway to the east and 42½ yards in length from the king's highway to the north, and 80 yards and 2 feet to the south, holding it from Michaelmas next for 80 years, at an annual rent of 21s 6d, payable at Lady Day and Michaelmas equally. Richard S agreed to keep the garden properly and in good repair, paying the tenths to the king as necessary, but if the rent should be in arrears by 2 months then the abbot and convent may re-enter the property, the agreement notwithstanding. The abbot and convent agree to warrant the property against all others. By virtue of this demise, Richard S held the property, and having made Robert S his executor, he then died, but leaving 64s 6s unpaid for three years rent, namely those sums due in Michaelmas 1458, Lady Day and Michaelmas 1459 and 1460, and Lady Day 1461. However, Robert S the executor has not paid this outstanding rent, to the abbot's damage of £10.

Pleading: RS states that long after the rental agreement, and long after the death of Richard S, namely 11 April 1458, Robert S and a certain Isabella, former wife of Richard S, as executors of Richard S, by a certain William Breteyn, their servant, returned possession of this property to the abbot, who agreed to this.

Pleading: The abbot, protesting that Robert and Isabella did not return possession of this property to him as they claimed, states that he did not agree to this surrender of possession, as claimed. Writ type: Trespass (force and arms)
Damages claimed: £40
Case type: Safe keeping; Taking of goods

Pleading: John Hay states that on 10 April 1457, in London, Simon Bryggeman forcibly took and carried away goods and chattels of his worth £30, namely 630 goat skins, 1200 kid skins, 23 skins called 'hyndcalfskynnes' and one skin called a 'stagskynne', against the peace and to his damage of £40.

Pleading: SB granted licence to imparl to Easter one month. [marginal note largely destroyed and illegible]

Pleading: [continued at Easter 1463, rot 114] SB denies force and arms and being against the peace. Parties on country. Concerning the rest, he states that JH ought not maintain his action, since concerning all the rest except the taking of 40 of the 630 goat skins, SB states that 8 April 1457, in the king's court held in the Guildhall in London in the parish of St Lawrence Jewry, before Thomas Canynges, then mayor and the aldermen of the city, he laid a bill of debt in £25 against one John Streyte, then in the custody of Ralph Verney, then one of the sheriffs of the city, stating that on 10 March 1457, in St Botolph without Bishopsgate, JS agreed to pay £25 for various sums of money loaned by SB to JS before that time, but which he had refused to pay, to his damage of 20s. The mayor and aldermen ordered that Ralph Verney have JS in the city court on 9 April then next to answer the bill. SB and JS came on that day, where JS acknowledged that he owed SB this £25, and the court ordered that SB should recover the debt, and 3s costs. SB also states that it is the custom of the city that if any recovery of debt or damages is ordered in the city court, either before the mayor and aldermen or the sheriffs, then they should have recovery from the goods and chattels of the person against whom the recovery was ordered in the city, according to a valuation made by two honest men of the city, and a sergeant-at-arms of the relevant court should make the recovery. He states that on 9 April after the recovery was ordered by the court, it was ordered to John West, sergeant-at-arms of that court, that he make execution of this order to SB of this £25 and 3s. At this time JS was possessed of all the goods mentioned in the plea, in the parish of St Botolph without Aldgate in Portsoken ward, and that before the date of the supposed trespass delivered them all, except the 40 goat skins, to JH for safe-keeping. The sergeant-at-arms therefore, according to the order of the court, took all these goods out of the possession of JH (except the 40 goat skins), and delivered them to SB in the parish of St Sepulchre in London, amongst other goods formerly of JS, valued at £25 and 3s by Thomas Noke and William Hardyng, and recovered by the sergeant. SB collected them and took them away, as was right. Concerning the other 40 goat skins, he states that JS was in possession of these skins in St Botolph without Aldgate before the time of the alleged trespass, and thus in possession gave them to SB in satisfaction of another debt of 20s. These 40 skins had also been in the safe-keeping of JH, and, being in possession, SB also took these from JH in St Sepulchre's parish, by virtue of this gift, as was his right.

Pleading: JH states that, concerning the main plea regarding everything except the 40 goat skins, all the goods concerned were his property, and not that of JS, as claimed. He seeks judgment. Regarding the other 40 skins, he states that these were also his property at the time of the alleged gift to SB by JS, and remained his property afterwards, and were not the property of JS as claimed. He seeks judgment and damages.

Pleading: SB repeats that the property concerned in the main plea did belong to JS at the time concerned. Parties on country. And concerning the second reply, he repeats that the 40 skins were given to him by JS as claimed. Parties on country, sheriff of London to have jury of St Botolph without Aldgate here at octave of Trinity.

Term: Hilary 1462
County: London
Writ type: Debt (bond)
Damages claimed: 40m
Case type: Bond

Pleading: John Fencle and John Broun state that on 13 September 1460 John Alcok made a bond with them in London in £43 6s 8d, payable on 13 September 1461, but he has not paid, to their damage of 40m. They show the bond in court.

Pleading: JA granted licence to imparl to quindene of Easter, with assent of plaintiffs.

Postea text: 3 further licences to imparl, to quindene of Easter 1463, with assent.

Case notes: Heading lost, but presumably London. Identical to preceding case on face of this rotulet. Either represents two separate cases, possibly on two separate bonds, or it is a scribal error and the same case has mistakenly been enrolled twice. However, since posteas appear on both, a scribal error seems unlikely.

Pleading: William Andrewe states that in the king's court in the Guildhall in London on 2 August 1458, before Thomas Rayner, then one of the sheriffs of that city, according to the customs of the city, he affirmed a certain plea of trespass against Robert Lynster, and found pledges to prosecute, namely [names omitted], for which it was ordered that [name omitted], sergeant at mace ('clavam') and a minister of the court, should attach RL to be here before the sheriff at the Guildhall on 4 October 1458 to answer WA on this plea. On that day, in the court held before Richard Nedeham, one of the sheriffs, the parties appeared, and the sergeant at mace stated that RL was attached by pledge of [names omitted], upon which WA sought against RL that on 20 October 1457, in the parish of St Sepulchre in the suburbs of London, RL had of the delivery of WA certain goods and chattels worth 20m for safe keeping, namely one defensive doublet covered with black fustian, one gold sphere called a musk ball, one gold ring with a red stone fixed in it, a gold cross, a silver and gilt ring, a silver necklace, one girdle ('zonam') bound with gold and silver, an ounce of broken silver, two silk girdles decorated with silver, two other decorated girdles, one bittern's claw ('ungulam onocroculi') called a 'Betourcley' set in silver, one amber rosary, one jet rosary, one coral rosary, one jet rosary with seven beads of silver and gilt, one crimson gown lined with black cloth, one black lined gown, a gown lined with black lambs' fur, three gowns for women, two lined with cloth and one with 'potys', one mattress, one pair of linen sheets, two covers, one blanket, three blue muslin ('carde') curtains, one brass ('eneam') jar, one sword, one canopy ('celar') of blue Muslin, one book called 'Sir Eglamour', one pair of crimson stockings, one fustian doublet, one pair of blackalyre stockings, one dagger, three tablecloths, six towels, one piece of woollen cloth measuring one yard, one chest, one small chest, three baskets ('cofinos'), one wooden bench, two ells of linen cloth called canvas, one leather beaker ('obbam'), one collar of black cloth, one cushion, one doublet, a black leather purse, one black lamb's fur, one painted cloth of white and green worsted, and one liripipe. These were to be returned to him on request in return for a certain agreed fee, but through RL's negligence these goods were later taken and carried away by persons unknown to WA, to his damage of £23. He prosecuted his suit, and RL received a licence to imparl. Later, on the same 4 October, before RN, sheriff, WA returned to court and offered himself, but RL did not come, and made default, as a result of which the sergeant at mace was ordered to have a jury for St Bartholomew's parish there on 13 October 1458 to assess damages. On that day, the jury assessed damages of £8, and costs of 13s 4d, to be recovered from RL. RL amerced. However, RL has not paid this sum, to his damage of 10m.

Pleading: RL granted licence to imparl to quindene of Easter.

Case notes: Heading lost, presumably London. Case seeking damages for suit already prosecuted before the sheriff of London. See also case on rot 363.
